Race & Sports Book House Rules As used in these Race & Sports Book House Rules (these House Rules ), the Property means and refers to the casino operating the Race & Sports Book ( Race & Sports Book ) where these House Rules are posted and applied. General Rules: 1. Void where prohibited or restricted by law. 2. Must be at least 21 years of age to wager or collect any winnings and all patrons ( Patron or Patrons ) must provide valid proof of age acceptable to the Property. 3. By participating in wagering activities, Patrons agree to these House Rules. 4. A copy of these House Rules and any changes will be available at the Race & Sports Book at all times. 5. All games, events, fights, or contests on which wagers may be placed at the Race & Sports Book (collectively, Events and each an Event ) are subject to all applicable federal, state, and local laws and regulations, including gaming, and all aspects of the Event are subject to the approval of appropriate regulatory authorities. 6. Patrons agree to allow the Property the unconditional use of their name and likeness for promotions/advertising and announcements without compensation, consideration, notice, review, or consent, where permitted. 7. Winning Patrons are responsible for any and all taxes, licenses, registrations and other fees, as applicable. 8. These House Rules, as written, control in all circumstances unless and only to the extent an express exception is set forth in official printed wagering information and media created by the Property and distributed for use at the Property and/or the Race & Sports Book. 9. All decisions regarding the interpretation of any rules, including these House Rules, for any wager lie solely with the Property, subject to Rule 12 in these General Rules. 10. The Property is not liable for injuries or losses arising or resulting from participation in wagering activities and is not liable in the event of any equipment or software malfunction, subject to Rule 12 in these General Rules. 11. The Property is not responsible for lost, late, mutilated or illegible wagering tickets (receipts) ( Ticket or Tickets ), or theft, destruction or unauthorized access to or alterations of Tickets or materials, or for human error which may occur in the processing of wagers submitted, all of which may limit, restrict or prevent a Patron s ability to participate in any wagering activity or Event, subject to Rule 12 in these General Rules. 12. A Patron may take to the Nevada Gaming Control Board any dispute regarding: (a) alleged winnings or losses, (b) the distribution of any cash, prize, benefit, or ticket, or (c) how a game or promotion is conducted. 13. Any attempt by any person to deliberately damage any Property equipment or software, or to undermine the legitimate operation of any wagering activity or Event may be a violation of criminal and civil laws. Should such an attempt be made, the Property reserves all rights, including the right to seek damages from any such person to the fullest extent of the law. 14. Records of wagers placed and winnings awarded will be retained by the Property for recordkeeping purposes in accordance with all applicable, federal, state and local laws, rules and regulations. 15. A Patron agrees to release and hold harmless the Property and its parents, subsidiaries, and affiliates, and their respective officers, directors, employees, representatives and agents from any and all liability arising directly or indirectly out of Patron s participation in wagering activities or events related thereto and/or the receipt, use, misuse or participation in any winnings. 16. Patrons with Disabilities Patrons who are unable to verbally or physically place a wager are permitted to designate a proxy to verbally or physically place a wager on their behalf. The Property must approve any proposed proxy. Approval is in the sole discretion of the Property, in compliance with state and federal law. Patrons must be present at all times when using a proxy. All wagers obtained by the proxy will be final and considered as the wagers of the Patron who requested the proxy. All payments shall be made only to Patrons and not their proxies. 17. The use of any communication device to provide information for placing wagers is prohibited, with the exception of using a mobile device to place wagers through the official mobile sports application for 1

