5 CITY OF HUGHSON AGENDA ITEM NO. 2.1 SECTION 2: PRESENTATIONS Meeting Date: April 8, 2019 Subject: Proclaim April 7-13, 2019 as National Library Week Presented By: Ashton Gose, Management Analyst Approved By: Staff Recommendation Proclaim April 7-13, 2019 as National Library Week. Background and Overview: The mission of the Stanislaus County Library is to foster the love of reading and open the door to knowledge. To spread the word on the importance of libraries, every April the Stanislaus County Library requests a Proclamation from the City of Hughson and the seven other cities in Stanislaus County, declaring a National Library Week. This year it will take place April 7-13, Ms. Heather Bailey, Hughson Library Branch Manager, will be present to accept the Proclamation from the City of Hughson. Fiscal Impact: There is not fiscal impact associated with this item.

6 PROCLAMATION NATIONAL LIBRARY WEEK - APRIL 7-13, 2019 WHEREAS, reading and literacy and the freedom to explore are cornerstones of a free and democratic society; and, WHEREAS, libraries support democracy through their commitment to providing equitable access to information for all library users regardless of race, ethnicity, creed, ability, sexual orientation, or socio-economic status; and, WHEREAS, literacy is key to achieving personal success in school, in business and in life; and, WHEREAS, libraries and librarians open a world of possibilities through innovative programming and through the power of information; and, WHEREAS, librarians are trained, tech-savvy professionals, providing training in and access to technologies; and, WHEREAS, libraries offer 24/7 access to library services through online resources such as ebooks, emagazines, downloadable audiobooks, music, and movies, online language instruction, and research databases; and, WHEREAS, libraries partner with parents and caregivers to empower children to enter Kindergarten with the knowledge and skills necessary for success in school and beyond; and, WHEREAS, libraries continually grow and evolve in how they provide for the needs of every member of their communities; and, WHEREAS, libraries, librarians, library workers, volunteers and supporters in Stanislaus County are celebrating National Library Week. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Hughson does hereby unanimously proclaim April 7-13, 2019, National Library Week in Stanislaus County and urges everyone to visit their local library to take advantage of the wonderful resources available, provided through the voter-approved 1/8-cent sales tax dedicated to the support of libraries. 11 City Council Minutes March 25, 2019 Director of Community Development: Director Simvoulakis informed the City Council about the Annual CDBG Community Meeting that was held on March 25, Police Services: Chief Seymour provided the City Council with the latest Crime Statistic Report. Student Representative: Student Representative Kerr informed the City Council that the high school prom with be held on April 5, He also informed the Council that Hughson High School s Academic Decathlon Team won the California State Academic Decathlon. 8.2: Council Comments: (Information Only No Action) Councilmember Bawanan attended several Chamber of Commerce Board Meetings since the last City Council Meeting. He provided a reminder of upcoming Hughson Fruit and Nut Festival Planning Meetings on March 26, April 9 and April 18, He attended the Knights of Columbus Annual Corned Beef and Cabbage Event on March 17, He also attended a Budget and Finance Subcommittee Meeting on March 18, Councilmember Hill attended a City/Fire 2+2 Committee Meeting on March 13, He attended a League of California Cities Meeting on March 21, 2019, and a Hughson Economic Development Committee Meeting on March 25, Councilmember Fontana attended a Hughson Economic Development Meeting on March 25, He will be attending a Hughson Sports and Fitness Complex Committee Meeting on March 27, 2019 and a workday for the Hughson Sports and Fitness Complex on March 30, Mayor Pro Tem Carr attended a Hughson Economic Development Meeting on March 25, He attended a City/Fire 2+2 Committee Meeting on March 13, He also recently attended a Sierra Vista Child and Family Services Board Meeting. 8.3: Mayor s Comments: (Information Only No Action) 9. 20 CITY OF HUGHSON AGENDA ITEM NO. 3.3 SECTION 3: CONSENT CALENDAR Meeting Date: April 8, 2019 Subject: Approval of the Request by the Hughson Chamber of Commerce to Have and Sell Alcohol at the 2019 Hughson Fruit and Nut Festival Event. Presented By: Raul Mendez, City Manager Approved: Staff Recommendation: Approve the request by the Hughson Chamber of Commerce to have and sell alcohol at the 2019 Hughson Fruit and Nut Festival event. Background: Section of the Municipal Code (Drinking and possession Public areas) states that It is unlawful for any person to drink any alcoholic beverage or to possess any can, bottle or other receptacle containing any alcoholic beverage which has been opened, or a seal broken, or the contents of which have been partially removed, on any public sidewalk, alley, street or highway, or in any cityowned park or other city-owned public place, unless the consumption of alcoholic beverages in such public place or places has been authorized by the city council. This section shall not be deemed to make punishable any such act or acts which are prohibited by the California Vehicle Code or by any other law of the state. (Ord , 1986). The Hughson Chamber of Commerce has requested that the City Council authorize the selling and serving of alcohol at the upcoming Hughson Fruit and Nut Festival scheduled Saturday, April 27, 2019 from 10a.m 6p.m and Sunday, April 28, 2019 from 10a.m 5p.m. For the last few years, the Hughson Chamber of Commerce Board of Directors has hosted the Barrel Room during the event. The Hughson Chamber of Commerce provides for the sale of cider and beer options for festival goers in a controlled enclosed area adjacent to the entertainment main stage. The Chamber works with the City of Hughson and Hughson Police Services to ensure adequate private security and safety measures are in place to provide a secure environment. The

