1 Crossbow Ranch Wildlife Preserve Rules and Regulations Season (Approved September 12, 2015) I. Authority In accordance with (i) Section 4.A. of the Declaration, the Hunting Owners shall receive all the rights, benefits, and obligations pertaining to the harvesting of wildlife as permitted by the Rules and Regulations ( R&Rs ), (ii) Article II, Section 4 of the Bylaws, only the Hunting Owners can vote on matters concerning hunting rights, hunting privileges, hunting obligations, or the Rules and Regulations, and (iii) Article V, Section 1 of the Bylaws, the Wildlife Committee ( WC ) shall supervise and facilitate voting matters concerning the R&Rs and thereafter revise the R&Rs each year, if necessary. Capitalized terms used but not defined herein shall have the meaning given to such terms in the Declaration. The R&Rs will remain in effect from the date approved above until amended. II. Wildlife Management Plan The WC is charged with developing and maintaining a Wildlife Management Plan ( WMP ) to (i) ensure the proper management of the Common Wildlife Preserve ( CWP ), and (ii) maintain the vitality of the whitetail deer herd and all other animals on the CWP. Items continually being evaluated include, without limitation, habitat, natural resources, food plot, nutrition, and the harvesting of whitetail deer in a manner that will increase the quality, size and vitality of the whitetail herd. Annually, the WC, through consultation with a Texas Parks and Wildlife ( TP&W ) biologist, will conduct a survey of all wildlife on the CWP. One of the goals will be to determine the number, age, and sex of all whitetail deer on the CWP. This data will be analyzed and taken into consideration when establishing the Annual Harvest Regulations. Each summer, the WC will review the WMP in detail. Before September, the WC will vote on any necessary changes. From that approved WMP, the WC will approve action items for the coming license year (September through August). 2 for the WC to comply with WMP recommendations (such as fall & spring food plots, supplemental feeding, controlled burns, flash grazing, etc). Once these action items are approved, they should not be changed until the next summer review. Such advanced planning will assist greatly in budgeting and scheduling such activities. III. Hunting on the WMP Only Hunting Owners, Designated Family Members ( DFM ), or Guests (collectively referred to as Hunters ) are allowed to hunt on the CWP in accordance with federal, state and local law. DFM is defined as an authorized spouse, parent, children (including adopted and step), sibling, and sons & daughter in-law. Hunting Owner or DFM must be present on the ranch when allowing their Guest access to the CWP for recreation or hunting activities. The R&Rs are binding upon everyone allowed access to the CWP. The R&Rs will be in effect from the date designated above until amended by the Hunting Owners. Whitetail categories are defined in Exhibit A. Once the annual harvest quota or any whitetail category or Exotic is reached, a notice will be sent to all Hunting Owners and any further harvest will be restricted. Guest are restricted from harvesting a Trophy Buck [Violations will be considered CLASS B.] Trophy Bucks may only be hunted with legal archery equipment or legal crossbows [Violation will be considered CLASS C.] All arrows and crossbow bolts taken onto the CWP must be clearly marked with the Hunter s lot number every six inches along the shaft with indelible, permanent marker or epoxy/enamel paint. Managed Lands Deer ( MLD ) permits may augment the regular bow, crossbow and firearm seasons to accomplish the harvest quota. This is expected to promote a healthy and manageable whitetail herd, with trophy animals being maximized to the extent possible. The WC may permit bow, crossbow and/or firearm hunting to fill MLD permits. 2 Crossbow Ranch Rules & Regulations September 12, 2015

