1 The COMMON COUNCIL of the City of Tomah met in REGULAR SESSION January 12, 2016 at 6:15 p.m. with Mayor Shannon Hough presiding. Following the Pledge of Allegiance, roll call was taken with Mary Ann Komiskey, Luke Bohlen, Mike Murray, Pam Buchda, Eric Prise, Dennis Greeno, Nellie Pater, and Larry Siekert present. Absent: None. Also in attendance: City Administrator Roger Gorius, City Attorney P. Berry, and City Clerk JoAnn Cram. Gregg Hagen videotaped the meeting. Motion by Buchda, second by Prise to adjourn to closed session pursuant to State Statute 19.85(1)(e) to confer with Legal Counsel with respect to contract negotiations. Motion passed without negative vote. Meeting reconvened at 6:47 p.m. Anyone Desiring to Appear Before the City Council. No one desired to appear. Minutes: Motion by Buchda, second by Pater to approve the December 8, 2015 Regular Council Minutes as presented. Motion passed without negative vote. Appointments: Appointment of Barb Cram to the Ambulance Commission to Fulfill the Remaining Term of Velma Hockenberry with the Term Expiring April Motion by Greeno, second by Buchda to approve the appointment of Barb Cram to the Ambulance Commission to fulfill the remaining term of Velma Hockenberry with the term expiring in April Motion passed without negative vote. Mayor s Report: The Community Meal representative is requesting volunteers to do a community table dinner and Mayor Hough is requesting that Council members volunteer to serve a community meal. Mayor Hough will put together a couple of dates and provide further information to the Council in an . Mayor Hough would like to open discussion regarding a consent calendar where everything is put in one motion and items could be individually pulled out as needed for further discussion. Administrative report: City Administrator Gorius provided an update on the CVB & Chamber Building Renovation. Admin. Gorius met with Senator Lassa during office hours at Tomah to discuss areas of concern. Admin. Gorius also attended a bar owners meeting to discuss and provide information on the revised alcohol licensing ordinance and the newly adopted demerit point system. On Dec. 23 rd, the City closed on the purchase of the South Side Lumber property. It is hoped the property will be available as a parking lot by the opening of the Aquatic Center in June. City Clerk Report: City Clerk Cram advised the following offices are on the April ballot: Alderpersons in Districts 2,3,4,6, and 8, Mayor, and Municipal Judge. The Mayor and alderperson terms are for 2 years with the exception of Mike Murray (Wards 7, 8, & 17) with a one year term. The Municipal Judge term is for 4 years. Incumbent Dennis Greeno has filed a notification of noncandidacy. Shannon Hough and Nellie Pater will be on the ballot for Mayor and Pam Buchda and Christopher King will be on the ballot for the office of Alderperson in District 4. Photo IDs will be required for all future elections. Library Report. Library Director Irma Keller advised that staff at the Library are working on obtaining new material that offer information that is not easily accessible via the Internet. Printed materials are still valuable. Director Keller provided December circulation figures. Storytime will begin on Monday, January 18 th at 6:30 p.m. Convention & Visitors Bureau/Chamber of Commerce. Executive Director Tina Thompson advised that Angie Hemmersbach started employment in the office today. The Annual Banquet is Monday, February 29 th with the theme of Leaps and Bounds on how Tomah has progressed over the years. The Community Survey for the downtown area is on the Chamber/CVB home page and their Facebook Page. It has also been spotlighted in the monthly and weekly newsletters. Business After 5 will be held on January 20 th at Best Western. The Area Guide for 2016 is being printed. Tomah Public Housing & Community Development Block Grant Monthly Report. A written report was provided by Dir. Muehlenkamp. One apartment at Lakeside Apartments has been totally rehabbed. The school has been providing assistance from the Building Trades class and have assisted in gutting the apartment and hanging drywall. They will also be doing all the trim work and installing kitchen cabinets. All of the housing programs are fully occupied with the exception of the one vacant apartment being rehabbed. There are also business loan funds available. Senior & Disabled Services Report. No report. 1

