However, the firearms are being sold in their As Is condition. It is the sole responsibility of the buyer to know exactly what they are buying & ensure they have viewed the firearm & the information provided is correct to their satisfaction. The mechanical workings of these firearms have not been tested. We highly recommend the firearms be checked for their safety & ability to fire by a qualified gun repair shop/gunsmith prior to shooting. Type Description: A Antique, B Black Powder, BBL Barrel only, C&R Curio & Relic, M Modern, R Regulated Firearm/Handgun, MD Banned Weapon banned for sale to a resident of the state of Maryland. Firearm Type/Category: The firearms will be broken down into 6 categories. #1 ANTIQUE. An Antique is generally a firearm that is made to fire modern metallic ammunition but was made prior to No paperwork is required to transfer this type of firearm. #2 BLACKPOWDER. A Black powder firearm is not made to fire modern metallic ammunition. No paperwork is required to transfer this type of firearm. Can be exceptions. #3 CURIO & RELIC. A Curio & Relic Firearm has been designated by the by the BATFE as having collector value or is over 50 years old. Only Licensee s who have applied for and received a CURIO & RELIC LICENCE through the BATFE Qualify for this category. #4 A Modern firearm is made after 1898 & is required to be transferred via an instant background check by an FFL dealer to transfer the firearm to you. #5 REGULATED. A Regulated Firearm is designated so by the State of Maryland & requires an instant background check & associated paperwork to be completed for the MD State Police. This covers most handguns that fire metallic cased ammunition. This paperwork requires a 7 day (Business Day) waiting period. NOTE: Maryland Residents must attain and present a Handgun Qualification License (HQL) in order to fill out paperwork. #6 MD BANNED This category will contain certain Assault Rifles (AR-15, AK-47, UZI, SKS w/detachable mag, ect ) that the State of Maryland has banned for transfer in the State of MD. This type of firearm can t be purchased by a Maryland Resident. It may be sold to residents of other States where that type of firearm is legal to purchase. THE FIREARM TYPES ARE LISTED BELOW IN THE CATALOG. AS A GENERAL RULE THESE ARE NOT SUBJECT TO CHANGE UNLESS A TYPOGRAPHICAL ERROR WAS MADE. Our FFL has the final say on this matter. If a firearm is listed as MODERN, REGULATED, CURIO & RELIC or MD BANNED it is on our FFL dealers ACUISITION & DISPOSITION (A&D) book & will not be changed, I.E. paperwork is required. Only a Firearm that is an ANTIQUE or BLACKPOWDER will require no paperwork. Catalogs/Seat Reservation: This catalog can be printed at your home or work. Catalogs will be available at the Auction Registration window. Catalogs will be Approx. $5. Seat Reservation can be done this year on the Preview Night. You can register on Thursday Night the 2nd and we will provide up to 4 seat reservation labels per registrant and you can place them on the available seats. This will be done on a first come first served basis. Abbreviations: The following is a list of abbreviations used here. BBL = Barrel, DA = Double Action, GA = Gauge, OAL = Over All Length, O/U = Over & Under, SA = Single Action, SBS = Side by Side, SAR/SA Rifle = Semi Automatic Rifle, BAR/BA Rifle = Bolt Action Rifle, LAR/LA Rifle = Lever Action Rifle, Rev. = Revolver, SSR = Single Shot Rifle, SAP/SA Pistol = Semi Automatic Pistol, DOM = Date of Manufacture, LOP = Length of pull. PURCHASING A FIREARM: Items will be sold in the catalog order listed. All State & Federal Laws will be adhered to when transferring firearms. Our FFL Dealer can transfer most regular rifles & shotguns (Listed as Modern) to Residents of Maryland, Delaware, Pennsylvania, Virginia and West Virginia. Residents of other State s must have their firearms shipped to an FFL Dealer in their state. There is no limit on Quantity of these types of rifles or shotguns (Listed as Modern) that can be purchased and the paperwork completed at one time. Once you purchase a firearm you may go to the FFL Office and initiate your paperwork. The paperwork will not be finalized until you have paid for your item(s) at the Registration windows. You will need to take your payment receipt to the FFL room. The receipt must be in the name of the person the background check will be completed in. For firearms listed as Regulated (I.E. Most Handguns) our FFL Dealer can only transfer those to Residents of Maryland. Residents of any other state must have those types of firearms (Listed as Regulated) transferred to a FFL Dealer in your State to process your