1. The Pennsylvania Lottery VIP Players Club 2018 Concert Giveaway (hereafter, the Giveaway ). (a) Participation and Entry: (1) Entrants must be members of the Pennsylvania Lottery VIP Players Club and enrolled into PA Lottery Special Offers emails to participate in the Giveaway. To join the VIP Players Club, visit http://www.palottery.state.pa.us/vip- Players-Club/login.aspx. Becoming a VIP Players Club member is free. (2) To enter the Giveaway, entrants must open the Giveaway email notification and follow the instructions. Entries must be submitted via the link provided in the Giveaway email notification. No other method of submission will be accepted, and entries submitted using any other method, including entries mailed or hand-delivered to the Pennsylvania Lottery, are not valid and will be disqualified. (3) The entry period for the Giveaway begins after 11:59:59 a.m. June 6, 2018 and ends at 11:59:59 p.m. June 10, 2018. All time references in this section are Eastern Prevailing Time. (5) Only one claimant per entry allowed. (6) Claimant must be 18 years of age or older. 2. Drawings and Prizes: (a) The prize entitlements described below are subject to all restrictions and limitations described in Section 3, or mentioned elsewhere in these rules. (b) The Pennsylvania Lottery will conduct one Drawing which will be held between June 11, 2018 and June 18, 2018. Giveaway participants may enter one of the giveaways described in section (2)(c), (2)(d) or 2(e), or may choose not to enter any of the giveaways described in section 2. (c) Pick One Philadelphia Area Concert Giveaway: (1) Sam Smith Concert Giveaway: The first winner selected from the Giveaway entrants that selected the Sam Smith concert giveaway shall be entitled to a prize of two (2) Suite tickets for the Sam Smith Concert to be held at the Wells Fargo Center on July 4, 2018. (2) Beck Concert Giveaway: from the Giveaway entrants that selected the Beck concert giveaway shall each be entitled to a prize of four (4) tickets to the Beck concert to be held at Festival Pier at Penn s Landing on July 20, 2018. Giveaway entrants that selected the Rise Against with AFI concert giveaway shall be entitled to a prize of two (2) tickets to the Rise Against with AFI concert to be held at Festival Pier at Penn s Landing on August 4, 2018. (4) O.A.R. Concert Giveaway: from the Giveaway entrants that selected the O.A.R. concert giveaway shall each be entitled to a prize of four (4) tickets to the O.A.R. concert to be held at Festival Pier at Penn s Landing on August 21, 2018. (d) Pick One Pittsburgh Area Concert Giveaway: (1) Styx and Joan Jett Concert Giveaway: from the Giveaway entrants that selected the Styx and Joan Jett concert giveaway shall each be entitled to a prize of four (4) lawn seat tickets to the Styx and Joan Jett concert to be held at KeyBank Pavilion on July 14, 2018. Giveaway entrants that selected the Styx and Joan Jett concert giveaway shall be entitled to a prize of two (2) lawn seat tickets to the Styx and Joan Jett concert to be held at KeyBank Pavilion on July 14, 2018. (2) Chicago and REO Speedwagon Concert Giveaway: from the Giveaway entrants that selected the Chicago and REO Speedwagon concert giveaway shall each be entitled to a prize of four (4) lawn seat tickets to the Chicago and REO Speedwagon concert to be held at KeyBank Pavilion on July 28, 2018. (3) Gin Blossoms Concert Giveaway: (i) The first winner selected from the Giveaway entrants that selected the Gin Blossoms concert giveaway shall be entitled to a prize of four (4) Box Seat tickets for the Gin Blossoms concert to be held at Stage AE on July 20, 2018. (ii) The second and third winners selected from the Giveaway entrants that selected the Gin Blossoms concert giveaway shall each be entitled to a prize of four (4) general admission tickets for the Gin Blossoms concert to be held at Stage AE on July 20, 2018. (iii) The fourth winner selected from the Giveaway entrants that selected the Gin Blossoms concert giveaway shall be entitled to a prize of two (2) general admission tickets for the Gin Blossoms concert to be held at Stage AE on July 20, 2018. (4) Lord Huron Concert Giveaway: (i) The first winner selected from the Giveaway entrants that selected the Lord Huron concert giveaway Page 5 of 15
