The proper hours for removal are between 11pm and 8am and Hodgson pleaded guilty. Wardell was charged with leading the manure away in a cart unfit for purpose, and he said he was not guilty. Mr Samual Hepworth, road inspector to the board, proved that he saw defendant leading the soil away and he allowed it to drop along the public streets. Mr Marshall said that both defendants had incurred a penalty of 5 but the board of Health did not wish to be severe in the present cases, which they had only taken up as a warning to others, the offences having become much too frequent.
