LOCAL LAW NO. 6 I FOR THE YEAR 2011 Members of the Common Council April A. Kennedy, Alfred J. Turcotte, George E. Primeau, Sr., Dianne R. Nolin, Roger R. Ceccucci and Ralph V. Signoracci IV, ask for unanimous consent for the introduction and passage of the following Local Law: A LOCAL LAW AMENDING THE CODE WITH RESPECT TO THE WARD BOUNDARIES OF THE CITY OF COHOES. WHEREAS, after the latest Census, the City must adjust its ward boundaries pursuant to law; and WHEREAS, after public input, consultation with its retained expert, and due deliberation, the Common Council finds the following adjustments to the ward boundaries to be appropriate and necessary; BE IT ENACTED by the Common Council of the City of Cohoes as follows: Section 1. 30 3 of the Code of the City of Cohoes shall be amended to read as follows: 30 3. First Ward. The First Ward shall be composed of all that part of the city included within the following lines, to wit: Commencing at a point on the northerly boundary line between the City of Cohoes and the Town of Colonie where it is intersected by the center line of the right of way of the former New York Central Railroad, also known as the "Mohawk River Trailway Crescent Branch," thence, proceeding in a generally southeasterly direction along said center line of said right of way to its intersection with the extension of the center line of that section of McElwain Avenue west of the center line extended of Imperial Avenue, thence easterly along the center line extended of said section of McElwain Avenue to its intersection with the property line of the Cohoes Housing Authority Apartments known as "Roulier Heights Apartments;" thence generally southerly, easterly and northerly along the property lines of said Roulier Heights Apartments until its intersection with the southern property line of lands belonging to the City of Cohoes, and formerly Erie Canal land, thence generally easterly along the southern property line of said City owned parcel to its intersection with the northern property line extended of the Cohoes Community Center, thence easterly along said property line extended to its intersection with the southern boundary line of the right of way of the former Olmstead Street Canal, thence northeasterly along the southern property line and property line extended of the right of way of the former Olmstead Street Canal to its intersection with center line of North Mohawk Street; thence southerly along the center line of North Mohawk Street to its intersection with the center line of New Courtland Street, thence continuing to its intersection with the center line of Saratoga Street; thence northerly along the center line of Saratoga Street to its intersection with the City of Cohoes boundary line where it is coterminus with the Town boundary line of the Town of Waterford, in Saratoga County; thence generally northwesterly along said City line, which is the main channel of the Mohawk River, to that point where the municipal boundaries of the City of Cohoes and Towns of Waterford and Colonie are co terminus; thence in a westerly direction along the boundary between the City of Cohoes and the Town of Colonie to a point of intersection at the easterly bank of the abandoned Erie Canal; then in a southerly direction along the easterly bank of the abandoned Erie Canal to the intersection of the easterly bank of the abandoned Erie Canal and a stream which runs along the
boundary between the City of Cohoes and the Town of Colonie; thence in a generally westerly direction following said stream as it winds and turns to the point of its intersection with the aforementioned center line of the right of way of the former New York Central Railroad right of way, the point and place of beginning; this shall comprise the First Ward. Section 2. 30 4 of the Code of the City of Cohoes shall be amended to read as follows: 30 4. Second Ward. The Second Ward shall be composed of all that part of the City included in the following lines, to wit: Commencing at a point where the center line extended of Chestnut Street intersects with the center line of the right of way of the former New York Central Railroad, also known as the "Mohawk River Trailway Crescent Branch;" thence southerly along the center line extended and center line of Chestnut Street to its intersection with the center line of Johnston Avenue, thence westerly along the center line of Johnston Avenue to its intersection with the center line extended of the walking path which runs in a north south path through the West End Park; thence southerly along the center line extended and center line of said walking path to its intersection with the center line of Columbia Street, thence easterly along the center line of Columbia Street to its intersection with the center line extended of Mohawk Street, thence easterly and southerly along the center line extended and center line of Mohawk Street to its intersection with the center line of Saratoga Street; thence northerly along the center line and center