States required paperwork. Maryland Residents are generally restricted to 1 Transfer or a regulated weapon within a 30 day period. You can purchase more than 1 at the Auction but only 1 can be transferred at a time within a 30 Day period. Once 30 days have elapsed the next set of paperwork can be sent off to the State Police to conduct the Background Check. Most Maryland Residents will need to attain and posses a Handgun Qualification License that is issued by the Maryland State Police in order to Fill out the paperwork to purchase a handgun. For firearms listed MD Banned (I.E. Most items that were on Maryland Assault Weapons Regulated Firearm List have now been banned for sale in the State of Maryland. All firearms listed as MD BANNED in the catalog will need to be transferred to an FFL Licensed Firearms Dealer outside of the State of Maryland. These firearms can t be transferred to you if you are a Maryland Resident These firearms can t be handed out in the State of Maryland to Resident of a State where they are legal to own. They will only be transferred from our FFL to an FFL in your state to process the required paperwork in your state. It is imperative that you ensure the firearm can be legally owned in your Jurisdiction. Once the firearm has been shipped out of Maryland it can t come back to our FFL Dealer. There will be a $15 transfer Fee + the cost of shipping to your FFL. Our FFL will either ship or hand deliver your REGULATED to a Dealer of your choice. The choice of whether to ship or deliver will be at the discretion of our FFL. We apologize for any inconvenience this may cause. Questions can be addressed to our FFL Dealer, Jeff or Allen & Marshall Auctioneers and Appraisers, LLC at Transfer time frames: Most Non-Regulated Rifles & Shotguns can have an instant Federal Background Check completed at the time of sale and you can take the Firearm with you the Day of the Auction (MD, DE, VA, WV & PA Residents Only). For MD Residents it is imperative that prospective buyers attain an HQL license from the MD State Police. This HQL card is required to be shown to the FFL prior to filling out of paperwork. It should be understood that the Maryland 7 Day Waiting Period begins on the day that the paperwork is submitted to the State Police. It may take us a week + to get the paperwork finalized

2 and submitted. At the earliest I would not expect MD Handgun Paperwork to start coming back for Days after the Sale Date. If you want it quicker we will gladly ship it to another FFL Dealer for them to process. They can also pickup the firearm directly from us. External Lock/Integral Internal Lock Information for Maryland Handgun Buyers: (1) A dealer may not sell, offer for sale, rent, or transfer in the State a handgun manufactured on or before December 31, 2002, unless the handgun is sold, offered for sale, rented, or transferred with an external safety lock. (2) On or after January 1, 2003, a dealer may not sell, offer for sale, rent, or transfer in the State a handgun manufactured on or after January 1, 2003, unless the handgun has an integrated mechanical safety device. For MD handgun purchaser firearms that fall under category #1 we will have cable clocks for sale for $ depending on the length required. For MD handgun purchasers that fall under category #2 we will have a limited # of Integral Safety devices available for sale for $ Either can be negated if you bring an approved lock with you when you pickup your firearm. If you need to Purchase an Integral lock please let us know at the time you are filling out your paperwork. We may have to order it. Buyer responsible for filling out required paperwork to complete the background check to transfer firearms purchased or Notify our FFL of your FFL s name and address where you would like your firearm transferred. Gun Transfer/Required Paperwork Information If you have questions please ask before you buy. 1. All required Local, State & Federal laws will be adhered to in transferring any and all firearms in the auction sale. This is non-negotiable. If you do not want to fill out the required paperwork please do not purchase any item for which paperwork is required. 2. If you are not allowed by law to purchase or own a firearm for any reason do not purchase one. If you are not eligible to purchase or own a firearm it is your responsibility to know. There shall be no refunds of any kind if you are unable to transfer a firearm into your name or do not pass the background check. We will gladly resell the firearm at a time of our choosing. 