THE NASCAR FOUNDATION S 2015 BETTY JANE FRANCE HUMANITARIAN AWARD 2015 OFFICIAL RULES The NASCAR Foundation is excited to honor one outstanding fan for his or her commitment to children with the 2015 Betty Jane France Humanitarian Award (the Award ). The Award will be presented during the 2015 NASCAR Sprint Cup Series Champion s Week in Las Vegas, Nevada. 1. ELIGIBILITY: The Award winner will be selected from a pool of nominees, which is first narrowed to four (4) Award finalists. Individuals must be nominated by a friend, family member or nonprofit organization. NO SELF-NOMINATIONS WILL BE ACCEPTED. To be eligible, an applicant must be, at the time the application is submitted: (i) eighteen (18) years of age or older, and (ii) a legal resident of the United States of America. Each applicant must demonstrate that he/she has made a significant impact on the lives of children through volunteerism or charitable work during the last five (5) years and has a passion for NASCAR. For this Award, volunteerism is defined as voluntary action in service to others and the community. Individuals who receive compensation (financial or other) to perform charitable work volunteering, fundraising, etc. are ineligible for the Award. Employees of NASCAR, The NASCAR Foundation, International Speedway Corporation, International Motor Sports Association, Ford Motor Company, Nationwide Mutual Insurance Company or any of their subsidiaries or affiliated companies are ineligible for the Award. Applicants agree to attend and participate in all events or activities associated with the Award as requested by The NASCAR Foundation, which may include meeting with or speaking to media or large groups of people. Reasonable accommodations will be made if necessary. If requested by The NASCAR Foundation, the Award winner s charity agrees to select and send a benefiting child from the charity to attend all associated events for the Award as designated by The NASCAR Foundation (reasonable travel accommodations and associated costs to be paid by The NASCAR Foundation). Said child must be under the age of 18, able to travel and attend all events in Las Vegas, and be accompanied by a parent or guardian. Reasonable accommodations will be provided by The NASCAR Foundation on an as-needed basis. Previous finalists and corresponding participating charities for the Award cannot compete for the Award for a period of five (5) years from the year selected as an Award finalist or participating charity. Winners of the Award are not eligible to apply for the Award again. 2. AWARD FINALISTS SELECTION: (a) NOMINATION PROCESS: Nominations for the Award will be accepted in accordance with a two-part process consisting of an Official Preliminary Nomination and an Official Phase II Nomination. (i) Official Preliminary Nomination: Each eligible applicant must be nominated by friends, family members or a nonprofit organization. No self-nominations will be accepted. 1
Each preliminary nomination application will be individually evaluated in accordance with the criteria below. Those nominees whose applications are accepted during the preliminary nomination process will move on to the Phase II Nomination. The Preliminary Nomination selection process will commence at on March 11, 2015 and continue through May 8, 2015. Nominations must be submitted via email to bjfaward@nascarfoundation.org by midnight ET on May 8, 2015 or postmarked May 8, 2015. (ii) Official Phase Two Nomination: Applications selected during the Preliminary Nomination process will receive an Official Phase Two Nomination Form, inviting applicants to provide an in-depth explanation of their nominee and the accomplishments and positive impact that nominee has made in the lives of children. The Phase Two Nominations that are submitted will advance to the next phase of the Award finalists selection process, which is Phase Two Selection Committee. During this two-part process, Applicants will be judged on the following criteria: Impact of the applicant s volunteer service on the mission of the organization; Expected impact of The NASCAR Foundation s donation to the applicant s benefiting children s charity; Continuing the legacy of Betty Jane France by exhibiting the same compassion toward all children, especially those in need; and Overall story of the applicant s involvement with its benefiting charity (b) SELECTION OF AWARD FINALISTS: Official Phase Two Nomination forms received will be reviewed and ranked by an independent committee of business professionals and community leaders, in accordance with the criteria set forth above, and forwarded to The Foundation s Board of Directors for selection of the four Award finalists. Award finalists will be publicly announced at a 2015 NASCAR Sprint Cup Series Race, in the sole discretion of The NASCAR Foundation. (c) FAN VOTING PERIOD: Once the Award finalists are announced, voting will be opened to eligible members of the public to vote for their choice amongst the four (4) Award finalists chosen by The NASCAR Foundation s Board of Directors through an online campaign ( Award Vote ), resulting in a single Award winner. (i) Eligibility: The online voting for the 2015 Award is open to individuals aged 18 years or older who are legal residents of the United States and the District of Columbia during the time of voting. (ii) Voting Period: The voting period begins October 9, 2015 and ends at 11:59 P.M. EST. on December 3, 2015 on ( Voting Period ). (iii) How to Vote: During the Voting Period, voters will visit the website, http://www.nascar.com/award ( Website ) to view the four (4) videos, each featuring a selected finalist for the Award. To cast a vote for an Award finalist, voters will watch the Award finalists videos, select the vote button for the video of their choice, and then complete the form by providing his/her complete name and e-mail address or log into his/her Facebook account from the Website. Voters may only 2