3 IV. Hunter Education and Qualifying Every Hunter born on or after September 2, 1971, must successfully complete a Hunter Education Training Course. Hunters under age 14 must be accompanied by a licensed Hunter who has successfully completed a Hunter Education Training Course (if that adult is required to have Hunter Education). To document Hunter s Education and a valid Texas hunting license, each Hunter (including Guest) should complete the Acknowledgement of Receipt & Agreement Form, Exhibit E. Annually, before bow hunting on the CWP, each Hunter should be able to demonstrate archery proficiency, utilizing the specific archery equipment used for hunting. Proficiency is demonstrated by shooting three out of five arrows / bolts (using field tips or broadheads) into a six-inch target at twenty yards. [Violations to the rules in this Section will be considered CLASS E.] V. Limited Firearm Whitetail Deer Hunting No firearm hunting will be allowed during the Regular Whitetail Season unless specifically authorized by the WC, except as noted in Section VII: Unwanted / Target Species. [Violations will be considered CLASS C.] Limited, supervised firearm hunting for youth shall only be allowed when authorized by the WC. Youth 17 years of age or younger must be accompanied by the Hunting Owner, and remain in the same stand at all times. Trophy and Management Bucks may not be harvested during these hunts. [Violations will be considered CLASS C.] Cull Bucks and Does may be harvested during these hunts. These hunts must be coordinated through the WC. The hunting of certain whitetail deer (excluding Trophy bucks) with TP&W legal firearms (center fire rifle or handgun, muzzleloader, or shotgun with slugs or buckshot) could be authorized by the WC to fill the ranch quota during any Extended Whitetail Season. 3 Crossbow Ranch Rules & Regulations September 12, 2015

4 VI. Exotic Animals Exotic animals may be hunted throughout the year, unless specifically restricted by the WC. Firearm hunting for exotics will not be allowed during the TP&W whitetail deer hunting season. Hunting Lot Owners (including their DFM or Guest) are eligible to harvest One (1) Male Exotic of each available species (per hunting lot owned). Refer to Exhibit C for Harvest Limits, Restrictions and replacement fees for both Owner & DFM and Guests. Replacement of exotic animals and possible new exotic additions will be continually evaluated by the WC. VII. Other Game Animals: Duck, Dove, Quail, Turkey, Other Small Game, & Fish Game limits, means, and methods may be restricted by TP&W. Neither jackrabbits nor quail may be taken for any reason. It is pertinent to note that all Owners in good-standing are allowed to fish on the CWP. Bass fishing is catch and release only. VIII. Unwanted / Non-Target Species Predators, varmints, and hogs may be taken year-round, as the opportunity presents itself. Such animals may be taken without stand or zone reservation, but Hunter must be mindful of safety and careful not to disturb the enjoyment of the CWP by those having such reservation. No other firearm-hunting or spotlighting is allowed during the Regular Whitetail Season, unless specifically approved by the WC. 4 Crossbow Ranch Rules & Regulations September 12, 2015

5 IX. General Safety Before entering the CWP any individual that is authorized to enter the CWP must determine if there are Hunters or other individuals discharging weapons on the CWP. To signify hunting or shooting, an orange safety flag will be flown on the flagpole at the Cooler. If the safety flag is raised, that indicates that a hunt or shooting may be taking place. You must check the White Board at the Cooler to see what kind of activity is taking place, and where on the CWP it is taking place. No children under 14 years of age, or minor Guests are allowed on the CWP at any time without being accompanied by a parent or an adult Guest that has previously signed the Release of Liability form. This includes any use of the CWP, including, without limitation, hunting, fishing, vehicular use, hiking, etc. The failure to provide a signed release of liability before entering the Preserve will constitute immediate removal. Being intoxicated is prohibited on the CWP. Vehicles shall not (i) exceed 15 miles per hour, (ii) be operated in an unsafe manner, or (iii) harm the CWP or disturb the natural beauty or harmony of the CWP, the wildlife, domestic animals, other people, etc. Horseback riders must assume all inherent spook risks of their horses that may occur with ATV use and hunting being conducted. VI. Hunter Safety The safety of all individuals entering the CWP is of paramount importance and requires careful coordination. This is especially true during any firearm hunts. Responsible firearm and archery hunting requires each Hunter to know exactly where a projectile will land when discharged or released, and suppress the urge to discharge weapons if conditions could be considered unsafe or even questionable. 5 Crossbow Ranch Rules & Regulations September 12, 2015

