BIG LEAGUE IMPACT BRACKET CONTEST OFFICIAL RULES 1. NO PURCHASE IS NECESSARY TO ENTER OR CLAIM A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ELIGIBILITY: The 2017 Big League Impact Celebrity Bracket Challenge ( Contest ) is open to all legal residents of the 48 contiguous United States and the District of Columbia (residents of Alaska and Hawaii are not eligible), age 18 years or older, with Internet access as of March 12, 2017, except employees, officers, directors, agents and shareholders (and their immediate families (spouse, parent, child, sibling and their respective spouses) and household members (whether or not related)) of Big League Impact, Inc. ( Big League Impact or Sponsor ), Real Time Fantasy Sports, Inc. ( RT Sports or Administrator ), and their respective parents, subsidiaries, divisions, and affiliated entities (collectively, the Contest Entities ). RT Sports is the Contest Administrator and is the sole and final arbiter of all disputes relating to the basketball bracket operation of the Contest. Big League Impact disclaims any and all responsibility and liability associated with the basketball bracket operation of the Contest and any disputes relating thereto. Void wherever prohibited by law. Contest is governed by U.S. law and subject to all applicable federal, state and local laws and regulations. By entering the Contest, participants agree to accept and be bound by all terms of these official rules ( Official Rules ). This Contest is in no way sponsored by, endorsed by, administered by, or associated with the National Collegiate Athletic Association or any collegiate or professional sports league, team, or union. 2. HOW TO ENTER: A. From on or around 5:30 p.m. Eastern Time ( ET ) Sunday March 12, 2017 through 11:59:59 a.m. ET Thursday March 16, 2017 (the Entry Period ), Sponsor will conduct a Contest encouraging participants ( Participants ) to enter for a chance to win a prize. The Contest is based on the results of the 2017 NCAA Division I Men s Basketball Championship (the Tournament ). Participants will attempt to select the winners of the 63 games (the Contest excludes First Four Tournament games on Tuesday, March 14, 2017 and Wednesday, March 15, 2017) the Tournament comprises. To enter, during the Entry Period, a Participant must visit the Big League Impact Bracket Contest page located at www.bigleagueipmpact.org. Each Participant must click on the SIGN UP button and follow the instructions to: (i) Create a Tournament bracket and predict one (1) winner for each of the 63 games in the Tournament, round by round, beginning with the First Round (Round of 64) and continuing through the National Championship; (ii) Predict the total score of the National Championship (to be used as a tie-breaker if necessary); and (iii) Follow the instructions to complete and submit the online entry form, including providing his/her name, address, telephone number, and e-mail address. B. To be eligible, each online entry and bracket (each, an Entry ) must be received no later than 11:59:59 a.m. ET on March 16, 2017 ( Entry Deadline ). Participants may edit their Entries any time before the Entry Deadline. All Entries must be submitted in the name of an individual person and the prize can only be awarded to the person whose name is on the winning Entry. Entries generated by script, macro or other automated means will be void. The Contest Entities are not responsible for misdirected, incomplete, lost, late, illegible, undelivered, inaccurate or delayed Entries, or for technical, hardware, or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions or other errors or problems that may limit or affect a person s ability to participate in the Contest, whether human, mechanical, typographical, printing, electronic, network or otherwise, relating to or in connection with the Contest, including, without limitation, errors that may occur in connection with the administration of the Contest, the processing of Entries, the announcement of the prize or in any Contest-related materials. In the event of sabotage, acts of God, terrorism or threats thereof, computer virus or other events or causes beyond the Sponsor s
control that corrupt the integrity, administration, security or proper operation of the Contest, Sponsor and/or Administrator reserve the right, in their sole discretion, to modify, cancel or suspend the Contest. In the event of cancellation, Sponsor and/or Administrator reserve the right to award the prize from among all eligible, non-suspect Entries received prior to the event requiring such cancellation. False or deceptive Entries or acts will render the Participant ineligible. All Entries become the property of the Sponsor and will not be acknowledged or returned. Limit one (1) entry per person. 3. SCORING/TIE-BREAKERS : Participants will earn points by correctly predicting the winning teams among the 63 Tournament games. The number of points awarded for each correct pick of a winning game of the Tournament will increase with each round of the Tournament. There are zero points awarded for each incorrect pick or for any unsubmitted (blank) pick. The number of points awarded in this Contest is set forth below: Round First Round (Round of 64) Second Round (Round of 32) Third Round (Round of 16) Fourth Round (Round of 8) Fifth Round (Semi-Final) National Championship (Final) Points 1 point for each correct prediction 2 points for each correct prediction 3 points for each correct prediction 4 points for each correct prediction 5 points for each correct prediction 7 points for correct prediction If there are multiple Participants who tie for the most points, then ties will be broken and winner(s) will be determined in the following order: Tie-Breaker 1 Closest to the total points by both teams in the National Championship, without exceeding the number of total points 2 Closest to the total points by both teams in the National Championship, 3 Closest to the total points by the winning team in the National Championship, without exceeding the total points 4 Closest to the total points by the winning team in the National Championship, 5 Closest to the total points by the losing team in the National Championship, without exceeding the total points 6 Closest to the total points by the losing team in the National Championship, 7 Most points in the First Round (Round of 64) 8 Most points in the Second Round (Round of 32) 9 Most points in the Third Round (Round of 16) 10 Most points in the Fourth Round (Round of 8) 11 Most points in the Fifth Round (Round of 4/Semi-final) 12 Earliest submission of Contest Entry (as determined by Sponsor)