the Property Race & Sports Book or any Race & Sports Book affiliated with Property ( Mobile Sports App ) in a manner consistent with its Terms of Use, which are available at Property Race & Sports Book. 18. Nevada Gaming Commission Regulations prohibit wagering on Events from outside of the State of Nevada. 19. The Property reserves the right to add, delete, or change these House Rules and/or payoff odds with the approval of the Nevada Gaming Control Board. 20. Tickets are void after one year (365 days) from the date of the Event s conclusion. Winning Tickets may be redeemed at the Race & Sports Book, via mail, or, if after Race & Sports Book hours, at the Property cage. See the reverse side of the Ticket for mail-in redemption instructions and the address. 21. Tickets with winning wagers may be cashed at the Property Race & Sports Book or any Race & Sports Book affiliated with Property. 22. The Property assumes all responsibility for paying the mandatory.25% Federal Excise Wagering Tax required by law. 23. Statistics recognized by official league chairs, commissions, sanctioning organizations, and other authorities, will be used to determine all statistical wagering propositions. 24. For a wager to be payable, it must have Action as determined on an Event-by-Event basis. All wagers that are deemed No Action, as determined on an Event-by-Event basis, will be refunded. 2

SPORTS WAGERING RULES 1. Patrons are responsible and must check their Ticket for accuracy before leaving the wagering counter. (A) (B) (C) Tickets are only valid as printed and cannot be altered or disputed after Patron leaves the wagering counter. Once a wager is accepted by the Property and Patron, Tickets will not be altered or voided prior to the start of the Event for which the wager was placed except at the discretion of the Property s management team ( Management ) and with the approval Patron. Wagers may only be rescinded with the approval of the Nevada Gaming Control Board Chairman or his designee. At any given time all current odds are available to Patrons. Patrons will be notified of odds or line changes in the following manner: (i) (ii) (iii) Events and odds posted on electronic reader boards will be updated simultaneously with any administrative change, e.g. a line or odds change. Events that are not posted on electronic reader boards are still updated simultaneously with any administrative change and can be viewed on a Patron s view screen of each betting terminal when wagers are being made. Patrons may also request a computer-generated printout of the most current odds at any given time from a ticket clerk. (D) (E) Tickets are official, based on the most current event and wagering data available and may not always match propositions on display boards. Management reserves the right to protect the interest of both parties in the case of obvious mechanical or human error, e.g. wrong team or wrong time. 2. The Property is not responsible for lost, stolen, altered, illegible, or unreadable Tickets. Payment shall be made only on valid computer-generated Tickets. 3. Management in its sole discretion reserves the right to refuse any wager(s). 4. The Property will determine all minimum and maximum wagers on all Events. 5. All Events must be played on the date scheduled to have Action. All wagers deemed No Action wagers will be refunded. (A) (B) (C) Events including golf tournaments, boxing matches, tennis matches, auto races, track and field events and international tournaments must be held within 30 days of scheduled date to be considered Action. No Action wagers will be refunded. Property is not responsible for location changes. If an Event is moved from its original location, all wagers are still valid and are considered Action. All boxing wagers, including Win, Go/Don t Go, KO, Decision, Draw, etc., will have Action regardless of any change in weight class, scheduled length of the bout or championship sanction. All boxing Pick-the-Round proposition wagers are No Action if the scheduled length of the bout is changed from the distance displayed by the Race & Sports Book. 3

(D) (E) All Big Game future book wagers (index/odds to win a future contingency) are Action as long as a winner/champion is officially declared, regardless of season length, playoff format or date change. All future book bets are Action regardless of team relocation, name change or a change in league affiliation. No Action wagers will be refunded. All league championship and division future book wagers (including conference, division, etc.) have Action as long as a winner/champion is officially declared, regardless of season length, playoff format or date change. No Action wagers will be refunded. 6. For betting purposes, the winner of an Event will be determined on the date of the Event s conclusion according to these House Rules and Nevada Gaming Commission Regulations. The Property does not recognize defaults prior to the start of the Event, suspended Events, protests, or overturned decisions, etc. for wagering purposes. 