6 Discharging firearms and/or hunting from the main ranch roads are prohibited. Failure to comply with these requirements could result in termination of privileges, including being barred from entering the CWP. VII. CWP Use / Reservations Nobody will be allowed to participate in hunting activities or any form of recreational activity, or otherwise enter the CWP until they: 1) Are in good standing with the POA, including full compliance with all WC & POA penalties, and 2) Have signed the Release of Liability, Consent for Exposure to Dangerous and Hazardous Conditions, & Assumption of the Risk attached hereto at Exhibit B, and 3) Have signed the Acknowledgement of Receipt & Agreement Form, Exhibit E. Hunting Lot Owner should sign an Exhibit E for each Guest. In order to manage use & reservations on the CWP, it has been divided into Units. Each Unit has at least one POA hunting or observation blind. Any Owner may reserve a specific Unit for himself/herself or his/her DFM or Guest. The DFM shall have all of the same scheduling rights as the Owner. An Owner or DFM may reserve a maximum of two Units per hunting lot owned: one Unit for the Owner or DFM and one for the Guest. Remember that Owner or DFM must be present on the ranch when allowing their Guest access to the CWP for recreation or hunting activities. Units are reserved on a first-come, first-served basis, in person no more than 48 hours in advance. Reservations are made in-person, by the Owner or DFM, at the Cooler. To make a reservation, the Owner or DFM must: 1) Sign-in the logbook (with all other hunt & Owner information requested). The Owner or DFM must sign-in his Guest. Unit reservations may not be made for other Owners or his Guests. 2) Select an available Unit from the White Board by marking Hunter s name & lot number. In addition, Owner or DFM must hang their numbered tag (by lot number) on the hook on the area map, indicating which Unit they are selecting; Owners and DFM will not be required to take their tag down at the end of each hunt. The map/tag system will be used for Owners to visually show which Units are reserved. 3) Owner or DFM must make sure the orange safety flag is being flown. It is the responsibility of the first Owner or DFM to put his name on the White Board to raise the flag at that time. As long as 6 Crossbow Ranch Rules & Regulations September 12, 2015

7 there are still names on the White Board, the flag should remain flying. It is the responsibility of the last Owner or DFM hunter to remove his name from the White Board to lower the flag. If the Owner or DFM changes their unit(s) reservation during the hunt, they should make the change on the White Board and re-hang the tag in the appropriate Unit on the map. At the completion of the reservation, the Owner or DFM should: 1) Sign out of the logbook (completing all required information.t), 2) Remove Owner s & any Guest s name from the White Board and remove tag from map, and 3) Check to see if there are any other names on the White Board. As long as there are still names on the White Board, the orange safety flag should remain flying. It is the responsibility of the last Owner or DFM hunter to remove his name from the White Board to lower the flag. The maximum contiguous term for Unit reservations is 4 days by the same person on the same Unit. Owners cannot monopolize Units or areas by coordinating hunts, back and forth. A rotation system that includes new, incoming Owners to rotate into an area, if that stand or area is being dominated by existing Owners, will be in effect. When more Owners request a Unit than there are Units available, priority will be given to Owners who have not selected a Unit in the prior week. On weekends, any surplus Owners will be given priority on the second weekend day if there is competition for selected location. Owners always have priority over Guests. If an Owner reserves a Unit for his or her Guest, and another Owner wants that Unit, the Guest may be bumped in order to accommodate the second Owner. If this occurs, the first Owner may reserve a different Unit for his or her Guest, if available, or the Guest may utilize the same Unit as the Owner. There may be up to three stands in any given Unit simultaneously. All Owners, DFM, or Guest are to proceed to and from their assigned Unit only by utilizing the most direct and expeditious route, to avoid disturbing other locations where Owners may choose to stay all day. 7 Crossbow Ranch Rules & Regulations September 12, 2015

