2 Five Rules of Firearms Safety ALWAYS Treat All Firearms as if they are Loaded Treat every firearm that you encounter as if it were a loaded firearm until you have personally verified its condition both visually and physically. ALWAYS Keep Firearms Pointed in a Safe Direction Never point the muzzle of your firearm at anything you are not willing to destroy. This includes YOURSELF. ALWAYS Keep Your Finger Off the Trigger Until Ready to Shoot Make sure that you keep your finger off the trigger of your firearm until you are on target and have made a conscious decision to shoot. ALWAYS Be Aware of Your Target and What is Beyond It Pay particular attention to your target. Be absolutely sure that it deserves to be shot BEFORE you fire. Be aware of the area around and behind your target. You are responsible every round that leaves your firearm. Make sure you know where it will go. ALWAYS Maintain Positive Control of Your Firearm at All Times You are responsible for making sure that your firearm is under your control at all times. If you do not have it in your possession, you must insure that it will not fall into the hands of anyone who might use it to injure themselves or someone else. Safe Gun Handling Major Causes of Gun Accidents Ignorance May not know how to operate the firearm May not know gun safety rules Negligence Knows gun safety rules but fails to apply them Acts carelessly when handling or using firearms The Combat Triad Mindset Marksmanship Gun Handling 2
3 Characteristics of a Sociopath Glib and superficial, egocentric and self-important. Lack of empathy, remorse or guilt. Weak and vulnerable are their favorite targets. Deceitful and manipulative. Poor behavior controls. Can be extremely impulsive. Needs excitement. Lack of responsibility. Exhibits anti-social behavior. Developing the Combat Mindset Understanding the Contradictions Resolving the Legal, Moral, Social and Religious Issues. Overcoming the Natural Reluctance to Kill or Injure Another Person. Making Life Preparations (having a will, life insurance, etc.) Getting Your Mind in the Right Place Deciding Your Own Life is Worth Defending. Don t think Survive, think Win. You CANNOT WORRY about what happens to your OPPONENT. Accept the fact that you WILL be INJURED. Go on the OFFENSIVE - ATTACK YOUR ATTACKER. Mental Conditioning - Dealing with Fear Fear is the physical and emotional result of a lack of preparation, awareness or confidence. Causes of Fear Fear of the unknown Fear of being injured or killed Fear of breaking the law Fear of not doing the right thing Physiological Responses to Fear Elevated heart rate and blood pressure Rapid respiration and trembling Pronounced loss of fine motor skills Tunnel vision, dry mouth, shaky voice Fear can paralyze, causing you to hesitate or Freeze 3
4 Mental Conditioning - Combating Fear Steps to Combating Fear Acknowledge the fact that you are afraid. Avoid dwelling on the danger or the chance of failure. Take control of your body using autogenic or combat breathing. Focus your mind on getting through the danger. Expect the unexpected. Turn fear into anger which acts as a motivator. Fear should be the trigger for IMMEDIATE and DECISIVE action. Anatomy of a Violent Criminal Attack Criminal Acts Have a Script Selecting a Victim The Approach and Initial Interview Taking Control of the Victim Taking the Prize The Getaway Three Pillars of Success for a Criminal I want it to be easy I don t want to get hurt I don t want to get caught Don t Participate in the Script and Knock Down the Pillars Threat Responses Avoid the Threat. Use Awareness and Intuition Retreat from the Threat. Create Distance and Protect Boundaries De-escalate the Threat Use Voice and Distraction Confront the Threat 4
5 Levels of Awareness Condition White -- Unaware of Surroundings Can be self imposed on imposed by environment Condition Yellow -- Relaxed Awareness Should be situationally and environmentally aware while armed. Condition Orange -- Potential Threat Identified Act to Reduce Threat - Use What If? Games to Visualize Response Condition Red -- Threat is Real - Action Required Action Taken Must Be Immediate and Decisive Mental Conditioning - Intuition Intuition is the ability to sense or know immediately without reasoning. Intuition relies on the brain s pattern matching capabilities. Stay alert and aware of your surroundings. Look for the unusual. Assess the situation and plan your actions accordingly. Maintain a confident and alert mindset. Do not dismiss your intuition because you don t have facts. Mental Conditioning - Boundaries 6 ft 12 ft 25 ft 25+ ft Use Physical Distance and / or Objects to Maintain Boundaries 5
6 Threat Response - Confront Think about what you might do before an attack occurs. What is your potential aggressor doing (demeanor and actions)? Does your attacker have any sort of weapon (knife, gun, etc.)? How close is your potential attacker? Will you have the opportunity to draw your firearm? Carry another type of personal protection device. Never give up or surrender your firearm. Never Give Up... High Continuum of Force Firearm Justification Required Knife Physical Force Level of Force Low OC Spray Taser Light Distraction Voice No Justification Required Distance Leave Area Level of Threat High 6
7 Criminal vs. Civil Legal System Criminal Laws made and enforced by Government Burden of proof is beyond a reasonable doubt Right to legal counsel Presumed innocent No illegal search or seizure Right to a jury trial Civil Laws come from English Common Law and are enforced by individuals Burden of proof is based on the greater weight of evidence No right to counsel No presumption of innocence Full disclosure of all relevant information is required by all parties Cannot be compelled to testify against yourself Penalties include loss of money, property, liberty or life Limited right to jury trial Silence can be seen as evidence of guilt Penalties include only loss of money or property Criminal and Civil Liability You should NOT assume that you understand the meaning of a criminal law by simply reading the statute and attaching your own meaning or dictionary definitions to it. You may be charged criminally if you commit an act of gross negligence while attempting to defend yourself with a firearm. A criminal may NOT recover damages in a Civil action if their injuries occur during the commission of, attempted commission of or while fleeing the scene of a FELONY criminal act. Criminals in a Civil action may NOT deny a prior Criminal conviction that is relevant to the Civil action. What exactly is Justification? It is an explanation of why a person takes a particular course of action in a particular set of circumstances. Can be used as a legal defense in either a Civil or Criminal proceeding Would a reasonable person respond in substantially the same manner in a similar set of circumstances? Is the threat that is being defended against credible? Is the response to the threat appropriate to the level of threat being experienced? Any use of force must be reasonable and appropriate to the level of threat that is being manifested. 7
