Nashville Predators Foundation Chuck a Puck Nights Contest Presented by Nissan Official Rules (the Official Rules ) The Nashville Predators Foundation (the Administrator ) Chuck A Puck Nights Contest Presented by Nissan (the "Promotion") will be held on the following Nashville Predators game days: February 16, 2013, March 9, 2013, March 23, 2013, and April 6, 2013 (the Game Days ) at Bridgestone Arena (the Arena ). The entry period for the Promotion will be from the times the doors open on each Game Day until the end of the second intermission of each Game Day (the "Entry Periods"). Central Time shall control for all purposes of this Promotion. The Promotion is governed by these Official Rules, and is subject to all applicable U.S. federal, state and local laws. Void where prohibited by law. 1. Eligibility: The Promotion is open only to legal residents of the United States, void in Florida, New York, and Rhode Island (the Participant ). If Participant is aiming for the Grand Prize target and Participant is under 18, the Participant must have a parent or guardian with him/her at all times and if he/she should ultimately be deemed the Grand Prize Winner on April 23, 2013, that parent or guardian must accept the Grand Prize on his/her behalf. Any Participant aiming for the 2013 Nissan Pathfinder target must furnish a valid driver s license as required by the law in the Participant s jurisdiction of residence and any required insurance coverage. Current or former full-time and part-time employees, officers and representatives of the Administrator, the Nashville Hockey Club, LP d/b/a the Nashville Predators, Powers Management, LLC, Nissan North America, Inc., and their respective parent companies, subsidiaries, distributors, affiliates, vendors, advertising and promotion agencies and companies involved in the design, implementation and execution of the Promotion (collectively, the Promotion Entities ) are not eligible, as well as the immediate family and household members of each such employee/officer/dealer/representative are not eligible to receive the Grand Prize. "Immediate family members" shall mean parents, step-parents, children, stepchildren, siblings, step-siblings or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three months a year, whether related or not. In addition, current or former professional or semi-professional hockey players and coaches who have played or coached at that level anywhere in the world, current or former collegiate or junior collegiate hockey players and coaches who have played or coached at that level anywhere in the world within the past five (5) years, current or former high school hockey players and coaches who have played or coached at that level anywhere in the world within the past five (5) years, and current or former Olympic hockey players and coaches who have played or coached at that level anywhere in the word within the past five (5) years are ineligible for Grand Prize target, but may aim for the other four (4) targets. The Promotion is subject to all applicable federal, state
and local laws and regulations. Participation in the Promotion constitutes Participant s full and unconditional agreement to these Official Rules and Promotion Entities decisions, which are final and binding in all matters related to the Promotion. Winning the prize is contingent upon fulfilling all requirements set forth herein. 2. How to Enter: During the Entry Periods, Participant will be able to purchase a foam puck or foam pucks. One (1) puck will cost Five Dollars ($5) and a group of 5 (five) pucks will cost Twenty Dollars ($20). The pucks will be sold from the time the doors open on each Game Day until the end of the second intermission on each Game Day. After purchasing one (1) puck, the Participant will be handed a gold card; after purchasing a group of 5 (five) pucks, the Participant will be handed a blue card. Foam pucks will be available for purchase in the Ticket Sales area on the main concourse by the main doors; the Administrator s table located on the main concourse; the AT&T Fan Information Center; and the 300 level ticket table (the Designated Areas ), locations subject to change. The pucks will be sold for cash only at each of the Designated Areas, except the Administrator s table will also accept credit card payments. The Participant will be given instructions on how to pick up his/her foam puck(s). Each Participant must complete an entry form (the Entry Form ), providing his/her first and last name, phone number, and email address. Participant s entry into the Promotion will be complete upon purchasing puck(s) and completing the Entry Form. All purchased pucks must be thrown on Game Day in which they were purchased. Multiple purchases per Participant will be accepted. Proceeds will benefit the Monroe Carell, Jr. Children s Hospital at Vanderbilt via the Administrator. 