ELIGIBILITY: The MBNA Blue Jays Getaway contest (the Contest ) is open only to residents of Canada, excluding the Province of Quebec, who are of legal age of majority in the province/territory in which they reside at the time of entry. Employees, officers and directors of The Toronto-Dominion Bank (of which MBNA is a division) ( Sponsor ), Rogers Blue Jays Baseball Partnership (the Blue Jays ), the other MLB Entities and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the Contest, and the household members of any of the foregoing (whether or not related) are not eligible to participate or win a prize. The MLB Entities shall mean the Office of the Commissioner of Baseball (the BOC ), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ( MLBAM or MLB.com ), Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., the Major League Baseball Clubs (the Clubs ), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities. The Contest is subject to all applicable federal, provincial and municipal laws, rules and regulations. Sponsor and the Blue Jays shall have the right at any time to require proof of identity and/or eligibility to enter the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. Sponsor and the Blue Jays reserve the right, in their sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
2. HOW TO ENTER: The Contest entry period (the Entry Period ) begins at 11:00 a.m. Eastern Time ( ET ) on April 14, 2014 and ends at 5:00 p.m. ET May 26, 2014 (the Contest Closing Date ). Limit of one (1) entry per person/e-mail address, regardless of the method of entry. By way of illustration, if two (2) or more otherwise eligible persons share a single e-mail address, only one (1) of them may enter the Contest. If one (1) person has two (2) or more e-mail accounts, that person may enter the Contest only once and only the first entry received from such person will be considered. There are two (2) ways to enter: online or by mail. No other method of entry will be accepted. a. Online Method: During the Entry Period go to www.bluejays.com and click on the Contest banners, buttons and/or links to access the online entry form for the Contest (the Online Entry Form ). The Online Entry Form (including all required information) must be fully completed and submitted during the Entry Period to be eligible. Incomplete entries will be deemed void. By successfully transmitting a completed Online Entry Form as directed, you will be entered in the Contest. MLBAM s computer shall be the official clock of the Contest with respect to entries submitted online. Free access to the Internet is available at most public libraries. b. Mail-in Method: If you do not wish to enter online, you may enter the Contest by hand-printing your full name, address, city, province, postal code, age, day & evening telephone numbers and email address (optional) on a postcard and mailing it in an envelope with proper postage affixed to: Manpreet Pandha (Attention: MBNA Blue Jays Getaway Contest), One Blue Jays Way, Suite 3200, Toronto, ON, M5V 1J1. Mail-in entries must be postmarked by May 26, 2014 and received at the above address by May 30, 2014. By entering this Contest, each entrant consents to the collection, use, and disclosure of his/her personal information for the purposes and in the manner described herein. All information submitted by entrants online is being collected by MLBAM and is subject to, and will be treated in a manner consistent with, MLB.com s Terms of Use accessible at: http://mlb.mlb.com/mlb/official_info/about_mlb_com/terms_of_use.jsp and Privacy Policy accessible at: www.mlb.com/privacy. Information submitted by entrants online will also be provided to (a) the Blue Jays, treated in accordance with the Blue Jays Privacy Policy, available at www.bluejays.com/privacy, and (b) Sponsor, treated in accordance with Sponsor s Privacy Policy available at www.mbna.ca/privacy, subject in each case to the entrants stated preferences from time to time. Online entrants may be given the option to receive commercial e-mails and/or other communications from Sponsor, the Blue Jays and/or MLB.com; however, eligibility to participate in the Contest is not dependent upon the entrant s consent to receive such e-mails and communications and consenting to receive such e-mails and communications will not impact the entrant s chances of winning.