7. Minimum play requirements for betting purposes are set forth below. Event results are official after: Football (Professional and College) 55 minutes of play Football First Half and Halftime (Professional and College) 25 minutes of play Basketball (Professional) 43 minutes of play Basketball First Half and Halftime (Professional) 20 minutes of play Basketball (College) 35 minutes of play Basketball First Half and Halftime (College) 15 minutes of play Hockey (Professional, College, Amateur) 55 minutes of play Boxing (Professional and Amateur) When bell (buzzer, etc.) is sounded signifying the start of the opening round the bout is considered official for betting purposes, regardless of the scheduled length. For boxing Go/Don t Go, KO, Decision and Draw propositions see rule #11 of these House Rules. Baseball (major league, minor league, college, amateur) In all nine-inning scheduled games, winners and losers are official after nine innings of play, unless the home team is leading after eight and one-half innings. Called games must go a minimum of five innings or four and one-half innings if the home team is ahead (also applies to seven-inning scheduled games). If a game goes past five innings and is subsequently called, the winner is determined by the score after the last full inning of play; except in a case in which the home team scores to tie or take the lead in the bottom half of the inning in which the game is called, the runs do count. For baseball totals, run lines, and propositions see rule #14 of these House Rules. Note: All other Events not listed above that involve a scheduled length of play or time limit must play to their conclusion or have five minutes or less of scheduled playing time remaining when the contest concludes to be considered official for wagering purposes. If an Event is declared not official for wagering purposes wagers will be refunded. For all Events not listed above, in the event the predetermined length of play, time limit, distance, etc. is not reached, but the Event is called final by Event officials with a winner declared, it is also considered official for wagering purposes. 8. When wagering on totals (over/under) on Events involving a scheduled time limit, all Event wagering rules applicable to minimum length of play requirements shall also apply to total wagers, i.e., Event must play to its conclusion or have five minutes or less of scheduled playing time remaining for total wagers to be considered Action. 4

9. On half-time wagers, scoring during the second half shall determine winners and losers. Overtime periods are included as part of the second half. On first-half, quarter, period, set, inning etc. wagers, only scoring during that designated portion of play shall determine winners and losers. 10. If on the day of the Event conclusion, no winner(s) is/are determined, the minimum play requirements are not met (see Rule 7 of these Sports Wagering Rules) or No Contest is declared, all wagers on that Event will be considered No Action. No Action wagers will be refunded. Boxing 11. In boxing Go/Don t Go (over/under) proposition wagers, a full round is defined as one in which the bell (buzzer, etc.) has sounded, signifying the conclusion of such round. If a fighter is counted out or the bout officially stopped prior to the bell, that round is not considered a full round for wagering purposes. If a half round (one minute and thirty seconds of a round), or other specified time is listed, the official time of the bout s conclusion, as determined by ring officials, will determine proposition winners and losers. (A) (B) (C) On boxing KO proposition wagers, KO includes knockout, technical knockout, disqualification, or any other stoppage. On boxing Decision proposition wagers, Decision means fight must go to the judges scorecard(s) to determine a winner, including a technical decision. On boxing Draw proposition wagers, Draw means the fight must go to the judges scorecard(s) and declared a draw, including a technical draw, regardless of number of rounds completed. 12. If the fight ends exactly at a half a round, it will be graded as an over. 13. In round distance wagering, if a fighter fails to answer the bell for the start of any round, the fight officially ended in the last round fought. In total wagering, if a fighter does not answer the bell to start a round where the fight has gone the exact distance listed on the total, the UNDER is the winner. Fight Distance Example: Fighter A/Fighter B total rounds are listed as 6 rounds. Fighter A fails to answer the bell to start the 7th round. The fight officially ends in the 6th round. The proposition would have UNDER as the winner. Baseball 14. When wagering on baseball totals (over/under), the game must go at least the regulation nine innings (eight and one-half if the home team is ahead) for a scheduled nine-inning game or seven- innings (six and one-half if the home team is ahead) for a scheduled seven-inning game. Thereafter, if a game is called or suspended the score will be determined after the last full inning; unless the home team scores to tie or take the lead in the bottom half of the subsequent inning, in which case the score is determined at the time the game is called. Listed or specified pitchers must start in over/under wagers or there is No Action. No Action wagers will be refunded. Note: totals. Rules for baseball proposition bets and run line bets are the same as those for baseball 5

