A message from the Executive Director This past year has been an exciting one for APHA. With rising Paint Horse superstars and our growing community service efforts, I am excited to see what 2008 has in store. The year 2007 began with Got Country Grip, the world s fastest Paint Horse, holding an undefeated lifetime record. He ended the year the same and set new benchmarks for the racing industry along the way. But Got Country Grip wasn t the only Paint Horse that broke records this past year. SM Country Snowman, who has the same sire as Got Country Grip, became the first 2-year-old racehorse to earn $150,000. Also, top reining stallion Colonels Smokingun became the National Reining Horse Association s first Paint million-dollar sire. And, pleasure horse Zippos Sensation was the first Paint inducted into the National Snaffle Bit Association s Hall of Fame. He also was named the APHA Breeders Trust incentive s leading sire for an unprecedented seventh consecutive year. Several APHA programs also expanded their horizons this year, including the Breeders Trust, Gelding Plus and Paint Preferred incentives. Each grew by either offering larger cash payouts or encompassing new enthusiasts. The Breeders Trust incentive paid out a record $1,153,781.71 for 2007, more than $81,600 above last year. It was the fifth consecutive year that the program paid more than $1 million dollars. In addition to competition, our members also focused on several humanitarian initiatives last year, including the inaugural Saddle Up! For St. Jude trail ride, two Kids Days and several American Paint Horse Foundation projects. We are proud of the work our membership has put into these worthwhile programs and their Paint Horses this year. It is paying off in big ways. Another fact we are proud to point out is that the American Junior Paint Horse Association is the fastest-growing segment of our membership. Today, it is celebrating its second year of super growth with more than 7,000 members. Since our youth are the future of the association, we are very excited about this report. A message from the President While there has been significant growth throughout various aspects of the American Paint Horse Association in 2007, one area truly stands out our international growth. In November of last year, Executive Director Lex Smurthwaite and I had the pleasure of representing the association at the Equus Horse Show, hosted by the Mexican Paint Horse Club (MPHC), in the city of León, located in central Mexico. While there, we were able to visit with our Paint Horse enthusiasts to the south and bring a bit of APHA to them. It was amazing to me to see the number of people who were so excited to see representatives from APHA. We were treated with great respect and conducted a good deal of APHA business. They were very appreciative of having someone from APHA. APHA s presence at International Paint Horse events is very beneficial for several reasons. We are able to promote the breed and the association by answering questions from the exhibitors and distributing information. It also creates an opportunity to spread the word about APHA and recruit new members, while reaching out to our current members. Throughout 2007, we also had representatives at the European Paint Horse Championship Show in Aachen, Germany; the Danish Paint Horse Championships in Marienheem, The Netherlands; the Pinse Show in Vejle, Denmark, and the Haras Nationaux in Paris, France, just to name a few. In addition, APHA and the Brazilian Paint Horse Association are working on a racing program to debut this year. We hope to sustain our presence these countries, as well as reach out to more in 2008. In the meantime, APHA members in the United States and elsewhere should keep in mind the tremendous market available abroad. It is a great opportunity for growth. As Paint Horse enthusiasts and businessmen and women, we are always looking for ways to market our beautiful breed. And, with our International affiliates hosting more than 150 APHA-approved shows in 2007, the market is definitely available. Another record-breaking year for Paints in 2007 4 The American Paint Horse Association (APHA) saw some of its brightest stars shine brilliantly during 2007, and the past year also saw the creation of several exciting new initiatives for the association. Two well-known Paint stallions Colonels Smokingun and Zippos Sensation helped launch Paints onto a new level of excellence in open competition during 2007. Colonels Smokingun, owned by McQuay Stables of Tioga, Texas, was the first Paint stallion to become a National Reining Horse Association million-dollar sire, and Zippos Sensation, owned by Simons Show Horses of Aubrey, Texas, was the first Paint Horse to be