1 The South Atlantic Fishery Management Council s South Atlantic Update Published for fishermen and others interested in federal marine resource conservation issues Winter 2018 Management of Atlantic Cobia (GA to NY) May Change Hands Council will consider alternatives and public input in March before making decision No one would argue that federal fisheries management can be complicated. That word was used often during recent public hearings held in January for management changes proposed for Atlantic cobia. The Council held a series of hearings via webinars with listening stations in Virginia, the Carolinas, and Georgia. Fishermen and others had the opportunity to weigh in on alternatives to the current management system. The alternatives are designed to be more effective and provide fair and equitable access to the Atlantic cobia fishery - without reducing protection to the stock. The Atlantic migratory cobia stock is managed from Georgia to New York. Cobia in federal waters off the east coast of Florida are considered part of the Gulf of Mexico migratory stock. The current management boundary for the two stocks was established following a 2013 stock assessment. Annual catch limits were set for each migratory stock. NOAA Fisheries determined the recreational catch limit for Atlantic cobia was exceeded in 2015, leading to a shortened season in Cobia harvested in both state and federal waters count toward the annual catch limit. Subsequent overages occurred during 2016, and the recreational fishery was closed again on January 24, The Council is considering a range of alternatives for managing Atlantic cobia, ranging from complementary management with the Atlantic States Marine Fisheries Commission (ASMFC) to removal of Atlantic Cobia from the current federal management plan. The ASMFC recently approved an Interstate Fishery Management Plan for Atlantic Cobia that will be implemented in April The plan establishes baseline regulations and allocations on a state-bystate basis for state waters. Should the Council choose to remove Atlantic cobia from the federal management unit - a move that Council members chose as their preferred alternative - the ASMFC Interstate Plan could also be applied to federal waters at the request of each state. The ASMFC Interstate Plan will be implemented from GA to NY for Atlantic cobia in state waters beginning in April 2018 regardless of the Council s actions. Cobia migrate to spawn and are sometimes targeted in federal waters and sometimes closer to shore in state waters, depending upon their migratory patterns. They are prized by fishermen for their large size and tasty meat, and efforts to catch them have increased, particularly along the northeast coast of North Carolina and coastal Virginia, where they often occur in state waters. The Council will consider public input as it decides on alternatives during its March meeting for better managing Atlantic cobia. This includes removing Atlantic cobia from the current federal fishery managment plan, with the intent to provide fair and equitable access to the fishery. A Cobia Stock ID Workshop will begin in April and a new stock assessment is scheduled for completion in Public comment will also be taken as part of the March meeting. So I will. After more years than I wish to count we inally had our red snapper season. It was later than we wanted because of delays caused by Hurricane Irma, but in the end we got it. There should be a season this year beginning in July, and an amendment for additional measures is ongoing. Recreational ishermen sent in data on the MyFishCount pilot project which may help with future management. It is encouraging that new methods of data collection are ongoing and also in the planning stages. Citizen science is one of those paths forward, with the NMFS Science Center and managers helping to set the standards and types of data that need to be collected. It isn t just our Council that has data needs as I noted at the recent Gulf of Mexico Council meeting. We all fall in the same boat - what data we have and how it can be used often drives our management decisions. The need for more and more timely assessments has been a need for a long time. Those conversations are in the works now and considering our tight budgets, ways to be ef icient are mandatory. I see a day when, at the very least, our most sought after species will have updated catch limits each year. The way we manage our isheries is changing as our needs change. Some of us remember no trip or bag limits and year-long seasons on many of our main isheries. That isn t the case any more. Fishermen have changed the way they ish as regulations have changed. The goals now might be seasons for recreational ishermen and bag limits that lead to trip satisfaction, while commercial ishermen need to be able to produce enough ish for the markets while making enough money to draw more professional ishermen into the business. It is going to take wisdom and networking between the stakeholders and managers to ful ill the stakeholder s needs as we go forward. We can do this. 3 In the News: Living in the Dark: A Deep-Sea Coral Expedition In August, NOAA s National Centers for Coastal Ocean Science led an 18-Day expedition on board NOAA Ship Nancy Foster, titled Southeast Deep Coral Initiative: Exploring Deep-Sea Coral Ecosystems off the Southeastern United States. You can now learn more about the initiative, including interviews with scientists directly involved in the expedition to study deep-sea corals, the team involved in collecting these delicate samples from the deep, and the importance of protecting these deepwater habitats. New Trade Rule Combats Illegal, Fraudulent Seafood Seafood Import Monitoring Program underway as of January 1, 2018 Cold Weather Impacts 2018 Shrimp Season in SC and GA Both state and federal waters remain closed to harvest in order to help protect overwintering shrimp Unusually cold weather gripped the southeast in January, with water temperatures plummeting along the coasts of South Carolina and Georgia. Sustained water temperatures below 48 degrees can injure or kill many marine animals, including white shrimp, a valuable commercial fishery