line extended of Saratoga Street to its intersection with the center line of New Courtland Street, thence northerly and westerly along the center line of New Courtland Street to its intersection with the center line of Mohawk Street; thence northerly along the center line of Mohawk Street to its intersection with the extension of the south property line of the right of way of the former Olmstead Street Canal, thence southerly and westerly along the southern property line of the former Olmstead Street Canal to that point in the southern property line of the right of way of the former Olmstead Street Canal where it meets the northern property line of the Cohoes Community Center, thence westerly along the extension of said Cohoes Community Center northern property line to its intersection with the southern property line of a parcel of land belonging to the City of Cohoes, and formerly Erie Canal land; thence generally westerly and southerly along said property line to its intersection with the property line of the Cohoes Housing Authority Apartments known as "Roulier Heights;" thence southerly, westerly and northerly along said property line to its intersection with the extension of the center line extended of that section of McElwain Avenue which is west of the center line extended of Imperial Avenue; thence westerly along said center line to its intersection with the center line of the right of way of the former New York Central Railroad, also known as the "Mohawk River Trailway Crescent Branch;" thence northwesterly along the center line of said right of way to its intersection with the center line extended of Chestnut Street; which is the place and point of the beginning; this shall comprise the Second Ward. Section 3. 30 5 of the Code of the City of Cohoes shall be amended to read as follows: 30 5. Third Ward. The Third Ward shall be composed of all that part of the City included within the following lines, to wit: Commencing at a point where the center line extended of James Street is intersected by the center line of Columbia Street; thence southerly along the center line and center line extended of James Street to its intersection with the City of Cohoes City line where it is co terminus with the town line of the Town of Colonie; thence easterly, southerly and easterly to that point where the City boundary line intersects the center line of Dyke Avenue, thence northwesterly along the center line and the center line extended of Dyke Avenue to its intersection with the center line of the river front arterial highway known as "Interstate 787"; thence northerly along the center line of Interstate 787 to the center line extended of Mohawk Street; thence
northwesterly along the center line and center line extended of Mohawk Street to the center line extended of Columbia Street; thence continuing westerly along the center line extended and center line of Columbia Street to its intersection with the center line extended of James Street; which is the place and point of the beginning; this shall comprise the Third Ward. Section 4. 30 6 of the Code of the City of Cohoes shall be amended to read as follows: 30 6. Fourth Ward. The Fourth Ward shall be composed of all that part of the City included within the following lines, to wit: Commencing at a point where the center line of the extension of the rear lot lines of the properties facing Meadowlark Drive intersect the City of Cohoes City line where it is co terminus with the boundary of Town of Colonie; thence southerly and easterly along said City line to its intersection with the extension of the center line of James Street; thence northerly along the center line extended and center line of James Street to its intersection with the center line of Columbia Street; thence westerly along the center line of Columbia Street to its intersection with the center line extended of the West End Park walking path; thence northerly along the center line and center line extended said path to its intersection with the center line of Johnston Avenue; thence easterly along the center line of Johnston Avenue to its intersection with the center line of Chestnut Street; thence northerly along the center line and center line extended of Chestnut Street to the center line of the right of way of the former New York Central Railroad, also known as the "Mohawk River Trailway Crescent Branch;" thence northwesterly and northerly along said right of way to its intersection with the center line of Vliet Boulevard; thence westerly along the center line of Vliet Boulevard to the center line extended of Surprenant Way, formerly Dudley Avenue, thence southerly along the center line extended and center line of Surprenant Way, formerly Dudley Avenue, to the center line extended of St. Marie s Lane; thence westerly along the center line and center line extended of St. Marie s Lane and continuing westerly along the center line and center line extended of Leversee Avenue to the center line of Platt Street; thence southerly along the