inducted into the National Snaffle Bit Association s Hall of Fame. Zippos Sensation was also named leading Breeders Trust sire of 2007 for an unprecedented seventh consecutive year. The stallion s 113 enrolled get earned $93,670.61 during the year to secure the title for him. For the second time, Dunthat Benthere, owned by Amanda Ringer of Grand Island, Florida, topped the Breeders Trust leading money-earner list. These two Paints, in addition to the others enrolled in the program, helped 2007 to be the highestpaying year ever for the program, with more than $81,600 dollars paid above last year s previous record payout. Total, the Breeders Trust program paid $1,153,781.71 an estimated $14.57 per point earned. In other competition, Paint racehorse Got Country Grip also shattered previous standards of racing excellence. With a perfect track record of 15 wins in 15 lifetime starts, the 4- year-old solid bay gelding not only cemented his spot as a Paint legend in 2007, but he also secured his place in racing history when he topped the Quarter Horse record for number of lifetime wins. It s time to go for the big one, said owner Jimmy Maddux of Weatherford, Texas, after his horse s last race of the year, referring to the modern day Thoroughbred record of 16 straight victories held by Citation, Cigar and Hallowed Dreams. Maddux plans to pursue that goal during 2008. Another up-and-coming racehorse, SM Country Snowman, a loudly-marked red roan overo who has the same sire as Got Country Grip, also had a record-breaking year. At the conclusion of his initial racing season, SM Country Snowman had amassed $159,383, becoming the first Paint racehorse to earn $150,000 during its 2-year-old year. APHA also supported the sport of kings by starting a new tradition in 2007 Family Night at the Races. The inaugural event, held at Lonestar Park in Grand Prairie, Texas, offered the public a family-friendly, fun way to learn more about the breed and horse racing. Pre-existing APHA programs also expanded their horizons this past year. For example, the revamped Gelding Plus incentive which recognizes the efforts of aged Paint geldings in APHA competition went down under, making Australia the site of the program s first international cash payouts. The Paint Preferred program, which now recognizes Paints that excel in Open competition, offered larger payouts than ever before. At the National Reining Horse Association s Futurity, Colonels Smokingun s son Colonels Nite Special, who is owned by Bob and Mary Anne Van Degna of Bar Double C Ranch in Cave Creek, Arizona, actually took home $9,467 in APHA incentive money for his second-place finish in the show s Open division. In addition to competing, Paint Horse enthusiasts also got the opportunity to ride for a cause with the inaugural Saddle Up! for St. Jude Trail Ride in Benbrook, Texas. Ninetyeight riders turned out for the charitable ride and auction and raised more than $12,000 for St. Jude Childrens Research Hospital in Memphis, Tennessee. The money will be used to fund children s cancer research and treatment. Also benefiting research and other worthwhile causes was the American Paint Horse Foundation s inaugural Donate & Draw program, where one lucky entrant, Joyce Reim of Cobb, California, won a New Holland tractor. All money raised through the fund-raiser benefited the Foundation, which supports youth scholarships, promotes equine research and preserves the heritage of the American Paint Horse. APHA regional clubs joined in performing unique charitable work in 2007 as well. The Oklahoma Paint Horse Club took on the challenge of raising money for two causes in 2007 Harvest Farms Therapeutic Riding Center in Shawnee, Oklahoma, and St. Jude s. Club members hosted a pilot challenged rider class at a show that raised more than $7,800. Challenged rider classes provide opportunities to those with disabilities to participate in riding programs that display their talents on horseback. Additionally, one special American Junior Paint Horse Association member from West Jordan, Utah, put together his second benefit team roping for the Make-A-Wish Foundation, which grants wishes to children with lifethreatening illnesses. A cancer-survivor and Make-A-Wish recipient himself, 14-year-old Garrett Stewart made dreams come true for several children with the $6,000 he raised. And, APHA awarded renowned country music entertainer Charlie Daniels with its Legendary Achievement Award and a lifetime membership for his work the past 25 years with American Paint Horses. This year, Daniels also donated one of his Paint colts to a charity auction to support a family center dedicated to preventing child abuse through education and support services. In addition to record-breaking Paint