OFFICIAL CONTEST RULES UAB FOOTBALL PROMOTION 1. NO PURCHASE NECESSARY. PURCHASE WILL NOT INCREASE THE CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED. A person may only be chosen as a winner once during the UAB football season. Neither Jim Burke Automotive nor any of its agents are responsible for lost, damaged, or delayed entries. All materials submitted become the property of the sponsoring dealership and none will be returned. 2. This Promotion is sponsored by Jim Burke Automotive, Inc. located at 1301 5 th Ave N, Birmingham, AL 35203 (hereinafter referred to as Sponsor ). Fired Up Rewards App (For game on 8/30/2018) 3. Contestants must download the Fired Up Rewards app prior to the football game on 8/30/2018. Contestants must then register for the competition using the app within two hours before the game start time. 4. Participants in the skills challenge will be randomly selected from the registrants of the app. Chance of selection varies based on the number of registrants. The winner of the chance to participate in the skills challenge will be notified at the end of the first quarter by text, phone call, and/or instadium announcement. At that time, the first and second alternates will also be notified. All three potential contestants must proceed to the location announced within 12 minutes of the time of the notice. If the first chosen contestant does not appear at that time, or otherwise does not qualify under these Official Contest Rules, the first alternate will be selected, then the second alternate if the first alternate does not qualify or does not appear. 5. The chosen contestant will participate in the Pass, Punt & Kick challenge described below. Ticket Giveaway (For all games on or after 9/15/2018) 6. This Promotion offers entrants a chance to win two (2) tickets to a UAB home football game (face value of $35 per ticket), and further to participate in a contest for the chance to win monetary prizes or a vehicle. By participating in this Promotion, each entrant unconditionally agrees to abide by these Official Contest Rules and the decisions of Sponsor, which shall be final and binding in all matters relating to this Promotion. Contestants must enter by filling out the applicable form on Jim Burke s website (www.jimburke.com/uabblazersfootball-cargiveaway). Limit one entry per person per day. 7. The contest will begin on Sunday of each game week at 12:01 AM, and will end on Tuesday of each game week at 11:59 PM. Contestants may only enter to win tickets for the home game during that specific game week. The winner from all entrants will be randomly selected on Wednesday of each game week. The winner will receive a call, text, or email notifying them that they have been chosen. The chosen contestant will then have three hours from the time of that notice to respond. If they do not respond within three hours, another contestant will be randomly chosen. If the chosen contestant Page 1 of 5
does not already have tickets to the next UAB football game, Jim Burke Automotive will provide them two tickets. The chosen contestant must verify that they meet the criteria to participate based on the terms and conditions outlined in these rules and the attached CONTESTANT AGREEMENT TO PARTICIPATE. The chosen contestant must also consent to, and execute the attached CONTESTANT AGREEMENT TO PARTICIPATE and these Official Contest Rules in order to receive tickets and participate in the next level of the Promotion (the skills challenge). The contestant who qualifies must go to Jim Burke Automotive to pick up their tickets and sign any documentation needed, no later than Friday of game week at 5:00 PM. Any contestant failing to appear and sign the necessary documents by that time will be disqualified. Skills Challenge 8. The second phase of the Promotion, the skills contest, will include either Pass, Punt & Kick, or Target Throw. The rules for each specific game are outlined below. The contest for the specific game will be announced at the time of the skills challenge. 9. The contestant will meet with UAB staff prior to the start of the game on game day to prepare for the contest at halftime. The contestant s name will be announced during halftime to come down to the field and participate in the skills challenge to win either cash or a car. At the games on 9/15/2018, 9/29/2018, 11/3/2018, and 11/10/2018, the contestant can win $10,000 if they complete the challenge successfully. At the other two games (8/30/2018 and 10/20/2018), the contestant can win $25,000 or a vehicle (MSRP approximately $25,000) from a predetermined selection of Jim Burke Automotive vehicles, chosen by the winning contestant. Winner must hold a valid driver s license and provide proof of insurance to take delivery of a vehicle. Prizes are not transferable or exchangeable for any other prize. If a winner on 8/30/2018 or 10/20/2018 does not qualify to take delivery of a vehicle, the winner may only select the cash prize. IF A WINNER SELECTS A VEHICLE, WINNER MUST PAY ALL APPLICABLE TAXES, TITLE, TAG AND LICENSE FEES, PLUS $688 RETAIL DELIVERY FEE PRIOR TO TAKING DELIVERY. 10. Odds of winning depend upon the number of eligible entries received by Sponsor prior to each drawing. 11. All winners are responsible for any expenses associated with the prize selected, including, but not limited to: $688 retail delivery fee (in the case of a vehicle prize), taxes, registration, title, license fees, insurance, extended warranties and all other costs incurred in claiming, registering or using the vehicle. Winner is also responsible for all costs associated with any optional accessories ordered by the winner. A winner of a vehicle must take delivery and must take possession of the vehicle no later than thirty (30) days after receiving notice that the vehicle is ready to be claimed. Failure of the winner to take possession within such time will result in disqualification. The winner must provide evidence of insurance and a valid driver s license prior to taking delivery of the vehicle. All taxes, upgrades and any other expenses not specifically identified in these Official Rules as included in a prize are the responsibility of each winner. Sponsor reserves the right to substitute the vehicles, in whole or in part, of equal or greater monetary value if such vehicle cannot be awarded, in whole or in part, as described for any reason. 