3 STATUTORY BASIS FOR CHARGES THE AUTHORITY TO RAISE CHARGES The authority to charge ship, passenger, cargo and other dues as considered fit is vested in the board of Saqr Port by the Ras Al Khaimah (RAK) Ports Act No. 9 of THE POWER TO COLLECT CHARGES RAISED By virtue of the RAK Ports Act No. (9) of 2008 the Saqr Port may recover rates payable to them in respect of a ship by distraint and sale of the ship and its tackle and in respect of any goods by distraint and sale either of those goods or any other goods held on harbour premises belonging to the persons liable for payment of the dues. PAYMENT TERMS Payment due within 30 days of the date of demand/invoice unless otherwise indicated. Thereafter interest will be charged at 2% per month PRO-RATA. The Port Authority reserves the right to demand full payment prior to departure. CHANGES TO TARIFF Saqr Port reserves the right to alter/modify the above tariff giving a notice period of 7 days only. Rates increase when vessels remain within the Port for more than five days and port users should refer to the three separate tables below. 7 RATES ON COMMERCIAL VESSELS ASSESSED TO GROSS TONNAGE b) Vessels requesting a Port Authority berth for purposes other than working cargo (Lay-by Charges). Subject to availability, a vessel lying alongside a Port Authority wharf, but not loading or discharging cargo, will be liable to pay a daily rate of AED per metre of vessel length per day from the day of first entering the Port, in addition to the tonnage rate detailed in Table 1 and 3 on Page 3. Small Tug less than 999 GRT AED 1, per day (subject to duration of stay). Note: No lay-by/repair charges will be levied on vessels during cargo operations. These charges will only be applied prior to or post cargo operations, however a grace period of 1 1 /2 hours will be given post cargo operations for completion of repairs and all other formalities. c) Port Waste Reception Facilities The port has engaged with local authorities with regard to the control of waste therefore all commercial vessels laying alongside Port Authority wharves shall incur a mandatory charge on entry for general and recyclable waste facilities upon entry of AED per vessel per day plus a disposal charge of AED per container. Supply vessels will be charged AED 1, per calendar month. Hazardous waste removal shall be approved upon submission of substance requested to be landed. Misuse or cross contamination of waste facilities whereby general waste has been placed in recyclable waste containers shall incur a charge of AED per container. Repeated misuse shall see the removal of said facility. d) Service Rebates At the discretion of the General Manager and on application by the service representative, rebates on vessel dues may be awarded. Application must be made at each quarterly end by the production of a report detailing: Name of service and its provider. Name of vessels. Dates of arrival. Port/s of loading. A commercial vessel, for the purposes of applying the above rates and charges is defined as a vessel assessed as to Gross Tonnage (i.e. a vessel having an International Tonnage Certificate). 2. Fractional parts of any weight, measure, number or value shall be charged according to the nearest greater whole number. 3) A Cargo Declaration Form must be completed by the ship s agent or the consignee of the cargo or agent thereof and submitted to the Port Authority no later than 24 hours after completion of discharge and/or loading. 4) Declarations of catch values for fish, shellfish and other sea-caught foodstuffs should be accompanied by a landing certificate clearly detailing the market value. 5) Terms of payment: 30 days from date of demand. 12 GENERAL AND BULK CARGO SERVICES AND CHARGES b) GOODS IN TRANSIT/STORAGE When space is available goods may be stored for a period on Saqr Port s wharves and within its transit sheds. Storage is at the discretion of the General Manager and dependent on traffic requirements. Saqr Port does not accept any responsibility for any loss or damage, however caused to any goods placed on its wharves or within its transit sheds. Transit Sheds Rent on the use of transit sheds is charged according to current market rates and availability and will be quoted on application. In order to avoid any dispute with regard to the calculation of storage charges for shipments within Saqr Port s storage yards/transit sheds, a daily report is to be forwarded to Saqr Port by 0800 hrs every day identifying the previous 24 hours figures. The report should include the volume of shipments transported from vessel to yard/yard to factories and vice versa. Aggregate/Limestone Storage of Aggregate and Limestone will be on a square metre basis determined at the discretion of and on application to the General Manager. PAPER COPY UNCONTROLLED Doc. 18 a) PILOTAGE MARINE SERVICES AND CHARGES The Saqr Port as the Competent Harbour Authority (CHA) for pilotage in Saqr Port hereby makes the following list of pilotage charges and conditions of use of the pilotage service to take effect from the date above and replacing those previously applied. AII charges are based on Gross Tonnage assessed in accordance with an International Tonnage Certificate. Pilotage in the Port is compulsory. The following pilotage charges are applicable only to acts of pilotage carried out between 0700hrs 1900hrs Sunday to Thursday. Vessel movements carried out outside these normal hours will be subject to an additional charge of AED 1, for vessels up to 5999 GT and AED 2, for vessels over 6000 GT. 20 c) TOWAGE Towage Charges: Harbour Tugs are available for hire at the following hourly rates. Their use is compulsory and the number to be deployed is at the discretion of the General Manager/Harbour Master. Note: Hire of the Port Authority tugs is at all times subject to availability of the tugs and crews and to the UK Standard Conditions for Towage and Other Services (1983). Tariff for special surveys such as pipelines, anchor search etc will be on application. b) IMMOBILISATION AT SAQR PORT ANCHORAGE: Prior approval from Harbour Master is required and a stand by tug is compulsory while immobilising at Saqr Port Anchorage. The stand by tug will remain inside harbour and will be charged Dhs. 900/ per hour. 25 WASTE MANAGEMENT SERVICES Tenant Waste Charges Tenants operating within the port shall be supplied general and recyclable waste facilities at a monthly charge of AED 1, PCM for general waste containers and AED PCM for recyclable waste containers. This shall include the transportation and disposal of said waste. Misuse or cross contamination of waste facilities whereby general waste has been placed in recyclable waste containers shall incur a charge of AED per container. Repeated misuse shall see the removal of said facility. Vessel Waste Charges In respect of commercial vessels laying alongside, the port shall supply general and recyclable waste facilities as a compulsory service, charges as such are detailed below: 1 Waste Disposal Charges (Per removal) AED General Waste Skip (Compulsory placement) AED Recycle Waste Skip (Compulsory placement) AED Misuse of Waste Facilities AED Waste Identified of a hazardous nature shall be dealt with upon request, however the port shall withhold permission for any substance deemed not suitable for disposal with the Emirate. The amount shall be a fixed charge as noted below, dependent on the severity of the violation. In all cases where the first offence exceeds a verbal warning, a AED charge will be applied, increasing in AED increments for subsequent offences. In cases of risky driving being recorded, a AED 1, charge will be applied, increasing in AED increments for subsequent offences.