shall be entitled to a prize of four (4) Box Seat tickets for the Lord Huron concert to be held at Stage AE on July 26, 2018. (ii) The second and third winners selected from the Giveaway entrants that selected the Lord Huron concert giveaway shall each be entitled to a prize of four (4) general admission tickets for the Lord Huron concert to be held at Stage AE on July 26, 2018. (iii) The fourth winner selected from the Giveaway entrants that selected the Lord Huron concert giveaway shall be entitled to a prize of two (2) general admission tickets for the Lord Huron concert to be held at Stage AE on July 26, 2018. (5) Flaming Lips Concert Giveaway: (i) The first winner selected from the Giveaway entrants that selected the Flaming Lips concert giveaway shall be entitled to a prize of four (4) Box Seat tickets for the Flaming Lips concert to be held at Stage AE on August 24, 2018. (ii) The second and third winners selected from the Giveaway entrants that selected the Flaming Lips concert giveaway shall each be entitled to a prize of four (4) general admission tickets for the Flaming Lips concert to be held at Stage AE on August 24, 2018. (iii) The fourth winner selected from the Giveaway entrants that selected the Flaming Lips concert giveaway shall be entitled to a prize of two (2) general admission tickets for the Flaming Lips concert to be held at Stage AE on August 24, 2018. Giveaway: Giveaway: (e) Pick Another Concert from Across the State (1) 3 Doors Down and Collective Soul Concert from the Giveaway entrants that selected the 3 Doors Down and Collective Soul concert giveaway shall each be entitled to a prize of four (4) tickets to the 3 Doors Down and Collective Soul concert to be held at the 2018 Clearfield County Fair on August 3, 2018. Giveaway entrants that selected the 3 Doors Down and Collective Soul concert giveaway shall be entitled to a prize of two (2) tickets to the 3 Doors Down and Collective Soul concert to be held at the 2018 Clearfield County Fair on August 3, 2018. (2) Jason Mraz Concert Giveaway: (i) The first through the fifth winners selected from the Giveaway entrants that selected the Jason Mraz Page 7 of 15
concert giveaway shall each be entitled to a prize of two (2) Steel Terrace tickets, including food and non-alcoholic beverages and one parking pass, for the Jason Mraz concert to be held at Bethlehem Musikfest on August 12, 2018. (ii) The sixth through the twelfth winners selected from the Giveaway entrants that selected the Jason Mraz concert giveaway shall each be entitled to a prize of four (4) Sands Steel Stage tickets for the Jason Mraz concert to be held at Bethlehem Musikfest on August 12, 2018. (iii) The thirteenth winner selected from the Giveaway entrants that selected the Jason Mraz concert giveaway shall be entitled to a prize of two (2) Sands Steel Stage tickets for the Jason Mraz concert to be held at Bethlehem Musikfest on August 12, 2018. (3) Breaking Benjamin Concert Giveaway: from the Giveaway entrants that selected the Breaking Benjamin concert giveaway shall each be entitled to a prize of four (4) tickets to the Breaking Benjamin concert to be held at the Pavilion at Montage Mountain on August 17, 2018. Giveaway entrants that selected the Breaking Benjamin concert giveaway shall be entitled to a prize of two (2) tickets to the Page 8 of 15
Breaking Benjamin concert to be held at the Pavilion at Montage Mountain on August 17, 2018. (4) Shinedown Concert Giveaway: from the Giveaway entrants that selected the Shinedown concert giveaway shall each be entitled to a prize of four (4) tickets to the Shinedown concert to be held at the Pavilion at Montage Mountain on August 31, 2018. Giveaway entrants that selected the Shinedown concert giveaway shall be entitled to a prize of two (2) tickets to the Shinedown concert to be held at the Pavilion at Montage Mountain on August 31, 2018. 3. Restrictions: (a) The odds of an entry being selected in a giveaway, described in section 2, depend upon the number of eligible entries received for that giveaway. (b) To be eligible to participate in a particular giveaway, entrants must have complied with the requirements of these rules. (c) The Lottery is not responsible for late, lost or misdirected entries not entered into the Giveaway. The Lottery is not responsible for entries that are not entered into the Page 9 of 15
Giveaway because of incompatible internet browsers or other technical issues. If a Giveaway entry is selected as a winner and is disqualified or otherwise rejected during or following the Drawing, the Lottery will select another entry to replace the disqualified or otherwise rejected entry in accordance with these rules and Lottery procedure. select the winners. (h) The Pennsylvania Lottery is the sole administrator of the Giveaway. Any other promotional partner, is not a sponsor of the Giveaway, and is in no way responsible for the administration of the Giveaway or the verification of winners. All inquiries regarding the Giveaway should be directed to the Pennsylvania Lottery. (i) The Pennsylvania Lottery reserves the right, in its sole discretion, to cancel or suspend the Giveaway, and change these rules if the Drawing cannot be conducted as planned