1. The Pennsylvania Lottery VIP Players Club 2018 Spring Sports BIG Giveaway (hereafter, the Giveaway ). (a) Participation and Entry: (1) Entrants must be members of the Pennsylvania Lottery VIP Players Club and enrolled into PA Lottery Special Offers emails to participate in the Giveaway. (ii) The third winner selected from the Giveaway entrants that selected the Arena Football giveaway shall be entitled to a prize of two (2) game tickets, with each ticket holder participating in an on-field experience and one ticket holder receiving a team jersey, for the Philadelphia Soul home game against the Baltimore Brigade to be held on June 30, 2018. 3. Restrictions: (a) The odds of an entry being selected in a giveaway, described in section 2, depend upon the number of eligible entries received for that giveaway. (b) To be eligible to participate in a particular giveaway, entrants must have complied with the requirements of these rules. (c) The Lottery is not responsible for late, lost or misdirected entries not entered into the Giveaway. The Lottery is not responsible for entries that are not entered into the Giveaway because of incompatible internet browsers or other technical issues. If a Giveaway entry is selected as a winner and rejected or otherwise disqualified during or following the Drawing, the Lottery will select another entry to replace the Page 20 of 26
rejected or otherwise disqualified entry in accordance with these rules and Lottery procedure. select the winners. (i) The Pennsylvania Lottery reserves the right, in its sole discretion, to cancel or suspend the Giveaway, and change these rules if the Drawing cannot be conducted as planned due to errors in these rules or advertising, unauthorized intervention, tampering, fraud, technical errors, viruses, worms, bugs, or any other cause beyond the control of the Pennsylvania Lottery that, in the Pennsylvania Lottery s sole judgment, could corrupt or impair the administration, security, fairness, integrity, or proper conduct of the Giveaway drawings. (j) All entries shall be subject to verification by the Pennsylvania Lottery. (k) The Pennsylvania Lottery reserves the right, in its sole discretion, to disqualify an entrant found to be tampering with the operation of the Giveaway or the associated Drawing or to be acting in violation of these rules or applicable law. (l) The Giveaway is governed by the laws of the Commonwealth of Pennsylvania. Applicable laws and regulations apply. (m) The Giveaway winners will be responsible for all taxes arising from or in connection with any prize won. Page 22 of 26
(n) Prizes are not transferrable. (o) Final determination of winners will be made by the Secretary, whose judgment will be final and binding. (p) All tickets are subject to program availability, venue capacity and age restrictions. In the event the winner is not available on the date of the game or event that is part of a prize awarded in the Giveaway, there will be no extensions or substitutions of prizes and the winner will not receive any reimbursement for the unused prize. (q) The game and event dates referenced in section 2 of these rules are subject to change at the discretion of the team or venue providing the prize. In the event that there is a change in the date or location of a prize described in these rules, the winner will be contacted by the Lottery as early as possible to communicate the change and provide details for prize fulfillment. If this should occur, the prize shall not be considered to be not available under subsection 3(r), below. (r) In the event a prize described in these rules is not available, the Lottery may either provide a substitute prize, determined by the Secretary to have an equivalent value to the prize won, or make a cash payment to the winner, in an amount determined by the Secretary to have an equivalent value to the prize won. (s) Winners and/or guest(s) must abide by all venue policies. Any promotional partner reserves the right to revoke full or partial prize from any winner or winner s guest who it and/or venue personnel deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any venue policy or law, and/or may bring the promotional partner into disrepute. The Lottery and all other promotional partners are not responsible for injury, loss or damage to person or property in connection with the Giveaway. By accepting a prize, each winner agrees to release and hold harmless the Lottery, any other promotional partner, their respective affiliates and their respective directors, officers, employees, representatives and agents (collectively, Released Parties ) from any and all claims for damages or liability, including (without limitation) personal injury and/or death and property damage, arising in whole or in part, directly or indirectly, from: acceptance, possession, use, nonuse, or misuse of a prize; participation in or travel to/from any Giveaway related activity; or participation in this Giveaway.
