1 PROTEST NO. 1 Event: RS:X - Men Race: 2 Protestor: POL Protestee: NED RRS 10 Observer Cezariusz PiorczyK POL and NED were on starboard both beating to windward on leg one. NED was 10 to 15 meters ahead of POL NED completed a tack to port. POL and NED were then on a collision course NED was almost stationary and POL was planing POL tried to luff but hit NED midships which resulted in a crack in the bow of POL NED did a 360 penalty. POL finished race 2 and raced in race 3 NED did not keep clear as required by rule 10 and exconerated herself in accordance with B.44.1 NED acknowledged breaking rule 10 and took a penalty turn which was appropriate as there was no serious damage When it was obvious that NED was not keeping clear, it was not possible for POL to avoid contact RRS,10,14, B44.1 Protest is Dismissed NED took a 360 penalty Protest dismissed Sally BURNETT, Stephen WRIGLEY, Rut SUBNIRAN, Miguel ALLEN, Klaus LAHME PROTEST NO. 2 Event: Laser Radial - Women Race: 2 Protestor: USA Protestee: CHN RRS 10 1.CHN and USA were close-hauled on starboard tack about 3 boat lengths from the windward mark. CHN's track was ahead and to leeward of USA's track 2. CHN tacked to port onto a collision course with USA. USA immediately bore away and passed astern of CHN. 3 USA hailed "Protest" immediately, and again 5 seconds later, and again 4 seconds later as CHN passed the mark. 3.CHN heard the second hail of protest when she was on starboard tack approaching the mark. She rounded the mark and began her two-turns penalty, 10 seconds after she first heard the hail of protest. 4. There were no boats to windward of CHN as she approached the mark on starboard tack. 1. CHN on port failed to keep clear of USA on starboard and broke RRS CHN did not get well clear of other boats as soon after the incident as possible, Therefore, her penalty turns did not exonerate her for her breach of RRS 10. Lynne BEAL, Rodrigo GUERRA ALGORTA, Alfredo RICCI, Peter SHRUBB PROTEST NO. 3 Event: Laser Radial - Women Race: 1 Protestor: ARU Protestee: CRO RRS 11 Eduardo Porto observer ARU and CRO on leg 2 were sailing downwind on starboard with ARU clear ahead. CRO became overlapped with ARU 5 boat lengths to windward CRO and ARU converged as CRO sailed by the lee ARU and CRO maintained their courses ARU hailed CRO when the boats were less than one boat length apart As CRO luffed and sheeted in, CRO's boom hit the shoulder of the ARU competitor. There was no injury and no boat took a 2 turns penalty. CRO the windward boat failed to keep clear of ARU the leeward boat as required by rule 11. Therefore she did not take the appropriate penalty for her breach of RRS 10. The International Jury is not satisfied that it has made a significant error in the decision of Protest 2. 3 Race: 3 Protestor: CRO Protestee: DEN RRS 11 HEARD WITH CASE 8. At the start of Race 3 CRO and DEN were sailing closehauled on starboard tack with DEN overlapped to windward of CRO and CRO advanced by 1 metre. The distance between the boats was 30cm and both boats were heeled to leeward, when CRO flattened the boat there was immediate contact between the back of the sailor of CRO and the port side of DEN. There was no damage or injury. No boat took a two turns penalty. As windward boat DEN did not keep clear of CRO and broke rule 11. It was not reasonably possible for CRO to avoid contact and so she did not break rule 14. DEN did not avoid contact with CRO and broke rule 14. RRS 11, 14 DEN is scored DSQ in Race 3. DEN DSQ Race 3 Andrus POKSI, Chun QU, Doug ELDER, Christina ORTENDAHL, Alan BASER PROTEST NO. 6 Event: Laser Radial - Women Race: 3 Protestor: FIN Protestee: BRA RRS 12 About 7 minutes to the Start of Race 3, FIN was on starboard tack, stationary on the water, on a close hauled course and with the sail flapping. BRA was clear astern. BRA collided with the stern of FIN. The contact caused that the rudder fitting of FIN broke. FIN was not able to start Race 3. BRA failed to keep clear from FIN as a clear astern boat. As the boats were not racing, BRA is not penalized. FIN was unable to race due to physical damage through no fault of her own caused by a boat that was breaking a rule of part 2. RRS 12, 14, 62.1(b) Protest dismissed. Redress given to FIN. FIN is to be scored in race 3 points equal to the average, rounded to the nearest tenth of a point (0.05 to be rounded upward), of her points in all races sailed before the last scheduled day of her opening series (including the reserve day before the medal race day, if racing is later scheduled on that day), except race 3. POL completed a tack onto port tack and is on a collision course with EST. POL continued sailing on Port tack on a collision course with EST. EST bore away and passed to POL stern. If EST had not bore away it would have hit POL 1 metre from the stern. POL on port failed to keep clear of EST on starboard as required by RRS 10. RRS 10 POL is DSQ in race 4. At the start of race 5, USA and BRA were sailing on starboard tack with BRA 1.5 board lengtths to windward of USA and both pumping. After approximately 12 seconds there was contact between the boards that caused both boards to capsize. There was no damage or injury to either board or athlete. It took USA between seconds to recover from the capsize and continue racing. BRA took a 360 turn penalty. BRA failed to keep clear as a windward board and to avoid contact and broke RRS 11 and 14. 4