8 Justification as a Legal Concept Justification must be provided for ANY use of force, either Physical Force or Deadly Force There is NO justification for the reckless injury or killing of an innocent bystander. Burden of Proof is on the Prosecution to show that you were NOT justified in using force. Does the use of any force end when the threat ends? Words alone NEVER justify the use of any type of force. Disparity of Force and Justification Disparity of Force involves factors that change the nature of the threat affecting Justification. Factors include: Age Sex Numbers Size Physical Infirmity Special Skills Presence of Drugs or Alcohol Criminal Offenses Involving Firearms Negligent Homicide Manslaughter Second Degree Murder First Degree Murder Endangerment Threatening or Intimidating Aggravated Assault Shooting at Structures Unlawful Discharge Criminal Trespass Disorderly Conduct Misconduct with a Firearm 8
9 Castle Doctrine Laws Use of lethal or physical force in self-defense is justified using Castle Doctrine if the following apply: Someone has unlawfully or forcefully attempted to enter or has entered your residence, occupied vehicle, place of business, land or a building that you lease or any other place where you have a right to be. AZ law presumes that if someone is unlawfully or forcefully entering your residence or occupied vehicle, anyone in the residence or vehicle is considered to be under an imminent threat of deadly harm. Exceptions include someone who has a legal right to be in the residence or vehicle; a parent, grandparent or other person who has legal custody of of child occupying the residence or vehicle; or a law enforcement officer acting in performance of their official duties. Defensive Display of a Firearm May be used when and to the extent a reasonable person would believe that physical force is necessary to protect against the use of or attempted use of unlawful physical or deadly force. Defensive Display includes: Verbally informing a person that you have a firearm available for use. Exposing or displaying a firearm in a manner that a reasonable person would understand was meant to protect oneself or another from the unlawful use of physical or deadly force. Placing your hand on a firearm while the firearm is contained in a pocket, purse or other form of containment or transport. Defensive Display is not required prior to either the threat or use of actual physical or deadly force as long as the use of that force is justified. Aftermath of a Legal Shooting Remain as calm as possible in the aftermath of the situation Make sure that you and your family are safe Remove any weapons that might be accessible to your assailant Call 911 and report the event. Request that they immediately send both Police and EMS. Identify yourself and give basic situational information 9
10 Aftermath of a Legal Shooting Keep 911 on the line while you await assistance. Make sure that you are not in possession of a weapon when the Police arrive on the scene Consider making no formal statement until you have an attorney. This is your legal right. Don t be intimidated. Expect for all present to be interviewed separately. Expect to be taken into Police custody as a result of the event, even though you appear justified. Contact with Law Enforcement There is no legal requirement to volunteer the fact that you are an Arizona CCW Permit holder. If asked if you are armed or a permit holder by Police, you are legally required to answer truthfully. Police can legally require that you surrender your firearm during a traffic stop. Courtesy and cooperation go a very long way towards making your life easier during a traffic stop. Open vs. Concealed Carry Under Arizona law Open Carry is legally permitted in any location where it is legal to possess a firearm Concealed carry is permitted in any location where it is legal to openly carry a firearm except school grounds and posted restaurants that serve alcohol. AZ CCW Permit holders must be in possession of both their permit and a government issued photo id. 10
11 Restaurant Carry in Arizona This sign must be placed next to the restaurant s state liquor license in order to be a valid posting. The sign may be posted in additional locations as well, but must appear next to the liquor license in order to be a valid posting. Restaurant Carry in Arizona Restaurant may prohibit concealed carry by posting DLLC approved signage next to their liquor license. Permit holders may legally enter licensed establishments to determine if they permit firearms. Signage is not required at the entrance and signage at the entrance only is not proper notice or posting. Carrying in violation of no firearms posting or consuming alcohol while carrying a firearm in a posted establishment is a Class 3 Misdemeanor. Where you cannot legally carry firearms State law requires state and local governments to offer to check firearms a readily accessible site, immediately retrievable at departure, if they wish to prohibit them from being carried in their buildings. Private property where proper notice of no weapons permitted has been delivered either verbally or in the form of a sign at the entrance to the establishment. School property unless simply transiting the property. Any Federal office building, including Post Offices. Any correctional facility either public or private. Any polling place on election day. 11
12 Where you cannot legally carry firearms Any nuclear or hydroelectric generating station. Any military base unless permitted by the Commander. Any game preserve. State parks (if posted). Indian reservations in Arizona may or may not recognize the Arizona CCW Permit. Check Tribal Law. Inside the secure area of any airport (Duh!) Administrative Rules - CCW Permit is good for 5 years from date of issuance. Renewal is the permit holder responsibility. Renewal must be submitted within 90 days prior to or 60 days after expiration with the applicable fee ($43) Military personnel deployed overseas are provided 90 days to renew following their deployment.
