1 1001 Boulders Parkway Suite 300 Richmond, VA P F MEMORANDUM TO: FROM: PROJECT: RE: Louisa County Timmons Group Louisa Regional Business Park Site Assessment Threatened and Endangered Species Resource Database Summary DATE: September 14, 2018 Timmons Group has completed a preliminary desktop evaluation to identify known and potential species occurrences and habitat of state and federally threatened and endangered (T&E) species at the Louisa Regional Business Park Project (Site). This evaluation included database queries utilizing: U.S. Fish and Wildlife Service (USFWS) Information for Planning and Conservation search (IPaC), USFWS Bald Eagle Concentration Areas mapping tool, The Virginia Department of Game and Inland Fisheries (VDGIF) Virginia Fish and Wildlife Information Services (VaFWIS), VDGIF Wildlife Environmental Review Map Service (WERMS) ArcGIS mapping tool, VDGIF Northern Long-eared Bat (NLEB) and Little Brown Bat Location and Roost Trees mapping tools, Virginia Department of Conservation and Recreation - Department of Natural Heritage (DCR-DNH) watershed search database, and The Center for Conservation Biology (CCB) Eagles Nest Locator. The VDGIF-VaFWIS database search included all areas within the project limits and areas within a two (2) mile radius of the project limits. WERMS is an ArcGIS server database which contains map, feature, and geodata service on critical wildlife resources. This service allows users to view, query, and analyze information compiled into one database from numerous resources which provide data on both federal and state protected species. The DCR-DNH database searched for any threatened or endangered species known to occur anywhere in the South Anna River-Harris Creek subwatershed (HUC YO04). The IPaC database was reviewed for an official federal T&E species list within the project limits. NLEB, little brown bat, and bald eagle mapping tools and locators show the known locations or habitats in Virginia for these protected species. Based upon the results of the evaluation, data indicates the surrounding habitat is conducive to the presence of two (2) federally endangered/state endangered (FESE) species, one (1) federally threatened/state threatened (FTST) species, one (1) federally threatened (FT) species, three (3) state endangered (SE) species, and four (4) state threatened (ST) species as listed on the following page: Page 1 of 2

Atlantic Pigtoe (Fusconaia masoni) ST (Freshwater Clam) 10. Green Floater (Lasmigona subviridis) ST (Freshwater Mussel) 11. Migrant Loggerhead Shrike (Lanius ludovicianus migrans) ST (Pine-Grassland Bird) The potential for impacts to these T&E species as a result of this Site s development are summarized below: The Northern Long-eared Bat (NLEB), which was noted in the USFWS IPaC search results (Attachment 1), may require additional evaluation if tree clearing is proposed. However, because there are no known hibernacula or maternity roosts for any of these bat species within a two (2) mile radius of the project limits (Attachment 2), no project related restrictions are expected. Therefore, the Project will not likely be affected by this species as outlined in the USFWS NLEB Final 4(d) Rule. Further coordination with USFWS and the Army Corps of Engineers will be required if a wetland or stream impact is required. VDGIF-VaFWIS has no confirmed documentation of any of the protected species within the two-mile buffer of the project limits (Attachment 2). The NLEB and Yellow Lance species were identified by the USFWS IPaC species search (Attachment 1 and 3). USFWS will likely request a pre-construction survey to clarify whether the Yellow Lance species is currently present within the project limits in order to determine the extent of potential impacts, and to develop a plan to avoid impacts to this mussel species, if found. No bald eagles have been documented by USFWS or from the CCB Eagle Nest Locator within the project limits (Attachment 1, 2 and 4), and are not documented within the 2-mile search radius buffer. If found, USFWS eagle guidance recommends that a 660-foot buffer between project activities and eagle nests be maintained. The species list fulfills the requirements of the U.S. Fish and Wildlife Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended (16 U.S.C et seq.). Any activity proposed on National Wildlife Refuge lands must undergo a 'Compatibility Determination' conducted by the Refuge. Please contact the individual Refuges to discuss any questions or concerns. New information based on updated surveys, changes in the abundance and distribution of species, changed habitat conditions, or other factors could change this list. Please feel free to contact us if you need more current information or assistance regarding the potential impacts to federally proposed, listed, and candidate species and federally designated and proposed critical habitat. Please note that under 50 CFR (e) of the regulations implementing section 7 of the Act, the accuracy of this species list should be verified after 90 days. This verification can be completed formally or informally as desired. The Service recommends that verification be completed by visiting the ECOS-IPaC website at regular intervals during project planning and implementation for updates to species lists and information. An updated list may be requested through the ECOS-IPaC system by completing the same process used to receive the enclosed list. The purpose of the Act is to provide a means whereby threatened and endangered species and the ecosystems upon which they depend may be conserved. Under sections 7(a)(1) and 7(a)(2) of the Act and its implementing regulations (50 CFR 402 et seq.), Federal agencies are required to utilize their authorities to carry out programs for the conservation of threatened and endangered

A Biological Assessment is required for construction projects (or other undertakings having similar physical impacts) that are major Federal actions significantly affecting the quality of the human environment as defined in the National Environmental Policy Act (42 U.S.C. 4332(2) (c)). For projects other than major construction activities, the Service suggests that a biological evaluation similar to a Biological Assessment be prepared to determine whether the project may affect listed or proposed species and/or designated or proposed critical habitat. Recommended contents of a Biological Assessment are described at 50 CFR If a Federal agency determines, based on the Biological Assessment or biological evaluation, that listed species and/or designated critical habitat may be affected by the proposed project, the agency is required to consult with the Service pursuant to 50 CFR 402. In addition, the Service recommends that candidate species, proposed species and proposed critical habitat be addressed within the consultation. More information on the regulations and procedures for section 7 consultation, including the role of permit or license applicants, can be found in the "Endangered Species Consultation Handbook" at: Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require development of an eagle conservation plan ( eagle_guidance.html). Additionally, wind energy projects should follow the wind energy guidelines ( for minimizing impacts to migratory birds and bats. Guidance for minimizing impacts to migratory birds for projects including communications towers (e.g., cellular, digital television, radio, and emergency broadcast) can be found at: and comtow.html.