3. Determination of Winner/Odds of Winning: Odds of winning depend on the number of pucks purchased. Starting with three (:03) minutes to go in the third period of each Game Day until ten (:10) minutes after the conclusion of each Game Day, Participant will go to one of the designated pick up locations, which are located on the concourse by the center ice sections of the lower level by Sections 105/106 and 115/116 (the Designated Pick Up Areas ), location subject to change. At either of the Designated Pick Up Areas, the Participant will present his/her blue or gold card(s) to receive his/her puck(s). Each puck will have a written number on the back of it. The Participant will also be given a card that has the same number(s) of his/her particular puck(s). Any pucks not picked up ten (:10) minutes after the conclusion of each Game Day will be disqualified from the Promotion and will not be given a refund. At the conclusion of each game on Game Day, the Participant will enter into a skills contest. The Participant will enter the lower level sections on either side of the Arena. At the designated time, approximately ten (:10) minutes after the conclusion of each game, Participant will toss his/her puck(s) onto the ice aiming for various targets. The Participant will be given one (1) minute to toss his/her puck(s) towards the various targets. Any puck(s) tossed after one (1) minute will not be eligible. There will be five (5) targets in total each Game Day. Whichever puck is closest to the bulls-eye for each target will win that prize. Administrator has the sole discretion to modify the start time of the Promotion on each Game Day and has the sole discretion to determine each winner. The Promotion will take place at Bridgestone Arena at 501 Broadway, Nashville, TN, 37203.
4. Winner Notification: There will be five (5) winners in total each Game Day (each a Winner ). The Winners will be notified at the conclusion of the Promotion on each Game Day. The PA announcer will announce the winning numbers along with the designated corresponding prizes. Each Winner must bring his/her numbered card to redeem his/her prize at the AT&T Fan Information Center. The Winners will be determined in the sole discretion of the Administrator. All Winners must comply with all terms and conditions of these Official Rules, and all winnings are contingent upon fulfilling all requirements. Except where prohibited by law, the Promotion Entities will require all Winners to sign and return to the Administrator an affidavit of Eligibility, Liability and Publicity Release (the Affidavit ), as well as fulfill any such other requirements as determined by the Promotion Entities in order to compete in the Promotion or to claim their prizes. In the event: (a) of noncompliance with the above or within any of the aforesaid time periods, (b) a Winner is found to be ineligible to enter the Promotion or receive a prize, (c) a Winner cannot or does not comply with the Official Rules, or (d) a Winner fails to fulfill the Release and/or Affidavit-related obligations, the Winner shall be disqualified from the Promotion. Upon disqualification, no compensation shall be given. In the event that a Winner is disqualified for any reason, the Administrator will select another valid Winner in accordance with Section 3 above. The parties obligations under any section of the Official Rules shall survive the termination of these Official Rules or disqualification of Participant for any reason. 5. PRIZES: Each of the 5 (five) targets will have different prizes. Four of the targets will have secret prizes that will vary each Game Night, at the Administrator s sole discretion (the Secret Predators and Bridgestone Arena Prizes ). Examples of the Secret Predators and Bridgestone Arena Prizes include a Team Autographed Nashville Predators Jersey, a Suite night for sixteen (16) people, two (2) 501 Club tickets for Pink, and $100 Amerigo s gift card (ARV: between One Hundred Dollars ($100) and Three Thousand Seven Hundred Twenty Dollars ($3,720)). The fifth target will be for a chance to win a 2013 Nissan Pathfinder (the Grand Prize ). If a Participant aims for this fifth target, if his/her puck is the Winner that Game Day, he/she will qualify as a finalist ( Finalist ) for a chance to shoot a puck at the April 23, 2013 Nashville Predators Game ( Fan Appreciation Day Game ) for a chance to win the Grand Prize and become the Grand Prize winner (the Grand Prize Winner ). If Finalist is under 18, Finalist must have a parent or guardian with him/her at all times and if Finalist should ultimately be deemed the Grand Prize Winner on April 23, 2013, that parent or guardian must accept the Grand Prize on the Grand Prize Winner s behalf. The Finalist from each Game Day will receive four (4) complimentary tickets to the April 23, 2013 Fan Appreciation Day Game. The Finalists must give their contact information to the Administrator on the Game Day to be eligible to compete for the Grand Prize on April 23, 2013. Each of the four (4) Finalists may make a single attempt to shoot one (1) puck through the hole to win the Grand Prize. The Administrator will randomly select the order in which the Finalists will shoot. Should one (1) of the Finalists make his/her puck through the hole, that Finalist will be the Grand Prize Winner and the Promotion will be deemed over, even if all four (4) Finalists did not have a chance to shoot. To win, the puck must go completely through the hole in the board. In order to qualify for the Grand Prize, the Finalist must successfully shoot a regulation hockey puck using a regulation hockey stick completely through a target opening measuring a