5 BRA took an appropriate penalty. USA's score was made significantly worse by capsizing because of the action of BRA breaking a rule of Part 2. Between the middle and the end of the first beat, the wind decreased to 4/5 knots and shifted to the left (about 30 degrees). On the 1st downwind, the boards were able to lay the gate on one tack (on starboard). At the gate, after 18 minutes of racing, the Race Committee made a change of course to the left (to a direction of 160) and reduced the lenght (0.45NM to 0.35NM). Right after, the wind started to turn right again. At the last downwind leg, the wind went back to 190 and increased to 9/10 knots. The first board took 32 minutes to finish the race. The published Race Managment Policy 12.1 states that "On the first half of the first leg, the Race Managment team may abandon in the event of a major, persistent, wind shift (more then 25 degrees). After that, the Race Managment team will let the race continue if it is able to adjust to the changed conditions.". The published Race Managment Policy 12.3 "Collapse of wind: The Race Managment team may 5

6 abandon the race when it is unlikely that the leading boat will complete the course within the overall time limit, even if a new wind were to arrive." The Race Committee followed the published Race Managment Policy. There was no improper action or omission of the Race Committee. RRS 62.1 (a) Redress not given. GBR was almost stationary at the mark. LTU established an inside overlap with GBR and the boards collided. Both boards tacked and rounded the mark. The mast of LTU collided with the boom of GBR. GBR capzised GBR was on position 8 before the capzised and on position 14 after uprighting. GBR finished the race 14th. LTU took a 360 penalty turn. NZL was not aware that she was UFD, and the Race Committee did not display flag X and her national letters with a sound signal in the vicinty of any mark during the race. During the race NZL was penalized for a breach of RRS 42 under RRS P. As she did not complete a two-turns penalty, she was scored DSQ without a hearing. NZL continued to race and to finish. 7

8 The race committee made no error when they did not display flag X and NZL with a sound signal at a mark after NZL breached the U flag rule at the start. When NZL continued to race, the jury properly penalized her when she broke rule 42, and properly disqualified her when she did not take a two-turns penalty. GER was sailing on a starboard layline, RUS was just under the layline. 3. RUS tacked to port at a distance of two boat lenghts from the mark. 4. GER bore away at a distance of approximately 1 meter from RUS when aiming at her aft quarter. RUS failed to keep clear of GER as a port tack boat. BRA was sailing the first upwind leg in race 4. The windward and offset marks on the Finn course were dark orange. The gate marks for the Laser course were red and were positioned approximately 250 metres to windward and 250 metres to the right laterally from the Finn windward mark. BRA sailed toward the Laser marks and overstood the windward mark by approximately 200 metres before realizing he was sailing to the Laser mark. AUT bore away at a distance of approximately half a boat lenght from NZL when aiming at the position of NZL's helm and passed approximately 1,5 meter astern of NZL. 3. No boat took penalty turns. 10 PROTEST NO. 21 Event: RS:X - Men Race: 6 Protestor: Jury (reopening Case 12) Protestee: GBR Review the decision of case 12 Procedural Matters: After deciding case 12, the jury reviewed the tracking and the mark roundings of race 6 and decided that it might have made an error when deciding what redress was given to GBR. Based on this, decision is made to reopen. When GBR approached mark 1 and the incident occurred, he was in 8th position. After rounding mark 1, the wind shifted and for the rest of the race, the boards sailed directly to the subsequent marks without crossing each other in different tacks or gybes. The positions of GBR and the other boards in the fleet did not substantially changed after rounding mark 1, as reflected in the mark rounding sheets and tracking. The redress to be granted, which is as fair an arrangement as possible for all boards affected, is to award GBR finishing points equal to her position at the time of the incident. ITA tacked to starboard and there was a collision course. When ITA had finished the tack there were 3 boat lengths between ITA and the courseline of GRE. ITA bore off and passed 1,5 m astern of GRE. If ITA did not bear away there would have been contact between ITA bow sprit and midway between the shrouds and the aft cross beam of GRE. GRE on port failed to keep clear of ITA on starboard as required by rule RRS 10 GRE is DSQ in race 2. GRE is DSQ in race 2. 11