2 Treasurer s Cash & Investment Reports for December. Motion by Greeno, second by Buchda to accept the treasurer s cash and investment reports for December. Motion passed without negative vote. Bartender Licenses. Motion by Pater, second by Siekert to approve the bartender s license as listed. Motion passed without negative vote. Bartender licenses approved as follows: Ann-Marie E. Schmidt. Special Beer Permit Tomah/Warrens Sportsman s Alliance for Fisheree at Winnebago Park on February 13, Motion by Pater, second by Buchda to approve the Special Beer Permit for the Tomah/Warrens Sportsman s Alliance for a Fisheree at Winnebago Park on February 13, Motion passed without negative vote. Special Beer Permit Queen of the Apostles Parish on February 6, 2016 for the Mardi Gras Dance in the Gymnasium at 315 W Monroe Street. Motion by Pater, second by Buchda to approve the Special Beer Permit for the Queen of the Apostles Parish on February 6, 2016 for the Mardi Gras Dance in the Gymnasium at 315 W Monroe Street. Motion passed without negative vote Budget Amendment - Recognizing $1800 Wal-Mart Community Giving Grant and Authorizing an Expenditure of $1,758 for the Leads Online Program for Law Enforcement. This grant will pay for one year of the Leads Online Program which is a cross-jurisdictional reporting and investigative tool that allows officers online access to transactions from thousands of businesses to include scrap metal processors, secondhand stores, internet drop-off stores, and pawn stores. Motion by Siekert, second by Komiskey to approve the 2016 Budget Amendment recognizing an $1800 Wal-Mart Community Giving Grant in the Grants and Donations Account #G and authorizing an expenditure of $1,758 in Acct. G Service Contracts for the Leads Online Program for Law Enforcement. Motion passed without negative vote. K9 Jager Transfer of Ownership. K9 Jager has been a valued member of the Police Dept. since On January 3, 2016 Officer Hintz (K9 Jager s handler) submitted his resignation as he has accepted a position with the Holmen Police Dept. Because K9 Jager is entering into the end of his work expectancy cycle, it is recommended that the transfer of ownership to the Holmen Police Dept. be approved with a purchase price of $1,500 and the funds be placed into an account that may be used to purchase a police K9 in the future. Motion by Siekert, second by Buchda to approve the transfer of ownership of K9 Jager to the Holmen Police Department for $1,500 effective with the resignation of Officer Hintz and authorize those funds be designated for future purchase of a K9. Motion passed without negative vote. Approval for Out of State Training FBI National Academy. The FBI National Academy serves to improve the administration of justice in police departments and to raise law enforcement standards, knowledge, and cooperation worldwide. There is no fee to attend as tuition, meals, lodging, and travel expenses are paid. The City would be responsible to pay Lt. Holum s wages/benefits while he is attending the training in addition to a $250 assessment fee. Concern was voiced regarding establishing an agreement that a commitment be made to stay with the police department for at least 3 years after an extended training opportunity. Concern was also voiced regarding establishing this type of requirement as it is currently not done for other departments and we simply don t know what the future will bring. Contract violations and requirements for union employees are also something to consider. Motion by Buchda, second by Prise to approve the out of state training for Lt. Holum to attend the FBI National Academy in the state of Virginia pending his acceptance into the academy through the nomination process. Motion passed with one negative vote (Komiskey). Budget Amendment Recognizing a Donation of $100 in Grants and Donations Special Recreation Account #G and Authorizing an Expenditure of $100 in Fund G Grants and Donations to Purchase Supplies for Special Recreation Events. The families of Wendy & Jeff Von Haden, Bill and Andrea Schaller, Lynda and Ritch Miller, and Debbie and Gary Granger submitted a donation of $100 for City of Tomah Special Recreation Events. This Budget amendment should be applied to 2015 as the donation and expenses occurred in Motion by Buchda, second by Bohlen to approve the 2015 budget amendment and recognize the $100 donation in Account G Donations Special Recreation and authorize the expenditure of $100 from Acct. G Recreation Supplies to purchase items for Special Recreation Events. Motion passed without negative vote. 2

