TOYOTA MONSTER RAFFLE NATIONAL RUGBY LEAGUE LIMITED TERMS & CONDITIONS 1. All entries for the Toyota Monster Raffle are subject to these Terms & Conditions. 2. In these Terms & Conditions: Participant means a person who is eligible to participate in the Toyota Monster Raffle; Toyota Monster Raffle means the Toyota Monster Raffle conducted by the promoter in accordance with these Terms & Conditions; Web Site means the web site located at www.rugbyleague.com.au/onecommunity and accessible on the internet through the World Wide Web or via other wireless platforms connected to the internet. 3. Entry is open to all residents of New South Wales, Queensland, the Australian Capital Territory, Victoria and Tasmania (and other countries where the law allows residents to enter promotions of this nature). Employees of the National Rugby League Limited and its agents and their immediate families are ineligible to enter. 4. The Toyota Monster Raffle commences at 12.01am (E.S.T) on 5 March 2012 and ends at 5.00pm (E.D.S.T) on 14 September 2012 ( Promotion Period ). 5. Each Participant that enters the Toyota Monster Raffle agrees to be bound by these Terms & Conditions. How to enter 6. To participate in the Toyota Monster Raffle, a Participant must: (a) purchase a Toyota Monster Raffle ticket for $5.00; and i. complete in full all of the Participant s contact details on the ticket stub of the Toyota Monster Raffle ticket; or ii. complete in full all of the Participant s contact details in the online entry form on the Web Site. 7. The promoter however reserves the right at its sole discretion not to accept entry of any Participant, including if the entry contains anything slanderous or defamatory or is otherwise unsightly in any way. If the promoter determines not to accept the entry of a Participant it will refund the Participant the purchase price of the ticket. 8. Participants in the Toyota Monster Raffle are permitted multiple entries. If a Participant purchases an entire book of Toyota Monster Raffle tickets, the Participant must complete in full the Participant s contact details on all of the ticket stubs that comprise the ticket book and return the ticket book to the promoter or the promoter s agent. 1 of 7
9. By entering the Toyota Monster Raffle, unless otherwise advised, the Participant agrees that the promoter may use the contact details collected from the Participant to communicate special offers or for other marketing or publicity purposes without any further reference, payment or other compensation to the Participant, including but not limited to sending the Participant electronic messages. 10. Participant s personal information may be disclosed to State and Territory lottery departments and winner s names published as required under the relevant State lottery legislation. A request to access, update or correct any information should be directed to the promoter. 11. Subject to paragraph 7, all tickets that have been paid for will be entered into the draw. 12. All decisions as to whether a Participant s entry has been incorrectly submitted (for example, if the ticket has not been paid for) will be at the sole discretion of the promoter. The promoter and its agencies associated with the Toyota Monster Raffle are not liable and do not accept responsibility for any error, omission, interruption, deletion, defect, delay in delivery or delivery failure that may result in a Participant s entry not being received or received properly. This includes any errors or failures that are caused by the promoter and its agencies, including those arising out of any negligence or breach of duty on their behalf. Prizes 13. The prizes will be decided by the drawing of tickets butts at random from a barrel. First prize will be drawn first and then all other prizes will be drawn in descending order. A complete list of the prizes is available on the Web Site. 14. Prizes are not transferable and not redeemable for cash or exchange. 15. The total prize value is up to $93,675.82 as at 20 January 2012. 16. In the event that any prize became unavailable for reasons beyond the promoter s control, the promoter reserves the right to substitute any prize for a prize of similar value subject to state regulation. 17. For all gift voucher prizes, expired vouchers are non-refundable in whole or in part. After a voucher has expired, it is no longer valid and all transaction attempts will be declined. Any unused value at the date of expiry will become the property of the issuer of the voucher. 2012 Toyota Kluger and Grand Final Package 18. First prize includes a 2012 Toyota Kluger 4x2 KX-R 5 seat 3.5L Petrol Automatic Wagon (Model 5Z74000). The Toyota Kluger will be a Silver Pearl colour with black trim. All on-road costs are included. Motor vehicle insurance is not included. 19. First prize also includes for two people return economy flights to Sydney from any airport in Australia, one night s accommodation at the Holiday Inn, Darling Harbour (double or twin share) on the 30 th September 2012 and two Category 1 tickets to the Telstra Premiership Grand Final on 30 th September 2012 at ANZ Stadium total value up to $50,094.20. 2 of 7