15. Baseball wagers are accepted in the following manner: (A) (B) (C) Action team against team, regardless of the starting pitchers. One Specified Pitcher A wager on or against one specific pitcher, regardless of other starting pitcher. Specified pitcher must start or wager is deemed No Action. No Action wagers will be refunded. Both Specified Pitchers A wager that specifies both starting pitchers. Any variation constitutes No Action. No Action wagers will be refunded. Note: Each teams starting pitcher is defined for wagering purposes as the pitcher that throws the initial pitch. 16. In the event of a pitcher(s) change prior to the start of a baseball game, money odds may be adjusted. If one scheduled pitcher starts against an unscheduled pitcher, Action and live One Specified Pitcher wagers will be computed at the opening price established by Management with the new pitcher. 17. When wagering on totals (over/under), overtime periods, extra innings, etc., are counted in the final score. Hockey 18. In the event of a shootout, for wagering purposes, the winner is awarded one goal, which is considered in the determination of the winner and loser, and counted toward the game total. Golf 19. Most holes played wins player match-up propositions. If number of holes played is equal, low score wins match-up. 20. If golfers listed in a match-up proposition are involved in a three-way (or more) playoff, either player involved must win the playoff to win that match-up or wagers are deemed No Action. 21. All future wagers on golf are Action regardless if player begins play. Tennis 22. All future wagers on tennis are Action regardless if player begins play. Auto Racing 23. Wagers are accepted on drivers only, not team or car. (A) For driver match-up propositions, one driver is picked to finish in front of the other driver. Drivers need not win or finish the race. (B) For over/under, cautions, lap leader or lead change propositions, all scheduled laps must be run or wagers will be deemed No Action. 24. Once a race has started, match-ups and proposition wagers are Action regardless of when race runs to conclusion. 25. All future wagers on Auto Racing are Action regardless if driver starts or qualifies. 6

26. Results for auto racing will be considered official for wagering purposes within two hours after conclusion of the Event. At that time, applicable auto series recognized results and statistics will be used to determine all winners and losers. Any subsequent changes will not be recognized. Soccer 27. For soccer three-way wagering propositions, each is a separate wagering and must win, lose or tie. 28. For Events such as international football/soccer competition or challenge, a two option only line may be quoted. This is a wager on a team to advance, whether they win in 90 minutes, in an extra period, or in a penalty shootout. There is no possibility of a tie. 29. Soccer games do not have to go full regulation time (90 minutes). Event results are official for wagering purposes after 40 minutes of the second half has been completed or declared official in an extra period or a penalty shootout. UFC/MMA Fights 30. Fights must take place within one week of the listed date of the fight or the Event will be graded "No Action". Venue changes within the same country will not affect the status of pending wagers on the Event. Venue changes to a different country will result in a grade of "No Action" on all pending wagers for the Event. 31. If a fight weight class for an Event is changed for any reason, this will have no effect on any pending wager status. No wager will be voided based on a weight class change for an Event. 32. If the number of scheduled rounds in a fight or Event is changed or incorrectly posted, only the money line to win the fight will have Action. Any other wagers on the Event, including fight totals, fight propositions, exact round of ending, fighter to win inside distance, win by decision, and goes distance propositions will be No Action. 33. A total listed on a fight represents the total number of completed rounds. The halfway point of a round is at exactly one minute and thirty seconds into a three minute round. Thus, 4½ rounds would be one minute and thirty seconds of the 5th round. The halfway point of a two minute round is at the one minute mark. The halfway point of a five minute round is at the two minutes and thirty seconds mark. 34. Unless otherwise stated, the ring announcer will announce the elapsed time of any uncompleted round. At X:XX of round X or X:XX into the Xth round refers to time completed in the round, not time remaining in the round. 35. If the fight ends exactly at a half a round, it will be graded as an over. 36. Event results will be graded/re-graded based on the official result at ringside. An Event result may be revised or altered after initial presentation by the ring announcer. Event results are not official for wagering purposes until verified by officials at the Event venue. The overturning of a fight decision by an official or unofficial sanctioning body, based on appeal, suspension, lawsuit, drug testing result, or any other fighter sanction, will not be recognized for wagering purposes. 37. A wager on a fighter "Inside Distance" wins if the selected fighter wins by KO, TKO, DQ, submission, or technical decision. 38. A wager on a fighter to win by "KO/TKO" wins only if the fighter wins by KO, TKO, DQ, or corner stoppage. A win by submission is not considered a KO/TKO in MMA. 39. A wager on a fighter to "win by any decision" wins if the selected fighter wins by technical decision or a decision where the fight goes the complete distance, meaning the fight goes the full number of scheduled rounds. 7

