Terms and Conditions for BOC Family Rebate Card and Trunki 1. The first 500 customers who submit their applications for BOC Family Rebate Card by 31 December 2013 (the Promotion Period ) and charge a minimum of S$200 within one (1) month from the date of card approval will receive a free Union Jack Trunki (known as Trunki ). 2. BOC Family Rebate Card applications submitted via BOC Branches, BOC website and SMS channels before 31 December 2013 must be approved by 15 January 2014 to be eligible for this Promotion. 3. This Promotion is applicable to new BOC Family Rebate Cardmembers who do not have any BOC Credit Card at the point of approval of their BOC Family Rebate Card applications. 4. This Promotion is applicable to Principal Cardmembers of BOC Family Rebate Card only. Supplementary Cardmembers are not eligible for this Promotion. 5. Each Principal Cardmember is limited to one (1) Trunki. A redemption letter will be sent to eligible Cardmember s billing address (as per BOC s records) within two (2) months after BOC determines at its absolute discretion that the criteria under this Promotion have been met. 6. Eligible Cardmembers have to present the original redemption letter, their BOC Family Rebate Card, NRIC/Passport at Bloom & Grow (Singapore) to collect their Trunki. Any Trunki that is not collected within one (1) month from the date of the redemption letter will be forfeited. 7. The Trunki must be collected by the Cardmember in person or by an authorized representative. The authorised representative must present his/her NRIC or passport, the redemption letter, together with the written authorization, during collection of the Trunki. 8. The redemption letter is strictly non-replaceable if lost, misplaced or damaged. 9. Only transactions (including internet purchases) made with the newly approved BOC Family Rebate Card will be counted towards meeting the spending criteria. Fund transfers, reversals, reversal instalments, tax payments, annual fees, bank charges and unposted, cancelled, disputed and refunded transactions will not qualify and are expressly excluded from the spending criteria. 10. Only accounts that are maintained in good standing and conducted in a proper and satisfactory manner as determined by BOC in its sole discretion at the time of fulfilment will be eligible for the Trunki. 11. Customers who cancelled their BOC Family Rebate Card within the last six (6) months are
not eligible for the Promotion when they re-apply for BOC Family Rebate Card during the Promotion Period. 12. This promotion is not valid with any other promotions and cannot be combined or repeated with any existing promotions. 13. BOC will charge the value of the Trunki redeemed should the BOC Family Rebate Card be cancelled within two (2) years from the card approval date. 14. The Trunki is non-transferable, non-exchangeable & non-replaceable for credit, cash, rewards points or kinds in all case, whether in full or in part. 15. BOC is not a supplier of the products provided by the participating merchant involved in this Promotion and will not accept any liability in relation thereto. BOC shall not be liable in any way to any customer or any other person for any loss or damage or expenses arising in connection with this Promotion howsoever arising, including without limitation, from any late or non-notification. 16. BOC reserves the right to substitute or replace the Trunki with another gift of similar value without prior notice. BOC makes no representation or warranty whatsoever in respect of the Trunki, whether as to the quality or merchantability or fitness for purpose or performance or otherwise whatsoever. 17. BOC is not an agent of the merchant of the products and services comprising the Trunki. Any disputes should be resolved directly with the merchant. Redemption and use of the Trunki are also subject to the terms and conditions of the merchant. 18. BOC reserves the right in its absolute discretion to vary the terms and conditions of this Promotion or change or withdraw this Promotion at any time without giving any reason. In case of dispute, the BOC's decision is final and no correspondence will be entertained. 19. In the event of any inconsistency between these terms and conditions and any brochures, marketing or promotional materials relating to this Promotion, these terms and conditions shall prevail. 20. BOC Family Rebate Card Cash Rebate is only valid for BOC Family Rebate Credit Cardmembers ( Cardmember ) for transactions made with BOC Family Rebate Card. 21. Cardmembers will be awarded the following Cash Rebate for all their spend with BOC Family Rebate Card: (a) 1% on the total spend with the BOC Family Rebate Card if the Cardmember charges more than S$1,000 on his/her BOC Family Rebate Card; or (b) 0.5% on the total spend with the BOC Family Rebate Card if the Cardmember charges S$1,000 or less on his/her BOC Family Rebate Card