8 VIII. CWP Access during Whitetail Seasons The dates of Whitetail Seasons are set by TP&W, and reflected in Harvest Regulations (Exhibit A). For use of the CWP during Whitetail Seasons, the CWP shall be reserved by Stands as the effective Unit. Owners, DFM, or Guests must verify that their name is associated with the proper Stand before traveling to that location. Owners, DFM, or Guests will only have access to the Stand they have reserved and they must use the most direct and expeditious route when entering or exiting their assigned Stand. For the morning hunt, Owners must be at their Stand at least one hour before legal sunrise and remain in their stand until two hours after legal sunrise. For the afternoon hunt, Owners must be at their Stand two hours before legal sunset and remain in their Stand until after legal hunting hours. Wounded animals that travel outside an Owner s Stand proximity (200 yard radius) cannot be pursued until after legal hunting hours. Between the hours of 10:00 AM and 2:00 PM, Owners, DFM, and their Guests may enter the CWP. Such use must not interfere with other Owners or present safety hazards. Without reservations, Owners, DFM, and their Guests must exit the CWP by 2:00 PM. IX. CWP Access outside of Whitetail Hunting Seasons The dates of Whitetail Seasons are set by TP&W, and reflected in Harvest Regulations (Exhibit A). For use of the CWP outside Whitetail Season, the CWP shall be reserved by Zones as the effective Unit. These Zones must be clearly marked on the CWP map. Owners, DFM, and their Guests must enter designated Zones in the CWP through the approved reservation process. These Zones shall be divided into areas that are functional for hunting and recreational activities, including but not limited to; hiking, atv riding, horseback riding, fishing, etc. All rules regarding vehicle types and road use as described in XVII. Vehicles apply. All hunting done during this time must adhere to the all Safety regulations described herein. 8 Crossbow Ranch Rules & Regulations September 12, 2015

9 X. Blinds and Baiting Owners may use POA blinds or put up their own tripod, tree stand, or ground blind within the Unit they have chosen to hunt. Any owner s personal blind must be located within 200 yards of: the official gps coordinate of the Unit. The Hunter can only hunt facing towards his/her chosen Unit (this applies as long as two occupied Stands don t overlap). This is designed to prevent interference with other Hunters in other locations. If an Owner erects a personal blind, it must be located so as not to interfere with or present a hazard to other Owners in adjacent location, or Guests in the same location. Personal blinds may remain in the field, but the blind must be kept accessible for all Owners use. Such personal blind must have the Owner s name and lot number labeled on it. In addition, the blind information (GPS coordinate, stand type, and hunting unit) must be reported to the WC. Any unlabeled or unreported blind found on the CWP will be assumed to be donated to the POA, and may be removed from the CWP by any Owner. Such removal should be reported to the WC, and the blind should be left in the ranch barn. Only hand-broadcast feeding around a hunting site is allowed. No feeders or food piles, blocks, holes, etc. are allowed on the CWP, unless approved by the WC. [Violations will be considered CLASS C.] Feeding wildlife on private lots is strongly discouraged during the Whitetail Hunting Seasons, as it draws the wildlife away from the CWP. Hunters may not hunt whitetails closer than 100 yards to any protein feeder. The WC may set up Corn feeders set up to harvest Does and Cull bucks. Trophy and Management Bucks may not be taken within 100 yards of WC-approved corn feeders. [Violations will be considered CLASS C.] XI. Registration of Kills/Wounded Game Harvest data is crucial to implementing and executing a successful WMP. Both Crossbow harvest sheets and TP&W harvest information must be recorded. Blank Crossbow harvest data sheets may be found at the Cooler. In addition, TP&W requires harvest data to be recorded for any game animal harvested. For that purpose, a TP&W booklet will be left at the Cooler. 9 Crossbow Ranch Rules & Regulations September 12, 2015