in South Carolina and Georgia. According to the SC Department of Natural Resources, shortly after the first week in January SCDNR staff and members of the public began reporting dead fish and shrimp along the shores of tidal marshes and saltwater impoundments. As a result, the agency acted to protect surviving white shrimp by closing the trawling season in state waters on January 10, 2018 and requested NOAA Fisheries do the same in adjacent federal waters. Shortly afterward, the Georgia Department of Natural Resources Seafood traders are now required to provide more documentation for fish and fish products they wish to sell to American consumers. As of January 1, 2018, importers have new recordkeeping requirements for proving that seafood products entering the U.S. are legally and sustainably caught, and truthfully represented. The new rule, known as the Seafood Import Monitoring Program, marks a significant step in the global effort to prevent Illegal, Unreported and Unregulated (IUU) fishing and seafood fraud from entering U.S. markets. IUU fishing and seafood fraud threaten valuable natural resources that are critical to global food security and put law-abiding fishermen and seafood producers here in the U.S. and around the world at a disadvantage. The rule applies to the following priority species: Atlantic and Pacific cod, blue crab, mahi mahi (dolphin fish), grouper, king crab, sea cucumbers, red snapper, sharks, swordfish, and tunas. In the future, the U.S. plans to add other species to the list, closed state waters to trawling on January 15, 2018 and also requested a federal closure. According to GA DNR, observations of recent water temperatures and catches suggest one of the worse freeze kills in the 41 years it has been conducting monitoring surveys, with a 96.1 % reduction in white shrimp abundance from December 2017 to January White shrimp is the most valuable commercial fishery in Georgia. The South Atlantic Council manages shrimp in federal waters and has set criteria allowing the closure of adjacent federal waters at the state s request when cold weather threatens overwintering white shrimp. Federal waters were closed to shrimp trawling off the South Carolina coast on January 10th and off the Georgia coast on January 24th. I ve never seen temperatures drop including shrimp and abalone. Over the past year, NOAA Fisheries has worked with international importers to bring their operations into compliance with the new requirements. New requirements for documenting imported seafood are designed to help U.S. seafood producers. SCDNR After a steep decline in December, water temperatures plumetted in early January in Charleston Harbor, harming populations of overwintering white shrimp, as well as finfish such as speckled trout. this fast and this low, said Mel Bell, Council representative for SCDNR Marine Resources Division. Bell explained that the cold weather will likely result in a later opening of the spring white shrimp season. They certainly have the ability to bounce back. It has been bad in the past and we ve recovered. Each year is different. 3

4 New Regulations for Mutton Snapper Effective February 10, 2018, new regulations designed Credit: Eaton Street Seafood to protect spawning populations of mutton snapper and reduce overall harvest will be effective for both commercial and recreational ishermen. The new management measures, implemented through Amendment 41 to the Snapper Grouper Fishery Managment Plan, reduces the overall annual catch limit based on the most recent stock assessment. Mutton snapper are popular targets for ishermen in Florida and known for their delicious taste. Although not over ished or undergoing over ishing, the last stock assessment update concluded there are fewer ish than in the original assessment. Both the Council and the Florida Fish and Wildlife Commission have also heard continued concerns from the public about ishermen overharvesting mutton snapper as they aggregate to spawn in the spring each year. The Council and FWC have coordinated to develop compatable regulations in both state and federal waters. The following regulations are effective February 10th in federal waters: Mutton Snapper Regulation Changes (effective 2/10/18) Minimum size limit increases from 16 to 18 inches total length for both commercial and recreational sectors. Recreational bag limit within the ten-snapper aggregate bag limit decreases to 5 fish per person/day. Commercial trip limit of 500 pounds whole weight January through April and July through December. During the April through June spawning season, the commercial trip limit decreases to 5 fish per person/day or 5 fish per person/trip, whichever is more restrictive. Spiny Lobster Bully Net Regs Proposed The Council is considering new managment measures for spiny lobster to address inconsistencies between state regulations and those in federal waters off the coast of Florida, including regulations for the bully net ishery. Options include requiring an endorsement, vessel marking, and gear prohibitions for the bully net ishery, similar to those currently required in Florida state waters. Public scoping meetings were held in January via webinar. The Council will review scoping comments during its upcoming March meeting and determine if they wish to move forward. The following species are closed to harvest or possession in federal waters, unless otherwise specified: red snapper, goliath grouper, Nassau grouper, speckled hind, and warsaw grouper. Additional Notes: The sale of bag-limit caught snapper grouper species is prohibited. Recreational and commercial fishermen are required to use dehooking tools when fishing for snapper grouper species. The use of non-stainless steel circle hooks (offset or nonoffset) is required for all species in the snapper grouper complex when using hook-and-line gear with natural baits in waters north of 28 degrees N. latitude. All species in the snapper grouper complex must be maintained with heads and fins intact. (Cobia, king mackerel, Spanish mackerel, dolphin, and wahoo must also be landed with heads and fins intact.) Goliath and Nassau grouper must be released by cutting the line and not removing the fish from the water. 4