athletes and spreading goodwill in new ways, APHA also continued the traditions of the past. The association continued its work to sponsor the largest Paint Horse show on earth with its annual World Championship Paint Horse Show. This premier APHA event, which spotlights some of the best horses in the world, included a total of 1,671 horses. More than 4,200 entries were logged for the summer show, which took place for 14 exciting days at the Will Rogers Memorial Center in Fort Worth, Texas. At the World Show, Floyd and Maryann Moore of 6-J Paint Horses in Huntsville, Texas, generously donated a filly for the fifth consecutive year to the American Junior Paint Horse Association s (AjPHA) fund-raiser. donations raised more than $17,000 to benefit Youth scholarships. APHA also celebrated its third year of Kids Days, at both World Show and headquarters, in Fort Worth, Texas. There, several hundred area children got the chance to participate in fun activities and ride a Paint Horse; many for the first time. In all, APHA approved more than 1,200 shows around the world in 2007. APHA also hosted a judging seminar at its headquarters in Fort Worth, Texas, as well as an intercollegiate judging contest in 2007. Nineteen new APHA-approved judges joined APHA s roster during the year. The association experienced success with the continued growth of the AjPHA. With membersip totaling 7,200, this was the second straight year since its inception in 1974 that the Youth program has reported numbers higher than 7,000. While we are preserving and building on our traditions, we are definitely excited about the American Paint Horse Association s future, said APHA Executive Director Lex Smurthwaite. With tremendous athletes like Got Country Grip and SM Country Snowman and outstanding sires like Colonels Smokingun and Zippos Sensation breaking records in 2007, we are excited to see what next year will hold. We re also eager to continue to grow our new humanitarian outreach initiatives, which are leading the way in charitable fund-raising and educational opportunities, said Smurthwaite. Distinguished Service Award 6 Colorado woman earns highest honor from the American Paint Horse Association During her 30-year association with APHA, Jean Fell has bred and owned some legendary Paint Horses, like Sky Roper. The versatile 1974 palomino tobiano gelding, by Skippa Rope and out of Sky Mist, earned two open national championships in Western riding and several open and Youth reserve placings in hunter hack, jumping and Western riding. Jean Fell of Franktown, Colorado, a long-time American Paint Horse Association Director, received the 2007 Distinguished Service Award, the association s highest member honor. This award is presented to a special APHA member who has helped the association make significant strides through the years. Fell was recognized in 2007 for her more than 30 years of exemplary service to APHA. The wife of the late APHA President, Dale Fell, Jean Fell has served on the APHA s Board of Directors for 28 years. She has also been influential in the development of the Rocky Mountain Paint Horse Association s Youth Development Foundation Scholarship Program and was a founding member of the Zone 3 Zone-O-Rama, which has grown to become one of APHA s largest regional shows. Fell s tireless work ethic also led her to a place on the Colorado Horse Development Board, to which she was appointed by the Colorado Department of Agriculture commissioner. Fell is listed as the breeder of 55 Paint Horses, many of which earned race and show records in their lifetimes. One of her most well-known foals was Sky Roper, a 1974 palomino tobiano gelding, sired by Skippa Rope and out of Sky Mist. He went on to earn 1,519 lifetime points and two open and one Youth national championship titles in Western riding. He also earned multiple reserve open and Youth national titles in hunter hack, jumping and Western riding. Other notable foals Fell produced include stakes winner Go Way and Reserve Novice-Amateur Working Hunter World Champion Sacred Times. Currently, Fell serves as a board member on the American Paint Horse Foundation, which strives to support youth endowments and scholarships, promote equine research, preserve the heritage of the American Paint Horse and. She also holds both national and local offices within APHA, including the Chair of the Rules Standing Committee, which plays a role in the legislation of the organization. Incentive programs Breeders Trust has another record-breaking year For the fifth consecutive year, APHA s Breeders Trust program paid out more than $1 million for Paint Horses with performance records. With a record-breaking $1,153,781.71, the incentive program for Paint Horse owners, exhibitors, racers