Information submitted by entrants through the mail-in method is being collected by the Blue Jays and Sponsor and will be available to both parties. All such information will be treated by Sponsor in accordance with Sponsor s Privacy Policy available at http://www.mbna.ca/privacy and by the Blue Jays in accordance with the Blue Jays Privacy Policy, available at www.bluejays.com/privacy. Sponsor s and the Blue Jays treatment of information is subject to each entrant s stated preferences from time to time. 3. PRIZE: Grand Prize: One (1) eligible entrant will win one (1) prize (the Grand Prize ), consisting of: (a) Round trip economy air transportation for the winner and one (1) guest (collectively, the Travellers ) from the international airport within Canada closest to the winner s residence (as determined in the sole discretion of Sponsor) to New York City, New York, United States (departure on Friday, July 25, 2014 and return on Sunday, July 27, 2014; (b) One (1) hotel room (standard double occupancy) for two (2) nights in New York City, New York, United States in a hotel to be determined by Sponsor; (c) Return ground transportation (via a single vehicle) for the winner and one (1) guest from the New York airport to the New York hotel; (d) Two (2) admission tickets for the Travellers to see the Toronto Blue Jays Major League Baseball team (the Team ) play the New York Yankees at Yankee Stadium on Saturday, July 26, 2014 (the Grand Prize Game ). (e) Two (2) Team-branded replica jerseys; (f) Two (2) Team-branded baseball caps; (g) VIP experience at Yankee Stadium for the Travellers, including dining at Yankee Stadium and the opportunity to watch warm-ups on the field prior to the Grand Prize Game (the VIP Experience ); and (h) $500.00 US spending money for the winner. The estimated retail value of the Grand Prize is $7,000 CDN. 4. PRIZE CONDITIONS: Please note that the Grand Prize requires that travel take place between Friday, July 25, 2014 and Sunday, July 27, 2014. The Grand Prize must be accepted as awarded and may not be transferred, assigned, or redeemed for cash except at Sponsor s sole and absolute discretion. Sponsor reserves the right to substitute the Grand Prize (or portion thereof) with one of comparable or greater value at its sole and absolute discretion, for whatever the reason. The Grand Prize may not be exactly as advertised, and except as expressly
warranted herein, the Grand Prize is provided as is without further warranty of any kind. All Grand Prize details, including flight and ground transportation times, the Grand Prize Game seat locations and the exact nature and duration of the VIP Experience, will be determined in the sole discretion of Sponsor and/or the Blue Jays. Some restrictions may apply. Travel arrangements must be made through Sponsor s agent on a carrier of Sponsor s choice. Tickets are subject to certain terms and conditions as specified by issuers. The Travellers must travel together on the same itinerary and are responsible for ensuring they have all necessary travel documents (e.g. valid passport) and the Blue Jays, Sponsor and MLB Entities are not responsible in the event any Traveller is refused boarding at any time by the airline or airport security and any unused portion of the Grand Prize will be forfeited. Each Traveller must be of legal age of majority in his/her jurisdiction of residence, unless accompanied by a parent or guardian. The winner is fully responsible for any and all applicable federal, provincial, and municipal taxes (including income and withholding taxes). Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the BOC and/or the Blue Jays, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as part of the Grand Prize will govern in the event a legal game, event or exhibition, as defined by Major League Baseball, is not played due to weather conditions, an act of God, an act of terrorism, civil disturbance or any other reason. The winner and his/her guest agree to comply with all applicable stadium regulations in connection with the Grand Prize. The applicable MLB Entities reserve the right to remove or to deny entry to any winner and/or guest who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. The Released Parties (defined below) will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppages or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition. Major League Baseball game, event and exhibition tickets awarded as part of a Grand Prize may not be resold or offered for resale. Any such resale may result in disqualification and prize forfeiture, and may invalidate the license granted by the game ticket(s). Any and all additional costs and expenses associated with prize acceptance and use not specified herein as being provided including but not limited to travel and health insurance, transportation costs (including to and from the airport and to and from the Grand Prize Game), checked baggage fees, excess baggage fees, meals, gratuities and other expenses incurred by the winner (and any guests) in claiming, accepting and/or using the Grand Prize are the sole responsibility of the winner. 5. RANDOM DRAW: At approximately 11:00 ET on May 28, 2014, in Toronto ON, a Blue Jays representative will select by random draw one (1) potential winner from all
eligible entries received. The potential winner selected in accordance with the above will be contacted by telephone at the telephone number indicated on the selected entrant's Contest entry. If a potential winner cannot be reached within one (1) day of the first notification attempt, incorrectly answers the skill testing question (described in more detail below), as determined by the Blue Jays in its sole discretion, or declines the Grand Prize for any reason, he/she will be disqualified, the Grand Prize will be forfeited and, at Sponsor s discretion and time permitting, an alternate potential winner may be selected at random from among remaining eligible entries. Odds of winning depend on the number of eligible entries received. 