No. 224 of HEALTH INSURANCE ACT 1994 (DETERMINATION OF RELEVANT INCREASE UNDER SECTION 7A AND PROVISION OF INFORMATION UNDER SECTION 7B) (AMENDMENT) REGULATIONS These Regulations amend the Health Insurance Act 1994 (Determination of Relevant Increase under section 7A and Provision of Information under section 7B) Regulations 2014 (S.I. No. 312 of 2014) and provide that, in certain specified circumstances, relevant increases arising on premiums for health insurance contracts may not apply. No. 225 of EUROPEAN COMMUNITIES (FOOD SUPPLEMENTS) (AMENDMENT) REGULATIONS [47C] These Regulations give partial effect to Commission Regulation (EU) 2017/1203 of 5 July 2017 amending Directive 2002/46/EC of the European Parliament and of the Council and Regulation (EC) No. 1925/2006 of the European Parliament and of the Council. Under Directive 2002/46/EC, only those vitamins and minerals listed in Annex I thereto and in the forms set out in Annex II thereto, can be used in the manufacture of food supplements. Annex II has been amended on various occasions, most recently by Commission Regulation (EU) 2017/1203 which adds organic silicon (monomethylsilanetriol) and calcium phosphoryl oligosaccharides (POs-Ca ) to the list of substances which may be used in the manufacture of food supplements. These Regulations amend the European Communities (Food Supplements) Regulations 2007 (S.I. No. 506 of 2007) in the manner specified in these Regulations. Where this term is used in conjunction with an ICES or CECAF sub-area or division listed in Schedule 1 and Schedule 2, it means that only the European Union waters of that sub-area or division are included; length means in relation to a sea-fishing boat, the overall length of the boat, or the distance from the forepart of the stem of the boat to the aft side of the head of the sternpost of the boat or to the foreside of the rudder stock; fishing trip means any voyage of a fishing vessel during which fishing activities are conducted that starts at the moment when the fishing vessel leaves a port and ends on arrival in port; target species as provided for in Council Regulation (EC) No 850/98 of 30 March 1998 for the conservation of fishery resources through technical measures for the protection of juveniles of marine organisms, as amended; monkfish authorisation means an authorisation to fish for monkfish (family Lophiidae) granted under section 13 of the Sea-Fisheries and Maritime Jurisdiction Act 2006; fishing area means waters falling within the ICES sub-areas and divisions listed in Schedule 1 and Schedule 2 as defined in Annex III to Regulation (EC) No. 218/2009 of the European Parliament and of the Council of 11 March 2009, 2 as amended; stock means a species in a defined fishing area listed in columns (1) and (2) of Schedule 1 and Schedule 2; Catch retention and landing restrictions means the total quantity, in tonnes live weight, of that species of fish in column (1) a quantity of which, greater than that specified in column (3) or column (4), may not be retained onboard or landed by an Irish sea-fishing boat, dependant on the particular vessel s length and/or fishing method during July 2018; per cent by-catch means a percentage by live weight of the total quantity of all species of fish, for which the State has an EU fishing quota, retained on board or landed on any occasion. In this notice this definition does not apply to Cod in VIa; International waters of Vb east of W (COD/5BE6A). By-catch of cod in this area may be landed provided that it does not comprise more than 1.5 per cent of the live weight of the total catch retained on board per fishing trip. 3.1 During July 2018, a person on board an Irish sea-fishing boat greater than or equal to 55 feet in length, fishing in a fishing area listed in column (2) of Schedule 1, shall not have, or retain on board that boat or land (or cause or permit another person to have or retain on board the boat or land), a quantity of a species of fish listed in column (1) of Schedule 1 opposite that fishing area where the fish were caught that is greater than the corresponding quantity specified in column (3), either on a single occasion or when combined with previous landings by that boat of that species of fish caught in the specified area in July During July 2018, a person on board an Irish sea-fishing boat less than 55 feet in length, fishing in a fishing area listed in column (2) of Schedule 1, shall not have, or retain on board or land (or cause or permit another person to have or retain on board the boat or land), a quantity of a species of fish listed in column (1) of Schedule 1 opposite that fishing area where the fish were caught that is greater than the corresponding quantity specified in column (4), either on a single occasion or when combined with previous landings by that boat of that species of fish caught in the specified area in July During July 2018, a person on board an Irish sea-fishing boat fishing exclusively by means of Danish/Scottish Fly Seines in respect of which a monkfish authorisation has not been granted, shall not, in ICES division VIIa or ICES divisions VIIb-k, VIII, IX and X: Union waters of CECAF , have or retain on board that boat or land, a quantity of haddock greater than the quantity that is specified in column (5) of Schedule 1 opposite, mention of the relevant ICES area if the haddock was caught either on a single occasion or when combined with previous landings of that species of fish caught in the specified area in July During July 2018, a person on board an Irish sea-fishing boat fishing exclusively by means of gillnets in respect of which a monkfish authorisation has not been granted, shall not, in ICES division VIIa and ICES division VIIb-k, VIII, IX and X; Union waters of CECAF , have or retain on board that boat or land, a quantity of cod greater than the quantity that is specified in column (6) of Schedule 1 opposite, mention of the relevant ICES area if the cod was caught either on a single occasion or when combined with previous landings of that species of fish caught in the specified area in July Where a quantity is specified in (a) column (3) or column (4) of Schedule 1, or (b) column (3) or column (4) of Schedule 2, in respect of a particular species of fish, fishing area and type of vessel, and where that quantity is expressed as a per cent by-catch, a person on board an Irish sea-fishing boat of that type,