40. A wager on a fighter to "win by X round decision" wins only if the selected fighter wins by decision where the fight goes the complete distance. 41. When a "draw" occurs, wagers on both fighters "to win" are refunded. Other proposition wagers are graded according to their specific wording. 42. An "If Wins Only" wager loses when a fight ends in a draw. 43. Wagers with the following annotation "(Scorecards = No Action)", will be refunded if the fight goes to scorecards for any reason. For this specific case, wagers will have Action only if the fight is decided by KO, TKO, DQ, or submission. 44. Any fight that is deemed "no contest" or "no decision" will have all wagers refunded. 45. A wager on a fighter winning in a specific round is a loser if the fight goes the complete distance. 46. A fighter wins by "Unanimous Decision" when all three judges score that fighter as the winner. 47. A fighter wins by "Split-Decision" when two judges score that fighter as the winner and one judge scores the other fighter as the winner. 48. A fighter wins by "Majority Decision" when two judges score that fighter as the winner and one judge scores the fight a draw. 49. A fight is a "Unanimous Draw" when all three judges score the fight as a draw. In such event, all wagers will be refunded. 50. A fight is a "Split-Decision Draw" when one judge scores the fight a draw, one judge scores, the fight for one fighter, and one judge scores the fight for the other fighter. In such event, all wagers will be refunded. 51. A fight is a "Majority Draw" when two judges score the fight a draw and one judge scores the fight for either of the two fighters. In such event, all wagers will be refunded. 52. A fight is a "Technical Draw" when a fight ends before an allotted number of rounds (between four to six rounds, depending on sanctioning body rules) usually because of an accidental head-butt. In such event, all wagers will be refunded. 53. If the phrase "Fight goes 1:30 round X", and the fight ends at exactly that second of that round, then "Fight goes" will be graded the winner. 54. In round distance wagering, if a fighter fails to answer the bell for the start of any round, the fight officially ended in the last round fought. In total wagering, if a fighter does not answer the bell to start a round where the fight has gone the exact distance listed on the total, the UNDER is the winner. Fight Distance Example: Fighter A/Fighter B total rounds are listed as 6 rounds. Fighter A fails to answer the bell to start the 7th round. The fight officially ends in the 6th round. The proposition would have UNDER as the winner. 55. A round is not complete until a fighter starts the following round. 8

BUYING A HALF POINT 56. On football and basketball Event straight wagers, Patrons may buy a half point by paying an additional.10 cents to the current line per every dollar wagered. Example: laying 6 to win 5 (- 1.20) instead of laying (-1.10). 57. On all football Events, college and professional, buying a half point on or off three or seven points will cost an additional.30 cents to the current line per every dollar wagered. 9

PARI-MUTUEL FANTASY SPORTS WAGERING RULES 62. In each contest event, athletes are awarded fantasy points according to their in-event performance. The Fantasy points awarded to each athlete are dictated by the rules for that particular event. CONTEST TERMS Each of the wagering pool options (Win, Place, Show, Exacta, etc.) in a contest will be graded individually and will have their own payoff odds. Contest results and winners will be based on the total points scored from each athlete in the contest field. Each sport has its own unique scoring system described in detail below. Contests will be based on a minimum of two separate sporting events and a minimum of 3 players per contest field. If a contest athlete is declared inactive, or does not appear in the contest s scheduled events due to injury, weather cancellation, trade, coaches decision, demotion, or any other reason, the athlete will be scratched from the contest and wagers on this athlete will be refunded. With regards to wagers on a scratched athlete in the PICK-7 pool, contest entrants will receive the wagering favorite in the WIN pool for the contest