The Alabama Legislature passed into law Act 95-287 which changed the law with regard to eligibility of persons wanting to purchase a commercial gill net license in 1995 and subsequent years. In order to qualify to purchase a license, the applicant must show that he/she: a) purchased a license in two of five years during the years 1989 to 1993 and provide proof in the form of original, unamended income tax returns that at least 50% of his/her income was derived from the capture and sale of seafood species (commercial fishing) or b) that he/she purchased a license in each of the years 1989 to 1993 and paid his/her applicable Alabama income taxes in each of the years 1989 to 1993. The Alabama Legislature passed into law Act 2008-467 which changed the law with regard to the eligibility of persons wanting to purchase recreational and/or commercial gill net licenses. During the 2009 license year, only individuals holding a gill net license on June 1, 2008 could renew their license. These licenses must be renewed annually or else the license will be permanently forfeited. Commercial licensees must also continue to meet the license qualifications established by Act 95-287. In addition, commercial gill net licenses are no longer available to non-resident fishermen. 4
