1 TAB Terms & Conditions ("Conditions of Entry") Promotion TAB Tipping Champion $1 Million Promotion Promoter Tabcorp Holdings Limited ABN of 727 Collins Street, Melbourne VIC 3008 Promotional Period Start Date: 04/04/2018 at 4.00pm (AEST) End Date: 14/04/2018 at 6.30pm (AEST) Eligible Participants How to enter Entry is open to VIC, NSW, NT, TAS, QLD, ACT and WA residents aged 18+ who hold a verified TAB Account with an active registered phone number ( Registered Number ) and who continue to hold an active and unrestricted TAB Account at the time of the award of the relevant prize. The directors, officers and employees of the Promoter and its related bodies corporate and their immediate families and any of the Promoter s contractors associated with this Promotion and their immediate families are not eligible to participate in this Promotion. Excluded Persons are not eligible to participate in this Promotion. Excluded Persons means any person identified as a minor, a self-excluded patron or an involuntarily excluded patron. If a person is identified as an Excluded Person, the Promoter reserves the right to refuse to allow the person to take part in the Promotion, or receive, any or all aspects of the Prize, and the Promoter will notify any relevant regulator accordingly where required by law to do so. Eligible Participants who satisfy the following criteria (each, an Eligible Entrant ) during the Promotional Period can enter the Promotion by: Rules of the Championships Day 1 game 1. Logging in to their TAB Account on either the TAB app or tab.com.au; and 2. Navigating to the TAB Tipping Champion promotional page on the TAB App or on tab.com.au, and selecting a runner for a virtual $10 each-way bet in each of the available ten (10) races to be run on Day 1 of the Championships held at Royal Randwick on Saturday 7 April 2018 ( Championships Day 1 ) in accordance with all instructions and FAQs provided on the TAB App or on tab.com.au. Eligible Entrants must select all ten (10) runners prior to the official starting time of race 1 at Royal Randwick on Saturday 7 April Once an Eligible Entrant submits their selected runners, the selections are final and cannot be changed. Eligible Entrants will select a horse for a virtual $10 each-way bet on their selected runner for each of the ten (10) races. At the end of each of the ten (10) races the dividends of all runners will be calculated in accordance with the final dividends of the official NSW TAB tote. If an Eligible Entrant s selected runner is scratched, they will receive the official NSW TAB tote favourite as their substitute runner. The official NSW TAB tote favourite will be determined at the conclusion of the race in question once all dividends are final. At the conclusion of race 10 of Championships Day 1 (being the final race on the card) the Eligible Entrant who has recorded the highest virtual winnings will be deemed the Leading Tipster of the Promotion and will receive $100,000. If there is more than one Eligible Entrant who has recorded the highest virtual winnings, they will also be deemed the Leading Tipster. The $100,000 prize pool will be shared equally between all Leading Tipster/s. In the event that there is more than one Leading Tipster, all Leading Tipsters will enter a random Prize Draw where 1 (one) Leading Tipster will be selected for a chance to win an additional $1,000,000 (refer to the section titled Conduct of Prize Draw for more information). Abandoned Race - Singular o In the event that a race is run and abandoned by the Racing NSW Stewards before the runners finish, there will be no NSW TAB Tote dividend and therefore no winnings will be recorded. All participating Eligible Entrants will receive $0 for this abandoned event. Abandoned Races - Multiple o One (1) or more races of the ten (10) race card need to have been run in order for an Eligible Entrant to be deemed the Leading Tipster/s. Abandoned meeting o If, due to unforeseen circumstances, the meeting is abandoned before race 1, the competition will be null and void and no prizes will be awarded. Postponed meeting v1

2 o If a meeting is postponed due to unforeseen circumstances and all races will be rescheduled to run on a later date then the competition will remain available for all Eligible Entrants to participate in on that postponed date. Postponed races o If one (1) or less races are run, or the meeting is abandoned due to unforeseen circumstances and the remaining scheduled races will be postponed to a later date, then all competition entries will remain unchanged until the postponed races are run and the winnings are calculated. Number of entries Eligible Participants may only enter the Promotion 1 (one) time. Conduct of Prize Draw In the event that there is more than one Leading Tipster, a Prize Draw will be conducted as follows. All Eligible Entrants deemed as a Leading Tipster, will enter a draw ( Prize Draw ) which will take place at 11:00am (AEST) on 9 April 2018 at Gadens Lawyers, Level 25, 600 Bourke St Melbourne VIC In this draw, the first Leading Tipster randomly drawn from amongst all other Leading Tipsters