12 SPECIAL RULES: HUNT AUCTION 19 October 2018 Cape Wildlife Group s standard Rules of Auction will apply to all lots, unless in contradiction with any of the terms set out in the Special Rules of Auction, in which case the provisions of the Special Rules of Auction will apply. 1. Kindly note that Biltong packages, Trophy Packages and Rowland Ward packages are distinguished as follows, and unless determined otherwise in the Auction Catalogue, the Buyer hereby accepts that the aforementioned will have the following meaning: 4. The buyers must pay 25% of the winning bid + VAT on drop of the hammer, this to be followed up with 25% + VAT due March 2019 and the balance to be paid direct to the seller 30 days before a mutually agreed on hunting date. Biltong Package : includes the hunting of an animal for the utilization of its meat. This includes both males and females within any age category. Trophy and Rowland Ward quality animals (as defined below) may not be hunted, unless the Seller expressly determines otherwise. 5. The Buyer shall not be entitled to exercise any rights in respect of any purchased goods unless the total amount reflected on the Auctioneer s invoice in respect of such goods, has been paid in full Trophy Animal/Package : includes the hunting of any adult animal that is a good representative, with all the defining characteristics, of the specific specie. Rowland Ward animals is not guaranteed. Rowland Ward Package : Includes the hunting of animals that qualify for the minimum Rowland Ward requirements. The Buyer is informed herewith that the Owner/Seller may require a portion of the purchase price for the successful fulfilment of his or her duties and hereby consents thereto that the Auctioneer may release such funds to the Owner/Seller before a hunt is undertaken. The Auctioneer will inform the Buyer should the aforementioned apply. Hunting packages must be redeemed in accordance with the description of the lot(s) concerned. In the absence of a provisional date(s) in the auction description, all hunts must be undertaken in the 2019 hunting season, unless otherwise agreed to in writing between the Owner / Seller and the Buyer and approved by the Auctioneer. For the avoidance of any doubt the Owner / Seller and the Buyer must arrange a date for the hunt in respect of a package purchased by a Buyer within 30 days after the auction and must notify the Auctioneer in that respect The Owner/Seller indemnifies the Auctioneer and/or Cape Wildlife Group against any claim(s) regarding the information furnished by the Owner/Seller which might be incorrect. In the event of any dispute, the Buyer shall only have a claim against the Owner/Seller and not against the Auctioneer and/or Cape Wildlife Group. In the event where a Buyer allows another person to purchase on his or her buyer s number, the registered Buyer shall be liable for payment of such purchases. The Auctioneer accepts no liability for any withdrawal of goods from sale. The Auctioneer reserves the right to amend these Rules of Auction in writing.