and breeders in 2007 boasted a increased payout of more than $81,600 above the figure for 2006. BreedersTrust funds are based on a point system, with each point being worth a specific amount of money.the 2007 value was $14.57 per point. Yearly dividends are paid to subscribed stallion owners, foal nominators and recorded owners of horses enrolled in the program. Dunthat Benthere In the Breeders Trust program, the stallion subscriber receives 20 percent of the dividend, the foal nominator 10 percent and the foal s recorded owner on Dec. 31 of the showing year receives 70 percent. The Number One horse by money earned for 2007 is Dunthat Benthere, a 1996 red dun overo gelding by Tommys Reflection out of Impressive Ash Bar AQHA. Owned by Amanda Ringer of Grand Island, Fla., this Zippos Sensation is the second year the gelding has earned the title. The repeat winner earned the distinction by collecting 1,929 points throughout 2007, and ended the year with $28,110.09 in incentive money. For an unprecedented seventh year, the stallion that sired the most money-earning Breeders Trust foals was Zippos Sensation, a 1993 sorrel overo stallion owned by Simons Show Horses, LLC of Aubrey, Texas. One hundred and thirteen of his get earned $93,670.61 in 2007. Between the two programs, over $42,000 was awarded to talented Paint Horses at affiliate shows. Gelding Plus promotes aged Paint geldings 4 years old and older by paying out a potential $42,000 at select APHA-approved events. With automatic enrollment for every APHA gelding that was officially registered as a gelding prior to competition, $3,000 was Gelding Plus coordinator Jessica McGuirk presents Gelding Plus checks to (left to right) Suzanne Butterfield, Rylee Morgan and Ashley Jones at the Zone 2 Zone-O-Rama in South Jordan, Utah. up for grabs at each of the 14 approved APHA shows, 11 zone shows and three international shows. In 2007, 40 Paints received Gelding Plus payouts. APHA s Paint Preferred Program offered cash incentives to Paint Horses that competed in select National competitions. This included events such as the National Snaffle Bit Association World Championship Show in the Open 3-year-old Western Pleasure and Open 3-year-old Hunter Under Saddle classes and the National Reining Horse Association Futurity in the Open division. Thirty five of the world s best reiner s qualified for the National Reining Horse Association (NRHA) Open Futurity Finals, and six of those were registered Paint Horses, all competing for the coveted Open Futurity Champion title on December 1, 2007 in Oklahoma City. APHA put up an additional incentive for these horses through the Paint Preferred program. A very special horse and rider combo, Marcy Ver Meer and Colonels Nite Special (APHA)/ Gunners Special Nite (AQHA) scored high enough to win the Intermediate Open division and lead the Open division until the very last ride of the night, when she was edged out by Shawn Flarida by 1.5 points. Congratulations to rider Ver Meer of Cave Creek, Arizona, Colonels Nite Special, owned by Bar Double C Ranch, also of Cave Creek, and breeders Kim and Debra Sloan of Newfoundland, New Jersey. The owners received a check for $9,465 from APHA. Colonels Nite Special was sired by Colonels Smokingun, NRHA's newest Million Dollar Sire. Paint racing reaches new milestones Paint racing experienced a year full of shattered records, top performers and intense media coverage during 2007. The racing program saw 560 Paint horses start in 761 APHA-recognized races across 18 states, competing for $5.5 million dollars over the course of the year. Although racing experienced outstanding participation, names like Got Country Grip, SM Country Snowman and Texas Hero caught the attention of Paint racing fans everywhere. Got Country Grip possibly Paint racing s most famous athlete had another impressive year on the track. The 4-year-old Solid Paint- Bred finished the year undefeated in 15 lifetime races, to surpass the Quarter Horse world-record of 14 undefeated races. Got Country Grip is only two races shy of beating the Thoroughbred record, to become the winningiest racehorse. On his way to the top, Got Country Grip became the highest-earning Paint racer of all-time with $247,500. The gelding, owned by Jimmy Maddux of Weatherford, Texas, was named World Champion Solid Paint-Bred for the third consecutive year. He also earned the Champion Solid Paint-Bred Aged Horse and Champion Solid Paint-Bred Aged Gelding awards, of which he earned the equivalents his 2- and 3-year-old years. Another Paint racing phenomenon, SM Country Snowman was named World Champion Regular Registry, Champion 2-Year-Old and Champion 2-Year-Old Colt. The red roan overo stallion finished the year off as