maximum of one and one half (1.5) inches in height and three and one half (3.5) inches in width, completely over the goal line and successfully make a shot from behind the red line (minimum eighty nine (89) feet). Finalist may only make one (1) shot and any attempt will count as a shot. The Finalist must stand on the ice, may not stand on any form of artificial surface (carpet, rubber flooring, etc.), and may do nothing to change the surface of the ice (grooving, brushing, etc.) in order to enhance the chances of scoring a goal. No part of the Finalist s body or clothing may come in contact with the demarcation lines or the red line prior to shooting the puck. Any such contact shall constitute a foul and the shot shall be considered missed. In addition, the Finalist is not allowed any practice, warm-up, or qualifying shots at any time after the notification of participation in this contest until the actual Grand Prize attempt. ADMINISTRATOR RESERVES THE RIGHT TO AMEND THE RULES FOR THE GRAND PRIZE UP TO APRIL 23, 2013. One of the four (4) Finalists may be deemed the Grand Prize Winner and awarded the Grand Prize (ARV: Thirty Nine Thousand Dollars ($39,000.00)). The Grand Prize Winner is responsible for vehicle registration, license, all taxes, title, and insurance fees in his/her state of residence, for all costs associated with any available upgrade/option not provided with vehicle, and any other expenses related to the acceptance and use of the vehicle not specified herein. The Grand Prize Winner will receive detailed instructions of how to claim the vehicle at the conclusion of the Promotion. The Grand Prize Winner must provide valid U.S. driver's license, evidence of insurance in his/her state of residence, and provide payment for any costs/fees as detailed herein prior to pick up. Vehicle awarded may differ from any vehicle shown in any promotional materials. The Grand Prize Winner may not substitute, assign or transfer Grand Prize, but Promotion Entities reserve the right, at their sole discretion, to substitute a prize with one of comparable or greater value. The Grand Prize is awarded as is with no warranty or guarantee, either express or implied by Promotion Entities. All expenses and costs related to acceptance and use of the Grand Prize not expressly listed above, are entirely the Grand Prize Winner s responsibility. By entering, the Grand Prize Winner acknowledges that operating a vehicle can be a dangerous activity and agrees to accept all risk and responsibility associated with operating the vehicle. The Secret Predators and Bridgestone Arena Prizes and the Grand Prize are nontransferable and must be utilized by the Winners selected at the sole discretion of the Administrator. No prize substitutions except by Promotion Entities in their sole discretion if advertised prize is unavailable for any reason (in which case the Winners will receive an alternate prize of equal value). The Secret Predators and Bridgestone Arena Prizes and the Grand Prize are not redeemable/exchangeable by the Winners for cash or credit. Any portion of the Secret Predators and Bridgestone Arena Prizes and Grand Prize not accepted by the Winners will be forfeited. The Winners will be responsible for all applicable taxes in his/her state of residence and state of pickup (not limited to federal, state, local and/or income) on the Secret Predators and Bridgestone Arena Prizes and Grand Prize and will be required to provide his/her Social Security number or tax ID for tax reporting purposes. Administrator will file where required an IRS Form 1099 with the Internal Revenue Service for the fair market value of the Secret Predators and Bridgestone Arena Prizes and Grand Prize. The Winners and/or any person using the Secret Predators and Bridgestone Arena Prizes and the Grand Prize agree that the Secret Predators and Bridgestone Arena