4. WINNER DETERMINATION: On or around April 4, 2017 (after the end of the Tournament), one (1) eligible Participant who has earned the most points (and is the winner of any tie-breaker(s), as needed) will be the Winner. Potential Winner will be confirmed by e-mail. Potential Winner must meet all eligibility requirements, including the timely execution and return of all necessary releases and documents (if any) required by Sponsor. 5. PRIZES: A. One (1) Winner will receive: One (1) three-day/two night trip for the Winner and one (1) guest (guest must be over 18 years old) to The Lodge at Sea Island, Georgia, at an approximate market value ( AMV ) of Three Thousand Five Hundred Dollars ($3,500 US). The trip will include: (i) Round-trip coach-class airline tickets from the major U.S. gateway airport nearest to Winner s residence to, in Sponsor s discretion either Brunswick Golden Isles Airport (Brunswick, Georgia) or Jacksonville International Airport (Jacksonville, Florida) for the Winner and one (1) guest (If the Grand Prize Winner resides within 200 miles of St. Simons Island, Georgia, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for difference in prize value); (ii) Ground transportation between The Lodge at Sea Island and the airport for arrival and departure; (iii) One (1) room, double occupancy, at The Lodge at Sea Island for Winner and one (1) guest for two (2) nights; and (iv) Two (2) rounds of golf at the Sea Island Golf Club at the Lodge (Retreat Course, Plantation Course or Seaside Course, as determined by the club in its discretion and subject to available tee times during the stay) for Winner and one (1) guest. All trip/travel arrangements are determined by Sponsor in its sole discretion. Trip must be booked at least thirty (30) days in advance and is subject to availability. All travel must be completed by December 15, 2017. B. Winner is responsible for all costs and expenses not expressly provided for above, including, but not limited to, additional ground transportation, meals, incidentals, tips, telephone calls, souvenirs, hotel charges, taxes, fees and other personal expenses incurred during the trip. The Winner and guest must travel on the same itinerary (on dates specified by Sponsor, which may be subject to change) and are solely responsible for obtaining proper documentation (e.g., valid photo ID) prior to travel. All travel arrangements are subject to availability, blackout dates, and other restrictions. The actual value of any prize that includes travel will depend on point of departure and dates of travel. All tickets are subject to terms and conditions of their issuers. Travel must be made through Sponsor s (or its designee s) agent, on a carrier of Sponsor s choice, in seat locations determined by Sponsor. If any portion of any prize is canceled or postponed for any reason, Sponsor will have no obligation to award compensation in lieu of such prize, the remainder of the prize will be awarded, and Sponsor will have no further obligation to Winner. Winner may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, in its sole discretion, to substitute any prize with one of comparable or greater value. All federal, state and local taxes and any other costs and expenses associated by acceptance and use of prize are the sole responsibility of the Winner. All prize details are in Sponsor s sole discretion. 6. GENERAL: A. By entering this Contest, Participants grant the Contest Entities and their designees the right, unless prohibited by law, to use their names, nicknames, cities and states of residences, voices, pictures and likenesses, without compensation, notification or approval, for the purpose of advertising and publicizing the goods and services of the Contest Entities and all matters related to the Contest, in any manner or medium, now or hereafter known, throughout the world in perpetuity.
B. Potential Winner and guest may be subject to a background check before the prize is awarded. Sponsor reserves the right to disqualify a potential Winner based on the results of such background check if Sponsor determines, in its discretion, that awarding the prize to such potential Winner might reflect negatively on Sponsor. C. Winner may be required to execute an affidavit of eligibility, liability release, tax acknowledgment form, and, except where prohibited by law, a publicity release and return within three (3) business days of notification. Noncompliance within this time period or failure of potential Winner to respond to a notification attempt within three (3) days of such attempt may result in disqualification and, in Sponsor s discretion, an alternate winner may be selected. Such potential Winner may be disqualified and the Participant with the next highest scoring total may be selected as a potential Winner in Sponsor s discretion if a potential Winner fails to comply with any of the Official Rules. The Contest Entities expressly disclaim any responsibility and Participants agree to indemnify and hold harmless the Contest Entities from and against any and all claims, actions, demands and/or liability for injury, damage or loss whatsoever relating to or arising in connection with participation in this Contest (regardless of the cause of such injury, damage or loss). 7. DISPUTES: Participant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest will be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of Georgia or the appropriate state court located in Atlanta, Georgia; (ii) all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event attorneys fees; and (iii) under no circumstances will Participant be permitted to obtain awards for and PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participant and Contest Entities in connection with the Contest, are governed by and construed in accordance with the laws of the State of Georgia without giving effect to any choice of law or conflict of law rules (whether of the State of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia. 8.
