Some of these changes will not apply to every type of license, but many of the changes do impact more than one type of license, so be sure to check all the categories you think might apply to your license. 8 ACT 39 of created provisions for Casino Liquor Licenses. Casino Liquor License Act 39 creates a new type of license called a casino liquor license. Any slot machine licensee under the Gaming Act, or an affiliated designee holding a restaurant liquor or eating place retail dispenser license that sells liquor or malt or brewed beverages at or adjacent to a gaming facility, may apply for a casino liquor license. [47 P.S (a)]. The application fee for a casino liquor license is $1,000,000 for a casino. The annual renewal fee for a casino is $1,000,000 for each of the first four years and $250,000 for each year thereafter. [47 P.S (b), (c)]. There is a one-time fee of $10,000 for a restaurant licensee that does not have a slot license, but operates within or adjacent to the gaming facility. [47 P.S (b.l)]. Restaurant and eating place retail dispenser licensees may continue to use their licenses until the casino liquor license is issued. Once a casino liquor license is issued,the old license must be surrendered to the PLCB, unless it is subject to the quota, in which case it can be sold by its holder. [47 P.S (d)]. Rules for the sale of alcohol by a casino liquor licensee are different in that: It can sell/serve alcohol 24 hours a day, 365 days a year. [47 P.S (e)]. Sales may be made anytime the facility is open to the public. [47 P.S (i)(l)]. In addition to a restaurant licensee with a slot machine license being permitted to provide alcohol free of charge to any person actively engaged in playing a slot machine, a casino liquor licensee may now provide free alcoholic beverages to any person attending an invitation-only event held on the premises. [47 P.S (i)(4), 493(24)(ii)]. (Under the Gaming Act, free alcohol can also be provided to patrons at gaming tables). A casino liquor license expires under the following circumstances: if revoked by an administrative law judge, if non-renewed by the PLCB, if nonrenewed by the holder, or upon request by the slot machine licensee. However,the PLCB can issue a new casino liquor license to a new applicant, even if the previous license had been revoked, non-renewed, or had expired. [47 P.S (g), (h)]. A casino liquor license can only be transferred on a person-to-person basis. [47 P.S (f)]. 25 Pennsylvania slots law's local share Article has been annotated. about real money A couple million here, a couple million there, and before you know it, we're talking Fire trucks, police cars, playground equipment... and more This local share has been very lucrative, over the past decade, generating hundreds of millions of dollars statewide for uses ranging from propping up municipal budgets in cities like Bethlehem and Chester to helping subsidize schools in Philadelphia. In more rural settings, like the Hollywood Casino at Penn National Racetrack in East Hanover Twp., the money has been used to finance new fire stations, parks and other projects in smaller towns throughout the host county. That'll be $10 million, please, (unless 2 percent of the take is more) The law provided for each casino to pay 2 percent of their total slots winnings, or $10 million, whichever was greater, to the municipalities that host casinos. If that amount is more than half of said community's municipal budget, the surplus goes to the county for distribution to the host and / or surrounding municipalities. An additional 2 percent of the house's take goes to the host county. It was intended as a kind of impact fee, to help these communities deal with infrastructure, law enforcement and other needs that might be expected to arise with casino-related companies, until now, have grudgingly accepted the local share tax rate. The local share assessment was something legislators made part of the price of admission to Pennsylvania's casino market from the start. The legislature brought home the pork when it legalized casino gambling in 2004 through a provision requiring a hefty cut of each casino s profits to be carved out for the use of the host municipality. In the Legislature, this de facto revenue sharing program helped solidify the fragile majority needed to pass the slots law, which then-gov. In the midstate, the Hollywood Casino at Penn National Racetrack paid $13 million to Dauphin County in fiscal , an additional $1 million to East Hanover Twp. in Dauphin County, and $160,000 to East Hanover Twp., Lebanon County. And, as supporters like Fumo are always quick to remind, the biggest share of the slots take by far is still reserved for statewide reductions in school property taxes. Slot Revenue All licensed casinos in Pennsylvania pay taxes on the daily gross slot machine revenue they generate. This tax rale equates to 55 percent of the revenue each casino generates. Essentially, for every dollar wagered oṙ slot machines in Pennsylvania' s casinos. * 55 cents is returned to the state. The 55 percent tax rate is split into four separate entities- the State Gaming Fund, Local Share Assessment, the Pennsylvania Gaming Economic Development and Tourism Fund (GEDTP), and tire Pennsylvania Race Morse Development Fund ( PRI1DF). In total, since 2006, Pennsylvania s gaming industry has contributed nearly $8 billion through slot machine revenues. One proponent of such a move, Sen. Kim Ward, R-Westmoreland, has argued that would be a way for more communities to get some positive economic bump from casinos.
