Staff Recommended Motion: Approve Resolution No Background: In accordance with the Code of Ordinances of the City of West Palm Beach, Florida, 2003, Sections 90-4 and 90-5, the City imposes liens on private real property for delinquent payments due for utility services. The liens to be assessed by Resolution No are for unpaid water service, sewer service, and stormwater service charges for the month of February The list of properties to be assessed and the associated charges are attached to Resolution No as Exhibit A - Utility Lien List - February If not paid, these liens may be foreclosed by the City. Box 3366 West Palm Beach, FL Will Call Box 186 RESOLUTION NO A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WEST PALM BEACH, FLORIDA, APPROVING AND AUTHORIZING AN ASSESSMENT OF CITY LIENS FOR UNPAID WATER SERVICE, SEWER SERVICE, AND STORMWATER SERVICE; PROVIDING THAT SAID LIENS SHALL BE PRIOR IN DIGNITY TO ALL OTHER LIENS AGAINST THE ASSESSED PROPERTIES, SAVE AND EXCEPT A LIEN FOR TAXES; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. * * * * * * * * * WHEREAS, the City of West Palm Beach, Florida, maintains public records pertaining to the payment of water service charges, sewer service charges, and stormwater utility management assessments by the consumers of said services; and WHEREAS, according to said public records, certain real properties located within the City of West Palm Beach, Florida were provided with said services, and the consumers of said services have failed to pay for said services; and WHEREAS, pursuant to Sections 90-4 and 90-5 of the Code of Ordinances of the City of West Palm Beach, Florida, 2003, as amended, the City has caused notices of delinquency and non-payment of the water service, sewer service, and stormwater management service charges due the City of West Palm Beach for providing such services to be mailed to delinquent consumers at the account name and address of the consumer, and to the owner of the respective properties according to the County s ad valorem tax rolls; and WHEREAS, said notices specified the delinquent billings, individual and total, including the utility tax, and notified the consumers and/or owners that the delinquency must be paid within thirty (30) days from the date of the notice; and

4 RESOLUTION NO WHEREAS, certain consumers and/or owners failed to either pay said delinquent amounts or file an appeal of same with the City Commission to contest the validity of the amounts of the bills within thirty (30) days; and WHEREAS, it is recommended that, in accordance with the Code of Ordinances of the City of West Palm Beach, that the unpaid water service, sewer service, and stormwater management service charges be assessed against the respective properties and such liens shall be recorded against the respective properties by recordation in the Public Records of Palm Beach County; NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE CITY COMMISSION OF THE CITY OF WEST PALM BEACH, FLORIDA, that: SECTION 1: SECTION 2: SECTION 3: SECTION 4: The water service, sewer service and stormwater charges due to the City for the month of February 2016, along with an administrative fee, are hereby levied pursuant to Section 90-5 of the Code of Ordinances of the City of West Palm Beach, Florida, 2003, as amended, by the City of West Palm Beach on the real property indicated on the attached Exhibit A consisting of seven (7) pages attached hereto and incorporated herein, for failure on the part of certain consumers and/or owners to pay. To each of the aforesaid lien amounts shall be added the cost to reimburse the City to record each lien in the Public Records of Palm Beach County, Florida. Said liens shall be filed in the Office of the City Clerk as a lien against the indicated real properties. The City Clerk shall cause said liens to be recorded in the Public Records of Palm Beach County, Florida, by recording this Resolution in said records, and such liens shall be prior in dignity to all other liens against the said properties, save and except a lien for taxes. Said assessments shall bear interest from the date of adoption of this Resolution at the legal rate of 4.75% per annum until fully paid.

5 RESOLUTION NO SECTION 5: SECTION 6: Said assessments, if not fully paid, may be foreclosed in the same manner in which mortgage liens are foreclosed. The City Clerk is further directed to notify, by first class mail, the record property owners, as their names appear herein, of the passage of this Resolution by mailing to each of them a copy of same. SECTION 7: This Resolution shall take effect immediately upon its passage.
