1 Verification Report Establishment S M Verification of corrective actions proffered in response to NOS dated March as a result or egregious humane handling non compliance. Corrective actions associated with HAT activity Vlll (stunning effectiveness) and IX (conscious animals on rail) were veritied from 3/10 to 3/20/ Category VIII Plant conducted humane handling training for all barn employees. This training was held for second shift at 5:45 PM. 3/10/09, and included 25 employees. For first shift it was held at 5:00 AM, 3/11/09, with total of 24 employees present. I observed documentation to show that all barn employees in attendance signed that they attended the training session. The training information was printed in both English and Spanish with an interpreter present during the sessions. The areas covered were entitled: 1. Provisions for handling hogs humanely and safely. 2. Stunner gun 3. stunner safety instructions 4. Core Critical Training-dealing with seven core criteria a. Effective C02 stunning hogs b. Bleed rail sensitivity c. Slipping and falling d. Vocalization e. Electric prod use f. Willful acts of abuse g. Access to water All new employees will be given this training before allowed to start working. Maintenance logs on captive bolt maintenance, C02 concentration, and each time captive bolt is used to restun animal. Using natural blinking as the criteria for sensibility, there are five to 10 hogs per shift that the captive bolt is used on because the procurement supervisor deems hog returning to sensitivity. These were reviewed and verified by FSIS. The plant held a retraining session for the same employees on 3/18/09 at Particular emphasis was put on recognizing sensibility/insensitive. The plant instituted a monitoring program to be conducted three times per shift by the procurement supervisor or the lead person. Monitoring activities will include: 1. Was captive bolt required 2. If needed was captive bolt used properly \ :v \ 1.y j v

2 3. Sensibility checked 4. Was animal stuck properly Monitoring activities are documented with date, time, and signature of person doing monitoring. A review of all records showed monitoring was conducted as proffered by corrective actions. A total of 5.25 hours from 3111 to 3/20 was spent by FSIS inspection personnel verifying Category VIII (stunning e±tectiveness). 100% of all animals observed were effectively stunncd by C02 Catcgory IX Same retraining and captive bolt use as with Category VIII. Plant has placed a "rolling ladder" in the stick area to allow accessibility to hanging hogs on incline and facilitate sticking these hogs if line should stop. They have also built a walkway along area to facilitate sticking in area. On , plant installed an alarm and light that activates if line is ott for longer than 30 seconds. Prior to daily operation this alarm is tested to verify that it is functioning as designed. This alarm and light alerts the procurement supervisor or the lead person to go immediately to the stick area and verify to his satisfaction that no hogs have regained consciousness. When his verification is complete all stunned hogs will be stuck. If necessary the backup bleed rail will be used for additional hanging and sticking of stunned hogs. The same monitoring procedure as Review of records show time monitoring started, time ended, person doing the sticking, and signature of person doing the monitoring were all properly documented. Reviewed and verified by FSIS. The plant initiated a captive bolt stunning procedure, whereby. if a hog needs restunned with captive bolt, the person responsible fills out form with time, date, and signature. 100% of animals evaluated by FSIS personnel (VMO and CSI) performing HAT activities IX were observed to be insensible. 3 Verification Report (03/23/ /27/2009) Establishment 00003S M Verification of corrective actions proffered in response to NOS dated March 10, 2009 as a result of egregious humane handling non compliance. Corrective actions associated with HAT activity VIIl (stunning effectiveness) and IX (conscious animals on the rail) were verified from 03/23/2009 to 03/27/2009. Category VIII (b)(6),(b)(7)(c) brought the training records to the USDA office at the end of the shift on Friday. A review of the records showed that at the original training done the first week signed off as being trained. One new employee was trained this week. The training materials are listed on last week's Verification Report. The supervisor or the lead person was at the shackle table 100% of the time all week. The three times per day monitoring for proper use of captive bolt stunners ifrequired and the proper sticking of the animals by the procurement supervisor was verified as being done every day of this week. The backup bleed rail was operational all week, but there were no periods of extended down time so that its use was not necessary. A total of 4.25 hours from 03/23/2009 to 03/27/2009 was spent by FSIS inspection personnel verifying Category VIII. 100% of all animals observed were effectively stunned by carbon dioxide. Category IX