submit one (1) vote per day. Entries generated by script, macro or other automated means may be void in the sole discretion of The NASCAR Foundation. The use of multiple e-mail addresses, Facebook accounts, name variations, or other methods to create additional votes by a single individual during any one-day period is prohibited and may result in disqualification of the vote from the Award Vote in the sole discretion of The NASCAR Foundation. After casting a vote, voters may be able to share their vote selection on their Facebook page or Twitter, which will also include a link to the Website. Votes will be verified by an independent accounting firm. The winner of the Award is scheduled to be announced on-stage during the 2015 NASCAR Sprint Cup Series Awards in Las Vegas, Nevada. The NASCAR Foundation reserves the right to adjust the date, time and location of the Award winner announcement as the schedule may be required. 3. ADDITIONAL TERMS: The NASCAR Foundation reserves the right, in its sole discretion, to void suspect entries, or to modify, cancel, or suspend the Award Vote should virus, bugs, non-authorized human intervention or other causes beyond the control of The NASCAR Foundation corrupt or impair the administration, security, or fairness of the Award Vote. In any such event, The NASCAR Foundation reserves the right to select a winner for the Award from among all four (4) Award finalists prior to the occurrence requiring such action. The NASCAR Foundation assumes no responsibility for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, including, but not limited to, the Facebook platform, computer equipment, software, failure of any entry to be received by The NASCAR Foundation on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise. All personally-identifiable information provided during the voting process will be treated in accordance with the privacy policy posted at http://www.nascarfoundation.org/privacy-policy. By participating in this Award Vote, you agree to the privacy policies and to the terms and conditions of Facebook and Twitter, and to the decisions of The NASCAR Foundation, which decisions shall be final and binding in all respects. 4. AWARDS: Of the four (4) selected Award finalists for the Award, three (3) of the finalists and the one (1) winner chosen by the Award Vote will receive prizes as follows: (a) One (1) Award winner will receive: (i) A $100,000 donation from The NASCAR Foundation to the children s charity affiliated with the Award winner s original nomination for the Award. Said charity must be a registered, public, 501(c)3 tax-exempt organization within the United States. (ii) An all-expenses-paid trip* to a NASCAR race weekend designated by The NASCAR Foundation in 2015 as part of the Award recognition process and in recognition of the person as a finalist for the award. (iii) An all-expenses-paid trip* to the NASCAR Sprint Cup Series Champion's Week in Las Vegas in December 2015 (Award winner may bring one guest) to receive the Award and a trophy 3
(iv) An all-expenses-paid trip* for a child (and child s parent/guardian) who benefits from Award winner s designated charity to participate in activities during the NASCAR Sprint Cup Series Champion's Week in Las Vegas in December 2015 and receive a trophy. (v) One (1) 2015 Brand-New Vehicle directly provided by Ford Motor Company, make and model of vehicle provided will be determined in Ford s sole discretion (The value of the vehicle will be reported for tax purposes as required by law. Award winner is solely responsible for reporting and paying any and all applicable taxes related to the vehicle and paying any expenses associated with the vehicle that are not specifically provided for in the official rules. Recipient will receive an IRS form 1099 at the end of the calendar year and such form will be filed with the IRS.) (b) Three (3) Award Finalists will each receive: (i) A minimum $25,000 donation from The NASCAR Foundation to the Award finalist s designated children s charity. Said charity must be a registered, public, 501(c)3 tax-exempt organization in the United States. (ii) An all-expenses-paid trip* for each of the three (3) Award finalists to a NASCAR race weekend (Award finalists may each bring one guest) designated by The NASCAR Foundation in 2015 as part of the Award recognition process and in recognition of the person as a finalist for the Award. (iii) An all-expenses-paid trip* for each of the three (3) Award finalists to the NASCAR Sprint Cup Series Champion's Week in Las Vegas in December 2015 (Award finalists may each bring one guest), as well as a child (and child s parent/guardian) that benefits from the Award finalist s designated charity. *All-expenses-paid trips include reasonable costs of standard coach airfare, single standard/doubleoccupancy hotel room, meals, and transportation between airport and hotel. 