12. A winner of a vehicle may not substitute, exchange, or apply the vehicle s value to a higher cost or alternate vehicle. A selected vehicle must be one of Sponsor s designated vehicles that is currently in stock of inventory. Sponsor reserves the right to make available an alternate vehicle of equal or greater value, if the selected vehicle is not available at the time it is won for any reason. If the designated vehicle MSRP is under the stated value at the time the prize is won, the winner will not be awarded the difference between the vehicle s actual MSRP and stated value. The winner of any prize is responsible for paying any and all sales tax at time of delivery, estimated cost and fees may vary depending on the state and county in which the prize is awarded. All other costs and expenses related to prize acceptance and use not specified herein as being provided are the sole responsibility of the winner. Each winner will receive an IRS Form 1099 for the retail value of the prize from Sponsor. 13. This Promotion is open to legal residents of Alabama who are 19 years of age or older with a valid Alabama driver s license. This promotion is void where prohibited by law and is subject to federal, state and local regulation. The decisions of the Sponsor regarding this contest are final. The following classes of people are INELIGIBLE to participate in this Promotion: a. Current or former professional or semi-professional football players and coaches who have played or coached at that level anywhere in the world at any time. b. Current or former collegiate, junior collegiate, high school, or Olympic football players and coaches who have played or coached at that level anywhere in the world in the five years preceding the person s selection to participate in the challenge. c. Any person actively participating in the sporting event/tournament associated with this promotion. d. Current or former employees, family members, agents, successors, or assignees of Sponsor or any promotional agency involved with this promotion. Target Throw Rules 15. In order to win the Target Throw skills challenge, the contestant must successfully throw a regulation High School, NCAA, NFL, or Arena football, FROM A DISTANCE OF TWENTY (20) YARDS, ON THE FLY, THROUGH A TARGET OPENING MEASURING A MAXIMUM OF FIFTEEN (15) INCHES IN DIAMETER AND PLACED A MINIMUM OF THIRTY-SIX (36) INCHES IN HEIGHT ABOVE THE PLAYING SURFACE. No part of the contestant s body or clothing may come in contact with the demarcation lines/spots prior to throwing the ball. Any such contact shall constitute a foul and the throw shall be considered a miss. Each contestant is permitted only one attempt. Pass, Punt & Kick Rules 16. In order to win the Pass, Punt & Kick skills challenge, the contestant must complete the following: Page 3 of 5
a. Start from behind the end line (back line of end zone) and PASS the football towards the opposite end zone, then; b. Start from behind the exact spot where the previous pass first hit the ground or crossed the sideline out of bounds and PUNT the football towards the same end zone, then; c. With the ball placed at the exact spot where the previous punt first hit the ground or crossed a sideline out of bounds, successfully KICK a field goal through the regulation goal posts at the opposite end of the field from where the sequence started. 17. Each contestant is permitted only one attempt using a regulation High School, NCAA, NFL, or Arena football. No form of kicking tee or other artificial means of elevating the ball may be used during the KICK portion. A holder must keep the ball upright and one end of the ball must be touching the ground. Contestants will not be permitted to use any form of football or soccer kicking shoe. 18. Contestants must start the kick no more than four (4) yards away from the ball. The approach must be restricted to a normal two (2) step Field Goal Kick approach prior to kicking the ball. No part of the contestant s body or clothing may come in contact with the demarcation lines/spots prior to kicking the ball. Any such contact shall constitute a foul and the prize attempt shall be considered missed. Other Rules 19. Contestants in the skills challenge shall not be permitted any practice, warm-up, or qualifying throws, at any time after his/her participation in the promotion until the actual prize throw(s). 20. By participating in the skills challenge, each contestant acknowledges and consents to the entire activity being videotaped. 21. Acceptance of any prize offered (including tickets) constitutes permission to use winner's name, biographical information and/or likeness for purposes of advertising and promotion (including social media postings) without further compensation, including without limitation such use by Sponsor and OddsOn Promotions. 22. By accepting the tickets and in consideration of same, as well as the opportunity to win additional prizes through the skills challenge, the winners release Sponsor, its advertising and promotional agencies and each of the Sponsor s officers, directors, agents and employees, from any and all liability however caused with respect to this contest, the prize or any claims, demands, actions or causes of action of any kind whatsoever for injuries, damage, or losses to persons or property which may be sustained in connection with receipt, ownership, or use of any prize or while preparing for, participating in, and/or traveling to or from any contest related activity and winners also acknowledge that said parties have neither made, nor in any manner are responsible or liable for, any warranty, representation, promise or guaranty, express or implied, relative to any prize or otherwise. Prizes are offered as is with no written, express, or implied warranty from Sponsor, including but not limited to, quality, condition, merchantability, or fitness for a particular purpose. any and all warranties, express or implied, regarding any other aspect of this Promotion or any skills challenge. 23. By participating, entrant agrees to be bound by these Official Contest Rules and the decisions of Sponsor, which shall be final in all respects. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this contest, as determined solely by Sponsor. The decisions of Sponsor, the interpretation of these Official Contest Rules and all other aspects of this contest shall be binding and final in all respects. Sponsor will not be responsible for typographical, printing website or other inadvertent errors in these Official Contest Rules or typographical errors or in other materials related to this Promotion. 24. In the event that any potential winner (a) fails to satisfy any eligibility or verification requirement herein, (b) declines to accept the prize, or (c) is otherwise determined to be ineligible, Sponsor may, in its discretion, disqualify that individual. In the event a potential winner is disqualified or otherwise fails to appear prior to the skills challenge, an alternate winner may be chosen through the Fired Up Rewards app using the procedure outlined above. Alternate contestants are subject to all eligibility requirements and restrictions of these Official Contest Rules.