4 The "rolling ladder" was accessible all week. However, with the new permanent stand in place, the sticker was able to stick all the hogs on the rail as stated in the event mentioned below. The alarm and flashing red light that comes on when the bleed chain stops for was tested between 0418 and 0428 every day this week and was found to be functional. The same monitoring procedure as Category VIII is used with Category IX. Review of records show time monitoring started, time ended, person doing the sticking, and signature of person doing the monitoring were all properly documented. Reviewed and verified by FSIS. At approximately 1205 when I was finishing ante mortem and approaching the shackle table on 03/27/2009, the sticker observed a hog trying to breathe and voluntarily blinking its eyes at the sticker stand. He immediately stopped the line and called for the captive bolt gun. Another employee used the captive bolt gun on the hog. The hog was checked for sensitivity and found insensible. The hog was then stuck. While this was going on, the sticker stuck all hogs on the rail back to the shackle table. Company employees handled this event properly and as trained. All other animals evaluated by FSIS personnel (VMO and CSI) performing HAT activity IX were observed to be insensible. A total of 4.25 hours was spent performing this activity this week. Humane handling training was conducted for a new employee this week. Proper documentation was verified by me on 4/3/09. The records included the employee's signature confirming he received the course and had taken an exam to prove his working knowledge of the material. The same exam was given to all barn employees showing they understood material presented. The plant instituted a monitoring program to be conducted three times per shift by the procurement supervisor or the lead person. Monitoring activities will include: 1. Was captive bolt required 2. If needed was captive bolt used properly 3. Sensibility checked 4. Was animal stuck properly I observed the procurement supervisor or his designee in immediate area during all hours of stunning and sticking. This same individual performed the monitoring activities. These records were daily reviewed and verified by FSIS. A total on.5 hours from 3/30to 4/3 was spent by FSIS inspection personnel verifying Category VIII (stunning effectiveness). Almost 100% of animals observed were effectively stunned by C02. However, I did observe two animals on shackle table during the week that started to regain consciousness when line stopped, but were appropriately recognized and stunned by captive bolt. Category IX Plant has built a permanent walkway along side the area from shackle table to sticker. This stand allows access to all hanging hogs and therefore will replace the "rolling

6 ladder" that has been in area. This will allow accessibility to hanging hogs on incline and facilitate sticking these hogs if line should stop. On, 311 0/09, plant installed an alarm and light that activates if line for longer than Prior to daily operation this alarm is tested to verify that is functioning has designed. This alarm and light alerts the procurement supervisor or the lead person to go immediately to the stick area and verify to his satisfaction that no hogs have regained consciousness. A total of 3.75 hours on 4/6 through were spent by FSIS inspection personnel verifying Category VIII (stunning effectiveness). 100% of animals observed were effectively stunned by C02. Corrective actions associated with HAT activity VIII (stunning effectiveness) and IX (conscious animals on rail) were verified from 4/13/09 to 4/17/09 Category VIII There was one new employee that was given the required humane handling training on 4/10/09. FSIS reviewed the documentation verifying this training on 4/13/09. The plant's monitoring program, for HAT Categories VIII and IX. is conducted times by the procurement supervisor or the lead person. Monitoring activities included: 1. Was captive bolt required 2. If needed was captive bolt used properly 3. Sensibility checked 4. Was animal stuck properly I observed that procurement supervisor or his designee were in the immediate area during all hours of stunning and sticking. This same individual perfonned the monitoring activities. On /09, the plant installed an alarm and light that activates if line for longer than Prior to daily operation this alarm is tested to verify that is functioning has

10 designed. This alarm and light alerts the procurement supervisor or the lead person to go immediately to the stick area and verify to his satisfaction that no hogs have regained consciousness. When his verification is complete all stunned hogs will be stuck. If necessary the backup bleed rail will be used for additional hanging and sticking of stunned hogs. I observed this alarm and light appropriately being used as designed on several occasions during the week. I did observe the necessity for personnel to use this bleed chain on one occasion this week. The same monitoring procedure as Category VIII is used with Category IX. Review of records show time monitoring started, time ended, person doing the sticking, and signature of person doing the monitoring were all properly documented. Reviewed and verified by FSIS. 100% of animals evaluated by FSIS personnel (VMO and CSI) performing HAT activities IX were observed to be insensible. A 10tal of 4.0 hours were spent performing this activity for week of 4/13/2009. On one occasion I observed an animal started to regaining consciousness when line was stopped, but animal was appropriately stunned by captive bolt. I quizzed the procurement supervisor and was informed that for the week there was an average per day of that required restunning with captive bolt. Respectfully (b)(6),(b)(7)(c)