12 Alan BASER, Christina ORTENDAHL, Stephen WRIGLEY, Chun QU, Juan Manuel DUARTE PROTEST NO. 26 Event: Laser - Men Race: 6 Protestor: AUS Protestee: SWE RRS 10 AUS and SWE on starboard tack were approaching the windward mark for the second time in race 6. AUS was laying the mark, with SWE slightly below layline and slightly ahead. SWE tacked on to port and was then on a collision course with AUS. SWE tacked to keep clear and AUS luffed in order to avoid contact. AUS tacked on to port and was then on a collision with ARG who was approaching on starboard. SWE also tacked on to port and was to windward of AUS. AUS tacked on to starboard to avoid ARG. SWE tried to bear away to avoid AUS, but hit AUS approximately one metre from her stern and caused AUS to capsize. SWE tacked on to starboard and hit the windward mark as she rounded it. SWE takes a one-turn penalty and a two-turns penalty In the first incident SWE on port failed to keep clear of AUS on starboard, as required by rule 10. In the second incident, AUS broke rule 15 but was compelled to break that rule as a consequence of SWE breaking rule 10 in the first incident. SWE broke rule 10 in the second incident but was compelled to break this rule as a consequence of AUS breaking rule 15. SWE broke rule 31. SWE took her penalties in accordance with rule 44. AUS luffed on a right shift to a collision course with AUT and approximately 6 seconds later she bore away and passed astern of AUT. AUS gave room to AUT to keep clear as a right of way boat changing course. AUT kept clear of AUS as a port tack boat. RRS 10, 16 No rule is broken. Protest dismissed. Protest dismissed. 12

13 Andrus POKSI, Zofia TRUCHANOWICZ, Rodrigo GUERRA ALGORTA, Francisco JAUREGUI, Iskra YOVKOVA PROTEST NO. 28 Event: Nacra 17 - Mixed Race: 2 Protestor: ITA Protestee: ESP RRS 13, 18.3 ITA on starboard tack and ESP on port tack sailing towards the windward mark. ITA was above the starboard layline and ESP was on the port layline. ESP luffed and passed head to wind half a boat length from the mark. The boats were on a collision course. Before ESP reached a close hauled course ITA luffed when the boats were half a boat length apart. ITA did not luff above close hauled. After passing head to wind and before being on a close hauled course, ESP failed to keep clear of ITA, as required by rule 13. RRS 13 ESP DSQ in race 2. ESP DSQ in race 2. One boat lenght from the mark, HUN tacked to port to a collision course with CHI. 3. CHI bore away and 5 seconds later there was a contact between CHI's bow that got entangled with HUN's mainsheet causing CHI to luff and capsize. 5. There was no damage nor injury. HUN failed to keep clear of CHI as a port tack boat and to avoid contact. 15 Alan BASER, Christina ORTENDAHL, Stephen WRIGLEY, Chun QU, Juan Manuel DUARTE PROTEST NO. 33 Event: Nacra 17 - Mixed Race: 1 Protestor: Jury Protestee: Reopening (Case 27) Procedural matters: Jury reopened a hearing as it may have made a significant error by not establishing enough facts supporting the conclusion and decision in Case After the starting signal, AUS on starboard and AUT on port were sailing upwind on converging courses. 2. When AUT began to cross AUS at 5 boat lenghts in front of her, AUS luffed for 2-3 seconds on a right shift to a collision course with AUT. 3. Three seconds later AUS bore away and passed astern of AUT. 4. It takes at least 3 seconds for a Nacra to tack in the conditions that existed at the moment of the incident. It was not possible for AUT to keep clear of AUS by tacking. AUT kept clear of AUS as a port tack boat by holding her course and speed when AUS luffed. AUS gave room to AUT to keep clear as a right of way boat changing course. At about 15 seconds before the start, CRO was on starboard tack on the leeward of most of the fleet on the lay-line to the pin end boat. Three boats, USA, AUS and NZL were approaching the pin end boat on port tack. At that moment the pin end boat was bias about 10 degrees. AUS and NZL passed astern of CRO. CRO course was between 6 and 8 meters above the bow of pin end boat. USA approached on port tack the line to start close to the pin end boat. USA and CRO were on collision course with CRO on starboard tack. At a distance of a meter CRO, aiming at the aft quarter of USA, bore away hard and passed half meter astern of USA. FIN rounded the mark and gybed on to port to windward and less than 1m from ARG. There was contact between FIN tiller extension and ARG helm. FIN as a windward boat did not keep clear of ARG and broke rules 11 and 14.