in which the athlete is scratched. In the event that athletes tie in their performance scores, a tiebreaker will be used to determine the winner. If the athletes performance scores remain tied after employing the tiebreaker, the pools will be divided in the by the calculation rules stated in NV Gaming Regulation 26.220. TICKET CANCELLATIONS Ticket cancellations are possible at the discretion of Property Race & Sports Book. Account wagering is not applicable. CONTEST GUARANTEES. All contests will run without a minimum entry or prize pool requirement. All contests will be guaranteed for the minimum payout amounts posted when the wagering period for the contest ends. RESULTS & PAYOUTS Property Race and Sports Book will wait until final box scores of USFantasy s sports data supplier as well as an additional independent source have been reported for each contest's events in order to verify the final results. USFantasy s statistics providers may occasionally make revisions to final box scores correcting statistics published during live events. In those cases, results will be based on final box scores, posted shortly after live event conclusions. If revisions are made after the final box scores are published, scoring will not be reversed or changed. Contests will not be based on performances where relevant statistical information on the corresponding sporting events is not generally available through traditional media sources. After each contest ends, the winning results are published, generally no later than 30 minutes after the final event in a contest is completed. All winning Tickets are valid for 365 days after the date of result; Tickets may be cashed at any Property Race & Sports Book, paid by mail or at the Main casino cage after sportsbook business hours. 13

DISPUTE RESOLUTION All disputes will be resolved by Management and may be appealed to the Nevada Gaming Control Board. CANCELLED CONTESTS A contest may be cancelled and all wagers refunded if the minimum number of athletes and events are cancelled or postponed. The following must be met for a valid contest: contests must be based on a minimum of two separate sporting events and a minimum of 3 players per contest field. Property Race & Sports Book also reserve the right to cancel contests at our discretion, without any restrictions allowable by Nevada Gaming Commission regulations and guidelines. If inaccurate start times result in contest entry submissions after the start of the sporting event(s), a cancellation may occur because of the potential impact on the integrity of the contest. POSTPONEMENTS In the event that a scheduled event is cancelled, preempted, or postponed beyond the originally scheduled contest date. For any reason, after the start of the contest that includes such cancelled, preempted or postponed events, the selected athletes from those contests will be scratched from the contest and wagers will be refunded on those athletes according to the conditions listed under the contest Terms. SUSPENDED OR SHORTENED EVENTS If the league declares an event "suspended," then the statistics that are generated the day the event is originally scheduled will be used. Any statistics generated on a later date when the event is completed will not be included due to the timely nature of our contests. Athletes involved in any event that is postponed to a day that is other than the originally scheduled start date, will not be considered and wagers on these athletes will be refunded. Athletes involved any event that begins on the originally scheduled date, but is later postponed to a day that is other than the originally scheduled start date will not be considered and wagers on these athletes will be refunded. All other House Rules apply when not in conflict with these rules. POINT SCORING Point scoring for Football, Baseball, Basketball, Golf, Nascar and NHL for the respective sports may be found on the reverse side of USFantasy wagering sheets. DEFINITIONS Definitions for Win/Place/Show/Exacta/Exacta, Trifecta, Daily Double, Pick Three, Superfecta and Million $ Seven may be found on the reverse side of USFantasy wagering sheets. PAYOFFS For Pari-Mutuel respective payouts, scoring and calculations, please see USFantasy rules which are available upon request. HORSE RACING WAGERING RULES 63. In addition to the General Rules stated at the beginning of these rules, the following apply to horse racing wagers: (A) A wager accepted after the official Off Time of a race is void, and money will be refunded. (B) All races must be run on date and track scheduled. If a race is postponed and/or rescheduled to a later date, the event will constitute No Action. (C) Entries and field horses are classified as one betting interest unless otherwise specified. (D) An Exacta, Daily Double, Daily Triple, Quinella, Trifecta, or other exotic wager (a wager involving the picking of 2 or more probabilities) accepted on a race where that specific wager is not offered constitutes No Action. 14

