The following terms and conditions ("Terms and Conditions") apply to all Melbourne Stars 'Stars Clubs' ("Stars Club(s)"). To become a Stars Club, please refer to the Membership Terms and Conditions available here: www.melbournestars.com.au/starsclub. In order to obtain the benefits of membership or enter into any Stars Club promotions (as set out in these Terms and Conditions) a cricket club (Club) (such Club being affiliated with Cricket Victoria or playing within a competition affiliated or sanctioned by Cricket Victoria) must be registered as a Stars Club. 2. The Promoter is Melbourne Stars Ltd (ABN 28 152 852 278) of 86 Jolimont Street, East Melbourne, Victoria 3002 (Telephone 1300 MELB STARS or 1300 6352 78277) (Stars). 3. Information on how to become a Stars Club and details of available prizes available as part of the Stars Club program ("Stars Club Program") form part of these Terms and Conditions. 4. Any entry to a promotion not completed in accordance with these Terms and Conditions are void. Entry to a promotion will be deemed void if stolen, forged, mutilated or tampered with in any way. 5. The details of all Stars Clubs that win prizes will be published on the Melbourne Stars website (www.melbournestars.com.au) for a period of no less than 28 days. ELIGIBILITY - REGISTRATION AS A STARS CLUB 6. To be eligible to receive any benefits or enter any promotions detailed in these Terms and Conditions, a Club must be registered as a Stars Club. Benefits and Promotions for Clubs 8. All Clubs will be eligible to win the following prizes through the Stars Club program: Prize Qty How to Win Value $10,000 Cash Major Prize ) (the 1 All Clubs who sign up over 20 Melbourne Stars members through the Club Portal by 11.59pm by Tuesday 9 th January 2018 will be eligible to win the single Major Prize. All registered Stars Clubs will be prompted via email to respond to a question in 50 words or less in the month of November 2017 (50 Words or Less Entry). Clubs will have until 11.59pm on Tuesday 9 th January 2018 to submit a response following the process outlined in the prompting email. $10,000 Each valid entry for the Major Prize will have their 50 Words or Less Entry individually judged according to its merits on the basis of skill, creativity and originality as determined in the complete discretion of the Stars. Judging by the Stars will occur and the winner notified on Thursday 11th January 2018. Subject to these Terms and Conditions, the sole winning Club will be presented with the Major Prize $10,000 cheque on Tuesday 16 th January 2018. $1,000 2 All Clubs who are registered as a Stars Club prior to 30 th October 2017 are in the running to be one of two Stars Clubs to win $1,000 cash. The two winning clubs will be selected at random. This prize will be presented to the winning clubs on Thursday 24 th November 2017. $1,000 each The award for these prizes is a game of chance and both prizes are drawn from all registered Stars Clubs at random. All Stars Clubs who are registered as a Stars Club prior to 30 th October 2017 will have an equal and random chance of being drawn. The draw of the winners for each of the two prizes will take place at 10.00am on Thursday 16 th November 2017 at the Promoter s offices. The winners will be notified in writing on Thursday 16 th November 2017. Clubs will be invited to attend the match at their own cost (including match ticket costs) on Tuesday 16 th January 2018, where their club s name will be displayed on vision screen for the prize. $1,000 3 The three Stars Clubs that sign up the most Melbourne Stars members through the Club Portal by 11:59pm on Tuesday 9 th January 2018 will be awarded $1,000 cash. $1,000 each The three winning Clubs will be notified on Thursday 11 th January 2018 and will be presented with the prize at the Stars match on Tuesday 16 th January 2018.
