STEWARDS: R P Murrihy (Chairman), M F Van Gestel, G T Rudolph, C G Polglase and cadets J R Morton and J T Penfold (jl) Supplementary: ROYAL RANDWICK Saturday 22 February 2014 Race 5: Red Lea Chickens Light Fingers Stakes 1200m The Stewards today concluded an inquiry into B Shinn s riding of Zanbagh in this event. When evidence was taken on Wednesday, 26 February 2014 trainer Mr G Walter told the Stewards that B Shinn had ridden exactly in accordance with instructions, namely not to push his horse along from the barrier, not to attempt to make a 600m run and not to use the whip if the horse could not win. Sectional times provided by Betting Steward Mr T Griffin supported the evidence of B Shinn that the first sectional was faster than average and, significantly, the sectional between the 800m and the 400m was three lengths faster than average thus supporting B Shinn s contention that his mount was never travelling and was not able to tack onto the back of Arabian Gold and Gypsy Diamond, due to the mid race tempo increasing. Whilst the Stewards remained critical of B Shinn s lack of vigour rounding the home turn, as he placed his mount under pressure from the 350m, they were not satisfied that it had any material effect on the finishing position of Zanbagh. Mr Walter was told that, whilst he acknowledged that the instructions were given with a view to not only the Light Fingers Stakes, but also races later in the campaign of Zanbagh, that he must ensure that those instructions are not binding, particularly as Zanbagh got so far out of its ground. B Shinn was reminded that the responsibility from compliance with the reasonable and permissible measures rule rests on the shoulders of the jockey and that instructions are only to be seen as a guide to the rider. He was advised he must ensure he rides every mount so as not to leave any room for doubt. LATE SCRATCHINGS Stewards permitted the late withdrawal of the following horses due to the downgrade of the track. Race 8: Ultimate Gaze at 1.12pm. Albana at 1.16pm. RACE 1: Australian Turf Club Handicap 1400m: The Offer and Kaypers were crowded at the start between Keith s Legacy and Ecuador, both of which shifted ground. Shortly after the start Keith s Legacy was then hampered when crowded between The Offer, which was taken out by Kaypers, and Target In Sight, which shifted in slightly. When questioned, J Ford, rider of Keith s Legacy, stated that his mount pulled hard throughout the event and near the 900m raced in restricted room to the inside of Target In Sight, after improving to the inside of that runner. He added that near the

20140301ROSE 2 700m, as his mount continued to overrace, he was checked to avoid the heels of Target In Ice when the pace steadied. He added that, when placed under pressure in the straight, Keith s Legacy was then left without a finishing effort and was somewhat disappointing. A post-race veterinary examination of Keith s Legacy revealed the gelding had lost its off fore plate in running, with no other abnormalities. Trainer Mr D Vandyke stated it would now be his intention to experiment with the gear of Keith s Legacy and also indicated he may drop the gelding back in distance, where his intention would be to ride it a little more forward. Mr Vandyke undertook, to report back on the condition of Keith s Legacy subsequent to the race. RACE 2: TAB Rewards Handicap 1200m: Boss Lane was slow to begin. Near the 150m Greenbow was steadied to avoid the heels of Lonace, which commenced to give ground. When questioned regarding the disappointing performance of Dream Choice, T Clark stated that the gelding did not travel today in the rain affected going. He added, although Dream Choice had won at Rosehill on 15 February 2014 when the ground was somewhat rain affected, he felt the gelding did not feel comfortable in the going and, in his view, may have come to the end of its preparation. A post-race veterinary examination of Dream Choice did not reveal any abnormalities. Trainer Mr D Smith explained that Dream Choice had done well since it won at this track on Saturday, 15 February 2014 and that a forward showing had been expected. He stated that the track conditions may not have been to the gelding s advantage and Dream Choice may have come to the end of its preparation. Mr Smith undertook to report back on the progress of Dream Choice subsequent to the race, however, indicated that the gelding would now be freshened. RACE 3: Millie Fox Stakes 1300m: No report. RACE 4: Silver Slipper Stakes 1100m: Modoc jumped awkwardly and made contact with the nearside of its barrier. A short distance later Modoc was then checked when crowded between Unencumbered and Hampton Court, both of which shifted ground. Shortly after the start Hampton Court was then buffeted for a short distance when crowded between Unencumbered and Law, which shifted out slightly. Risen From Doubt was inclined to lay in under pressure in the straight. N Berry, rider of Unencumbered, reported that the colt did not handle today s slow track conditions. RACE 5: Parramatta Cup 1900m: When questioned concerning Carlton House leading today, N Rawiller stated that the entire was stepping up in distance and jumped better than at its previous two starts over shorter journeys and he, therefore, allowed it to stride forward. When questioned concerning the performance of Permit, H Bowman stated that Permit is a peculiar horse that must be kept on the bit and, when at the 1200m he urged his mount along to sit on the back of Junoob, Permit did not respond and dropped the bit completely. A post-race veterinary examination of Lightinthenite revealed the gelding to be mildly lame in the near foreleg. Trainer Mr J O'Shea was advised that he must produce a veterinary clearance prior to Lightinthenite racing again. A post-race veterinary examination of Permit revealed the gelding to be lame in front. Trainer Mr C Waller was advised that the gelding would be required to barrier trial prior to being permitted to race again. When questioned regarding the improved performance of Opinion, trainer Mr C Waller stated that he was pleased with the gelding s first up effort over 1400m at Rosehill on 15 February 2014 and the additional distance of today s race, together with the wet track conditions had been to his advantage.