(E) Official results and mutuels as determined at the Host Track on the day of the race will be considered official by the Property for wagering purposes. Any subsequently overturned decisions will be disregarded. (F) Rules for all race proposition wagers (futures, horse vs. horse, winning time over/unders, etc.), payoff odds and the determination of winners and losers shall be established by Management and displayed on printed media. (G) All statistical and other data displayed on the Race & Sports Book screens and scratch sheets are for the convenience of our Patrons. Maximum care is taken to insure the accuracy of such information and the integrity of the sources at all times. However, due to human or mechanical error, Property does not assume responsibility for the data inaccuracies. (H) In House (book wagers) and Non Pari-Mutuel winning wagers may be cashed at any Property Race & Sports Book. (I) In the event of a Pari-Mutuel system failure, or for any reason Pari-Mutuel wagers cannot be accepted, wagers may be accepted as House wagers and are subject to House wagering pay out limits. (J) Property assumes absolute responsibility for paying the mandatory.25% Federal Excise Wagering Tax required by law. (K) Property reserves the right to add, delete or change the Race & Sports Book House Rules and/or payout limits with the approval of the Nevada Gaming Control Board. PARI-MUTUEL HORSE RACING WAGERING RULES 64. In addition to the General Rules stated at the beginning of these rules, the following apply to Pari- Mutuel wagers: (A) Property shall pay full track odds on all Pari-Mutuel wagers. (B) Cancellations after Patrons leave the wagering counter may be accepted at the discretion of Management only. (C) Payoffs over fifty thousand dollars ($50,000) may be delayed for 24 hours following the next banking day. (D) In the case of a scratch (non-starter), the Host Track s current No Action /refund rules and policies and/or consolation payouts applicable to each wager type shall apply. (E) Lost Ticket claims may be accepted on Pari-Mutuel wagers at the discretion of Management only. (F) In the event of a dispute, the decision of the Nevada Gaming Control Board is final. NON PARI-MUTUEL ( HOUSE OR LIVE BROADCAST ) HORSE RACING WAGERING RULES 65. House wagering payout limits on all Live Broadcast ( Simulcast ) horse track races are: (A) Straight wagers (Win, Place and Show): Full track odds on the first one hundred dollars ($100). 15

(C) Daily Double limits: Full track odds on the first ten dollars ($10). Payout limit on the remaining wager balance is 100/1. (D) Exacta limit: Full track odds on the first ten dollars ($10). Payout limit on the remaining wager balance is 100/1 (E) Daily Triple limit 500/1 (F) Trifecta limit 500/1 (G) House Quinella limit 100/1 Property Quinellas are Track Quinellas where offered. If there is no Track Quinella, Property will offer a House Quinella in some cases. House Quinella payoffs are determined by multiplying the win mutuel of the first place finisher times one-half the place mutuel of the second place finisher, unless an entry or field horse run first and second. In such cases the payoffs are determined by multiplying the win mutuel of the first place finisher times one half the show mutuel of the third place finisher. 66. In the event of a scratch (horse is officially withdrawn or is officially declared a non-starter), straight wagers will be refunded; in a two-horse parlay the wager becomes a straight wager, a four-horse parlay is reduced to a three-horse parlay and so forth. A scratch in a Daily Double, Daily Triple, Quinella, Exacta or Trifecta, etc. constitutes No Action. When a scratch involves part of an entry or field, Action applies to the remaining portion of the entry or field. Property does not recognize consolation Daily Doubles or Daily Triples on House wagers. 67. In the event that there is no trifecta winner at the Host Track in a designated Trifecta race, Property will honor those Trifecta wagers that have correctly selected the order of finish for the Win, Place and Show finishers only. Payouts will be based upon the House Trifecta limit of 500/1 (300 for 1 on dog and off tracks). Property does not recognize consolation Trifectas on House wagers. 68. In all future wagering, the winner as determined by the track at the conclusion of the Event will also be declared the winner for wagering purposes. 69. All Property Race & Sports Book House Rules shall apply. MOBILE WAGERING ACCOUNT RULES 70. These House Rules apply to mobile wagering accounts ( Wagering Accounts ). 71. To open a Wagering Account, a patron must be a Total Rewards Card member and appear in person before an employee and supervisor of Property Race & Sports Book to complete and sign the Wagering Account Application. The patron must provide (1) a valid driver s license, stateissued identification, passport, non-resident alien identification card or other government issued photo identification, (2) social security number, if a US resident, and (3) other information required under N.R.S. Ch. 463 et. seq. and Nevada Gaming Commission Regulation 5.225(5). 