Race 5: Warwick Farm Handicap 1300m Stable representative Mr B Widdup reported that Iriomote had pulled up well and no abnormalities had been detected. HAWKESBURY Sunday 13 October 2013 Race 7: J K Williams Group Benchmark 65 Handicap 1500m The Stewards today concluded an inquiry opened into B Shinn s riding of third placegetter, Sensing, in the abovementioned race. Evidence was taken from rider B Shinn and stable foreperson Mr B Wintle. Mr Wintle advised that his instructions to B Shinn had been to endeavour to obtain a position midfield, but emphasised the necessity to obtain cover and, further, given the strong winds that were present at Hawkesbury on that day, to ensure that Sensing was placed under pressure from the 700m. B Shinn confirmed the instructions issued and advised Stewards that, from his outside barrier draw, when caught wide in the early stages, he was obliged to settle at the rear of the field so that he could race closer to the fence and further obtain cover in accordance with his instructions. B Shinn added that, as a consequence, he settled back further than he had been instructed and, with the slow early pace, his mount was somewhat disadvantaged. He said that when a number of horses in front commenced to overrace this resulted in Hezasmartypants shifting out three deep and going forward near the 800m, which resulted in the tempo of the event then increasing and Sensing not travelling as well as it was in the early stages. B Shinn added that for this reason, whilst he was mindful of his instructions, he elected to stay following one of the fancied runners in the race, Knowing Me, with the intention of improving to its outside making the home turn. He further added that, when placed under full pressure in the straight, Sensing found the line strongly. Stable foreman, Mr B Wintle expressed dissatisfaction with the ride on the day in that, given the instructions, he was of the view the opportunity had existed for B Shinn to improve from the 700m, as instructed. The Stewards today gave consideration to the evidence provided by Racing NSW Betting Steward Mr T Griffin in respect to betting around Australia on the event, which had indicated no concerns in respect to the integrity of the race, in that all betting was within normal parameters. Stewards also gave consideration to the sectional times of the event (first 900m in 57.07; last 600m in 33.95), which supported B Shinn s evidence that the tempo had indeed quickened over the last 800m of the event. After considering all the evidence, the Stewards advised B Shinn that, in their view, he had made an error of judgment in not improving to the outside of Knowing Me leaving the 700m, as instructed, but having regard to the sectional times of the race and B Shinn s evidence

20131019RAND 2 that his mount was not travelling well enough to improve to that point, they advised him that his error in the circumstances was not unreasonable and, therefore, not blameworthy and captured by AR135(b). B Shinn was also advised that, whilst the Stewards accepted his seniority as a rider and the discretion he can show in his riding given the circumstances of the race, he must ensure that wherever possible he rides his mounts in accordance with the instructions issued by the connections. ROYAL RANDWICK Saturday 5 October 2013 Race 9: McGrath Estate Agents Metropolitan 2400m The Stewards today concluded an inquiry into the catastrophic breakdown of Lucrepitous in the Group 1 Metropolitan Handicap on 5 October 2013 when a report was received from the University Veterinary Teaching Hospital, Camden. Racing NSW Senior Official Veterinarian Dr C Suann, in the presence of Mr P Muscut, stable foreman for trainer Mr C Waller, detailed to the Stewards the gelding s treatment and veterinary records provided by the stable. The necropsy report confirmed the race day diagnosis that Lucrepitous had suffered a fracture to the right humerus and that there was no gross evidence of any pre-existing stress fracture. Urine and blood samples taken from Lucrepitous on 5 October 2013 were lodged with the Australian Racing Forensic Laboratory for analysis. RACE 1: City Tattersalls Club Victory Vein Plate 1000m: Candelara jumped away awkwardly and bumped Rich Rupee. Double Happy and Expect were slow to begin. Expect and Miss Sakkara were both inclined to lay out rounding the home turn. When taken out by Expect, Arcadian raced ungenerously for some distance rounding the home turn. Double Happy was held