Second Reading and Consideration of Adoption HISTORICAL PERSPECTIVE: The City of Beaverton (City) operates a municipal water supply utility under ORS chapter 225 that distributes potable water to its respective water system users. The Tualatin Valley Water District (TVWD) is a domestic water supply district under ORS chapter 264 that distributes potable water to its respective water system users. Some TVWD water system users are situated within Beaverton's current city limits. ORS 222.520 authorizes cities to withdraw territory from domestic water supply districts. ORS 222.524 and an intergovernmental agreement (IGA) dated as of February 23, 2018, between the City and TVWD sets out terms and conditions regarding the manner in which the City may withdraw TVWD service areas, including areas situated within Beaverton's current city limits. As required by ORS 222.524 and through the adoption of Resolution No. 4493 on February 27, 2018, the City Council scheduled a public hearing for March 20, 2018, regarding the withdrawal of territory from TVWD. Notice of the hearing was published on March 1 and March 8, 2018, in the Beaverton Valley Times and on March 9 and March 16, 2018, in The Oregonian, both of which are newspapers of general circulation in the City. Notice of the hearing was also posted at the following five public places in Beaverton on two successive weeks prior to the March 20 hearing: (1) City Hall/The Beaverton Building, (2) Tualatin Valley Water District Offices, (3) Beaverton Main Library, (4) SW Griffith Drive Building, and (5) Fred Meyer store at Beaverton Town Square. At the scheduled public hearing, the Council heard any objections to and endorsements of the proposed withdrawal and determined the withdrawal is in the best interest of the City. INFORMATION FOR CONSIDERATION: The map of Known Withdrawal Areas shown in Exhibit A identifies five withdrawal areas that are situated within Beaverton's current city limits. Each of these areas is also within TVWD's current service area. The general vicinity and approximate number of water customer accounts in each of the five areas are: Area Location Accounts 2 East of S.W. Hocken Avenue and north of S.W. Millikan Way 36 3 East of S.W. 170th Avenue and south of S.W. Davis Road 975 4 East of N.W. 185th Avenue and south of U.S. 26 2,732 5 North of S.W. Shaw and east of S.W. 170th Avenue 4 6 West of S.W. Schells Ferry Road and south of S.W. Denney Road 360 A detailed map and legal description of each area is provided in Exhibits B through F. (Area 1, located in the vicinity of Cedar Hills Boulevard and SW Jenkins Road, is intentionally omitted from the current list of known withdrawal areas as the City has already withdrawn the area from TVWD's service territory.) The City ultimately intends to serve city water directly to all of the five identified withdrawal areas. In the meantime, for a period beginning as early as July 1, 2018, TVWD has agreed to assist the City in transitioning TVWD water system users to the City. The sequence of the transition is generally expected to be as follows: Interim Water Service - Interim water service will start July 1, 2018, once water system users in the affected withdrawal areas are no longer part of the TVWD service territory. Temporarily, these water system users will continue to receive water service and utility bills from TVWD. In this context, interim water service is essentially a short-term arrangement where water supplied by TVWD is distributed to Beaverton water system users through pipes and other facilities owned, operated and maintained by TVWD. During this period, water system users will continue to be billed at TVWD rates. Wheeling Service - Wheeling services will start once the City has customer accounts set up and is ready to bill water system users in the affected areas. In this context, wheeling service is essentially a longer-term arrangement where water supplied by Beaverton is distributed to Beaverton water system users through pipes and other facilities owned, operated and maintained by TVWD. During this period, water system users will be billed at City rates and Beaverton will pay TVWD directly for wheeling services. Separation of Water Service - Full separation of water services will start once Beaverton has installed needed infrastructure to serve a withdrawal area and no longer needs to rely on pipes or other facilities owned, operated or maintained by TVWD. In this context, the separation of water service is essentially an arrangement where water supplied by Beaverton is distributed to Beaverton water system users through pipes and other facilities owned, operated and maintained by the City. During this period, water system users will be billed at City rates. The actual transition from the TVWD water system to the City water system will occur on an areaby-area basis. Within each area, there may be portions of the area that transition from wheeling services to separation of water services at different times. Agenda Bill No. 1806 7

ORDINANCE NO. 4727 AN ORDINANCE WITHDRAWING TERRITORY FROM THE TUALATIN VALLEY WATER DISTRICT AND DECLARING AN EMERGENCY The City Council of the City of Beaverton finds that: A ORS 222.520 and ORS 222.524 specify that whenever a part less than the entire area of a water district becomes incorporated as or annexed to a city, the city may cause that part to be withdrawn from the district at any time after such incorporation or annexation and after notice and hearing on the question of whether withdrawal is in the city's best interest; and, B. The territory identified on attached Exhibit A as "Withdrawal Areas," and more particularly described in attached Exhibits B through F, is territory that in the past has been annexed to the City of Beaverton, but heretofore has remained within the service area and territory of the Tualatin Valley Water District; and, C. In accordance with ORS 197.175 and state-wide planning goals, the City of Beaverton has long assumed the responsibility to plan and zone the land uses in the territory identified on attached Exhibit A as "Withdrawal Areas," and the City has planned to provide all City urban services to that territory; and, D. As required by ORS 222.524, the City Council held a public hearing on March 20, 2018, to hear any objections to the proposed withdrawal of territory identified on attached Exhibit A as "Withdrawal Areas" from the Tualatin Valley Water District and to determine whether such withdrawal is in the best interest of the City; and, E. As further required by ORS 222.524, the City Council caused the appropriate notice of the date, time, place, and purpose of the March 20 public hearing to be published, posted, and delivered in advance of the hearing; and F. The withdrawal of the territory identified on attached Exhibit A as "Withdrawal Areas" from the Tualatin Valley Water District is consistent with City policies and is in the best interest of the City; now, therefore, THE CITY OF BEAVERTON ORDAINS AS FOLLOWS: Section 1. Upon due consideration of all matters in the public record, including those raised and considered at the March 20 public hearing held with regard to the proposed withdrawal, the City Council hereby determines that the withdrawal of the territory identified on attached Exhibit A as "Withdrawal Areas," each more particularly described in attached Exhibits B through F, from the service area of the Tualatin Valley Water District is consistent with adopted City policies and in the best interest of the City. Section 2. The territory identified on attached Exhibit A as "Withdrawal Areas," each more particularly described in attached Exhibits B through F, is hereby withdrawn from the Tualatin Valley Water District effective as of July 1, 2018. Section 3. The City Recorder shall notify the Oregon Department of Revenue and Washington County tax assessor of this withdrawal on or before March 31, 2018. The City Surveyor is authorized to finalize the exhibits to this ordinance to conform to any applicable filing or administrative requirements, provided no material change is made to a boundary's legal description or related map. Section 4. If any provision of this ordinance is for any reason declared or held to be invalid or unenforceable by any court or administrative agency, the remainder of this ordinance shall not be affected thereby but shall be deemed as a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof, and each remaining provision of the ordinance shall be valid and enforceable to the fullest extent permitted by law. Section 5. The Council finds that ORS 308.225 requires this ordinance be in final approved form and filed with the Oregon Department of Revenue by March 31, 2018, for the boundary change contemplated by the ordinance to take effect on July 1, 2018. Therefore, the Council hereby declares an emergency affecting the public welfare, and this ordinance shall take effect immediately upon its adoption by the Council and approval by the Mayor.