the highest earning 2-year-old Paint racehorse of alltime. SM Country Snowman, owned by Rafter SM Ranch of Wagoner, Okla., accumulated $159,383 throughout the year. Only four other Paint racehorses have earned $150,000 throughout their entire careers. Also shattering old records was Texas Hero, who became Paint racing s first $3 million sire. Owned by Buddy and Ann Albin of Denton, Texas, the 17-year-old bay tobiano has sired 360 foals with 259 starters, earning a total of $3,055,109. These top Paint racehorses, along with others, helped Paint racing gain worldwide publicity. AjPHA continues to build tomorrow s leaders CANDICE LANCASTER 28 AjPHA leaders met in Louisville, Kentucky, in 2007 to discuss future activities. The American Junior Paint Horse Association (AjPHA) continues to grow strong, thanks to the efforts of members who have participated in leadership and community service initiatives throughout 2007. Throughout Laura Akerlund s 2006-2007 presidential term, Junior members from across the United States participated in several outreach activities, such as the Presidential Service Project. These activities clearly demonstrate j members compassion and caring attitude toward their community and fellow horse enthusiasts. Laura s Presidential Service Project, One Stride at a Time, encouraged regional clubs to become involved in fundraising for cancer research and cancer patients. AjPHA members sponsored cancer walks and trail rides, sold unique merchandise such as benefit pink ribbon tail socks, and organized special fundraising classes at APHA-approved horse shows. These efforts allowed the AjPHA to donate more than $10,000 to charitable organizations. The AjPHA regional club that exhibits the most dedication, effort and caring attitude toward the project is awarded the From the Heart Award, a $500 cash award sponsored by Markel Insurance. In 2007, the award was presented to the Arizona Junior Paint Horse Club and its members at the 2007 World Championship Paint Horse Show. Another great learning opportunity for Junior members in 2007 was the annual Youth Leadership Conference, held in Louisville, Kentucky, in conjunction with the APHA National Convention. AjPHA members travel from across the nation to attend this conference each year. Conference facilitator Doug Bratton had j members participate in activities that focused on leadership, teamwork, sportsmanship and a positive attitude. Conference attendees also were able to tour the famous Nashwan Stud Farm, the Kentucky Equine Sports Medicine and Rehabilitation Center, the Kentucky Horse Park, and the Keeneland Race Course. With more than 7,000 members, AjPHA promotes youth involvement with American Paint Horses worldwide. A message from the American Paint Horse Foundation Director It was an honor for me to have been chosen recently as the American Paint Horse Foundation s director a role that carries tremendous responsibility. I realize that the Foundation is actually the heart of the American Paint Horse Association, with strong ties to the caring, compassionate, honest and forthright people who have made our breed one of the largest and most highly respected in the world today. I recall my first week on the job at APHA in the summer of the year 2000. My first task was to interview our founder, Rebecca Lockhart, and to get at least two feature stories published about her one for the Paint Horse Journal and one forwestern Horseman magazine. It was a formidable challenge, but one that shaped my outlook about Paint Horses and the passionate people involved with them. I forged an immediate friendship with Rebecca, and to this day, she remains my mentor. From our founder and her words to me, I learned: When people tell you that something can t be done, or that it is impossible, strengthen your resolve and be determined to get it done. That s what I did. I love seeing the pleasure that horses give to children and adults. That s so important to what we do. Focus on the future, but don t forget the past. We have to keep promoting our Paints so people always know where we came from and how we started. If you make God a part of your dreams, then you should dream big. In my new role as director of this Foundation, Rebecca s advice is central to my way of thinking. I am thankful to Rebecca for her wisdom, to the APH Foundation Board for the chance to work alongside them and to the APHA Executive Committee for their support of the Foundation. Equally, I am indebted to my colleagues, APHA members, Paint owners and others in our equine community who have committed their resources to help us. If you are someone who knows deep inside that people s lives are improved when they interact in some way with American Paint Horses, then you are