Framed Signed BBL 07 Jersey 3 Three clubs will be drawn at random and awarded a Framed Signed BBL Jersey. The jerseys will be a mix of various designs and from various BBL seasons, selected at the entire discretion of the Stars. Each jersey will be awarded at random. The award for these prizes is a game of chance and all three prizes are drawn from all registered Stars Clubs at random. All registered Stars Clubs will have an equal and random chance of being drawn. The draw of the winners for each of the three Framed Signed BBL BBL 06 Jersey's will take place at 10:00am on Wednesday 10 th January 2018 at the Promoter's offices. The winners will be notified in writing on Thursday 11 th January 2018. Clubs will be invited to attend the match at their own cost (including match ticket costs) on Tuesday 16 th January 2018, where their club s name will be displayed on vision screen for the prize. $1,200 each Stars Signed Bat or Team Print Every Club that signs up 20 Stars members through the Club Portal will receive either a signed Melbourne Stars bat or a signed Team Print, determined at the absolute discretion of the Stars. The bats or prints may be from various BBL seasons. N/A Stars Away Game Live Sites 9. This year the Stars want to cheer on the team for their away games at YOUR Club! Three Stars Clubs will be awarded a prize to be a host for a Stars away game live site (for away games scheduled to be held on 20 th December 2017, 9 th January 2018, 12 th January 2018). The Promoter will bring in a large LED screen to watch the relelvant BBL match, as well as some the giveaways sleected by the Stars at its absolute discretion, Starman and some agreed activities. The winning Str Clubs can get their members, participants and their families to come along to a great evening at their club! The Away Game Live Site prize is valued at $10,000. The Total Prize Pool for the Away Game Live Sites promotions is $30,000.00. 10. In order to be eligible to win, Clubs will need to complete their submission via a wufoo form http://www.melbournestars.com.au/livesites. Entries must be submitted by 5:00pm on Sunday 12 th November 2017. 11. In order to to eligible to win, a Club must submit the wufoo form and provide responses to the following questions: a. What is the expected attendance at the Club s Live Site? b. What is your club currently doing to support the growth of the game? c. How will you work with local council and existing community groups to promote this event? d. How will you use this event to raise money for your club? (note that as a condition to receiving the prize, Clubs can not charge any entry fee to attend this event, but will be permitted to host a barbeque and use their club bar to sell food/beverages).
12. Each valid entry for the Away Game Live Site prize will have their responses judged by the Promoter according to its merits on the basis of skill, creativity and originality as determined in the complete discretion of the Promoter. Winning Clubs will be notified on Thursday 16 th November 2017. Benefits for Senior Cricketers Training Session 13. Two Stars Clubs will be selected by the Promoter at random to have two coaches selected by the Stars to attend the Club s training session on Tuesday 5 th December, 2017. The Coaches will provide the Club and participants with insights and training tips. The winning Clubs will be drawn at random by the Promoter through photos posted by Clubs to social media sites determined by the Promotoer using the hashtag details provided by the Promoter on the relelvant poster. It is expected that the Stars Club will have all necessary equipment and the training session preplanned, and the coaches will add to the existing training session format. This date cannot change. 14. All registered Stars Clubs who post the photos to the determined social media sites using the hashtags #TeamGreen & #StarsClub details will have an equal and random chance of being drawn. The draw of the winners will take place at 10.00am on Monday 27 th November 2017 at the Promoter's offices. The winners will be notified in writing on Monday 27 th November 2017. Benefits for Junior Cricketers Walk with the Stars 15. Stars Clubs with a junior premiership team (U12 U14) from the previous season (2016/2017) will be invited to attend a lap of honour on the MCG on Tuesday 16 th January 2018. 16. Eligible clubs will need to complete a wufoo form with their details and confirmation of the premiership. All submissions must be completed by Sunday 19 th November 2017. Eligible Clubs will be contacted by Friday 1st December 2017 with information about all relevant arrangements and details about their tickets. Participants will need to comply with all instructions issued by the Stars and sign or have signed all documentation required by the Stars and any relevant venue manager or owner. Training Visits - Fan Engagement Officers 17. Stars Clubs will be permitted to request that a Stars Fan Engagement Officer (FEO) attends one of the Club s U12 training sessions during the season. If they are able to attend, the FEOs will provide giveaways, they will endeavour to bring the Stars mascot and they will bring an inflatable bowling tunnel or other selected equipment for participants to use before or after training. 18. Clubs must submit an email to starsclubs@melbournestars.com.au in order to request an FEO visit. No request is guaranteed to be fulfilled and visits will be entirely dependent on availability and the FEO s schedule. Clubs will be notified if their request has been successful or not and the requirements for the visit. Benefits for Entry Level Programs Next Gen Nominees 19. Melbourne Stars FEOs will be selecting 22 participants from MILO T20 Blast Centres in the Stars region. Selected participants will be required to have their parents fill in their contact details via a wufoo form. FEOs will be selecting winners from October 1 st 2017 t. Winners will be invited to appear in the Next Gen activation at the MCG on Saturday 27 th January 2018. Participants will need to comply with all instructions issued by the Stars and sign or have signed all documentation required by the Stars and any relevant venue manager or owner.
