2 INFORMATION FOR TIDES END HOME OWNERS Tides End was established 19 years ago. There are currently 40 erfs (soon to be 48) each villa has a single garage and 1 parking space. There is a private jetty with 8 berths and a slipway, for use of all owners. There is also a general boat/trailer parking area. CONSTITUTION Tides End is regulated by a Constitution. On transfer of the property, you become a member of Tides End Home Owners Association (TEHOA) which is subject to the Constitution. Together with the Constitution, there is a set of rules, which have been developed over time, with the aim of making Tides End a harmonious community of people, who can co-exist together. The TEHOA and the TRUSTEES The Tides End Homeowners Association (TEHOA) is a voluntary body that, on behalf of all residents, manages the estate and its staff. There are a maximum of seven Trustees at any one time, elected at the AGM. This is in December each year. Each of the Trustees including the Chairman takes responsibility for different aspects of the working of the complex. They are also responsible for the upkeep and upgrading of the complex (within the budget), the communal gardens, together with the gates and driveways. The budget is reviewed annually and levy s for the financial year adjusted accordingly from October each year. Audited financial statements are circulated within the AGM pack. The Trustees meet quarterly throughout the year, but are always accessible by should anyone have any issues. Contact details of the current Trustees and their portfolios are attached. The security of the complex, the property maintenance, appearance, gardening (common areas), jetty, and finance are all part of their remit. The TEHOA deals with any application for change or modification to the villas, and with exceptions that may occur.

3 The complex is governed by rules for external paintwork and modifications which need approval from the Trustees. Should you wish to bring anything to the attention of the Trustees, please submit in writing, in order that the proposal/problem can be placed on the agenda. The Managing Agent is FSPA, based in Port Elizabeth, but with local representation in Knysna. STAFF There are two full time employees at Tides End, Mr S Van Rooyen (Sakkie) the on-site caretaker and general manager, plus a person employed for general duties and gardening. Casual labour is used when necessary. It is Sakkie who deals with day to day enquiries, and who will advise whether something is a matter to be referred to the TEHOA. Tides End is one of the few complexes that has a full time, on-site Caretaker and this we feel is a deterrent to unwanted visitors. RULES OF TIDES END These have been developed over time and agreed at AGM s. They include a number of dos and don ts that make for good neighbours and better complex living. Should you intend to rent your property, please ensure that your tenants or Agent are aware of the Rules. HOUSE MAINTENANCE In order to retain the overall appearance and quality of the complex it is imperative that properties are well maintained. Properties are reviewed, on an annual basis, and a report circulated to all home owners detailing the status and recommending any remedial work required. Any structural alteration requires the approval of the Trustees, and where applicable, the Municipality. A drawing of the proposed alteration should be submitted to the Trustees, in the first instance, in order that it can be discussed and approved or declined. PETS

4 Tides End has a NO PET S policy. Only pets with consent given prior to end December 2015 are permitted on the complex. SAFETY AND SECURITY There are a number of safety and security measures in place within the complex, and the Trustees are always willing and keen to improve on this. However, security is every resident s responsibility. Stopping at the main gate to discourage tailgating is requested. Also, it is vital, when a contractor is to work at your property that you advise the caretaker prior to any work being carried out. Contractors must be instructed that all labourers working on site, need to submit their ID to the caretaker for a copy to be taken, and Tides End branded vests will be provided for approved labour. There are prescribed rules for when contractors can and cannot work on the complex please review the attached Contractors Rules. Many of the Homeowners have appointed the services of security response companies on their properties. All Sound Security is the most popular in Knysna. JETTY There are currently 8 berths and 13 home owners with boats. This is now proving to be a problem over the holiday season. The Trustees are currently negotiating the purchase of extra berths from Waterways, however this situation has forced us to review the booking of a berth from a first come basis to a rotation schedule. Further details to be advised prior to the 2016 season. If there are berths not used by Home Owners then they can be made available to tenants. Boats must be either on the water, in your garage or within the Boat Park not left in the car parking areas. NEWSLETTER There is a regular Newsletter circulated, by , to all owners. 6 TIDES END HOME OWNERS ASSOCIATION RULES FOR OWNERS, VISITORS & TENANTS (The Home Owners Association Constitution has precedence in any conflict about the rules) Speed limit 10 k/h Pedestrian right of way on site No skateboards or roller skates on downhill drive No vehicle or boat repairs on communal areas Parking only in bays allocated for each house No parking of caravans or commercial vehicles Vehicles parked in unauthorized space may be removed at owner s expense Only pets with consent given prior to end December 2015 are permitted on Complex Owners to remove fouling No pet accommodation to be visible externally Quiet hours 12p.m 7a.m No loud noises Radios, T.V. sets etc. which may cause annoyance to others Contractors rules and permits to be obtained from Caretaker No externally visible laundry No litter, rubbish, cigarette butts Garden tools and equipment to be stored out of sight Externally all residences & communal areas to be kept tidy No signs, notices, billboards or advertisements No business, profession or trade may be conducted from houses *Houses to be maintained in original paint colour & design *All external alterations to be approved and in keeping aesthetically No storage or use of dangerous materials No firearms, pellet guns, stones etc. to be discharged or thrown on site Tides End staff may not to be used for private work during normal working hours *Application can be made, in writing, to the Trustee Committee and on revue may be approved. Owners are liable to reimburse the TIDES END HOME OWNERS ASSOCIATION for any damage or costs incurred by breaches of these Rules MARCH 2016

7 The ownership of the Jetty is as follows: RULES TIDES END/WATERWAYS JETTY The 8 bays on the Eastern side are owned by the Tides End Homeowners Association and the 6 bays on the Western side are owned privately by individual owners at Waterways Village. The Jetty Management acts for the Tides End Homeowners Association in matters pertaining to the Jetty and recommends further action, if any, to the Association. Use of the Jetty by those who are not property owners of Tides End or Waterways is a privilege, and not a right. Non- compliance with the under listed rules may lead to boats being removed or persons being denied access by the Jetty Management. RULES: 1. Fishing from the Jetty, including the use of hand lines as well as the use of throw nets, is not permitted. 2. All persons entering onto or using the Jetty shall be held personally responsible for any damage caused by them to the Jetty or to moored boats. 3. No swimming is allowed from the Jetty. 4. Car tyres or other projections around the Jetty are not permitted without prior approval of the Jetty Management. 5. The shore side of the Jetty may be used for mooring of canoes only. 6. Children under the age of 12 are allowed onto the Jetty only under adult supervision. 7. Jetty users may not park boats or vehicles on the lawn in the gardens of Tides End other than for short periods, e.g. launching or re- fuelling of boats. 8. The Jetty gate is to be kept locked at all times. 9. The Jetty deck shall be kept tidy and free of any objects at all times. 10. Personal safety of users and safety of those accompanying them is their responsibility, and all notices shall be taken cognisance of. 11. 8 MARCH 2016 NOTICE TO CONTRACTORS WORKING AT TIDES END All Contractors to report to the caretaker Sakkie Van Rooyen ( ) and submit ID documents for all labour working on site prior to commencement of job. Please note that in the interest of all residents, you are not permitted to operate machinery or noisy equipment during unsociable hours. The following is therefore to be noted: Working hours to be contained within 8.00am and 5.00pm Monday Friday. 8.00am 1.00pm Saturday No noisy procedures at weekends or Public Holidays.
