1 Rules and Regulations Note: Definition of Member of Hickory Ridge Home Owners Association is as follows: Homeowners, lot owners and fulltime residents of lots and and those who are homeowners, lot owners and fulltime residents of lots 1-33 who elect to be members of the Hickory Ridge Home Owners Association, this includes the developers, James R. and Monica A. Hughes. The following is a general list of rules and regulations regarding use of the facilities on Lot 60 Hickory Ridge Subdivision, 148 Hickory Ridge Drive, Glenwood, IA Please review with all members of your family before signing the required form. 1. The developers, James R. and Monica A. Hughes, lot owners, and the Hickory Ridge Home Owners Association are not responsible for personal injury or loss of property 2. All members and guests shall use these facilities at their own risk 3. No glass containers are allowed outside of the clubhouse 4. No pets are allowed 5. Trash must be picked up and disposed of properly 6. Hickory Ridge Home Owners Association has the right to remove any member or guest for inappropriate conduct or actions 7. Cost of any damages by a member or his/her guest will be charged to the family of the member 8. Any member violating the Hickory Ridge rules and Regulations may have their privileges suspended or be fined $100 per occurrence 9. Each family will be given 1 key or code for access to the Hickory Ridge Pool Pool Rules In addition to the general rules and regulations the following apply to the use of the pool and surrounding courtyard. For your safety and the safety of others, these rules will be strictly enforced: The pool schedule is as follows: Pool opening is the weekend of Memorial Day Pool closing is Negotiable depending on weather. Pool will be open 8am to 9pm daily Access to the pool is obtained by entering the front gate using your membership key or code.

2 Pool Rules Cont. 1. All members and guests shall use the pool facilities at their own risk. 2. Guests must be with a Hickory Ridge resident at all times. 3. All swimmers must shower before entering the pool 4. Persons with open skin abrasions, bandages, infections, colds etc. will not be allowed in pool area 5. Persons with signs of intoxication will not be allowed in pool area 6. No diving is allowed 7. No spitting or nose blowing 8. No profane or abusive language 9. No rough play or running will be permitted 10. Children under the age of 13 must be supervised by an adult 11. Children who do not follow the rules and regulations will be denied admittance unless accompanied by a parent 12. Members and guests are not permitted to enter pool equipment area unless authorized 13. Hickory Ridge Home Owners Association has the right to remove a swimmer for inappropriate conduct or actions 14. All children in Kiddie pool must be supervised by an adult 15. Weather may limit the use of the pool and patio area. Temperatures under 68 degrees or thunderstorms in the area will result in the pool closing 16. Proper swimming attire is required no cut offs, etc. Baby s must wear swim diapers. 17. Hickory Ridge Home Owners Association has the right to offer swim lessons to members and non-members in the Hickory Ridge Pool during the AM hours Hickory Ridge Pool Guest Rules Your guests are welcome to use the Hickory Ridge Pool facilities In addition to the general rules and regulations the following apply to all guests. 1. Guests must be with a Hickory Ridge Home Owners Association resident or lot owner at all times 2. Two guests per Hickory Ridge resident or lot owner at a time in the pool (Private parties excluded) 3. You are responsible for any damages your guest may cause 4. You are responsible for the conduct of your guest Hickory Ridge Home Owners Association has the right to limit the number of guests at any time to insure the Hickory Ridge members have access to the facilities.