5. CONDUCT AND DECISIONS All applicants agree to be bound by the decisions of The NASCAR Foundation, its board of directors and an independent accounting firm designated by The Foundation to oversee The Award process. The NASCAR Foundation reserves the right, at its sole discretion, to disqualify any applicant who violates any rule, gains unfair advantage in participating in the Award process, obtains winner status using fraudulent means or who engages (or is unable to control an official guest of the applicant from engaging) in any misconduct or behavior unbecoming of the positive, charitable nature and spirit of the Award or The NASCAR Foundation, including but not limited to any offensive, disruptive, harassing or threatening behavior at any time during the Award process. The NASCAR Foundation will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Award process in its sole discretion. The NASCAR Foundation s decisions concerning such disputes shall be final. If the conduct or outcome of the Award process is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of The NASCAR Foundation, The NASCAR Foundation reserves the right to terminate this Award, or make 4
such other decisions regarding the outcome as The NASCAR Foundation deems appropriate. All such decisions made by The NASCAR Foundation are final. The NASCAR Foundation may waive any of these rules in its sole discretion. Any attempt by an applicant or any other individual to deliberately circumvent, disrupt, damage or undermine the legitimate operation of this Award shall be subject to all applicable criminal and civil laws. Should such an attempt be made, The NASCAR Foundation reserves the right to seek civil legal recourse and/or criminal prosecution and/or damages from any such person to the fullest extent permitted by law. This Award process is governed by, and these Official Rules will be construed and interpreted pursuant to, applicable federal, state and local laws and regulations. All federal, state and local taxes, and all income and any other taxes, fees and surcharges will be the sole responsibility of the Award winner and the Award finalists. The Award winner and Award finalists further agree, except where prohibited by law, to grant The NASCAR Foundation and those acting pursuant to The NASCAR Foundation s authority, the right to use and publish their respective names, applicable photographs, likenesses, video and audio online and in print, or any other media, in connection with this Award process. 6. CONDITIONS AND LIMITATIONS OF LIABILITY By participating in this Award process and/or accepting the Award, each applicant agrees: (1) to release, discharge and hold harmless The NASCAR Foundation, NASCAR, Inc., each of their parent, subsidiaries, limited liability and affiliated companies, advertising and promotion agencies, and each of their respective employees, shareholders, officers, directors, agents, members, successors and assigns (collectively, the Released Parties ) from liability of any kind or nature for any loss, claims, damages, or injuries of any kind resulting in whole or in part, directly or indirectly from applicant s participation in this award process or from the acceptance and use/misuse of any prize including any travel/activity related thereto; (2) to abide by, and be bound by these Official Rules and the decisions of The NASCAR Foundation relating to participation in this Award process, selection of winners and awarding of prizes, which shall be final. By entering this Award process, all applicants grant permission to use respective applicant s name, other identifying information, city and state of residence, photographs, video as well as the names, likenesses and images of representative applicants for advertising, promotional and other purposes in any and all media now known or hereafter devised, worldwide, in perpetuity, without further compensation, notification or permission from applicants without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so, unless prohibited by law. The Released Parties are not responsible for: (i) lost, late, incomplete, stolen, misdirected, or undeliverable nominations; (ii) any and all actions, claims, injury, loss or damage (whether due to negligence or otherwise) to person(s), including death or property damage, arising in any manner, directly or indirectly, in whole or in part from participation in this Award process, or any award-related activity, and/or acceptance, possession, misuse or use of a prize. Upon selection as an Award finalist, each Award finalist and their respective charities shall be required to enter into separate marketing and promotional agreement as directed by The NASCAR Foundation. 5
