Dear Ms. Perry: Telephone: Fax: Swoods@martin.fl.us This responds to your request for a Traffic Control Agreement for The Preserve at Hammock Creek Homeowners Association, Inc. Enclosed is a printout from the Florida Department of State, Division of Corporations, for The Preserve at Hammock Creek Homeowners Association, Inc. Please review same and confirm that it contains the correct information for the property owners association. Also enclosed are a draft traffic control agreement, a copy of the Traffic Control Device Standards and an Engineer s Certification form. The Preserve at Hammock Creek Homeowners Association, Inc. is required to submit a certification of compliance with these Standards prior to the execution of the Agreement for Traffic Control on Private Roads, and the certification must be signed and sealed by a professional engineer licensed in the State of Florida. Please note that if signage is added or changed, an updated certification must be obtained in order for tickets issued by the Sheriff s Office to be upheld in court. When we receive the certification indicating that all FDOT standards have been met, we will then forward an agreement for traffic control for your review and signature. 2 over private roads located within the unincorporated area by written agreement approved by the Board of County Commissioners. Such an agreement grants the county traffic control jurisdiction over the private roads pursuant to Section (3), Florida Statutes. Traffic Control Agreements are made between the County and the private property owner. The agreements allow the County, through the Sheriff s Office, to enter onto private property for the purpose of enforcing the State of Florida Uniform Traffic Laws. Because the agreement calls for service on private roads, the law provides that the agreement should not result in added expense to the taxpayers and that the County may be reimbursed by the Association for any expenses incurred in providing this additional service. Due to the nature of this relationship, it is advisable that the private property owners have the requisite amount of insurance to cover the County for acts that are not wanton or willful. This office does not advise the Board of County Commissioners to enter into agreements with private property owners where the liability for tort rests entirely with the County. After the Agreement has been fully executed by The Preserve at Hammock Creek Homeowners Association, Inc. and provided to our office, together with the certification of compliance with the Traffic Control Device Standards, legal description and Certificate of Liability Insurance, we will place the agreement on the Board of County Commissioners agenda for its consideration and approval. Signage and Pavement Markings: I certify that the traffic control devices have been installed in accordance with the latest Manual of Uniform Traffic Control Devices, the Florida Department of Transportation s Design Standards, and Martin County s Standard details for Road & Site Construction and Public Facilities.