7 IRIS OIFIGIÚIL, JUNE 29th, (c) may, notwithstanding paragraphs 3 and 4, have or retain on board, between the hours of 00:01 and 23:59 of each day of a fishing voyage, up to 1.5 times the quantity of that species of fish specified if it was caught in that area during July 2018, and must ensure by 24:00 of each day of a fishing voyage that the quantity of that species of fish caught in that area and retained on board does not exceed the per cent by-catch quantity specified in that Schedule for that species, area and type of vessel. Norway Lobster 4 (Nephrops norvegicus) of which Functional Unit 16 of ICES Subarea VII (NEP/*07U16) within the catch limit for Norway Lobster in ICES area VII 7 tonnes 3.50 tonnes 6. Boats targeting Nephrops in ICES Areas VI & VII and Functional Unit 16 of ICES Subarea VII 6.1 During July 2018, in any one fishing trip, a person on board an Irish sea-fishing boat, targeting Nephrops in ICES Areas VI and VII may fish in either of ICES Area VI and ICES Area VII, excluding Functional Unit 16 of ICES Subarea VII, or Functional Unit 16 of ICES Subarea VII 6.2 Notwithstanding paragraph 6.1, during July 2018, a person on board an Irish sea-fishing boat greater than or equal to 55 feet in length fishing in a fishing area listed in column (2) of Schedule 2, shall not have, or retain on board that boat or land (or cause or permit another person to do so), a quantity of a species of fish listed in column (1) of Schedule 2 that is greater than the corresponding quantity specified in column (3). In such instance, the boat may only fish with fishing gear in which the cod end is greater than 100mm when the quantity of Nephrops in Area VI, Vb has been landed or retained on board, which exceeds the sum of column (3) and (4) then the boat may not fish in Area VI, Vb, for the remainder of the fishing period. 6.3 During July 2018, a person on board an obligated Irish sea-fishing boat greater than or equal to 55 feet in length, fishing in ICES Zone VII which is obligated to land Nephrops in Area VII, shall not fish for Nephrops when the quantity of nephrops has been landed or retained on board, which is listed in column (3) of Schedule 4, is exceeded. In such instance, the boat may only fish with fishing gear in which the cod end in greater than 100mm when the quantity of Nephrops in Area VII has been landed or retained on board, which exceeds the sum

12 906 IRIS OIFIGIÚIL, JUNE 29th, 2018 of column (3) and (4), then the boat may not fish in Area VII for the remainder of the fishing period. 6.4 During July 2018, a person on board an obligated Irish sea-fishing boat greater than or equal to 55 feet in length which is obligated to land Nephrops when fishing in ICES Zone Functional Unit 16 of VII, shall cease fishing for Nephrops when the quantity of Nephrops retained on board exceeds the quantity in column (3) of Schedule 4. Furthermore, when the quantity of Nephrops landed exceeds the quantity in column (3) then the boat may not fish in ICES Zone Functional Unit 16 of VII for the remainder of the fishing period. 6.5 WHITING During July 2018, a person on board an obligated Irish sea-fishing boat greater than or equal to 55 feet in length which is obligated to land whiting when fishing in ICES Zone VIIb-k, shall not fish for Whiting when the quantity of Whiting has been landed or retained on board, which is listed in column (3) of Schedule 1, is exceeded. In such instance, the boat may only target Non-Gadoid species in Area VIIb-k. When the quantity of Whiting in Area VIIb-k has been landed or retained on board, which exceeds the sum of column (3) and (4) of Schedule 1, then the boat may not fish in Area VIIb-k for the remainder of the fishing period. 6.6 HADDOCK During July 2018, a person on board an obligated Irish sea-fishing boat greater than or equal to 55 feet in length which is obligated to land haddock and by-catches of sole, plaice and megrim when fishing in ICES Zone VI, Vb, shall not fish for Haddock when the quantity of Haddock has been landed or retained on board, which is listed in column (3), is exceeded. In such instance, the boat may only target Non-Gadoid species in Area VI, Vb. When the quantity of Haddock in ICES Zone VI, Vb has been landed or retained on board, which exceeds the sum of column (3) and (4) of Schedule 1, then the boat may not fish in Area VI, Vb for the remainder of the fishing period. 6.7 During July 2018, a person on board an obligated Irish sea-fishing boat greater than or equal to 55 feet in length which is obligated to land Haddock when fishing in ICES Zone VIIa, shall not fish for Haddock when the quantity of haddock has been landed or retained on board, which is listed in column (3) of Schedule 1, is exceeded. In such instance, the boat may only fish with fishing gear in which the cod end in greater than 100mm when the quantity of Nephrops in Area VII has been landed or retained on board, which exceeds the sum of column (3) and (4), then the boat may not fish in Area VII for the remainder of the fishing period. 6.4 During July 2018, a person on board an obligated Irish sea-fishing boat less than 55 feet in length which is obligated to land Nephrops when fishing in ICES Zone Functional Unit 16 of VII, shall cease fishing for Nephrops when the quantity of Nephrops retained on board exceeds the quantity in column (3) of Schedule 4. Furthermore, when the quantity of Nephrops landed exceeds the quantity in column (3) then the boat may not fish in ICES Zone Functional Unit 16 of VII for the remainder of the fishing period. 6.5 WHITING During July 2018, a person on board an obligated Irish sea-fishing boat less than 55 feet in length which is obligated to land whiting when fishing in ICES Zone VIIb-k, shall not fish for Whiting when the quantity of Whiting has been landed or retained on board, which is listed in column (3) of Schedule 1, is exceeded. In such instance, the boat may only target Non-Gadoid species in Area VIIb-k.