10 Harvest data must be reported within seven days of harvest and recovery. [Violations will be considered CLASS F.] If a Hunter shoots, wounds, hits, kills, or harvests a whitetail or exotic, it must be reported to the WC by filling out the harvest sheets(s) and it will count toward the Hunting Owner s quota. If any trace of blood, hair, meat, fat, or any other body part from the animal is found on the ground and/or on the arrow/bolt, or by the Hunter s self- expression (admission), the WC will conclude that the animal was wounded or hit. XII. Camping on CWP Outside of the Whitetail Hunting Season, overnight camping may be scheduled on the CWP. XIII. Vehicles All-terrain vehicles ( ATVs ) with large flotation-type tires and USFS-approved spark arresters are allowed on roads and established existing primary and secondary trails on the CWP. Heavier vehicles such as automobiles, jeeps, trucks, etc. (collectively HVs ) should only be used only on existing ranch roads. ATVs or HVs may be used to transport an Owner to and from his/her Unit before and after posted access times - and to retrieve the harvest. Owners must park vehicles on common access roads (leaving right-of-ways), just off ranch trails, or on flagged parking sites within their hunting location to avoid interference with other owners and minimize damage to the CWP. All vehicles on the CWP should display a POA-approved Crossbow Ranch sticker to signify its authorization to be on the Preserve. Any vehicle found on the CWP without such sticker will be reported to the authorities as a possible trespasser. 11 XIV. Landowner Conduct & Rule Enforcement Any complaints regarding any Owner, DFM, or Guest or POA contractor s actions perceived to be in violation of these R&Rs should be reported directly to the WCC for violation action pursuant to Section XVIII. Penalty Assessment. The responsibility for enforcing the R&Rs lies with the WC / BOD only. Any Owner that attempts to unilaterally enforce the R&Rs disturbs the enjoyment & fragile peace of the POA, and this will not be tolerated. [Violations will be considered CLASS E.] XV. Non-Hunter Rights Non-Hunting Owners may access the Preserve and reserve Units for recreational purposes, in the same manner as Hunters do for hunting. A Non-Hunting Owner may hunt as a Guest of any Hunting Owner. XVI. Shooting Range The gun/rifle/pistol and skeet ranges will be open from 10:00 AM - 2:00 PM during the regular and extended Whitetail Seasons, and open from dawn till dusk after Whitetail Season unless an adjacent stand is already scheduled for hunting. Owners & DFM may reserve the Shooting Range through the approved reservation process. Additional rules for range use may be approved by the WC. Such rules will be prominently displayed at the range. XVII. Trapping Hunting Owners may set live / non-lethal traps on the Preserve. Each trap should have the Hunter s name and lot number labeled on it. In addition, the location (GPS coordinate, stand type, and hunting unit) must be reported to the WC. 12 XVIII. Penalty Assessment Any illegal activities will be promptly reported to the appropriate federal, state, or local authorities. Taking is defined as wounding or killing an animal, whether located and harvested or not. The taking of any animal, trophy or otherwise, in violation of the R&Rs will open the Hunter up to penalties. Penalty Buck and Penalty Doe are defined as any buck (or doe, if applicable) taken in violation of the R&Rs. If a Hunting Owner questions the age of a potential Penalty Buck or Penalty Doe, age will be determined by the TP&W or Crossbow-contracted wildlife biologist, with all costs for such aging to be paid by the Hunter, or the complainant, depending on the results. (Ex, If someone challenges the age, and is found to be incorrect, that person pays for the fees. If the Hunter is found to have harvested a penalty buck, he pays the fees). That fee is due upon receipt of the results, past due after 7 days from notification. Violations of the R&Rs shall be determined by vote of the WC in accordance with Article V, Section 1, of the Bylaws. Exhibit D sets the Penalties for violations of the R&Rs. The penalty structure has been approved for objective enforcement of violations of the Crossbow Ranch Rules & Regulations. In addition to the fines and penalties specified, the Association may also pursue other legal remedies, including the filing of civil or criminal complaints. 12 Crossbow Ranch Rules & Regulations September 12, 2015