3 Hickory Ridge Pool Facility Confirmation of Review I have received a copy of the Rules and Regulations of the Hickory Ridge Pool Facilities and have read and reviewed these with all members of my household and agree to abide by them. I also agree to hold harmless the developers and builders of Hickory Ridge, Glenwood, IA and the Hickory Ridge Home Owners Association for any injury illness I or members of my family or guests of my family, might receive due to the usage of these facilities. 4 Hickory Ridge Swimming Pool Agreement ALL HOMEOWNERS MUST COMPLETE AND SIGN NAME ADDRESS 1. GUEST POLICY We understand that the Hickory Ridge Pool Rules provide that guests under the age of FOURTEEN must be accompanied by an adult homeowner when using the Hickory Ridge Pool. We further understand that it is important that guests be supervised in their use of the swimming pool, as they may not share the vested interest the homeowners of the Hickory Ridge Home Owners Association and may not fully appreciate the costs and expenses associated with maintaining the swimming pool. We therefore assume full responsibility for and hereby indemnify the Hickory Ridge Home Owners Association, INC. and all Hickory Ridge Subdivision residents against all damage to the Hickory Ridge swimming pool, fences, gates, amenities, equipment, clubhouse, and other personal property associated therewith caused by any guest we may allow to use the Hickory Ridge swimming pool. Such indemnification shall include, but not be limited, the costs of repair or replacement, together with court costs and legal fees in the event legal collection of same becomes necessary. 2. CHILD SWIM RELEASE FORM THIS MUST BE COMPLETED AND SIGNED BY ALL PARENTS (OR GUARDIANS) TO ALLOW CHILDREN BETWEEN YEARS OF AGE TO SWIM WITHOUT BEING ACCOMPANIED BY A PARENT OR GUARDIAN, OR RELIABLE ADULT CUSTODIAN OVER 18 YEARS OLD. We understand that the pool rules of the Hickory Ridge Pool provide that children under the age of 14 must be accompanied by their parent, guardian, or reliable adult custodian 18 years of age or older. The parent or guardian must submit in writing to the Hickory Ridge Home Owners Association those people they wish to designate as a Reliable Adult Custodian if not themselves, for example, nanny or older sibling. We also understand that children between the ages of years of age may swim at the pool without a parent or guardian or appointed adult custodian ONLY IF this agreement is signed by a child s parent or legal guardian. We wish to allow the children listed below who are between the ages of years of age to swim at the pool WITHOUT their parent, guardian, or reliable adult custodian being present: Name Age Birthday We understand that there is not a lifeguard on duty and that the Hickory Ridge staff, other adults or people in attendance at the pool ARE NOT RESPONSIBLE for the safety or our children while they are swimming. We also understand that we are responsible for our children s behavior and actions while at the pool. We believe the above listed children are very capable swimmers and are able to swim safely in ALL areas of the pool. WE ASSUME ALL RESPONSIBILITY FOR AND RELEASE THE HICKORY RIDGE HOME OWNERS ASSOCIATION, INC., THE HICKORY RIDGE RESIDENTS, LOT OWNERS, DEVELOPERS THEIR HEIRS AND ASSIGNS, AND ALL OTHER PERSONS AND FIRMS FROM ANY AND ALL CLAIMS AND/OR DAMAGES ARISING OUT OF ANY INJURY OR FATALITY SUFFERERED BY THE CHILD (OR CHILDREN) LISTED WHILE AT THE POOL UNDER THIS AGREEMENT AND WHICH RESULTS FROM THE NORMAL RISKS ASSOCIATED WITH SWIMMING. We agree to frequently remind our children that they must follow all of the Pool Rules while at the pool, including, but not limited to, the roles prohibiting diving, running, pushing, shouting, and other offensive behavior. We recognize that pool privileges may be withdrawn from any person who violates or abuses the Pool Rules. Since there is not

6 a lifeguard on duty it is the parents and guardians responsibility to make sure that any child whose name does not appear on this form does not use the pool unsupervised. All Hickory Ridge Home Owners Association members and pool members must sign this form in order to use the swimming pool. If you have no children under 18 years of age, or if you do not intend to allow your children between the ages of years of age to swim unattended write NONE under the words Children s Names on this form. POOL RULES AND REGULATIONS We acknowledge receipt of the Hickory Ridge Pool Rules and Regulations and agree that our entire family shall abide and follow the Hickory Ridge Pool Rules and Regulations. 7 HICKORY RIDGE POOL RELIABLE ADULT CUSTODIAN DESIGNATION FORM We hereby designate as the Reliable Adult PRINT NAME LEGIBLY Custodian of our children _ While they are swimming at the Hickory Ridge Pool in our absence, We certify that above named custodian is over the age of 18 and has read and understands all of the rules and regulations of the Hickory Ridge Pool. We assume all responsibility for and release the Hickory Ridge Home Owners Association, INC. Hickory Ridge Homeowners, Hickory Ridge Lot Owners, Hickory Ridge Developers, their heirs and assigns and all other persons and firms from any and all claims and / or damages arising out of any injury or fatality suffered by the child (or children) while under the care of the designated adult custodian.