up on the heels of Chief Of The Clan for some distance approaching the 200m. When shifting out to improve around the heels of Chief Of The Clan, passing the 200m, Double Happy had to be restrained when Chief Of The Clan drifted out under pressure, whereby Double Happy raced greenly, shifted out and hampered Precia. Post-race veterinary examinations of Chief Of The Clan and Precia did not reveal any abnormalities. RACE 2: City Tattersalls Club Inglis Bonus Handicap 1600m: Correct weight was delayed when the Chairman of Stewards Mr R Murrihy and Deputy Chairman of Stewards-Operations, Mr M Van Gestel, viewed the judge s official monitor to verify the nose margin between the winner, Best Case, and Kirramosa. Best Case jumped awkwardly. Near 1000m, when racing tight to the inside of Bel Barrage (K O'Hara), which shifted in slightly, Fields Of Tuscany was reluctant to hold its position and in turn shifted in, causing Kirramosa to be hampered. K O'Hara was told she must ensure that horses to her inside were given sufficient racing room at all times. RACE 3: Aristocrat Brian Crowley Stakes 1200m: Barbed knuckled over on jumping away and sprawled, almost dislodging its rider, C Reith, and losing ground as a result (2L). C Reith stated it took almost 200m to balance up Barbed and, whilst he could not pinpoint any area of soreness, he was of the view that the gelding never fully stretched out at any point thereafter in the race. A post-race veterinary examination of Barbed did not reveal any abnormalities. Stable foreman Mr B Widdup undertook to report on the fitness of Barbed subsequent to the race and was asked to provide a veterinary clearance prior to that gelding s next race start. Over the concluding stages Barbed and Mr Jackman raced tight, initially due to Barbed being inclined to lay in under pressure. RACE 4: Bartier Perry Handicap 1600m: At the request of rider B Vassallo, Punch Your Weight, was inspected by the Club's Veterinary Officer behind the barriers and was passed fit to start. Index Linked began slowly (2L). Art Thou Ready and Index Linked were both inclined to overrace. When questioned regarding Punch Your Weight racing more forward, rider B Vassallo stated that

20131019RAND 3 the tactics had been left up to himself and, when Punch Your Weight began well, he elected to take up a forward position, but was caught wide throughout. Under pressure over the concluding stages, Index Linked was inclined to lay in. RACE 5: City Tattersalls Club Lightning Handicap 1100m: Unanimously shifted out at the start, resulting in Ichihara being taken out onto the hindquarter of Welkom Gold. Ninth Legion was slow to begin. When questioned concerning the performance of Unanimously, J Adams stated that the gelding travelled well in the run, but could not quicken when asked for an effort in the straight. He added that Unanimously was racing first up for five months and would take obvious improvement from the run. A post-race veterinary examination of Unanimously did not reveal any abnormalities. RACE 6: City Tattersalls Club Cup 2400m: On return to scale a protest was lodged by K O'Hara, rider of third placegetter, Planet Purple, against Kingdoms being declared the winner on the grounds of interference at the 100m. A further protest was lodged by T Bell, rider of second placegetter, Saint Encosta, against Kingdoms being declared the winner on the grounds of interference over the final 50m. By leave of the Stewards, those protest grounds were extended to include the final 100m of the event. After hearing evidence from the parties concerned and viewing the videos, the Stewards dismissed both objections, for the following reasons: Protest 3 rd against 1 st : Whilst the Stewards accepted that Planet Purple received interference when Kingdoms shifted out at the 100m, whereby it was checked and lost its rightful running, they could not be satisfied that it had a material effect on the finishing positions of the respective horses, bearing in mind the margin of 1¾ lengths. Protest 2 nd against 1 st : Whilst the Stewards accepted that T Bell was momentarily hampered in his ability to ride Saint Encosta out with the whip near the 100m when Planet Purple was taken out onto him by Kingdoms and again that T Bell was very briefly inconvenienced in his ability to ride Saint Encosta out at the 50m when Kingdoms shifted out and brushed Saint Encosta, they could not in the circumstances be satisfied that these incidents had a material effect on the