one of us. If you are proud of our Paint Horse heritage, then you are one of us. You are the Foundation upon which this breed stands. A message from the American Paint Horse Foundation President Now in our second official year as the American Paint Horse Foundation, we are proud to be building on the past accomplishments of our predecessors the American Paint Horse Heritage Foundation and the American Paint Horse Youth Development Foundation. From our experience with the Heritage Foundation, we discovered the importance of preserving the history of the American Paint Horse breed and honoring the people who helped advance it. There is no better testament to those people and those horses than our larger-than-lifesize Legacy of Color bronze sculpture, which adorns the entrance of APHA headquarters in Fort Worth, Texas. Our Foundation is honored to have been a part of the Legacy of Color bronze project. From our experience with the Youth Development Foundation, we discovered the importance of investing in the future of youth who have been involved with our association. Our Foundation is proud to have offered nearly $500,000 in scholarships to almost 500 youngsters since the program began 28 years ago. The future is bright for our Foundation, as we look forward to 2009 and beyond. We are now engaged in writing a strategic business plan and blazing an exciting trail for our future. In everything we do, our aim is to make our world a better place through interaction with the American Paint Horse breed and all individuals associated with our wonderful horses. Scholarship Endowment Funds Endowment funds may be established in the form of an honorarium or a memorial in any name. Donations to these funds are totaled together until $15,000 is reached. When the endowment fund total is reached the fund becomes permanent and the American Paint Horse Foundation issues a $1,000 scholarship, annually, in that individual s memory or honor. Organization and summary of significant accounting policies Organization The American Paint Horse Association, Inc. (The Association) is a not-forprofit membership organization incorporated under the laws of Texas and exempt from income tax under Section 501(c)(5) of the U.S. Internal Revenue Code. The Association was formed in 1962 to collect, record, and preserve the pedigree of Paint Horses. In addition, the Association is responsible for promoting and disseminating knowledge and information related to the Paint Horse breed. Basis of Accounting and Revenue Recognition The accounts are maintained and the financial statements have been prepared on the accrual basis of accounting in accordance with accounting principles generally accepted in the United States of America. Membership dues and subscription fee revenues are recognized over the applicable membership or subscription period. All other revenue is recognized in the period in which the services are provided. Breeders Trust support is recognized as a temporarily restricted net asset and will be released from restrictions in the applicable distribution years. (See Note 2, Breeders Trust Program) Cash For purposes of these financial statements, the Association considers cash to be all cash on hand, cash in banks in demand accounts, cash in investment brokerage money market accounts, as well as amounts deposited in U.S. Treasury backed money market accounts. Cash, restricted, is cash deposited specifically for the Breeders Trust program. Investments The Association carries investments in marketable securities with readily determinable fair values and all investments in debt securities at their fair values in the statement of financial position. Unrealized gains and losses are included in the change in net assets in the accompanying statement of activities. Inventory APHA General Store Collection inventory is carried at the lower cost or market determined by first-in, first-out method. Merchandise write-downs to market of all items determined to be slow moving or obsolete are reflected on the statements of activities under cost of merchandise sold. The write-downs for the years ending December 31, 2007 and 2006 were $ 36,293 and $ 40,779 respectively. Property, Equipment, Depreciation and Collections Property and equipment is stated at cost. Depreciation is computed using the straight-line method over the estimated useful lives of the related assets, which range from 3-30 years. The Association possesses various prints, original paintings and bronze sculptures purchased and carried at their cost or received as unrestricted gifts and carried at their estimated fair value. These works of art are on display and were not purchased or received for the purpose of re-sale. (See Note 5, Property And Equipment) 40