center line of Platt Street to its intersection with the center line extended of Watervliet Avenue; thence westerly along a line drawn from the intersection of the center lines of Platt Street and Watervliet Avenue to a boundary marker found on the west side of Pleasant Street where it becomes Ziemke Farm Lane, thence continuing westerly along a line drawn from that boundary marker to the intersection of the extension of the rear (western) lot lines of the town homes facing Pleasant Street, thence northerly along said rear lot line extension and rear lot lines to the intersection with the rear lot lines of the properties fronting Meadowlark Drive, thence westerly, southerly, northerly and westerly along a curved line co terminus with the rear lot lines and lot lines extended to its intersection with the City of Cohoes City Line, where it is co terminus with the boundary of the Town of Colonie, which is the point and place of the beginning; this shall comprise the Fourth Ward. Section 5. 30 7 of the Code of the City of Cohoes shall be amended to read as follows: 30 7. Fifth Ward. The Fifth Ward shall be composed of all that part of the City included within the following lines, to wit: Commencing at a point in the City of Cohoes City line where it is co terminus with the boundary of the Town of Colonie and the center line of the right of way of the former New York Central Railroad, also known as the "Mohawk River Trailway Crescent Branch;" thence southwesterly and southerly along said City line to its intersection with the extension of the rear north lot lines of the properties fronting on Meadowlark Drive; thence easterly, southerly, northerly and easterly along said rear lot lines and lot line extension to the intersection with the rear (west) lot lines of the town homes fronting Pleasant Street; thence southerly along said rear lot line and lot line extension to its intersection with the center line of Meadowlark Drive; thence
easterly along the center line of Meadowlark Drive to a boundary marker on the west side of Pleasant Street where it becomes Ziemke Farm Lane; thence continuing generally easterly from said boundary marker on the west side of Pleasant Street to that point where the center lines extended of Platt Street and Watervliet Avenue intersect; thence northerly along the center line of Platt Street to the center line extended of Leversee Avenue, thence easterly along the center line and center line extended of Leversee Avenue to the center line extended of St. Marie s Lane; thence continuing easterly along the center line and center line extended of St. Marie s Lane to the center line of Surprenant s Way, formerly Dudley Avenue, thence northerly along the center line and center line extended of Surprenant s Way, formerly Dudley Avenue, to the center line of Vliet Boulevard; thence easterly along the center line of Vliet Boulevard to the center line of the right of way of the former New York Central Railroad, also known as the "Mohawk River Trailway Crescent Branch;" thence northerly and northwesterly along said "Mohawk River Trailway Cresent Branch" to its intersection with the Cohoes City line where it is co terminus with the boundary of the Town of Colonie, which is the point and place of the beginning; this shall comprise the Fifth Ward. Section 6. 30 8 of the Code of the City of Cohoes shall be amended to read as follows: 30 8. Sixth Ward. The Sixth Ward shall be composed of all that part of the City included within the following lines, to wit: Commencing at a point where the City of Cohoes line is co terminus with the boundary of the Town of Waterford, in Saratoga County, where said City line is intersected by the center line of Saratoga Street, thence easterly, northerly and easterly along the City line, which is the main channel of the Mohawk River to its intersection with the main channel of the Hudson River at a point in the City line where the boundaries of the Counties of Albany, Rensselaer and Saratoga are co terminus, thence continuing southerly and westerly along the City line to a point where it intersects the center line of Dyke Avenue, thence northwesterly along the center line of Dyke Avenue to its intersection with the center line and center line extended to its intersection with the center line of the river front arterial highway known as "Interstate 787;" thence northerly along "Interstate 787" to its intersection with the center line extended of Mohawk Street, thence northwesterly along the center line and center line extended of Mohawk Street to its intersection with the center line of Saratoga Street; thence northerly along the center line of Saratoga Street to its intersection with the City of Cohoes City line, where it is co terminus with the boundary of the Town of Waterford, the point and place of the beginning; this shall comprise the Sixth Ward. Section 7. This Local Law shall take effect immediately upon filing with the Secretary of State. Approved as to form this 26 th day of April 2011. Gregory J.