20140301ROSE 3 RACE 6: Hobartville Stakes 1400m: The Stewards at around 8.30am this morning received a report from Mr Nathan Hayward, Chief Investigator Racing NSW Surveillance and Integrity Unit that, when carrying out an inspection of horses engaged at today s Rosehill Gardens meeting at Royal Randwick on course stables, he had detected a small lump associated with the nearside jugular vein of El Roca. Racing NSW Senior Official Veterinarian Dr C Suann inspected El Roca at the stables and, after perusal of Co-trainer Mr T Busuttin s treatment book, was satisfied that the lump was most likely due to an intravenous administration to the colt at 6am on Friday, 28 February 2014. After interviewing co-trainer Mr Trent Busuttin, managing owner Mr Martin Bradley and stable veterinarian Dr David Garth of Flemington Equine Clinic, the Stewards established that on Friday morning El Roca had been intravenously treated with a product that contained an alkalinising agent as one of its principal ingredients, contrary to Australian Rule 178AA(1), which provides that a person must not administer an alkalinising agent to a horse engaged to race on race day or one clear day prior to race day. A blood sample was taken from El Roca upon its arrival on course, which returned a TCO2 concentration within normal parameters. The Stewards were advised by Dr David Garth that he had administered intravenously a hypertonic saline and alkalinising solution with a view to correcting a fluid and electrolyte imbalance with respect to El Roca. Mr Busuttin was told that the product used was specifically referred to in the Prohibited Substances Notices of the Racing NSW magazine (replicating the Australian Racing Board National policy on pre-race treatment with alkalinising agents) as a product which must not be administered within one clear day of racing. Accordingly, acting under the powers of AR178AA(3), the Stewards withdrew El Roca from its engagement at 2.34pm and adjourned the inquiry until after the running of the last race. A further sample was sent to the ARFL for analysis. Co-trainer Mr Trent Busuttin pleaded guilty to a breach of AR178AA in that he authorised stable veterinarian Dr David Garth to administer an alkalinising agent containing sodium citrate as a principal ingredient to El Roca within one clear day of its scheduled race. Dr David Garth pleaded guilty to administering an alkalinising agent containing sodium citrate as a principal ingredient to the colt El Roca, a horse he knew was scheduled to race the following day. In assessing penalty, the Stewards took into account both parties prior good record, their cooperation and that there was no intent to deceive the Stewards in respect to the administration. They were, however, advised that with proper diligence they could and should have ascertained such an administration was not permitted. They were each fined the sum of $2000 and advised of their rights of appeal. Leaving the 1000m Koroibete was steadied to avoid the heels of Woodbine (N Rawiller), which shifted in when not quite clear. N Rawiller was advised to ensure he is two lengths clear when shifting ground. T Berry, rider of sixth place getter, Romantic Touch, pleaded guilty to a charge under AR137(b) of having failed to ride his mount out to the finish of the race. T Berry was fined the sum of $500. When questioned, T Berry, rider of Romantic Touch, stated that he was able to obtain an uncontested lead and travelled well in the early stages. He added that when placed under pressure the gelding was most disappointing when it failed to respond to his riding. A post-race veterinary examination of Romantic Touch revealed the gelding sustained a speedy cut to the near hind pastern. When questioned regarding the performance of Koroibete, B Avdulla stated that the gelding, which was racing first up over 1400m, was not entirely comfortable on the rain affected going and

20140301ROSE 4 would derive benefit from today s run. A post-race veterinary examination of Koroibete did not reveal any abnormalities. RACE 7: Irresistible Pools & Spas Handicap 1100m: Gun Case was slow to begin. Near the 600m, as the pace steadied, Maysoon shifted in to take up a position behind Cosmic Endeavour, resulting in Adage, which was following Maysoon having to be steadied for some distance to avoid the heels of that runner. In this incident Maysoon shifted in, crowding Diamond Oasis and resulting in both Gun Case and Flight Academy, which were following having to be steadied and Flight Academy making contact with the running rail. Near the 400m Mon Gateau and Maysoon came together, as Mon Gateau shifted to the outside of Cosmic Endeavour. Pasadoble overraced badly throughout the early and middle stages. Near the 200m Flight Academy became unbalanced when improving into a narrow run to the inside of Pasadoble. A post-race veterinary examination of Pasodoble revealed the filly to be displaying a poor post-race recovery. A post-race veterinary examination of Mon Gateau revealed the gelding to be displaying a poor post-race recovery, to have sustained a laceration to the near hind coronet and to have shifted its off fore plate. RACE 8: Rosehill Gardens Handicap 2000m: A Hyeronimus, rider of Dormello, dropped his whip at the entrance to the straight. When questioned regarding the performance of Forever Crazy, H Bowman stated he attempted to go forward from the 1000m and, although taken wide, his mount did not respond and failed to finish the race off in the very heavy conditions. A post-race veterinary examination of Forever Crazy did not reveal any abnormalities. Trainer Mr C Waller stated it is now his intention to spell Forever Crazy. When questioned, N Rawiller, rider of Black Jag, reported that he took hold of that gelding when it put in five or six bad strides near the 700m, which gave him the impression that Black Jag had broken down. A post-race veterinary examination of Black Jag did not reveal any abnormalities. Trainer Mr C Waller undertook to report back on the progress of Black Jag subsequent to the race.