21 Chamber decorates the Barrel Room in a fenced area with tables, chairs, umbrellas, wine barrels and table top arrangements in festive harvest colors. In prior years, the St. Anthony s Catholic Church Knights of Columbus have participatd as servers at the Barrel Room. This year the Hughson Lions Club will staff the Barrel Room. The Bank of the West staff oversees the beverage ticket sales. The Hughson Chamber of Commerce secures the appropriate daily licenses for the Hughson Fruit and Nut Festival weekend through the California Department of Alcoholic Beverage Control (ABC) for the Barrel Room. The Hughson Chamber of Commerce Board of Directors also hosts a Festival Appreciation Dinner event the Thursday before the festival in gratitude to local supporters. A catered dinner is provided to major sponsors and event committee members and donated wines are served at the Hughson Community Senior Center. The Festival Appreciation Dinner will take place again this year on April 25, 2019 and Col. (Retired) John and June Rogers and the Scranton and Qualle Hughson Post 872 of the American Legion will be the honored guest. Following approval by the City Council of this request, the Chamber will submit an application to the State of California for the appropriate licenses for the specified weekend. Per the ABC application requirements, the required form must be received within ten (10) days of the event, but should not be submitted more than thirty (30) days in advance to the local office (Stockton). Fiscal Impact: There is no fiscal impact to the City of Hughson associated with approval of this item. Net proceeds are utilized by the Hughson Chamber of Commerce to continue providing the annual Hughson Fruit and Nut Festival for the enjoyment of residents and visitors.

22 CITY OF HUGHSON AGENDA ITEM NO. 3.4 SECTION 3: CONSENT CALENDAR Meeting Date: April 8, 2019 Subject: Approval to Advertise the Position of City Treasurer Presented By: Raul L. Mendez, City Manager Approved By: Staff Recommendation: 1. Accept the resignation of the City Treasurer, Jaime Fountain as of April 2, 2019 and send her a Certificate of Appreciation on behalf of the City Council. 2. Approve advertising the position of City Treasurer. Background: The City Treasurer is a position appointed by the City Council, traditionally for a two-year term, whose primary duties are to review the City s investment practices and approve the monthly Treasurer s report. The position is currently held by Jaime Fountain who tendered her letter of resignation on April 2, 2019 (attached). Ms. Fountain was appointed to the position by the City Council on August 22, Recruitment for City Treasurer: In order to identify potential candidates for appointment to the City Treasurer position, the traditional practice is to open a recruitment. The recruitment would require identifying the essential functions, typical duties performed, and education and experience preferred. The essential function of the City Treasurer is to monitor and safeguard the City s cash and investments through oversight of City processes, reporting, and practices. The Treasurer ensures the City s financial viability and that proper financial records and procedures are maintained in a clear, concise, and understandable manner. The typical duties performed by the City Treasurer include but are not limited to the following:

23 Review the Treasurer's Report of Cash on Deposit and Invested, prepared by the Finance Manager. Certify that total cash on deposit and invested as is reported on the Treasurer's Report of Cash on Deposit and Invested. Identify appropriate adjustments to the Treasurer's Report of Cash on Deposit and Invested and verify and sign the report. Attest, in the Treasurer's Report of Cash on Deposit and Invested, that the City has cash on hand for six months. Attend quarterly City Council, Finance Committee and/or other meetings when required to provide information on treasury or investment matters. Understand and follow the City s Statement of Investment Policy in his/her review. Works with the City Manager and Finance Manager on appropriate review of financial and investment matters, to include City Council agenda items. Recommends appropriate investment or financial matters when warranted to the City Manager and/or City Council. Works with the Finance Manager on presentation of financial information to ensure that material is clear, concise, and easily understandable for Council and residents in their review. Graduation from a four-year college and post-graduate work in accounting, financial or management processes is preferred but not required. Experience in an administrative position involving finance, investments, budgeting, or similar financial matters is ideal. The candidate should possess a combination of training and experience that provides the knowledge, skills, and abilities required to provide sounds advice, recommendations, and conduct appropriate reviews of City financial records. The candidate should also possess the ability to learn, understand, interpret and apply applicable Federal, State and local laws and regulations pertaining to investments, finance and treasury items. Provided that the City Council is interested in opening the City Treasurer recruitment, advertising the appointment opportunity is the first step. The position can be opened for a 30-day period and posted in the local newspapers, city website and other local sources. Potential applicants would be asked to apply and need to be available to be interviewed by the City Council in a regular meeting if so desired. Fiscal Impact: As established by City Council Resolution No , the City Treasurer receives $100 per month, in the form of a stipend, for performance of the required duties. These funds are included as part of the annual budget process.

25 CITY OF HUGHSON AGENDA ITEM NO. 3.5 SECTION 3: CONSENT CALENDAR Meeting Date: April 8, 2019 Subject: Approval to Adopt Resolution No , Authorizing the Disposition of City Surplus Property Enclosures: Attachment A - Item for Surplus Presented By: Jaime Velazquez, Utilities Superintendent Approved By: Staff Recommendation: Adopt Resolution No , authorizing the sale of City surplus property as required in the Hughson Municipal Code, Chapter Background and Overview: City staff identified an item of City owned property that has no useful value since it has been taken out of service. In accordance with Chapter 3.08 of the Hughson Municipal Code, all City property must be declared surplus by resolution of the City Council prior to its disposition. There is only one item for consideration today. This includes a single Onan 275 kw Generator. Onan Model: 275DQAE-5849, Serial #: D City staff received an offer for $12,000 from Central California generator for the purchase of the item. A generator cannot be refurbished and reused under California state law, so the company intend to use it for parts. The subject generator was removed from Well 6 (located on Locust Street) when the well was taken offline over four years ago. Since its removal, it has been stored at the Hatch Road Lift Station. This generator was deemed non-operational by the San Joaquin Air Pollution Control Board for emission reasons. This generator no longer meets California air quality requirements. Upon adoption of Resolution No , the item can be declared surplus and sold.

26 Fiscal Impact: The proceeds received from the sale of the generator will be deposited in the appropriate enterprise fund and booked as revenue.

27 CITY OF HUGHSON CITY COUNCIL RESOLUTION NO A RESOLUTION OF THE HUGHSON CITY COUNCIL APPROVING CERTAIN CITY PROPERTY TO BE DECLARED AS SURPLUS, AND AUTHORIZING THE DISPOSAL THEREOF WHEREAS, the City of Hughson has certain items of surplus property that have no further use to the City; and WHEREAS, the list of surplus items has been presented to the City Council for their review; and WHEREAS, the Hughson Municipal Code Chapter 3.08 requires that property belonging to the city, of whatever kind, shall be sold only after having been declared by resolution of the City Council to be surplus property of the City; and, NOW THEREFORE, BE IT RESOLVED that the City Council declares the listed items in Attachment A are made part of this Resolution are surplus property and authorizes them to be disposed of in accordance with the Hughson Municipal Code.