Federal IncomeTax The Association is an exempt organization under Section 501(c)(5) of the U.S. Internal Revenue Code. Income earned from the performance of its Internal Revenue Service exempt purpose is not subject to federal income tax. Income in excess of $1,000 earned from its non-exempt purpose, (unrelated business income), would be taxable at normal U.S. corporate tax rates. The Association earned no taxable income from unrelated business activities for the years ending December 31, 2007 and 2006. Basis of Presentation Financial statement presentation follows Statement of Financial Accounting Standards (SFAS) No. 117. The Association reports information regarding its financial position and activities according to three classes of net assets: unrestricted, temporarily restricted, and permanently restricted net assets. The Association has no permanently restricted net assets. Concentration of Credit Risk Financial instruments that potentially subject the Association to concentrations of credit risk consist principally of cash in reputable financial institutions located in Fort Worth, Texas. Occasionally, its cash deposits are in excess of the $100,000 Federal Deposit Insurance Corporation protection. Use of Estimates The preparation of financial statements in conformity with accounting principles generally accepted in the United States of America requires management to make estimates and assumptions that affect certain reported amounts and disclosures. Accordingly, actual results could differ from those estimates. 2. Breeders Trust Program The Association provides an added incentive for Paint Horse owners who exhibit their horses. The Breeders Trust is a program that will pay cash awards for points earned at Association approved events by nominated horses. The Breeders Trust is accounted for as a restricted program and as such is reported in the Association s financial statements as temporarily restricted net assets due to the nature of the program. Breeders Trust award payouts for 2007 and 2006 were $1,153,782 and $1,072,142, respectively. (See Note 3 Investments for Breeders Trust investment information.) 3. Employee benefit Plans 401(k) Plan The Association participates in a defined contribution plan under section 401(k). The Plan is subject to the provisions of the Employee Retirement Income Security Act of 1974 (ERISA) and qualifies for its deferral arrangement under U.S. Internal Revenue Code 401(k). The Plan covers all employees with one year of service over the age of 21 that work at least 1,000 hours within the previous year. The Plan will have a noncontributory portion with a 5% contribution rate of eligible employees wages. The Association will match any eligible participants contributory deferral to a maximum of 5% of their pre-tax compensation. Total expenses for the years ended December 31, 2007 and 2006 were $381,170 and $392,512, respectively. Deferred Compensation Agreement The Association has entered into an eligible non-qualified deferred compensation agreement that covers the Executive Director under U.S. Internal Revenue Code 457(b). This is a noncontributory plan with annual deferral amounts set by the U.S. Internal Revenue Code. 8. Commitments Operating Leases The Association leases certain pieces of office equipment and storage space under non-cancelable operating leases that expire at various dates through December 2012. For the year ended December 31, 2007, the leases required monthly payments of approximately $7,734. Rental expense for those leases was approximately $96,063 for the year ended December 31, 2007. It is chartered as a non-profit corporation in the state of Texas and is exempt under U.S. Internal Revenue Service Revenue Code 501(c)(3) as a charitable publicly supported organization under 509(a)(1). The Association contributes to the Foundation the accounting, managerial and administrative services necessary for the ordinary day-to-day operations. During 2007 and 2006, the amount of like-kind contributions to the Foundation in expenses and services rendered amounted to $12,000 and $12,000, respectively. The Association is a separate corporation (not-for-profit) organized for the purpose of collecting, recording and preserving the pedigree of the Paint Horse. The Foundation is managed by a board of directors which consists of members of the Association. These services and expenses are listed as an unrestricted support contribution and then as corresponding expenses per the criteria for recognition under generally accepted accounting principles. At December 31, 2007 and 2006, the amount was $12,000 and $12,000, respectively. In addition, the Association made unrestricted contributions in 2007 and 2006 of $75,612 and $25,385, respectively. 46