due to errors in these rules or advertising, unauthorized intervention, tampering, fraud, technical errors, viruses, worms, bugs, or any other cause beyond the control of the Pennsylvania Lottery that, in the Pennsylvania Lottery s sole judgment, could corrupt or impair the administration, security, fairness, integrity, or proper conduct of the Giveaway drawings. (j) All entries shall be subject to verification by the Pennsylvania Lottery. (k) The Pennsylvania Lottery reserves the right, in its sole discretion, to disqualify an entrant found to be tampering with the operation of the Giveaway or the associated Drawing or to be acting in violation of these rules or applicable law. (l) The Giveaway is governed by the laws of the Commonwealth of Pennsylvania. Applicable laws and regulations apply. (m) The Giveaway winners will be responsible for all taxes arising from or in connection with any prize won. (n) Prizes are not transferrable. (o) Final determination of winners will be made by the Secretary, whose judgment will be final and binding. (p) All tickets are subject to program availability, venue capacity and age restrictions. In the event the winner is not available on the date of the game or event that is part of a prize awarded in the Giveaway, there will be no extensions or substitutions of prizes and the winner will not receive any reimbursement for the unused prize. (q) The event dates referenced in section 2 of these rules are subject to change at the discretion of the venue providing the prize. In the event that there is a change in the date or location of a prize described in these rules, the winner will be contacted by the Lottery as early as possible to communicate the change and provide details for prize fulfillment. If this should occur, the prize shall not be considered to be not available under subsection 3(r), below. Page 12 of 15
(r) In the event a prize described in these rules is not available, the Lottery may either provide a substitute prize, determined by the Secretary to have an equivalent value to the prize won, or make a cash payment to the winner, in an amount determined by the Secretary to have an equivalent value to the prize won. (s) Winners and/or guest(s) must abide by all venue policies. Any promotional partner reserves the right to revoke full or partial prize from any winner or winner s guest who it and/or venue personnel deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any venue policy or law, and/or may bring the promotional partner into disrepute. The Lottery and all other promotional partners are not responsible for injury, loss or damage to person or property in connection with the Giveaway. By accepting a prize, each winner agrees to release and hold harmless the Lottery, any other promotional partner, their respective affiliates and their respective directors, officers, employees, representatives and agents (collectively, Released Parties ) from any and all claims for damages or liability, including (without limitation) personal injury and/or death and property damage, arising in whole or in part, directly or indirectly, from: acceptance, possession, use, nonuse, or misuse of a prize; participation in Page 13 of 15
or travel to/from any Giveaway related activity; or participation in this Giveaway. Giveaway winners participate solely at their own risk and responsibility. Without limiting the foregoing, all prizes are provided as is without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow the limitations or exclusion of liability for incidental or consequential damages or exclusion of implied warranties. Check your local laws. (t) The winner is responsible for all costs, expenses and transportation, not specifically included in the prize won in the Giveaway, arising from or in connection with any prize won. (u) Giveaway prizes are not redeemable for cash. (v) Winners selected in the Drawing described in section 2 will be contacted via email by the Pennsylvania Lottery Winners Services. A list of winners will be posted to the Pennsylvania Lottery s website. (w) Winners selected in the Drawing described in section 2 will be required to pick up tickets on the day of the event at the venue s Will Call window. Winners will be required to pick up the tickets in-person and present valid photo ID. In Page 14 of 15
the event that any prize associated with the giveaways described in section 2 are to be fulfilled in any other manner, the Pennsylvania Lottery will communicate the method of fulfillment to the prize winner via email by the Pennsylvania Lottery Winners Services. (x) The identity or location of the seats associated with the ticket prizes described in Section 2 will be determined at the sole discretion of the venue providing the prize.