72. Wagering Accounts may only be used by the person named on the Wagering Account ("Account Holder"). Representatives or agents are not allowed. 73. Wagering Account activity may only be conducted through the mobile sports application for the Property Race & Sports Book or any Race & Sports Book affiliated with Property ( Mobile Sports App ). 74. A wager is not considered placed until Account Holder has verified and confirmed the wager in the Mobile Sports App and a confirmation message appears. Once a wager has been placed, it cannot be modified, canceled or voided. 75. Wagers will not be accepted if they exceed the balance in the Wagering Account. 76. Account transactions, including but not limited to account information changes or account closures must be conducted in person at Property Race & Sports Book by Account Holder. However, deposits and withdrawals by Account Holder may be conducted in person at Property Race & Sports Book and the Property cage. 77. Winnings are subject to IRS reporting and/or withholdings. All applicable taxes are the responsibility of Account Holder. Winnings will not be released to a Wagering Account until all applicable tax forms are completed and received by Property. 78. Wagers placed through the Mobile Sports App are the sole responsibility of the Account Holder. Property is not responsible for unauthorized access to the Wagering Account. 79. History of transactions placed will be available for viewing on the Mobile Sports App for a period of 90-days. 17

80. Wagering Accounts will be suspended after sixteen (16) months without wagering activity pursuant to Nevada Gaming Commission Regulation 5.225(16). To renew a suspended Wagering Account, Account Holder must appear in person at Property Race & Sports Book and present a valid, government issued photo identification and social security card pursuant to Nevada Gaming Commission Regulation 5.225(a). 81. Wagers will be deducted directly from the Account Holder's Wagering Account balance. Winnings from wagers will be credited directly to Account Holder's Wagering Account as soon as reasonably practicable after the Event result is declared official. 82. Wagers will only be accepted from within the State of Nevada. Property is prohibited by law from accepting wagers that originate from outside of the State of Nevada. 83. Upon Account Holder s reasonable request, Property shall provide Account Holder with a statement of account showing each deposit, withdrawal, credit to, and debit to the Wagering Account made during the time period reported by the account statement. Account Holder may dispute any transaction according to Nevada Gaming Commission Regulation 7A. 84. For all wagering transactions or communications, Property is required to make a voice, print, electronic or other approved record of the entire transaction and shall not accept any such wager or transaction if the recording system is inoperable. The record of Patron s confirmation of all wagering information shall be deemed to be the transaction of record, regardless of what was recorded by Property s system. The records will be made available to the Nevada Gaming Control Board upon request. 85. Property has the right to the following, within good and sufficient reason: (A) Refuse any application of a Wagering Account; (B) Refuse deposits to accounts; (C) Refuse to accept all or part of any wager; (D) Declare that any or all wagers shall no longer be received; (E) Suspend or close any account at any time, unless there is a pending investigation or patron dispute, provided, however when an account is closed, Property shall return the balance of the wagering account to Patron pursuant to the terms of the Wagering Account application, Mobile Sports App Terms of Service, House Rules, Nevada Gaming Commission Regulation 5.225(19)(d)(5), and state and federal law. 86. Property shall keep confidential, except from (a) the Nevada Gaming Control Board, (b) financial institutions participating in a program established in accordance with Section 314(b) of the USA Patriot Act, (c) as required by federal or state law, or (d) as authorized by Account Holder, the following: (A) The amount of money credited to, debited from, or present in any Account Holder s Wagering Account; (B) The amount of money wagered by an Account Holder on any event; (C) The account number and password that identifies the Account Holder; (D) The identities of particular entries on which Account Holder is wagering or has wagered; and (E) Patron s name, address, and other information in possession of Property that would identify Account Holder. 87. All deposits into a Wagering Account must be in cash or Property casino chips only. 88. Mobile Wagering Account Rules are subject to change at any time. 18