is the Prize Draw Winner. The Promoter may draw additional reserve entries in the draw and record them in order, in case the Winner is deemed invalid, or the prize unclaimed ( Reserve Winner ). Prizes The Championships Day 1 prize is that the Eligible Entrant who has recorded the highest virtual winnings will receive $100,000. If there is more than one Eligible Entrant who has recorded the highest virtual winnings, the $100,000 prize pool will be shared equally between them. The Prize awarded to the sole Leading Tipster or, in the event that there is a Prize Draw, the Prize Draw Winner ( Winner ), is the opportunity to win $1,000,000 by selecting the winning horse ( Selected Horse ) in a Group 1 race nominated by Tabcorp ( Nominated Race ) on Day 2 of the Championships held at Royal Randwick on 14 April 2018 ( Championships Day 2 ). The Winner must also select a second horse ( Secondary Horse ) which will be used as the Winner s selected horse to win the Nominated Race if their Selected Horse is scratched. The Winner will also receive two (2) Members tickets to attend the Championships Day 2, two (2) return airfares to Sydney Domestic airport, and three (3) nights accommodation in Sydney from 12 April to 15 April (see section titled Prize Description for more information). Rules of the Championships Day 2 Prize Tabcorp reserves the right to select the Nominated Race at its own discretion. The Nominated Race will be selected on Tuesday 10 April Once the Nominated Race is selected it cannot be changed by the Promoter or the Winner. If the Winner does not respond to any contact efforts made by the Promoter by 9am (AEST) 11 April the Winner will forfeit their position and a Reserve Winner will be notified, using their Registered Number and the address in their TAB account. The Winner must notify the Promoter of their Selected Horse and Secondary Horse in writing by by 10am, Thursday 12 April If the Winner has not communicated their Selected Horse to the Promoter by 10am on Thursday 12 April 2018, the Winner will be allocated the TAB fixed odds race favourite for the Nominated Race as at 8.00am on Saturday 14 April 2018 ( Allocated Horse ). If there is more than one favourite for the Nominated Race at 8.00am on Saturday 14 April 2018, the horse with the lower saddlecloth number will become the Winner s Allocated Horse. If the Selected Horse is scratched for any reason prior to the jump of the Nominated Race, the Winner s selected Secondary Horse will become the Winner s selected horse to win the Nominated Race. If the Secondary Horse is also scratched, the Allocated Horse will become the Winner s selected horse to win the Nominated Race. If the Allocated Horse is scratched for any reason prior to the jump of the Nominated Race, the Winner will be given the horse with the next available sequential saddlecloth number (for example, if the Allocated Horse is wearing number 3 and both numbers 3 and 4 are scratched, the Winner will be given horse number 5). Major Prize: If the Selected Horse (or the Secondary, Allocated or any subsequent Allocated Horse as the case may be) wins the Nominated Race, the Winner will receive a prize of $1,000,000. Official results only, protests, scratchings apply (as defined in the NSW Totalizator Betting Rules). If there is a dead heat for the winner of the Nominated Race which includes the Selected Horse (or the Secondary, Allocated or any other subsequent Allocated Horse as the case may be), the Major Prize will be reduced proportionally to the number of horses involved in the dead heat (i.e. if it involves two (2) horses, the Winner will receive $500,000, if it involves four (4) horses, the Winner will receive $250,000) v1

3 Abandoned Nominated Race o In the event that the Nominated Race is run and abandoned by the Racing NSW Stewards before the runners finish and will not be rescheduled, the Winner will not have another opportunity to win the Major Prize. Postponed Nominated Race o In the event that the Nominated Race is postponed to a later date due to unforeseen circumstances, the Winner will have the opportunity to win $1,000,000 by selecting the winning horse of the postponed Nominated Race. Prize Description Value (per prize) Championships Day 1 Prize: $100,000 (to be paid by bank $100,000 transfer to the Leading Tipster/s nominated Australian bank account held in their name). Major Prize: $1,000,000 to be paid by cheque to the Winner Maximum total prize value: $1,000,000 In addition to the Major Prize, the Winner will receive the following prizes Two (2) Members tickets to attend The Championships Day 2 (14 April 2018). Two (2) Economy Return Airfares to Sydney Domestic airport from the nearest capital city of the Winner s choice. (Arrive 12/04/18, Return 15/04/18) Three (3) night s accommodation at the Primus Hotel (12 April, 13 April, 14 April) Transfers to and from Sydney airport to hotel Members Tickets - $310 for two people. Return Airfares - $1,400 for two people. Accommodation - $2,700 for two people. Transfers from Sydney Airport - $160 TOTAL PRIZE POOL VALUE - $1,104,570 Conditions To enter the Promotion