20. All winners will be selected at random. Winners will be placed by the Stars in an activity during either the relevant WBBL or BBL match on the relevant day. Next Gen at Match 21. All Next Gen participants for Stars Matches will be selected from Stars Clubs. JUDGING 22. Where a promotion or benefit referred to in these Terms and Conditions is conducted as a game of skill, chance plays no part in determining the winner. 23. Where a promotion or benefit referred to in these Terms and Conditions is conducted as a game of chance or is referred to as a random selection: a. all prizes/winners are drawn at random, and all entrants/participants have an equal and random chance of being drawn; b. the Promoter will keep records for three years after the completion of the Competition, which provide: i. an accurate financial accounting of the Competition and all entries; and ii. an accurate reporting of the distribution of the prizes/benefitd. 24. For the avoidance of doubt, and unless otherwise specified, winners will be advised in writing usually within 48 hours of any prize being judged/awarded. 25. The Promoter's decision on the winners of the Promotion is final and no correspondence will be entered into in relation to that decision. STARS CLUB PROMOTIONS TERMS AND CONDITIONS 26. Registration as a Stars Club, and subsequent entry into any promotion conducted under the Stars Club Program or described in these Terms and Conditions, is deemed acceptance of these Terms and Conditions and the Stars Club Membership Terms and Conditions. Subject to any applicable laws, these Terms and Conditions may be updated by the Stars at any time and no notice of the updated Terms and Conditions is required to be provided to Stars Clubs or any other persons. 27. No responsibility will be taken for lost, late or misdirected entries. Errors and omissions in the registration for a promotion may be accepted at the Star s absolute discretion. Failure by the Stars to enforce any of its rights at any stage does not constitute a waiver of those rights. 28. Incomplete, indecipherable, illegible, inaccurate or illegal entries or those which contain offensive or defamatory comments or which breach any law or infringe any third party rights, including intellectual property rights, will be deemed invalid. 29. For the avoidance of doubt, only Victorian cricket clubs that are affiliated with Cricket Victoria are eligible to be registered as Stars Clubs. Cricket clubs from other states and territories or Victorian cricket clubs that are not affiliated with Cricket Victoria are ineligible to be registered as Stars Clubs. 30. Employees of the Melbourne Stars and agencies associated with any promotion contained in these Terms and Conditions, and their respective immediate families, are ineligible to enter into any of those promotions. 31. The Stars reserve the right, at any time, to verify the validity of a Club's ongoing registration as a Stars Club or entry into any promotion contained in these Terms and Conditions (including but not
limited to a Club s identity and place of residence) and disqualify any Club who submits a registration or entry that is not in accordance with these Terms and Conditions. 32. The Stars reserves the right to extend any registration period for any promotion set out in these Terms and Conditions in its absolute discretion and subject to any relevant legislation. 33. Except for a cash prize referred to in paragraph 8, prizes are not transferrable, exchangeable or redeemable for cash. Prize values are in Australian dollars exclusive of GST and are based on the recommended retail value of prize components at the time of printing. The Promoter accepts no responsibility for any variation in the value of any prize. 34. To the extent permitted by law: (a) the Promoter makes no representations or warranties as to the suitability of any prize or benefit received as a result of winning any competition; and (b) no compensation will be payable if, for any reason, a winner is unable to use the prize or winning activity as stated. 35. It is a condition of accepting the prizes/benefits that the winners must comply with all the conditions of use of the prize/benefit and prize/benefit supplier's requirements. 36. The Stars will advise any Stars Club who wins a prize/benefit as part of the Stars Club Program about how and when they are to accept their prize(s) /benefit(s). If for any reason the winners decide not to accept their prizes/benefits at the time stipulated by the Stars, the prize/benefit will be forfeited. 37. If a prize/benefit is unavailable, for any reason, the Stars, in its absolute discretion, reserves the right to substitute the prize/benefit with a prize/benefit of a nature to be determined by the Stars in its absolute discretion. 