3. The actual buyer of the firearm must fill out the required paperwork. Make sure when you check in you register under the name that the paperwork will be filled out in. You will need to bring your receipt to the FFL dealer and the name on the receipt must match the name the paperwork is being filled out in. It is against the law for you to fill out the paperwork in your name and then give the firearm to someone who may not be able to legally own that firearm. Known as a "Straw Purchase". 4. Identification/Photo ID required. You must bring a valid/current identification as to who you are in order to register for the auction and complete the required paperwork to transfer a firearm. This also applies to FFL Dealer & C & R License holders. Your name or business must be listed on the license in order to use it. Another person s license cannot be used by any individual other than the person/business named on the license to receive a firearm. 5. You must be at least 18 years of age to purchase a non regulated rifle or shotgun or ammo. You must be at least 21 years of age to purchase a pistol, regulated firearm (AR-15, AK- 47ect ), pistol grip shotgun or Handgun Ammo. Antique/Black powder Rifle/Pistol/Shotgun Information - Most Black powder Rifles, Pistols & Shotguns do not require any paperwork in the State of Maryland and can be handed out on the day of the Auction. There are a few exceptions! Some black powder firearms now use Smokeless propellant and are regulated. Some firearms that have interchangeable barrels are also regulated. Curio & Relic Information - Some firearms may fall under the ATF Curio & Relics licensing and if they are purchased by an individual with a "C&R License" no paperwork is required. NOTE: Items that meet the age requirements but have been altered from their original configuration may NOT be delivered on a C&R License. The determination of whether a firearm falls under the "Curio & Relic" shall be made by the discretion of Jeff Smith of Smitty's Gun Shop (our FFL dealer) and his word shall be final. Associated Fee's for the Required Paperwork/Transferring the firearm(s) to you. Allen & Marshall Auctioneers & Appraisers, LLC is the New FFL Dealer & will be completing the required paperwork. You will be responsible for paying them. They will accept cash, checks or Amex/Visa/MC/Disc.

6 Modern Rifles/shotguns - A transfer fee of $30 will be collected on each MODERN rifle/shotgun purchased. We can transfer to Residents of MD, VA, WV, PA & DE. Modern Pistols/Regulated Firearms - A transfer fee of $45 (We are still Collecting the $10 fee for the State of MD) will be collected on each Regulated Firearm purchased for Residents of MD. Allen & Marshall Auctioneers and Appraisers, LLC is has a MD Regulated Firearms Dealers License. All firearms listed as REGULATED in the Catalog will need to be transferred to an through Maryland New Online Licensing Portal ( If you are a Maryland Resident with an HQL you will need to visit the website, create an account, fill out the paperwork online and attain a Tracking # upon completion. You provide us that tracking # and then we can access your application through the Dealer side of the Website. We attach your Firearm info to your Application and forward it to the MD State Police. This is the only way to purchase a Pistol in the State of Maryland at this time. The old Paperwork is no longer being accepted as of January 1 st, C & R License holders - A transfer fee of $10 per C&R firearm will be charged. You must have an original signed copy of the required paperwork/c & R License. (Preferably signed in blue/red ink) Non Maryland Handgun/Regulated Firearm Buyers or Long gun Purchasers not from MD, DE, VA, WV, PA. - A transfer fee of $15 per modern firearm will be charged + the cost to ship the item. Integral Internal Lock For Maryland handgun purchasers only. Required for Pistols made after Dec. 31, Will be notated in the catalog. Cost is $ Can be negated if you provide an approved lock at the time the pistol is picked up. Lock must be an Internal Lock approved by MD State Police. Can t be a padlock/cable lock. Maryland Banned Firearms: Due to recent changes in Maryland s Firearm Laws some firearms in the Auction are banned for sale in the State of Maryland. Those firearms will be Notated that way in the catalog as they are not transferable to Residents of Maryland. These firearms can only be transferred out of State of MD to a resident of another State who lives in a jurisdiction where they are able to legally purchase that type of firearm. It is the purchaser s responsibility to know if these firearms are legal in your State. Once delivered out of State these firearms will not be returnable to Maryland. These firearms must be Shipped to/delivered