3 Resolution Authorizing the Borrowing of $247,659 for the Purpose of Financing the Purchase of a Peterbilt 320 Truck Chassis and Labrie Automizer through the Board of Commissioners of Public Lands of Wisconsin and Levying a Tax to Pay Principal and Interest When Due. This resolution authorizes a 3% 5-year loan through the Board of Commissioners of Public Lands for the purchase of a recycling truck. Initially, it was proposed to lease the vehicle. In doing further research, it was determined it would be more fiscally responsible to do an outright purchase. Motion by Murray, second by Pater to approve Resolution No Authorizing the Borrowing of $247,659 for the Purpose of Financing the Purchase of a Peterbilt 320 Truck Chassis and Labrie Automizer through the Board of Commissioners of Public Lands of Wisconsin and Levying a Tax to Pay Principal and Interest When Due. Motion passed without negative vote. RESOLUTION NO By the provisions of Sec of the Wisconsin Statutes, all municipalities may borrow money for such purposes in the manner prescribed, and, By the provisions of Chapter 24 of the Wisconsin Statutes, the Board of Commissioners of Public Lands of Wisconsin is authorized to make loans from the State Trust Funds to municipalities for such purposes. (Municipality as defined by Sec (2) of the Wisconsin Statutes means a town, village, city, county, public inland lake protection and rehabilitation district, town sanitary district created under Sec or 60.72, metropolitan sewerage district created under Sec or , joint sewerage system created under Sec (4), school district or technical college district.) THEREFORE, BE IT RESOLVED, that the City of Tomah in the, Wisconsin, borrow from the Trust Funds of the State of Wisconsin the sum of Two Hundred Forty Seven Thousand Six Hundred Fifty Nine and 00/100 Dollars ($247,659.00) for the purpose of financing the purchase of a Peterbilt 320 Truck Chassis and Labrie Automizer and for no other purpose. The loan is to be payable within 5 years from the 15 th day of March preceding the date the loan is made. The loan will be repaid in annual installments with interest at a rate of 3.00 percent per annum from the date of making the loan to the 15 th day of March next and thereafter annually as provided by law. RESOLVED FURTHER, that there shall be raised and there is levied upon all taxable property, within the City of Tomah, in the, Wisconsin, a direct annual tax for the purpose of paying interest and principal on the loan as they become due. RESOLVED FURTHER, that no money obtained by the City of Tomah by such loan from the state be applied or paid out for any purpose except financing the purchase of a Peterbilt 320 Truck Chassis and Labrie Automizer without the consent of the Board of Commissioners of Public Lands. RESOLVED FURTHER, that in case the Board of Commissioners of Public Lands of Wisconsin agrees to make the loan, that the Mayor and clerk of the City of Tomah, in the, Wisconsin are authorized and empowered, in the name of the City to execute and deliver to the Commission, certificates of indebtedness, in such form as required by the Commission, for any sum of money that may be loaned to the City pursuant to this resolution. The Mayor and clerk of the City will perform all necessary actions to fully carry out the provisions of Chapter 24, Wisconsin Statutes, and these resolutions. RESOLVED FURTHER, that this preamble and these resolutions and the aye and no vote by which they were adopted, be recorded and that the clerk of this city forward this certified record, along with the application for the loan to the Board of Commissioners of Public Lands of Wisconsin. Resolution Appointing Bond Trust Services Corporation to Serve as Fiscal Agent in Connection with Outstanding Obligations. The City has three debts that we do not have a paying agent for. The paying agent sends invoices when the debt and interest payments are due and is the go between from the Depository Trust to the City. The yearly fee is approximately $1,000. These services would include fiscal agent responsibilities for the General Obligation Promissory Notes, Series 2008A dated March 4, 2008, General Obligation Promissory Notes, Series 2013A dated July 10, 2013, and the General Obligation Refunding Bonds, Series 2015A dated January 8, Motion by Murray, second by Prise to approve the resolution appointing Bond Trust Services Corporation to serve as fiscal agent in connection with outstanding obligations for the City of Tomah with the fee not to exceed $1,000 and if the fee exceeds $1,000, it should come back to the Council for approval. Discussion: Question arose as to the specific costs related to this service and whether or not the fee would increase over time. As the Council was unable to obtain the requested information, it was the consensus to gather more specific cost related information for this service and present it at the next meeting. Motion and second were subsequently withdrawn. Motion by Bohlen, second by Prise to table the Resolution regarding appointment of Bond Trust Services Corporation until the February meeting. Motion passed without negative vote. Establish Wage for Wastewater Treatment Facility Supervisor Position. Mr. Don Pierce has announced that he will be retiring on February 1, Bass has been instrumental in maintaining the excellent rating and performance of our plant. Brandy Leis has been selected to take the Wastewater Treatment Facility Supervisor position. It is requested that the wage be established at $55,485 Range 16, Step 6 effective February 1, 2016 upon the retirement of the current supervisor. Motion by Greeno, second by Komiskey to approve the starting wage for the new hire for the Wastewater Treatment Plant Supervisor at $55,485, Range 16 Step 6. Motion passed without negative vote. 3

