Vera, Capital Improvement Project Manager December 18, 2012 Ordinance: An Ordinance providing for the City of South Miami approving the donation of land requested by the State of Florida Department of Transportation for transportation related purposes for road improvements to include a new bike lane by the conveying approximately 2,496 Square Feet more or less of swale area along SW 57 Avenue in South Miami, Florida. Background: FOOT is proposing a miling and resurfacing project along SR 959/SW 57 Avenue (Red Road from SR5/US1 (S. Dixie Highway to SR 976/SW40 St (Bird Road in Miami-Dade County. The project is 1.82 miles long. As part of the milling and resurfacing, additional pavement area is being added to provide a 5 foot shoulder along the corridor. These shoulders will also be striped to serve as a bicycle pathway along both sides of the road. During the due diligence process, FOOT noticed that the City of South Miami has ownership of a portion of the swale on SW 57 Avenue and SW 68 Street of approximately 2,496 square feet in size. In order to have clear tile for the entire roadway and be able to commence the project, FOOT is requesting that the City of South Miami donate that portion of the swale. 1 ORDINANCE NO. 2 3 An Ordinance providing City of South Miami approval for the donation of 4 land requested by the State of Florida Department of Transportation for 5 transportation related purposes and for road improvements to include a 6 new bike lane by the conveying approximately 2,496 Square Feet more or 7 less of swale area along SW 57 Avenue in South Miami, Florida. 8 WHEREAS, the State of Florida Department of Transportation proposes to construct or 9 improve State Road No. 959, Item No. 4284841, in Miami-Dade County, Florida; and 10 11 WHEREAS, it is necessary that certain lands now owned by the City of South Miami, 12 Florida, be acquired by the State of Florida Department of Transportation; and l3 14 WHEREAS, said property is not needed for City purposes; and 15 16 WHEREAS, the State of Florida Department of Transportation has made application to 17 said City to execute. and deliver to the State of Florida Department of Transportation a deed, or 18 deeds, in favor of the State of Florida Department of Transportation, conveying all rights, title 19 and interest that said City has in and to said lands required for transportation purposes and said 20 request having been duly considered; and 21 22 WHEREAS, the City Commission of the City of South Miami wishes to convey title to 23 said lands to the Department of Transportation. 24 25 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION 26 OF THE CITY OF SOUTH MIAMI, FLORIDA: 27 28 Section 1. The application of the State of Florida Department of Transportation for a 29 deed, or deeds, is for transportation purposes which are in the public or community interest and 30 for public welfare and the land needed for transportation purposes is not needed for City 31 purposes 32 33 Section 2. The City Manager is hereby instructed to execute a deed of the City of 34 South Miami, Florida conveying title to the Florida Department of Transportation. 35 36 Section 3. Severability. If any section, clause, sentence, or phrase of this ordinance is 37 for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding 38 shall not affect the validity of the remaining portions of this ordinance. 39 40 Section 4. Ordinances in Conflict. All ordinances or parts of ordinances and all 41 sections and parts of sections of ordinances in direct conflict herewith are hereby repealed. 42 However, it is not the intent of this section to repeal entire ordinances, or parts of ordinances, 43 that give the appearance of being in conflict when the two ordinances can be harmonized or 44 when only a portion of the ordinance in conflict needs to be repealed to harmonize the 45 ordinances. If the ordinance in conflict can be harmonized by amending its terms, it is hereby 46 amended to harmonize the two ordinances. Therefore, only that portion that needs to be 47 repealed to harmonize the two ordinances shall be repealed. 48 49 Page 1 of2

South Miami Green Tasli Force Meeting Deccmbcr 7,2011 SR 959 (S.W. 57 th Avenue) From US-1 to Bird Road Florida Department of Transportation Financial Project ID: 428484-1-52-01 Project DeSCliptioll FDOT is proposing a milling and resurfacing project along SR 959/SW 57 Avenue/Red Road from SR 5/US 1/S Dixie Highway to SR 976/SW 40 StrcetlBird Road in Miami-Dade County. The project is 1.82 miles in length. The adjacent land use is mostly residential with some commercial use at the intersection with SR 976/SW 40 StreetIBird and mixed commercial, residential and institutional use from SW 60 Street south to US 1. The posted speed limit along the project segment varies from 35 to 40 MPH. The typical section along the project limits consists of two undivided lanes, left turn lanes at almost all signalized intersections, and sidewalk on both sides of the roadway. SW 57 A venue has one northbound and one southbound travel lane from SW 40 Street to SW 64 Street. South of SW 64 Street, SW 57 Avenue has two northbound travel lanes, and from SW 66 Street to US 1, there are two southbound trave1 lanes. Other existing features include a school zone from SW 46 Terrace to sollth of SW 42 Terrace and a bus bay on the west side of the roadway north of SW 64 Street. SR 959 was designated as a state historic roadway on June 28, 1989 as stated in Senate Bill No. 124. This Bill has been recently modified to allow improvements related to the safety of vehicular and pedestrian use within the FDOT right of way. The scope of work for this segment consists of the following: Pavement resurfacing and rehabilitation (milling and resurfacing). Signing and pavement marking improvements. o Restriping travel lanes to 11 feet and adding approximately 2.5 feet of additional pavement to provide 5' paved shoulder along the corridor. These shoulders will also be striped to serve as a bicycle facility along both sides of the road. o Upgrading all pedestrian ramps to be compliant with FDOT and Americans with Disabilities Act (ADA) requirements. Replacing existing span-wire traffic signals with mast-arm installations at the intersection with SW 56 Street. Extending the westbound left-turn lane on US I for vehicles turning SOLlth onto SW 57 Avenue. Relocating three palm trees from the median on US 1 east of the intersection with SW 57 Avenue in order to extend the westbound left-turn lane. Removing two parking spaces on the west side of SW 57 Avenue just south of the intersection of SW 40 Street to improve sight-distance for turning vehicles from S.W. 41 Street.
