ORDINANCE NO. SB-3131 AN ORDINANCE MAKING FINDINGS AND ESTABLISHING A STAR BOND PROJECT DISTRICT WITHIN THE CITY OF OVERLAND PARK, KANSAS PURSUANT TO K.S.A. 12-17,160 ET SEQ., AS AMENDED (BLUHAWK STAR BOND PROJECT). WHEREAS, pursuant to K.S.A. 12-17,160 et seq., as amended (the STAR Bonds Financing Act ), the City of Overland Park, Kansas (the City ), is authorized to assist in the development and redevelopment of eligible areas within and without the City in order to promote, stimulate and develop the general and economic welfare of the State of Kansas and its communities; and WHEREAS, pursuant to the STAR Bonds Financing Act, the Governing Body of the City adopted Resolution No. 4227 (the Resolution ) on May 16, 2016, finding and determining that it is desirable to encourage the development and redevelopment of certain real property within the City located in the general vicinity of the southwest corner of 159 th Street and U.S. Highway 69 in the City and to consider the establishment of a STAR bond project district at such location (the STAR Bond Project District as further described herein); and WHEREAS, the Resolution provided for a notice of a public hearing considering the establishment of the STAR Bond Project District to be given in accordance with the STAR Bonds Financing Act and that said public hearing would be held on June 20, 2016; and WHEREAS, notice of the public hearing was duly given in accordance with the STAR Bonds Financing Act; and WHEREAS, on June 20, 2016, the Governing Body of the City conducted a public hearing, which hearing was continued on July 11, 2016, August 1, 2016 and August 15, 2016, on the proposed STAR Bond Project District; and WHEREAS, the Kansas Secretary of Commerce has determined that the proposed STAR Bond Project District is an eligible area in that it is a major commercial entertainment and tourism area, as such terms are defined in the STAR Bonds Financing Act, in accordance with the requirements of the STAR Bonds Financing Act; and WHEREAS, the proposed STAR Bond Project District does not include any real property which has been a part of another STAR bond project district established under the STAR Bond Financing Act; NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OVERLAND PARK, KANSAS AS FOLLOWS: Section 1. The STAR Bond Project District is within the boundaries identified by the Resolution and published in the notice of the public hearing. The legal description and map delineating the STAR Bond Project District are set forth in Exhibits A and B of APPENDIX 1 attached hereto and incorporated herein by reference.

Section 2. The Governing Body of the City hereby finds and determines that the STAR Bond Project District proposed to be developed is a STAR bond project as defined in K.S.A. 12-17,162 and amendments thereto. Section 3. The STAR bond project district plan for the STAR Bond Project District which is a preliminary plan that identifies all of the proposed STAR bond project areas and identifies in a general manner all of the buildings and facilities in each STAR bond project area that are proposed to be constructed or improved is attached hereto as Appendix 1 and incorporated herein by reference. Section 4. The Governing Body of the City hereby establishes the STAR Bond Project District in compliance with the STAR Bond Financing Act. Section 5. The STAR Bond Project District may be terminated by the Governing Body at any time by passage and publication of an ordinance; provided that following the execution and delivery of a redevelopment agreement or agreements by the City entered into between the City and an entity or entities with rights to develop property within the STAR Bond Project District, the termination of the STAR Bond Project District may be limited by the terms and conditions of such agreement or agreements. Section 6. This Ordinance shall take effect and be in full force from and after its passage by the Governing Body of the City and publication in an official City newspaper. APPENDIX 1 STAR BOND PROJECT DISTRICT PLAN This STAR Bond district plan (the District Plan ) consists of the buildings, facilities and improvements proposed to be constructed or improved in each of the following proposed STAR bond project areas and generally described as follows: The District shall consist of four (4) project areas (each a Project Area ), which are planned to be located in the following general areas and include Project Area 1 (east of the western boundary of Antioch, south of the northern boundary of 159 th Street, west of the U.S. 69 Highway right-of-way, north (and inclusive of a portion) of Hospital Drive North and 165 th Street, in the northwestern/northeastern/southern/central portion of District): Up to approximately thirty-one (31) buildings to be utilized for a mixture of uses, including retail, office, hotel, financial services, or residential; Museum / retail building; Multi-sport athletic facility and entertainment venue; Structured and surface parking, street, drive and other infrastructure improvements; Off-site / public right-of-way improvements; and Stream corridor improvements / open space amenities. Project Area 2 (west (and inclusive of a portion) of the U.S. 69 Highway right-of-way, in the southeastern portion of District): Up to approximately five (5) buildings to be utilized for a mixture of uses, including retail, office, hotel, financial services, or residential, along with the construction of street, drive, right-of-way, parking and other infrastructure improvements. Project Area 3 (a portion of the north-central area of the District, south of 159 th Street, west of Lowell Avenue and surrounded by Project Area 1): Up to approximately five (5) buildings to be utilized for a mixture of uses, including retail, office, hotel, financial services, or residential, along with the construction of street, drive, right-of-way, parking and other infrastructure improvements. Project Area 4 (a portion of the southeastern area of the District located in the northeast and southeast corners of Lowell Avenue and 162 nd Street and surrounded by Project Area 1): Up to approximately eight (8) buildings to be utilized for a mixture of uses, including retail, office, hotel, financial services, or residential, along with the construction of street, drive, right-of-way, parking and other infrastructure improvements.