38. Prizes/benefits, or any unused portion of a prize/benefit, awarded as part of the Stars Club Program are not transferable or exchangeable. 39. If a winner of a prize/benefit is not readily identifiable, and the Promoter has made reasonable efforts to identify the winner of the prize/benefit but was unsuccessful, the Promoter may draw an additional prize/benefit winner. 40. The Star's decision in relation to any aspect of any promotion relating to the Stars Club Program is final and binding on every Club who enters any promotion and no correspondence will be entered into. 41. Clubs consent to the Stars using the Club's (and their participants, members or those otherwise associated with the Club or the relelvant prize or benefit) name, likeness, image and/or voice (including photograph, film and/or recording of the same) in relation to their participation as a Stars Club, in any manner whatsoever, including but not limited to if they are a winner of a prize/benefit under any promotion as part of the Stars Club Program, in any media for an unlimited period without remuneration for the purpose of promoting the Stars Club Program (including any outcome), and promoting any products or materials manufactured, distributed and/or supplied by the Promoter. 42. If any promotion under the Stars Club Program is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Stars, the Stars reserves the right, in its sole discretion, to the fullest extent permitted by law: a. To disqualify any Club; or b. To modify, suspend, terminate or cancel the Stars Club Program, as appropriate. 43. Except for any liability that cannot be excluded by law, the Stars (including its directors, officers, employees and agents) excludes all liability (including negligence), for any personal injury suffered or sustained in connection with any promotion or benefit under the Stars Club Program or prizes awarded as part of any promotion under the Stars Club Program; or any loss or damage
(including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of any activity related to the Stars Club Program, including, but not limited to, where arising out of the following: a. any technical difficulties or equipment malfunction (whether or not under the Star's control); b. any theft, unauthorised access or third party interference; c. any registration or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Stars) due to any reason beyond the reasonable control of the Stars; d. any variation in prize value to that stated in these Terms and Conditions; e. any tax liability incurred by a winner or entrant; f. participation in any benefit listed under these Terms and Conditions; or g. use of the prize. 44. As a condition of accepting a prize/benefit as part of any promotion under the Stars Club Program, a winning Stars Club and/or participants from that Stars Club may be required to sign legal documentation as and in the form required by the Stars and/or prize/benefit suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 45. The Stars collects personal information in order to manage the Stars Club Program and the associated promotions conducted under it, and entry into any promotion is conditional on the provision of this information by a Club. Information about a Club (and its participants, members or those otherwise associated with the Club or the relelvant prize or benefit) may also be used by the Stars and may be disclosed and used by third parties, including but not limited to agents, contractors, service providers, prize/benefit suppliers, commercial partners and related companies for the purposes of carrying out promotional, marketing, planning, product development, publicity, research and profiling purposes, including sending electronic messages, direct mail and telephoning the Club (and its participants, members or those otherwise associated with the Club or the relelvant prize or benefit), unless the Club (and its participants, members or those otherwise associated with the Club or the relelvant prize or benefit, as the case may be) withdraws consent to the use of their information in this manner. The Club (and its participants, members or those otherwise associated with the Club or the relelvant prize or benefit) should direct any request to access, update, withdraw, correct information, or request not to receive information about future promotions or further correspondence by emailing the Stars at info@melbournestars.com.au. 46. All personal information will be collected, used and disclosed in accordance with the Stars Privacy Policy which can be found at www.melbournestars.com.au.