4 Ordinance Rezoning 920 Kilbourn Avenue from R2 One and Two Family Residential District to B-General Business District as Requested by Lisa Mueller. The property has never been occupied as residential and historically has been occupied as a Church, Knights of Pythias Hall and a photography studio. The property is currently an illegal nonconforming use as the last commercial use terminated more than 12 months ago. The applicant plans to have a café/coffee shop on the lower level and an art/glass studio and meeting room on the main level. Motion by Greeno, second by Pater to waive the first verbatim reading of the Ordinance Rezoning 920 Kilbourn Avenue from R-2 One and Two Family Residential District to B-General Business District. This percentage was the maximum allowed under current limits imposed by the state. It is requested that the non-represented wage increase be set at 1% for 2016 retroactive to January 1 st. Motion by Komiskey, second by Prise to approve a 1% wage increase for non-represented employees retroactive to January 1, Motion passed without negative vote. Cram, City Clerk Ordinance Amending Section Restrictions Regarding Lake Tomah and Discharge of Firearms. The City currently has ordinances which regulate the shooting of a firearm within the City. State Statutes allow the City to create an ordinance that has an incidental effect on hunting but only if the primary purpose is to further public health and safety. This ordinance previously restricted the use of boats to hunt or trap on Lake Tomah while the lake is occupied by swans during their migration season. This language is eliminated. ORDINANCE NO D ORDINANCE AMENDING ARTICLE III, MISCELLANEOUS OFFENSES AGAINST PEACE AND GOOD ORDER SECTION AND ARTICLE IV WEAPONS SECTION DISCHARGE OF FIREARMS OF THE MUNICIPAL CODE OF THE CITY OF TOMAH The Common Council of the City of Tomah do ordain as follows: SECTION ONE: Section Article III Miscellaneous Offenses Against Peace and Good Order Restrictions Regarding Lake Tomah is hereby amended to read as follows: (a) Bow fishing. All persons bow fishing on Lake Tomah shall comply with all rules and regulations established by the State Department of Natural Resources, for bow fishing. Bow fishing shall only be permitted during the time periods as established by the Department of Natural Resources. (b) Waterfowl Hunting. All persons waterfowl hunting on Lake Tomah shall comply with all rules and regulations established by the State Department of Natural Resources for waterfowl hunting. Waterfowl hunting shall only be permitted during the time periods as established by the Department of Natural Resources. SECTION TWO: Section Article IV Weapons Discharge of Firearms is hereby amended to read as follows: No person, except a law enforcement officer, shall fire or discharge any cannon, gun, pistol, air or spring gun or any firearms of any description. As described in Section 28-53(b), Waterfowl Hunting, the discharge of firearms while lawfully waterfowl hunting on Lake Tomah is allowed. The Act does not modify the portion of the statute that allows municipalities to prohibit or regulate hunting on property owned by the municipality. The ordinance change allows bow hunting on all private land within the City with the permission of the landowner, that bow hunting must be further away than 100 yards from a building unless written permission is given from the landowner and that all bow hunters be required to discharge their arrows or bolts toward the ground. ORDINANCE NO D ORDINANCE AMENDING ARTICLE IV, WEAPONS - OFFENSES AGAINST PEACE AND GOOD ORDER SECTION BOW HUNTING ON CERTAIN LANDS AND SECTION SLINGSHOTS; BOWS AND ARROWS OF THE MUNICIPAL CODE OF THE CITY OF TOMAH The Common Council of the City of Tomah do ordain as follows: SECTION ONE: Section Article IV Weapons - Offenses Against Peace and Good Order Bow Hunting on Certain Lands is hereby amended to read as follows: 5