20. The winner of the first prize will be presented with a Toyota Kluger during half time of the Telstra Premiership Grand Final unless otherwise presented by the promoter at its sole discretion. However, the first prize winner must collect their Toyota Kluger from their nearest Toyota dealer. 21. The first prize does not include airport transfers, additional meals, additional accommodation or other transport, spending money, travel or other insurance. Flight and accommodation bookings are non-negotiable. Dates are set and nontransferable. 22. If flights are not required, the prize will include a limousine ride to the Telstra Premiership Grand Final on 30 September 2012 at ANZ Stadium or other substitute prize of similar value subject to state regulation. 2012 Toyota Hilux and Grand Final Package 23. Second prize includes a 2012 Toyota Hilux 4x2 Workmate 2.7L Petrol Automatic Single Cab (Model 1R82150). The Toyota Hilux will be a Glacier White colour with grey trim. All on-road costs are included. Motor vehicle insurance is not included. 24. Second prize also includes for two people return economy flights to Sydney from any airport in Australia, one night s accommodation at the Holiday Inn, Darling Harbour (double or twin share) on the 30 th September 2012 and two Category 1 tickets to the Telstra Premiership Grand Final on 30 th September 2012 at ANZ Stadium total value up to $31,938.66. 25. The winner of the second prize will be presented with a Toyota Hilux Workmate during half time of the Telstra Premiership Grand Final unless otherwise presented by the promoter at its sole discretion. However, the second prize winner must collect their Toyota Hilux Workmate from their nearest Toyota dealer. 26. The second prize does not include airport transfers, additional meals, additional accommodation or other transport, spending money, travel or other insurance. 2013 Premium NRL Membership 30. Fourth prize comprises two 2013 premium level memberships (incl season pass) to an NRL Club of your choice and $500 worth of NRL merchandise of your choice. Total prize value, $2,810.00. Bryon Break for two 31. Fifth prize comprises two night s accommodation for two people in a standard room at The Byron in Byron Bay, New South Wales, full buffet breakfast for two mornings, 1 hour relaxation or remedial massage per person in the spa and wellness centre, and a gourmet lunch or dinner voucher to the total value of $100. Total prize value is $1,388. 32. The winner will be presented with a voucher for the prize which must be redeemed within 12 months. All bookings and arrangements must be made by the prize winner directly with The Byron. 33. The prize does not include flights, additional meals, additional accommodation, airport transfers, spending money, travel or other insurance. NRL Merchandise 34. Sixth prize comprises $1000 worth of merchandise from the NRL Club of your choice. Harvey Norman Voucher 35. Seventh prize is a $1000 Harvey Norman Gift Voucher, which entitles the winner to spend $1000 at a Harvey Norman Store in Australia. The voucher is valid for 12 months from the date the voucher is issued. IHG Hotels Voucher 36. Eighth prize entitles the winner to spend $500 on IHG hotel accommodation. This voucher can only be used for accommodation within Australia. The winner must quote the NRL Monster Raffle Prize when making the booking. Details of IHG hotels can be found at www.ihg.com. The voucher may only be used once and no change can be made if the voucher is not fully redeemed. Red Balloon Voucher 38. Ninth prize is a $500 Red Balloon gift voucher which entitles the winner to spend $500 at www.redballoondays.com.au. The voucher is valid for only 12 months from the date the voucher is issued. 39. Tenth prize is a one day World Pass to Dreamworld and WhiteWater World for two adults and two children and is valid for only 12 months from the date the pass is issued. Prize valued at $319.96. 