22. Cardmembers will be awarded additional 4% cash rebate on spend at any supermarkets, petrol stations and selected merchants in Singapore. To enjoy the additional 4% cash rebate on spend at any supermarkets, petrol stations and selected merchants in Singapore, Cardmember must charge a minimum of S$100 and maximum S$1,000 on spend at any supermarkets, petrol stations and selected merchants in Singapore to BOC Family Rebate Card in each billing cycle. The additional 4% Cash Rebate awarded on spend at any supermarkets and petrol stations is valid till 31 December 2013. The additional 4% Cash Rebate awarded on spend at selected merchants is only applicable to the spend at Guardian Health and Beauty, POPULAR Bookstore, Toys R Us and Watsons, and is valid till 31 December 2013. 23. Combined spend from the Main and Supplementary Cards is allowed. 24. Cash Rebate shall be calculated on the amount of each retail purchase transaction, rounded down to the nearest Dollar. 25. The combined spend is calculated based on posted local and foreign retail sales, posted 0% interest-free installment plan, posted recurring bill payment and excludes interest, annual fees, finance charges, cash advances, balance transfer, and all fees charged by BOC or any other third parties (if any). 26. Transactions made must be posted transactions before the end of each billing cycle. BOC accepts no liability for any late submission of the purchases by merchants. 27. The Cash Rebate will be credited into the Cardmember s BOC Family Rebate Card account ( Account ) on the following billing cycle after the end of the month. The Cardmembers spent on the BOC Family Rebate Card will be reflected on the Principal Cardmember s monthly statement. 28. The total Cash Rebate awarded will be limited to S$100 per Account for each billing cycle. 29. Cash Rebate may only be used to settle Card Transactions incurred on the Principal Card or the Supplementary Card (if any). Cash Rebate may not be converted to or exchanged for cash nor be transferred or paid to any person in any manner whatsoever nor be used to settle or pay any other liability of any person whatsoever nor be applied towards settlement of any Cardmember s liabilities. 30. All unused Cash Rebate will be forfeited on the earlier of: (a) the expiry of such Cash Rebates at the end of two (2) calendar years from the month of the Cash Rebate credited into the Account; or (b) BOC s receipt of the Principal Cardmember s request to terminate his Card; or (c) the termination of the Principal Card by BOC for any reason whatsoever.
31. The Account must be in good standing at the time of crediting of the Cash Rebate. In the event the Account is delinquent, terminated or suspended for any reason whatsoever before the Cash Rebate is credited into the said Account, BOC reserves the right to forfeit the Cash Rebate at its sole discretion. 32. BOC may vary the terms of or withdraw the Cash Rebate Promotion without any prior notice. 33. The terms and conditions set out above are supplement to, and to be read together with and form an integral part of, the BOC Cardmembers Agreement, as may be amended from time to time by the BOC in its sole and absolute discretion. Unless the context otherwise requires or the terms and conditions below expressly provide otherwise, all words and expressions defined in the BOC Cardmembers Agreement shall have the same meanings when used or referred to below. BOC s decision on all matters pertaining to the award or use of any or all of the benefits and privileges stated below shall be final and binding on the Cardmembers. The benefits and privileges described below may be amended, supplemented or revoked by BOC at any time in its sole and absolute discretion. 34. BOC is entitled in its absolute discretion, at any time and from time to time without notice, to vary the terms and conditions of Cash Rebate. 35. BOC may at any time vary, modify or amend these terms and conditions as it may, in its absolute discretion, think fit, and the Cardmembers shall be bound by such variations and amendments. 36. Any abuse or fraud in respect of the issuance of Cash Rebate, may result in the cancellation of Cash Rebate already credited into the Account. 37. Without prejudice to any of BOC's rights and remedies, BOC is entitled, at any time, in its absolute discretion and without notice, to terminate the Promotion or withdraw, cancel or invalidate any Cash Rebate already credited into the Account. 38. BOC is not liable if it is unable to perform its obligations under these terms and conditions, due directly or indirectly to the failure of any machine or communication system, industrial dispute, war, Acts of God, or anything outside the control of BOC or its servants or agents. BOC shall not be responsible for any delay in the transmission to BOC of evidence of retail purchases by the participating merchants or any other third party. 39. Save in the case of gross negligence or wilful misconduct, BOC shall not be liable for any errors, delays, omissions in the performance of its obligations under these terms and conditions. 40. BOC's records of all matters relating to the Promotion are conclusive and binding on the Cardmembers. BOC is entitled, for any reason and at any time, without liability, to suspend
the calculation or awarding of Cash Rebate, to rectify any errors in the calculation, or otherwise adjust such calculation. 41. BOC's decision on all matters relating to the Promotion is final and binding on the Cardmembers. 42. All information is correct at the time of publishing or posting online. 43. Should there be any inconsistency between the English and the Chinese version of these terms & conditions, the English version shall prevail.