6 Sec Bow hunting. Bow hunting, either by bow and arrow or crossbow, within the City of Tomah shall be allowed with the following restrictions: (1) All persons bow hunting shall comply with all rules and regulations established by the state department of natural resources for hunting with a bow. (2) Bow hunting shall only be permitted during seasons as established by the department of natural resources. (3) It shall be unlawful for a person to discharge a bow and arrow or crossbow within a distance of one hundred (100) yards from a building located on another person s land. This restriction shall not apply if the person who owns the land on which the building is located allows and gives written permission to the person to use or discharge an arrow or crossbow within the specified distance of the building. (4) Except at the followings location bow and arrows or crossbows may not be discharged on or across any portion of land owned or occupied by the City of Tomah unless specifically authorized by the City of Tomah chief of police or the chief of police s designee. (a) Bow hunting for deer shall be permitted on that land owned by the City of Tomah and located at Bloyer Field that is east of the north-south runway and north of the east-west runway extended to the railroad tracks and south of the railroad tracks, subject to the following restrictions: (i) No person shall hunt, stand, walk or drive any vehicle within 200 feet of the paved runway. (ii)notwithstanding the foregoing, all other regulations involving the airport are hereby affirmed. (b) Bow hunting for deer shall be permitted on that land owned by the City of Tomah and located on a parcel of land so noted as Parcel ID within the Monroe County GIS internet based system. Due to the Tomah Police Departments firearms range, bow hunting on this parcel shall be restricted to the following location within this parcel (i) Using the western most boarder line, running north and south, of Parcel ID (440 Cardinal Avenue), and extending the same line south through Parcel ID , bow hunting is allowed to the west of this line. (c) Bow hunting for deer shall be permitted on that land owned by the City of Tomah and located on a parcel of land so noted as Parcel ID within the Monroe County GIS internet based system. Due to the City of Tomah's waste water facility being located on this parcel of land, bow hunting on this parcel shall be restricted to the following location within this parcel (i) Bow hunting shall not be allowed within the confines of the waste water facility or within 200 yards of the confines of the facility. (5) While bow hunting for deer on property that is owned by the City of Tomah temporary tree stands or blinds are allowed so long as they are removed at day's end and trees are not damaged while being installed. (6) Hunting may not occur across or within any public right of way or within fifty (50) feet of the center of a right of way and never closer than thirty (30) feet of the nearest border of a right-of-way. (7) A bow and arrow or crossbow must be discharged toward the ground. (8) Bow hunting must meet all of the following public health, safety and welfare conditions: (a) Arrows or other projectiles shall not enter, occupy, or traverse land owned or occupied by another without the owner s prior written consent even if otherwise used in conformance with this section. (b) Bow hunters must follow state hunting laws, Wisconsin DNR hunting regulations, and safe hunting practices such as ensuring no people or property are in the vicinity of the target and the area beyond the target before discharge of an arrow or bolt. (c) Bow hunters must use best efforts to promptly dispatch an animal on the permitted property with a safe and effective shot. If a wounded animal is not recovered on the hunter or co-applicant s property, then entry on to another s property is permitted only with the prior permission of the landowner. (d) Bow hunters shall take all reasonable steps to immediately and properly dispose of any portion of an animal killed or injured during a bow hunt including immediately field dressing any animal killed or injured at the site of the bow hunt, and promptly processing the meat and disposing of the by-products from the hunt. (9) Bow fishing is allowed as per section 28-53(b) of these ordinances. SECTION TWO: Section Article IV Weapons Slingshots; Bows and Arrows is hereby amended to read as follows: Sec Slingshots; bows and arrows. No person shall discharge or cause the discharge of any dangerous missile from any slingshot or cause the discharge of any dangerous missile from any slingshot or bow and arrow within 600 feet of any inhabited dwelling or building or any public park, square or enclosure; provided, however, that this section shall not apply: (1)To the shooting or discharging of toy arrows or arrows that have a tip made of rubber or similar material. (2)To a supervised archery range approved by the council or archery courses conducted under the supervision of a school or the city department of parks and recreation. (3)Within the interior of a single-family dwelling. (4)To the shooting or discharging of a bow and arrow for purposes of bow fishing as allowed in Sections and (5)To the shooting or discharging of a bow and arrow for purposes of hunting as allowed in Section SECTION THREE: All Ordinances in conflict with the foregoing are hereby repealed.
