1 QUARTERLY COMPLIANCE AND ENFORCEMENT SUMMARY
2 Highlights for the Second Quarter of 2010 The 2nd for 2010 outlines six Orders, 60 Administrative Sanctions, 358 Tickets and 14 Court Convictions for a combined total of over $94,000 in fines. Notable highlights this Quarter: The (QCES) now includes the names of individuals issued tickets under Ministry of Environment and Ministry of Natural Resource Operations legislation. The addition of this information has been made possible by legislative amendments enacted in the fall of Including the names of ticketed individuals allows the ministry to better achieve two of the primary purposes of the QCES, which are: (1) to provide greater transparency in the governance of British Columbia s environment; and (2) to provide an added measure of deterrence from breaking environmental laws. The QCES has always included the names of corporations issued orders, tickets, or convicted in court. Marika and Michael Ramousch were convicted in court for illegal activities related to their Guide Outfitting operation (Rocky Mountain Adventures) and fined $1,495 with an additional creative sentence of $8,700 payable to the Habitat Conservation Trust Foundation. The judge also suspended Michael Ramouschs' Guide and Assistant Guide licences. Outside of the Court process, the Ramousch's also received two separate administrative sanctions issued under authority of the Wildlife Act. Michael Ramousch received an automatic two year suspension of his hunting licence, while Marika Ramousch faced a three month suspension of her Guide Outfitter licence (during the 2009 spring bear hunt). The decision to hold an administrative hearing for Marika Ramousch was made by the ministry last year to consider the charges that were before the courts. Under the Wildlife Act, a Regional Manager may hold a hearing to consider licensing actions in response to the conduct of a Guide Outfitter, Guide Angler or Trapper. Through their licence, guides and trappers are representatives of the Crown in British Columbia. As such, they need to be held to a high standard of conduct and must always operate within the law. 4 Orders ISSUED TO LOCATION ACT REG. SECTION DESCRIPTION Perkovich, Michael, d.b.a. T. P. Log Salvage Ltd. Campbell River Environmental Management Act 81 A Pollution Prevention Order was issued to protect the environment from contaminated runoff. The order requires the following: (1) removal of all hydrocarbon based products (fuel, oil, grease, etc) from site and either disposal at an authorized facility or storage in a secure location with adequate containment for spill prevention; (2) upon completion of above, submit to the ministry a report containing: (a) the type and amount of waste hydro carbon products removed and location of their disposal; (b) photographs of waste hydrocarbon products removed; (c) record and photograph of the salvageable hydrocarbon products and their secure storage location; and (d) photographs of the site after all removal work has been completed. Makepeace, Christine and Walter, d.b.a. Makepeace Organic Farms Ltd. Osoyoos/South Okanagan Grasslands Protected Area Park Act 16 A Park Act Order was issued to property owners to stop active vineyard operations within a protected area. The activities were in contravention of the Park Act and involved a boundary trespass. The property owner was ordered to: (1) remove all structures and installations within the protected area; (2) submit a restoration plan approved by a Qualified Professional (QP) and the ministry; and (3) restore the area to its original condition as specified in the approved plan within 3 years. Danielson, Loretta; Gainor, Bruce and Connie; Grills, Michael; McMinn, Nancy; Hampton, Dori and Robert; McCullough, Bradley and Katherine; Pryor, Thomas Clinton, Porcupine Creek Water Act 87 An Engineer's Order was issued to require the water licence holders to re-build an authorized diversion structure in a creek. The order requires the following: (1) submit design drawings prepared by a QP that: (a) restricts water flow entering the ditch to no more than the licensed quantities; (b) is equipped with a shut off mechanism; (c) allows for fish passage; (d) does not restrict the capacity of the culvert; and (e) is capable of measuring diversion flows. Upon ministry approval of the design: (2) commence construction of the diversion structure; (3) provide for fish passage and sufficient fisheries flows to allow spawning, incubation of eggs, and rearing of fish during construction; and (4) submit to the ministry bi-weekly flow measurements to demonstrate that sufficient fisheries flows are being maintained. Wright, Ed and Judith Telkwa, Aulstead Springs Water Act 88(1)(d) An Engineer's Order was issued provide leave to commence construction for the removal and re-construction of a dam. The key components of the project will be: (1) dewatering of the existing reservoir; (2) removal of the existing dam and saddle dam; and (3) reconstruction of a new dam and saddle dam. Page 4 of 25

The order requires the following: (1) cease and discontinue any works that may cause further erosion; (2) retain a QP to submit a site erosion, sediment control and re-vegetation plan that considers: (a) removal or stabilization of material excavated from the creek bed; (b) stabilization of all disturbed areas to minimize surface erosion; (c) re-establishment of riparian vegetation; (d) monitoring of remedial activities; (e) details regarding the intentions for the unauthorized works (buried 16" pipe) between the reservoir and the creek; (3) remedial work shall commence upon approval of the plan; and (4) notify the ministry upon completion of the work. Thomas, Julie and Kenneth Cariboo, Cluculz Water Act 93(2)(q) An Engineer's Order was issued in response to the unauthorized construction of a boat launch. The order requires the property owners to do the following: (1) retain a QP to submit a site assessment and remediation plan that considers: (a) the impacts of the construction; (b) an evaluation of pre-construction fish habitat and riparian vegetation; (c) recommendations for re-establishment of fish habitat; (d) assessment for stabilization of disturbed areas to stop further erosion; (e) recommendations for monitoring and construction alternatives for the boat launch based on good environmental practices; and (2) submit the plan to the ministry for approval.
