1 Volume 1- Part C Main Report Main Issues Raised on the Proposed Amendments to the Draft County Development Plan 2007 in relation to the Proposed Amendments to the Draft Record of Protected Structures
2 County Development Plan Review Section 12 (8) Manager s Report to Members Volume 1 Part C November 2008 Introduction This Section of the Manager s Report deals with submissions relating to Proposed Change 7.5 which included additions, deletions or amendments to the Record of Protected Structures. The Section is divided into four subsections as follows: Section A: Proposed Change as per the Proposed Amendment Document 19 th September 2008 Section B: General Submissions Received Section C: Manager s Response on Submissions Received on Individual Structures relating to Proposed Change 7.5 Section D: Summary Table of Manager s Response to all Proposed Changes Section A includes the Proposed Change as per the Proposed Amendment Document which was published on 19 th September Section B relates to general submissions received relating to the Record of Protected Structure. Section C includes the Manager s response to submissions relating to individual proposed Record of Protected Structures. Sections D includes a summary table of all the proposed changes incorporated into the Proposed Change 7.5. The general submissions received supported the inclusion of the proposed additions to the Record of Protected Structure in the Proposed Amendment to the Draft County Development Plan. The submissions relating to individual proposed RPS raised a number of issues including support of the proposed change, amendments to the change and removal of a number of proposed RPS. In relation to the requests to remove a structure a number of issues were raised in relating to the merit of including the structure and the implications of the structure being included in the Record of Protected Structure. In some cases it is acknowledged that a building internally may lack any significant original features as a result of alteration and modernisation. However, the remainder of the building could have architectural merit and unusual features that merits its inclusion. A Section 57 Declaration can be sought on each structure by the owner where the Council will establish the extent of what is being protected. In each case the submission have been considered with advice from the Heritage Unit of Cork County Council in order to form the Manager s Response to the proposed change. 2 Cork County Council

8 County Development Plan Review Members Volume 1 Part C 2008 Section 12 (8) Manager s Report to November Section B: GENERAL SUBMISSIONS RELATING TO RECORD OF PROTECTED STRUCTURE The submission supports and welcomes the addition of structures to the RPS the proposed amendment change of the Plan. The Submission from the DOEHLG relates to the issue that structures should not be removed from the RPS unless the structure no longer possesses the special interest that caused it to be included in the RPS in the first instance. While on the other hand the submission agrees that if structures have lost their special interest that they should be removed from the RPS. It does however state that removing a protected structure from the RPS does not in itself alter the intrinsic architectural merit or character of the particular structure. This approach will be considered at the next stage of considering the Record of Protected Structures. The other general submission was received from Mitchelstown Heritage Society which supports the addition of structures to the RPS proposed as part of Submission No received on the Draft plan. It is recommended that the building is included on the RPS in recognition of its architectural merit. No change recommended to the proposed change. Cork County Council 9

It is considered that the building should remain on the RPS for historical reasons. Recommend no change to the proposed amendment 10 Cork County Council
11 Section 12 (8) Manager s Report to Members Review November Part C County Development Plan Volume Proposed Change Former Workhouse wall/entrance, Mitchelstown RPS The relevant planning issues in this case are concerned with - the removal of the proposed RPS or amend the description in line with the NIAH. It is recognised that there are no longer workhouse buildings located within the site. However, the surrounding boundary wall does merit protection. It is considered that the description former Workhouse Wall is more accurate and clear and it is recommended that the wording be amended be to say Former Workhouse Wall in place of Former Workhouse. MODIFY THE PROPOSED CHANGE AS FOLLOWS: RPS Description Former Workhouse Wall Cork County Council 11
12 County Development Plan Review Members Volume 1 Part C 2008 Section 12 (8) Manager s Report to November Proposed Change Relating to Former CBS Monastery, Brigown, Mitchelstown RPS The relevant planning issues in this case are concerned with - the removal of the proposed RPS. Recommendation: The Christian Brothers Monastery forms part of a wider ecclesiastical complex comprising of church, graveyard, convent, schools and Legion of Mary Hall. Although no longer in use the building makes a significant contribution to the town as the monastery for the adjacent Christian Brothers School. The building is both of architectural, historical and cultural merit and should be added to the Record of Protected Structures. Inclusion supported by Ministerial Recommendation. No change recommended to the proposed amendment. 12 Cork County Council
13 Section 12 (8) Manager s Report to Members Review November Part C County Development Plan Volume PROPOSED CHANGE RELATING TO PAROCHIAL HOUSE, BRIGOWN, MITCHELSTOWN RPS The submission raises the matter of the implications of having a structure included as a proposed RPS in relation to proposed work to be carried out to the church. It is considered that the inclusion of the structure as a proposed RPS does not necessarily preclude such work; it is therefore recommended that the building is included as a RPS in recognition of its architectural merit. No change recommended to the proposed change.. Cork County Council 13
14 County Development Plan Review Members Volume 1 Part C 2008 Section 12 (8) Manager s Report to November Proposed Change Relating to CBS School Entrance Gates, Brigown, Mitchelstown RPS The relevant planning issues in this case are concerned with the removal of the proposed RPS. The Minister for the Environment, Heritage and Local Government recommends the gate pillars for inclusion in the Record of Protected Structures and the Heritage Unit concurs with this recommendation. The gate piers are a fine example of excellent craftsmanship. They consist of large ashlar blocks with rustication and ribbon dressing. The gate piers are currently in good condition and do not require any works. No change recommended to the proposed amendment. 14 Cork County Council
15 Section 12 (8) Manager s Report to Members Review November Part C County Development Plan Volume Proposed Change Relating to Kents Farmhouse, Ballynamona RPS The relevant planning issues in this case are concerned with - the removal of the proposed RPS. This building warrants inclusion in the Record of Protected Structures in recognition of its vernacular architectural features. The building contains a very steeply pitched roof, sash windows of varying types, which add interest to the main elevations of the building, while the building position relative to the road and the general group of outbuildings creates a strong focal point in the landscape. However, the notification letter was issued to a John Kent, therefore it is accepted that adequate notification was not given. It light of this it is recommended that the building is not added to the Record of Protected Structures in this instance. It should be noted that consideration may be given to its proposed addition at a future date and is included on the National Inventory of the Architectural Heritage. Recommend to reject the proposed change from the proposed amendments. REJECT THE PROPOSED. Cork County Council 15
16 County Development Plan Review Members Volume 1 Part C 2008 Section 12 (8) Manager s Report to November PROPOSED CHANGE RELATING TO JOHN MULLINS THATCHED FARMHOUSE BALLYBEG RPS The relevant planning issues in this case are concerned with the removal of the proposed RPS. The thatch house has a high level of intactness and should be included in the Record of Protected Structures. However, the notification was sent to a John Mullins and the submission has identified Mr Daniel Mullins as the owner. On the basis of the issue with the notification, it is considered that this structure cannot therefore be added to the Record of Protected Structures at this time. It should be noted that consideration may be given to its proposed addition at a future date. Recommend to reject proposed change REJECT THE PROPOSED. 16 Cork County Council
17 Section 12 (8) Manager s Report to Members Review November Part C County Development Plan Volume PROPOSED CHANGE RELATING TO 18TH CENTURY KINGSTON FARMHOUSE KILSHANNY RPS The relevant planning issues in this case are concerned with the removal of the proposed RPS. The case has been put forward that the building has been altered by modern interventions and therefore does not warrant inclusion in the Record of Protected Structures. On the basis of the information received and that the structure does not feature on the NIAH it is recommended to remove the proposed structure from the RPS. Recommend to reject proposed change. CORK ST, MITCHELSTOWN RPS The relevant planning issues in this case are concerned with - the removal of the proposed RPS. The building is now located within a Proposed Architectural Conservation Area. It is considered that this provides sufficient protection of the structure. Furthermore on the basis of the information received in the submission, and it is recommended that the proposed structure be removed from the Record of Protected Structures. Recommend to reject proposed change. REJECT THE PROPOSED. 18 Cork County Council