13 EXHIBIT A Harvest Regulations Season The Regular Whitetail Season will run from Oct 3, 2015 through Jan 3, If harvest quotas are not achieved, the season may be extended by vote of the WC. Extended Whitetail Season is for Late Antlerless/Spike from Jan 4 through Jan 17, Firearms have been approved for the Extended Whitetail Season. Each Hunting Owner is entitled to two bucks in total* (Cull Buck or Management Buck), plus unlimited Doe, per hunting lot owned. Trophy Buck are Restricted this season. A Cull Buck is a (i) buck at least 2½ years old with at least one un-branched (no points** off the main beam) antler, or (ii) buck at least 3½ years old with six or fewer points or no brow tines. A Management Buck is a buck at least 4½ years old with eight or fewer points (provided the buck cannot otherwise be defined as a Cull Buck). A Trophy Buck is a buck at least 5½ years old with no point or width restrictions (provided the buck cannot otherwise be defined as a Cull or Management Buck). *Individual buck harvest must follow TP&W county restrictions in **The definition of a point is referenced in the TP&W Outdoor Annual. Once the harvest quota for each whitetail category is reached, a notice will be sent to all Hunting Owners and further harvesting of that category will be Restricted. Whitetail Class... Cull Management Trophy Does 2015 Harvest Quota... Unlimited Unlimited Restricted Unlimited It is important that each Hunter age the deer correctly before harvesting the animal. If you are not sure of the age, or question whether or not the animal meets harvest requirements, DO NOT SHOOT! If payment is not made or postmarked within 7 days, a $50 late fee per month will be imposed until all fees are collected. 16 Exhibit D Penalty Fee Schedule Actual Replacement Cost ( ARC ) will be calculated as the median of three written quotes for a comparable-quality animal, solicited by the WC Chairman from local breeders. Comparable quality will be determined by each breeder. For whitetail deer, breeders must be licensed by TP&W. Price will include delivery to the Crossbow Ranch. MAJOR VIOLATIONS Major violations will result in the assessment of a penalty, and forfeiture of the harvested animal (including meat). Keep in mind that one harvest may constitute two or more violations (such as harvesting a tagged animal using restricted means). Class A TAGGED WHITETAIL. Violation of the R&Rs caused by the taking of a tagged whitetail deer. The penalty will be: a fine of $1,000 plus ARC. Class B RESTRICTED ANIMAL. Violation of the R&Rs caused by the taking of an animal that is Restricted. The penalty will be: a fine of $500 for a male (whitetail or exotic) or $250 for a female (whitetail or exotic), plus ARC. Class C RESTRICTED MEANS & METHODS. Violation of the R&Rs due to the fact that the animal was taken in a restricted manner. These are specifically labeled in the R&Rs. The penalty will be: a fine of $500 per violation, plus ARC. Class D INCORRECT AGE. Violation of the R&Rs caused by taking of an animal younger than the required by R&Rs. The penalty will be: $250 base, plus $250 per year of age less than the required age. [For instance, if the required age of a trophy whitetail buck is 5.5 years old, and the taken trophy whitetail buck is 3.5 years old, the owner would be assessed a financial penalty of $750 ($250 base + $250 x 2), in addition to forfeiture of the taken animal.] Animal forfeiture is only in effect if animal is over one year younger than required by the R&Rs. MINOR VIOLATIONS Minor violations will be reinforced first by a written warning from the WC Chairman to the owner; this warning does not require a WC vote. If the problem is not resolved in seven days, or is repeated, the following penalties will be used by the WC. 16 Crossbow Ranch Rules & Regulations September 12, 2015

17 Class E LANDOWNER CONDUCT & RULE ENFORCEMENT. The penalty will be a fine of $250. Class F FAILURE TO REPORT. Failure to report the taking of wildlife, as pursuant to the R&Rs, will result in a fine of $100 per occurrence. Class G NON-CONFORMING The penalty for Non-Conforming Violations not specified herein shall be a minimum fine of $50.00 per violation, based upon the severity of the offense. The WC will address these issues on a case-by-case basis. REPEAT MAJOR VIOLATORS. All Hunters make innocent mistakes, but one must learn from those mistakes to prevent them from being repeated. Repeat violators will be dealt with more severely. For Major Violations, an additional fine of $500 will be added to the penalty if the Owner, his DFM, or Guest has previously been assessed a penalty for the offenses we now consider MAJOR VIOLATIONS within the past three calendar years from date of violation.