40. The prize does not include flights, meals, accommodation, airport transfers, spending money, travel or other insurance. Roses Only Voucher 41. Eleventh prize is a $200 gift voucher which must be used within 6 months and is redeemable against products from Roses Only. 2012 Kangaroos Jersey 42. Twelfth prize is a signed Kangaroos Jersey signed by the 2012 Australian Rugby League team worth $165. Magazine subscription 43. Thirteenth prize is a News Magazine subscription to the value of $80. Arrangements will be made between the promoter and the prize winner as to which magazine they wish to subscribe to. Available magazines may be viewed at www.isubscribe.com.au. Draw 44. The draw will be a manual draw that will take place at Rugby League Central at 10.30am on 21 September 2012 at Driver Avenue, Moore Park, NSW 2021. Two members of the Toyota Monster Raffle committee and a Justice of the Peace or solicitor will be present at the draw. Participants are not required to be present at the draw but may do so if they wish. Notification of winners 45. Every effort will be made to notify the winners by telephone within 2 working days of the draw and by mail within 21 days. The winners names will also be published on the Web Site and in The Australian newspaper on Friday, 28 September 2012. It is the Participant s responsibility to notify the promoter if their contact details change during the Promotion Period. 46. All Participants consent to publishing their name on the Web Site. 47. All claimed prizes will be distributed to winners within 28 days of the draw. The promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. Unclaimed prizes 48. A winner has 12 months to claim their prize by contacting the promoter by telephone on the number provided below. In the event that the winner does not claim their prize for whatever reason, or if the Participant does not satisfy these Terms & Conditions or forfeits their prize, the promoter reserves the right to 5 of 7
(upon receiving approval from all State lottery departments if required) sell the prize and the proceeds of the sale will be paid to the National Rugby League Limited to be used for not-for-profit purposes. 49. If a winner is from the ACT and does not claim their prize, a second chance draw will be held. The second chance draw will be a manual draw that will take place at Rugby League Central at 10.30am on 24 September 2013 at Driver Avenue, Moore Park, NSW 2021. Every effort will be made to notify the winners of a second chance draw by telephone within 2 working days of the draw and by mail within 21 days. The winners names will also be published on the Web Site and in The Australian newspaper on Monday 1 October 2013. Dispute 50. In the event there is a dispute concerning the conduct of the Toyota Monster Raffle, the decision of the promoter is final and no correspondence will be entered into. The promoter and their related bodies corporate, officers, employees, contractors and agents, and all other suppliers of prizes, will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect or consequential loss) which is suffered or sustained in connection with the Toyota Monster Raffle, the promotion of the Toyota Monster Raffle or the use of any prize, except for any liability which cannot be excluded by law. 51. Subject to the approval of state authorities, if for any reason the competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the promoter which corrupts or affects the security, fairness or integrity or proper conduct of the competition, the promoter reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process or to cancel the competition. 52. Subject to the approval of state authorities, if any act, omission, event or circumstance occurs which is beyond the reasonable control of the promoter and which prevents the promoter from complying with these Terms & Conditions, the promoter will not be liable for any failure to perform or delay in performing its obligation and the promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend the Toyota Monster Raffle. 55. All proceeds from the Toyota Monster Raffle will be deposited into the One Community Fund. A grant will then be made to each participating junior and senior rugby league club. National Rugby League Ltd and Toyota Limited receive no financial benefit from the Toyota Monster Raffle. 56. The Toyota Monster Raffle is authorised to be conducted under NSW Permit No. GOCAU/XXXX; QLD Permit No. XXXXX; VIC Permit No. XXXXX/12; ACT Permit No. R 12/XXXX; TAS Permit No. XXXXX. 7 of 7