to/picked up by your FFL. If you are an FFL you can take the firearm with you. Shipping Information for Firearms: It should be understood that items will be shipped as soon as they can be readied for shipment by the Auction Co. We are the FFL and are responsible for the shipment of Firearms to an FFL in your state. This is not an instantaneous process. Before anything happens we need a copy of your FFL s license so we know where we need to ship the firearm. With the size of the Auction and the Paperwork required it is normally 7-10 days before items start to be shipped. Depending on the amount of Online Bids/Firearms that require shipment this process can take 2-3 weeks to ship all of the firearms. Firearms being shipped by the FFL will include any firearm that uses a propellent to fire a projectile and will include Modern, Antique, Regulated, B. Powder & C&R firearms. Shipping for Non Firearm Items: Allen & Marshall Auctioneers will not handle the shipping of Non-Firearm items. All Non Firearm items that require shipping will be out sourced to the UPS Pack and Ship Store located in Salisbury, MD. Payment for the packing, materials, boxes, insurance, Signature Confirmation, handling & shipping of purchased lots is the sole responsibility of the buyer. Buyer is responsible for the actual cost of shipping. Shipping fees must be paid prior to the items being shipped. Buyers will be notified or delivery to the UPS Store. You will be responsible for Paying the UPS Store directly. It should be understood that shipping is very expensive. Allen & Marshall Auctioneers has no affiliation with the UPS Store and as such we have no control over the cost of shipping charges. High Capacity Magazines: NO High Capacity magazines (Over 10 Rds) can be handed out at the Auction. Some firearms in the Auction have Magazines with a Capacity over 10 Rds and we may be selling High Capacity Mag s. These Magazines can t be handed out in the State of MD. If you purchase one of these firearms or magazines we can ship your magazines out of the State of Maryland to a Destination of your choosing (Where they are legal of course)! This shipping (At your cost) will be provided by the FFL/Auction Co. to Ensure that the Magazines are property removed from the state. At that point it s your responsibility what you do with them. Transfer time frames: Most Non-Regulated Rifles & Shotguns can have an instant Federal Background Check completed at the time of sale and you can take the Firearm with you the Day of the Auction (MD, DE, VA, WV & PA Residents Only). For MD Residents it is imperative that prospective buyers attain an HQL license from the MD State Police. This HQL card is required to be shown to the FFL prior to filling out of paperwork. It should be understood that the Maryland 7 Day Waiting Period begins on the day that the paperwork is submitted to the State Police. It may take us a week + to get the paperwork finalized and submitted. At the earliest I would not expect MD Handgun Paperwork to start coming back for Days after the Sale Date. If you want it quicker we will gladly ship it to another FFL Dealer for them to process. They can also pickup the firearm directly from us. HQL Handgun Qualification License for MD Residents- MD Handgun/Regulated Firearm purchasers must attain & possess the HQL (Handgun Qualification License) in order to purchase/fill out the required MSP Paperwork at a participating dealer. Visit for information on attaining the HQL. You must have the HQL card with you in order fill out the Required Firearm paperwork. You should have an HQL if you intend to purchase a handgun & are a MD Resident (State Law since 2013) If you purchase a handgun & don t have an HQL a storage fee will be incurred. The storage fee will be $2 per day for a period of 30 days not to exceed $60. From Day 31 on there will be a $5 per day storage fee per firearm stored. This fee will stop when you present us your HQL in person & can complete the required paperwork. If you do not provide us an HQL in a timely manner storage fee s will accrue & continue to be charged until the purchase price of the firearm has been exceeded. At that time the firearm belongs to the Auction Co. This can be negated if you provide us an FFL to ship your firearm to that is willing to hold your firearm until you get your HQL.

7 We apologize but people have been using the Auction Co. as a Storage Facility and many don t follow through with attaining the HQL. If you purchase a handgun and don t possess an HQL or meet one of the criteria that exempts you a form will be filled out at the time to ensure that you understand and will comply with this policy.