Prizes and Grand Prize will not be sold nor in any other manner be used in direct promotion of any business. Promotion Entities will not provide any money for any expenses incurred as a result of participating in the Promotion or claiming or using any prize, including but not limited to transportation and other incidental expenses incurred while claiming or using the Secret Predators and Bridgestone Arena Prizes and Grand Prize (except as otherwise expressly indicated in these Official Rules). All taxes, title, registration or other fees on the Secret Predators and Bridgestone Arena Prizes and Grand Prize are the Winners sole responsibility. All entries become the property of the Administrator and will not be acknowledged or returned. Entries, and all contestant information contained therein, will be shared by Promotion Entities and may be used by one or more parties for marketing purposes. 6. Publicity; Use of Personal Information: Except where prohibited or restricted by law, the Winners acceptance of any prize constitutes the Winners agreement and consent for Promotion Entities to use and/or publish Winners full names, cities and states of residence, photographs or other likenesses, Entry, pictures, portraits, voice, testimonials, biographical information (in whole or in part), and/or statements made by Winners regarding the Promotion or Administrator, worldwide and in perpetuity for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Administrator, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval. 7. No Tampering; Right to Cancel, Modify: Promotion Entities and their parent, subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors shall not have any obligation or responsibility, including any responsibility to award any prizes to Participants, with regard to: (a) Entries that contain inaccurate information or do not comply with or violate the Official Rules; (b) Entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) Participants who have committed fraud or deception in entering or participating in the Promotion or claiming the prizes; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the Winner to accept the prizes for any reason; (f) if the prizes cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Administrator's reasonable control; or (g) any damages, injuries or losses of any kind caused by prizes or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this Promotion or any promotion or prize related activities. Promotion Entities reserves the right, in their sole discretion, to disqualify any individual it finds to be (a) tampering with the entry process or the operation of the Promotion, or with any Website promoting the Promotion; (b) acting in violation of the Official Rules; or (c) entering or attempting to enter the Promotion multiple times through the use of multiple Entry Forms. If Administrator determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Promotion, Administrator reserves the right to void the Entries at issue, and/or terminate the relevant portion of the Promotion, including the entire Promotion,
and/or modify the Promotion and/or conduct a random drawing to award prizes using all eligible Entries received as of the termination date. The Promotion Entities failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 8. Release of Liabilities; Disclaimer of Warranty; Forum Selection Clause: By participating in the Promotion, Participant agrees to release and hold harmless Promotion Entities and any promotional partners, each of their parents, subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively the "Released Parties"), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever, including without limitation, property damage, personal injury (including emotional distress), and/or death, which may occur in connection with preparation for, or participation in, the Promotion, or possession, acceptance and/or use or misuse of the prizes or participation in any Promotion-related or prize-related activity and for any claims or causes of action based on publicity rights, defamation or invasion of privacy and merchandise delivery. The Released Parties assume no responsibility for any injury or damage to Participant s or to any other person's computer, regardless of how caused, relating to or resulting from entering or downloading materials or software in connection with this Promotion. Participant acknowledges that Promotion Entities have neither made nor are in any manner responsible or liable for any warranty, representations or guarantees, express or implied, in fact or in law, relative to prize or any component thereof, including, but not limited to, express warranties provided by the supplier of the prizes (or any component thereof) or their affiliates. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Participant or Promotion Entities in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Tennessee, without giving effect to any choice of law or conflict of law rules (whether of the State of Tennessee, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Tennessee. In addition, any dispute relating to the Promotion (including these Official Rules) shall be brought in the appropriate state or federal court having jurisdiction over the subject matter located in Davidson County, State of Tennessee. Participant hereby irrevocably consents to the personal jurisdiction of said courts and waives any claim of forum non conveniens or lack of personal jurisdiction that they may have. Participant further agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Promotion shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys' fees; and (iii) under no circumstances will Participant be permitted to obtain awards for and Participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. 9.