While it is acknowledged that the building internally lacks any significant original features, the remainder of the building does have architectural merit and unusual features, and also contributes to the streetscape. It is therefore recommended that the building be added to the Record of Protected Structures. This is also a recommendation from the Minister of Environment, Heritage and Local Government. Recommend no change to the proposed amendment Cork County Council 19

On the basis of the information received in the submission it is recommended that the building be removed as a proposed Record of Protected Structures. Recommend To Reject The Proposed Amendment. 21 Section 12 (8) Manager s Report to Members Review November Part C County Development Plan Volume Proposed Change relating to Former Railway Hotel, Brigown/Upper Cork St RPS The relevant planning issues in this case are concerned with - the removal of the proposed RPS. This building has a number of unusual architectural features. It is a corner site, five-bay, two storey structure, with attic accommodation over. Original features include, rendered chimney stacks, terracotta chimney pots, rendered walls, rusticated quoins, decorative cornices and keystones and moulded rendered surrounds. It is therefore recommended that this building be added to the Record of Protected Structures in recognition of its architectural and historic merit. The Minister for the Environment, Heritage and Local Government has also included this building within his Ministerial Recommendations. Recommend no change to the proposed amendment. On the basis of the information received in the submission it is recommended that the building be removed as a proposed Record of Protected Structures. 23 Section 12 (8) Manager s Report to Members Review November Part C County Development Plan Volume PROPOSED CHANGE RELATING TO MITCHELSTOWN CASTLE STABLEYARD, MITCHELSTOWN RPS The relevant planning issues in this case are concerned with - the removal of the proposed RPS based on a number of issues or amend in accordance with the NIAH survey. Taking into consideration the submission and the NIAH survey it is recommend that the front elevation of the stable yard building be included on the RPS. This is a pedimented three bay entrance breakfront to centre having occlus to pediment. It is recommend that the proposed change be amended by changing the description of the proposed RPS to Farmyard Complex as per NIAH. Recommend to modify the proposed change. 24 County Development Plan Review Members Volume 1 Part C 2008 Section 12 (8) Manager s Report to November Proposed Change Relating to Carillon Lodge, Courtmacsherry Harbour RPS The submissions support the inclusion of Carillon Lodge as a proposed RPS. The building has been included as a proposed Record of Protected Structures in recognition of its architectural merit and historical associations. Carillon Lodge is a very unusual octagonal gate lodge with gothic style windows and is associated with Courtmacsherry House. It is therefore recommended that the building be added to the Record of Protected Structures. No changed recommended to the proposed change. 24 Cork County Council
25 Section 12 (8) Manager s Report to Members Review November Part C County Development Plan Volume Proposed change Relating to Rockville Station Road, Carrigtwohill RPS The submission requests the removal of the proposed RPS. This house consists of a primary residential house, which incorporates an earlier vernacular dwelling, and a series of significant outbuildings to the rear and side of the existing dwelling. This complex of buildings has significant architectural merit and contributes to the overall streetscape along Station Road, which contains a number of historic structures. It is therefore recommended that this building is added to the Record of Protected Structures. No change recommended to the proposed amendment. Cork County Council 25

This church dates to While it has obviously undergone some changes it still retains much of its original historic fabric. The building is also of historical merit being built on the site of an earlier church. It is therefore recommended that the building is added to the Record of Protected Structures. No change recommended to the proposed amendment. : 26 Cork County Council