finishing positions of the respective horses. At a subsequent inquiry J Ford pleaded guilty to a charge of careless riding in that passing the 100m, whilst riding his mount out with the whip, he permitted Kingdoms to shift out taking Planet Purple out onto Saint Encosta resulting in Planet Purple having to be checked and losing its rightful running. J Ford s licence to ride in races was suspended for a period of seven meetings to commence on Wednesday, 23 October 2013 and to expire on Friday, 1 st November 2013, on which day he may ride. In addition, the Stewards issued a fine of $2,000, as they took the view that the actions of J Ford of continuing to ride Kingdoms out with the whip when that gelding had shown a tendency to lay out and shift ground had displayed a win at all costs attitude, which was reflected in the degree of interference to Planet Purple. Planet Purple jumped awkwardly and made contact with Ghost Protocol. Planet Purple was inclined to overrace in the middle stages. On straightening, Vaquera and Thubiaan made contact, as Vaquera endeavoured to shift out to improve. RACE 7: City Tattersalls Club Handicap 1400m: Tagus got its head up on jumping away, shifted out and bumped Keith s Legacy. Keith s Legacy got its head up and overraced in the early stages. Hidden Warrior overraced in the early stages. Strike The Stars was held up until near the 150m. App. J Kissick, rider of third placegetter, Riva De Lago, was questioned as to why, rounding the home turn, he had not improved up on the back of his stablemate, Coup Ay Tee, which would have allowed him to come to the outside of the heels of that runner and have a clear and unimpeded run in the straight. App. Kissick advised the Stewards that his instructions had been not to expose

20131019RAND 4 Riva De Lago too early, as it performs best when held up for a run. He added that, nevertheless, he accepted that he had erred in improving up to the inside of the heels of Coup Ay Tee on straightening, which resulted in he being held up on the back of Soledad for some distance until near the 200m when he was able to shift to the outside of Coup Ay Tee to obtain clear running. Whilst the Stewards accepted that the eventual winner, Strike The Stars, also had been held up and it had come from behind Riva De Lago to win the race, he was nevertheless reprimanded for having failed to exercise the necessary degree of judgment by positioning his mount on the home turn to the inside of the heels of Coup Ay Tee when a far better option was to trail that runner into the straight. At today s inquiry App. Kissick was assisted by Mr P Muscut, stable foreman for trainer Mr C Waller. When questioned concerning the performance of the winner, Kingdoms, as opposed to its 10 th placing in the Group 1 Metropolitan Handicap on 5 October 2013, trainer Mr J O'Shea stated on that occasion the gelding was ridden back and struggled to make ground, being beaten 3.3 lengths by the winner, Seville. Mr O Shea added that Kingdoms took benefit from that run over 2400m and that the addition of a nose roll today and from its better barrier, being ridden forward, were the principal factors in the improvement. RACE 8: City Tattersalls Club Nivison 1200m: Driefontein was slow to begin. Gamba was held up for a run in the early part of the straight. When questioned concerning the performance of She s Clean, J Collett stated that he could offer no excuse, except that his mount was kicking out in the barrier, which may be indicative of it coming into season. Stable representative Mr P Muscut stated that She s Clean had worked exceptionally going into the race. A post-race veterinary examination of She s Clean did not reveal any abnormalities, other than there were indications of possibly being in season. The Stewards ruled that She s Clean must trial to their satisfaction and a veterinary clearance must be produced prior to racing again. A post-race veterinary examination of Emotional Circus, which weakened badly in the final 100m, did not reveal any abnormalities. Trainer Mr K Lees undertook to report to the Stewards the future race plans for Emotional Circus. GENERAL: Swab samples were taken from all winners and the following runners: Race 1: Chief Of The Clan, Alpha Miss (2), Candelara, Precia, Miss Sakkara, Scratch Me Lucky. Race 2: Vitello, Suadela, Fields Of Tuscany, Kirramosa. Race 3: Sir Moments, Boss Lane (2), Dothraki, Barbed. Race 4: The Offer, Done Nothin Wrong, Via Facile, Punch Your Weight, Leebaz.