5 MyFishCount.com: Results of 2017 pilot reporting project for red snapper; plans for 2018 During the fall 2017 red snapper miniseason, recreational anglers were able to report their red snapper catches and discards through MyFishCount.com, a pilot electronic reporting platform developed by the Snook and Gamefish Foundation in partnership with the South Atlantic Fishery Management Council. A total of 360 anglers created MyFishCount member profiles and reported 341 trips (completed and abandoned). Anglers were able to report information about the lengths and weight of their catch and discards, how fish were released, photos of their catch, depth of catch, and more. Scientists, anglers, and fishery managers obtained valuable information and insights into the private recreational fishery and electronic reporting that was not available prior to the 2017 red snapper season. For example, the anglers made the decision to keep or release a red snapper when fish averaged about 20 inches in length (see graphic). This trend might be attributed to the 20-inch minimum size limit established in 1992, but removed in The length of released fish is not captured by current monitoring programs and could be extremely valuable to fishery managers. The reporting platform also gathered that out of the 341 trips that were reported, 83% were abandoned (trips where anglers intended to fish but could not due to weather or other circumstances). The National Marine Fisheries Service used data gathered through MyFishCount to extend the 2017 red snapper mini-season, allowing for an additional weekend in December. The MyFishCount pilot reporting platform will continue to be improved, based on user feedback, and will soon be available as a mobile app to improve ease and timeliness of reporting. There was overall support for allowing more management flexibility and the Council s preferred alternative for removing Atlantic cobia from the fishery management plan. Fishermen generally support the states having more management authority and the ASMFC s Interstate Management Plan. Comments were also received on the timing of the Council s decision - whether the Council should move forward or wait to take Public hearing listening station. action after a Cobia Stock ID Workshop scheduled for 2018 and/or the 2020 stock assessment. Many fishermen, especially those from NC and VA, question the reliability of the recreational data used by NOAA Fisheries to close the fishery in the past as well as the 2013 stock assessment for cobia. Comments also included recommendations for lowering vessel limits, limiting the use of gaffs, and other measures. Atlantic Cobia Management - What s Next? Vessel limits will be determined once individual states set their seasonal restrictions, but would not exceed 6 fish per vessel. MREP 2018 Workshops Fisheries Science April St. Petersburg, FL Fisheries Management November Tampa, FL From The Executive Director s Desk Reauthorization of the Magnuson-Stevens Act - the Council s Perspective The Magnuson- Stevens Fishery Conservation and Management Act (MSA) was Gregg Waugh last amended through January 12, 2017 and signed into law by President Bush. In my August 2017 article, I covered some background and a brief overview of three major bills under consideration. Here is where we stand now: House Action: On December 13, 2017, the House Natural Resources Committee marked up and ordered to be reported H.R. 200 (as amended), the Strengthening Fishing Communities and Increasing Flexibility in Fisheries Management Act. The markup and other additional information can be viewed at: house.gov/calendar/eventsingle. aspx?eventid= Senate Action: On October 24, 2017, the Senate Commerce, Science and Transportation Committee s Subcommittee on Oceans, Atmosphere, Fisheries, and Coast Guard, held a hearing titled Reauthorization of the Magnuson- Stevens Fishery Conservation and Management Act: Fisheries Science. S Modernizing Recreational Fisheries Management Act of 2017 is the Senate s bill that will be used to amend the MSA. Senator Lindsey Graham s staff asked the Council to comment on S A brief summary is presented below, and the Council s letter is available at: Allocation Review we have adequate guidance and the Council is in the process of reviewing current allocations. Alternative Fishery Management these provisions would provide greater flexibility for the Council to manage the recreational sector without in-season closures. Limited Access Privilege Programs we have adequate guidance/procedures. Rebuilding Overfished Fisheries removing the arbitrary 10-year deadline would be beneficial. More attention should be given to the impacts of ending overfishing immediately, which is where the big reductions occur. Annual Catch Limits exemptions/ alternatives to the existing ACL requirements for data-limited species could improve the Council s ability to provide stability in setting harvest limits. Exempted Fishing Permits (EFPs) the existing EFP procedures provide a sufficient framework for the expedited, uniform, yet regionally-based process envisioned to test solutions and collect data to address specific management issues. Recreational Data Collection Marine Recreational Information Program (MRIP) was not designed to provide data for in-season ACL management; the current MRIP methodology cannot be modified nor can sufficient funding be provided such that in-season ACL management will work; alternative methods (e.g., state electronic logbook programs, federal forhire electronic logbooks, and electronic logbooks for private recreational anglers) should be fully implemented where they are available and developed. Additional details for each of these topics are included in a Working Paper on MSA Reauthorization available from the link to the fishery councils website shown above. The 8 Regional Fishery Management Councils prepared consensus positions on major topics and each Council developed their own regional perspectives. Each reauthorization of the Magnuson- Stevens Act has resulted in substantial changes to federal fisheries management. It is important that we continue to follow the progress of proposed legislation.