you must be available to travel to Sydney 12 April to 15 April By participating in the Promotion, the Winner consents to: o Attending Royal Randwick on 14 April 2018; Notification of prize winners o o Being filmed at Royal Randwick on 14 April 2018 while the Nominated Race is run; Being available for any reasonable Media (including TV, Radio, Social, Digital) requests relevant to the Promotion and organized by the Promoter between the dates 12 April to 20 April. Unless otherwise stated, each Winner is responsible for all associated costs with the Prize, including where applicable, travel, accommodation and any other ancillary costs. The Winner must re-verify their full legal name, date of birth and current residential address by providing the Promoter with original, certified copies of their identification documents in accordance with the TAB Account Verification Requirements as set out at tab.com.au. The Winner will not be awarded the Prize until their identity has been successfully re-verified by the Promoter. The Winner will notify the Promoter of the full legal name, date of birth and current residential address of the guest who will accompany the Winner to Royal Randwick on Championships Day 1. Prize values are GST inclusive, are in Australian dollars and are the recommended retail values as provided by the supplier (or an appropriate estimate of such value) and are correct at time of printing. The winner(s) must provide the Promoter with the details of their nominated Australian bank account that is held in the winner s name within five (5) business days of being notified that they have won a relevant prize by sending the Promoter a copy of a bank statement showing the winner s nominated bank account details, name and current residential address. The Promoter will complete their payment of both The Championships Day 1 prize ($100,000) and the Championships Day 2 $1,000,000 by Monday 30 April, The Leading Tipster/s of the Championships Day 1 will be notified in writing using the address provided in their TAB Account by 9 April The Winner of the Prize Draw will be notified: by phone using their Registered Number on 10 April 2018; in writing by 5.00pm (AEST) on 10 April 2018 using the address provided in the Winner s TAB Account; and v1

4 publicly, by their details being published on tab.com.au on 10 April 2018 and in a national circulating newspaper. If the Winner does not respond to any contact efforts made by the Promoter by 9am (AEST) 11 April the Winner will forfeit their position and a Reserve Winner will be notified, using their Registered Number and the address in their TAB account. General Terms and Conditions Any person entering this promotion ( you ) acknowledges and agrees that you have read these Conditions of Entry and that by entering the Promotion you are deemed to have accepted these Conditions of Entry. 1. Taxes Any taxes which may be payable as a consequence of the Winner or Unclaimed Prize Winner receiving the Prize are the sole responsibility of the Winner/Reserve Winner. The Promoter encourages the Winner/Reserve Winner to seek independent financial and tax advice. 2. Exclusion of Liability a. Whilst the Promoter will use all reasonable endeavours to arrange the delivery of the Prize, by entering this Promotion, a Winner/Reserve Winner acknowledges that circumstances beyond the control of the Promoter may prevent the delivery of the Prize (including the failure by the Winner/Reserve Winner to notify the Promoter of any change to their delivery details). In such circumstances where the Promoter forms a reasonable belief that any delay or loss of the Prize has not been caused or contributed by the Winner s negligence, fraud or misconduct, the Promoter may (if circumstances permit) re-deliver the Prize to the Winner. b. To the extent permitted by law, the Promoter is not liable for any loss, including, but not limited to, direct, consequential (including economic) or indirect loss or any loss of profits, by reason of any act or omission, deliberate or negligent, by the Promoter or their servants or agents, in connection with this Promotion or the arrangement for supply, or the supply or failure to supply, of any goods or services by any person to a Winner or Reserve Winner. c. Nothing in these Terms and Conditions affect, nor is intended to affect, any rights that you might have that are not able to be excluded under applicable Australian consumer protection laws. 3. Use of Personal Information / Marketing a. The Promoter complies with the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). b. Any entries become the property of the Promoter. Any information provided will be used by the Promoter for the purpose of conducting this Promotion. c. The Promoter may disclose your personal information to its contractors and agents to assist in conducting this Promotion or communicating with you. d. By entering the Promotion, you consent to your personal information being collected, used and disclosed by the Promoter, its agents, affiliates, related business companies, other companies associated with this Promotion, and business partners