6. DECLARING A WINNER: To be declared a winner and claim the Grand Prize, each potential winner must (i) be eligible according to these Official Rules, (ii) correctly answer, without assistance of any kind, whether mechanical or otherwise, a time limited mathematical skill testing question which will be administered by telephone at a mutually agreeable time, and (iii) sign a duly completed Liability and, except where prohibited by law, Publicity Release form and return same to Sponsor (or if directed, the Blue Jays) by the date specified on the form. The Liability and Publicity Release Form requires a potential winner to confirm acceptance of the Grand Prize as awarded, eligibility to participate in this Contest and compliance with these Official Rules and to release Sponsor, the Blue Jays, the other MLB Entities, and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, divisions, dealers, retailers, printers and advertising and promotional agencies, any and all other companies associated with this Contest (including Grand Prize suppliers and suppliers of materials or services related to this Contest), and all of their respective employees, directors, officers, shareholders, agents, representatives, successors and assigns (collectively, the Released Parties ) from any liability and damages which could arise out of or in any way related to the Contest and from the awarding, receipt, possession, use and/or misuse of the Grand Prize (or any portion thereof) or any travel or activity that is related to the receipt or use of the Grand Prize. If all required documents are not properly executed and returned within the specified period of time, or the potential winner otherwise fails to comply with these Official Rules, a disqualification will result and the Grand Prize will be forfeited and, at Sponsor s sole discretion and time permitting, an alternate potential winner may be randomly selected from among all remaining eligible entries. Refusal or return of such documents as non-deliverable or potential winner s noncompliance with these Official Rules will also result in disqualification and, at Sponsor s sole discretion and time permitting, may cause an alternate potential winner to be chosen from among all remaining eligible entries. All Travelers must sign a duly completed Liability and, except where prohibited by law, Publicity Release form and return same to Sponsor (or, if directed, the Blue Jays) by the date specified. 7. WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Contest and submitting an entry, each entrant agrees (i) to be bound by these Official Rules,
including all entry requirements, (ii) that the decisions of Sponsor and the Blue Jays are final and without appeal, and (iii) to waive any and all claims against the Released Parties and Facebook, Inc. ( Facebook ) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Contest or from the receipt, possession, use and/or misuse of the Grand Prize (or any portion thereof) or any travel or activity that is related to the receipt or use of the Grand Prize. By acceptance of the Grand Prize, the winner authorizes Sponsor, the Blue Jays, MLBAM and each of their respective designees to use in any related publicity, such winner s name, photograph, image, any statements they may make regarding the Grand Prize, city and province of residence, likeness and/or voice for advertising and promotional purposes worldwide in perpetuity and in any form of media now or hereafter devised worldwide (including the Internet), without limitation and without additional compensation or consideration, notification or permission, unless prohibited by law. 8. GENERAL CONTEST TERMS AND CONDITIONS: The Released Parties are not responsible for stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, postage-due or garbled entries, transmissions, email or mail; or for lost, interrupted or unavailable network, cable, satellite, server, Internet Service Provider ( ISP ), website, or other connections including those through and/or by any website, availability or accessibility or miscommunications or failed computer, satellite, telephone, cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; failures or malfunctions of phones, phone lines or telephone systems, any error, omission, interruption, defect or delay in transmission, processing, or communication; non-delivery; misdirected, blocked, or delayed e-mail notifications; printing, typographical or other errors appearing within these Official Rules, in any Contest-related advertisements or other materials; or any other errors, problems or difficulties of any kind whether human, mechanical, electronic, network, computer, telephone, mail, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the Grand Prize or in any Contest-related materials, or the cancellation or postponement of any Major League Baseball game, event or exhibition. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Contest or website or attempt to undermine the legitimate operation of the Contest by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsor s representatives or who are in violation of these Official Rules,
as solely determined by Sponsor and/or the Blue Jays, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Contest is unlawful and subject to legal action by Sponsor, the Blue Jays, MLBAM and/or their respective agents. Sponsor and Blue Jays shall have the sole right to disqualify any contestant for violation of these Official Rules or any applicable laws relating to the Contest, and to resolve all disputes in their sole discretion. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any prize, and (ii) disclaim any implied warranty. The failure of Sponsor, the Blue Jays or MLBAM to enforce any term of these Official Rules shall not constitute a waiver of that provision. All disputes will be resolved in the Province of Ontario under applicable Ontario and Federal laws. Sponsor, the Blue Jays and MLBAM reserve the right, in their sole discretion, to cancel, suspend or otherwise modify the Contest (or any portion thereof) for any reason, including, but not limited to incidents where a virus, bugs, unauthorized human intervention, or other causes corrupt the administration, security, fairness, integrity or proper operation of the Contest (or any portion thereof). In the event of cancellation, Sponsor may elect to identify winners and award the Grand Prize by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation.