for any promotional activities, including your personal participation in reasonable promotional activities as requested by the Promoter, and any marketing and publicity purposes without any further reference, payment or other compensation to you. e. Your consent includes authorising the Promoter, its agents, affiliates, related business companies, other companies associated with this Promotion and business partners to send you future direct mail and/or electronic messages including but not limited to, SMS, MMS, and regarding any promotional, marketing and publicity activities. f. You consent to the notification of your personal information to any relevant regulator or state or territory department where required by law to do so. Your personal information may be disclosed to State and Territory lottery departments and Winner s names published as required under the relevant lottery legislation. The Promoter will use reasonable endeavours to provide you reasonable prior notice where their personal information is going to be disclosed to State and Territory lottery departments or published under lottery legislation. A request to access, update or correct any personal information should be directed to the Promoter v1

You consent to the publication of their name and suburb of residence (however their full address will not be published) and agree to participate in reasonable Promotion activities as requested by the Promoter without any further payment or compensation. h. You understand and accept the Promoter s Privacy Policy located on the Promoter s website, a. The Promoter, its employees, officers, agents and its parent companies and subsidiaries are not responsible for and shall not be liable for: i. any condition caused by events beyond the control of the Promoter that may cause the Promotion to be disrupted or corrupted; ii. any injuries, losses (including, without limitation, loss of profits), or damages of any kind caused by the Prize or resulting from acceptance, possession, use, or misuse of the Prize, or from participation in the Promotion or downloading material from tabrewards.com.au or tab.com.au; or iii. any printing or typographical errors in any materials associated with the Promotion. b. The Promoter reserves the right to: i. conduct a review of publicly available information and other information available to the Promoter in relation to the Winner, Reserve Winner and, if applicable, their guest/s (which may include politicallyexposed person, public record, social media, adverse media and other background checks) for the purpose of assessing the honesty and integrity of the relevant Winner, Reserve Winner and, if applicable, their guest/s; ii. in its sole and unfettered discretion, disqualify a Winner and/or Reserve Winner or, if applicable, require a Winner and/or Reserve Winner to select an alternative guest, where any check referred to in paragraph 4(b)(i) returns an adverse outcome; iii. cancel or suspend the Promotion, should the security, fairness, integrity, or proper operation of the Promotion be compromised in any way by way of any virus or bugs in the IT system used for this Promotion, unauthorised human intervention, or other causes beyond the reasonable control of the Promoter; iv. disqualify any Eligible Participant who engages in offensive, illegal or objectionable conduct in respect of this Promotion; v. disqualify any Eligible Participant who tampers with the entry process, or who submits an entry that is not in accordance with these Terms and Conditions; vi. cancel, terminate, modify or suspend the Promotion in accordance with any written directions given by any relevant government or regulatory authority to do so; vii. request a Winner or Reserve Winner provide proof of age, identity or proof of residency at the nominated Prize delivery address. c. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, systems failures, tempests, natural disasters, acts of God, civil unrest or strikes, the Promoter may in its absolute discretion cancel the Promotion or part of the Promotion and recommence it from the start on the same conditions subject to Australian law. d. By entering this Promotion, you acknowledge that it is a condition of accepting the Prize that you may be required to sign a legal release in a form reasonably determined by the Promoter. e. To the extent that a situation or issue arises for which these Terms and Conditions make no provision or in relation to which the relevant Terms and Conditions are unclear, the Promoter will make a decision regarding such situation. You will have the right to request an internal review of the Promoter s decision. Subject to any regulator direction to the contrary, the decision of the internal review will be final and binding. f. In the event that a Winner or Reserve Winner is identified as being in breach of these Terms and Conditions (the Refused Winner ), the Promoter reserves the right to refuse to allow the Winner to take part in, or receive, any or all aspects of the Prize, and the Promoter will notify any relevant regulator accordingly where required by law to do so v1
