2017-2021 Measure K Bicycle, Pedestrian, Safe Rutes t Schl and Smart Grwth Incentive Prgram Guidelines September 2017 I. Intrductin 1. Backgrund The Measure K Renewal Ordinance and Expenditure Plan as passed by the vters f San Jaquin Cunty in 2006 includes a Bicycle, Pedestrian, and Safe Rutes t Schl Funding Prgram. The Measure K Expenditure Plan specifies that 60% f the funds will be allcated accrding t a cmpetitive prcess. The Expenditure Plan als specifies a minimum f $65 millin in federal transprtatin funding r Measure K funding will be made available during the life f the Measure K Renewal prgram fr smart grwth incentives t lcal jurisdictins in San Jaquin Cunty. These funds will be available fr infrastructure imprvements that will assist lcal agencies in better integrating transprtatin and land use, such as street calming, walkable cmmunity prjects, transit amenities and alternative mdes f transprtatin. These funds will be available t enhance infill develpment, neighbrhd revitalizatin and dwntwn imprvements. These guidelines describe the plicy, standards, criteria, and prcedures fr the develpment, adptin and management f the 2017-2021 Measure K Bicycle, Pedestrian and Safe Rutes t Schl and Smart Grwth Incentive Prgram. 2. Prgram Gals Pursuant t the Measure K Strategic Plan, the gals f the Measure K Bicycle, Pedestrian and Safe Rutes t Schl and Smart Grwth Incentive Prgram are t: Meet the mbility needs fr peple f all ages and abilities in San Jaquin Cunty by imprving and enhancing the existing bicycle and pedestrian netwrk Prviding better cnnectivity, accessibility, and safety measures between specific rigins and destinatins referred t as Cmmunity Activity Centers (CACs) Assist lcal agencies in better integrating transprtatin and land use Supprt infill develpment, neighbrhd revitalizatin, and dwntwn imprvements 3. Prgram Schedule and Funding Years The guidelines fr the first prgram f prjects must be adpted by September 28, 2017 Prgramming capacity fr the 2017 Measure K Bicycle, Pedestrian and Safe Rutes t Schl and Smart Grwth Incentive Prgram will be fr state fiscal years 2017/18 thrugh 2020/21. Surce The 2017-2021 Measure K Bicycle, Pedestrian and Safe Rutes t Schl and Smart Grwth Incentive Prgram is funded frm varius Measure K surces. These are: $3.85 millin frm the Measure K Bicycle, Pedestrian, and Safe Rutes t Schl Cmpetitive Prgram $7.78 millin frm the Measure K Smart Grwth Incentive Prgram $8.17 millin frm the frmer Measure K debt service reserve fund that is available t either prgram. In additin t furthering the gals f this prgram, all prjects must meet eligibility requirements specific t at least ne Measure K funding surce. 5. Distributin The 2017-2021 Measure K Bicycle, Pedestrian and Safe Rutes t Schl and Smart Grwth Incentive Prgram will be distributed as fllws: $170,000 will be taken ff the tp f the Bicycle, Pedestrian, and Safe Rutes t Schl prgram r Smart Grwth Incentive Prgram t prvide prject and applicatin develpment assistance fr the lcal jurisdictins. $20,000 each t the cities f Escaln, Lathrp, Ldi, Manteca, Ripn and Tracy $25,000 each t the City f Stcktn and the Cunty f San Jaquin These funds will be available t the lcal jurisdictins fr prject and applicatin develpment wrk upn entering int cperative agreements with SJCOG. Eligible expenditures include but are nt limited t prcurement f cnsultant assistance, staff time, utreach, and preparatin f technical studies, exhibits, and cnceptual plans. The terms fr the use f the funds will be specified in a cperative agreement entered int by SJCOG and each lcal jurisdictin. A minimum f $3.85 millin will be prgrammed n a cmpetitive basis t Bicycle, Pedestrian, and Safe Rutes t Schl prjects A minimum f $7.78 millin will be prgrammed n a cmpetitive basis t Smart Grwth Incentive Prgram prjects A gal f $4 millin will be prgrammed n a cmpetitive basis t prjects with a ttal prject cst less than $500,000 in jurisdictins with a ppulatin less than 200,000. These funds may be prgrammed t prjects frm bth the Bicycle, Pedestrian, and Safe Rutes t Schl Prgram and the Smart Grwth Incentive Prgram, and are intended t prmte gegraphic equity in the prgram. If an insufficient number f suitable prjects that fulfill the gals f the prgram are submitted, SJCOG staff will make these funds available fr ther prjects. Fr prjects requesting funds frm the Smart Grwth Incentive Prgram, the maximum Measure K cntributin is $2 millin per prject Fr prject planning, the Measure K cntributin is capped at $250,000 per prject Fr envirnmental analysis, design, and engineering, the Measure K cntributin is capped at $250,000 per prject Fr prject cnstructin, the Measure K cntributin is capped at the difference between the funds spent fr ther phases and an allcatin limitatin nt t exceed $2 millin. 2

Matching Requirements Fr prjects with a ttal prject cst ver $500,000, a minimum f 10% f the ttal prject cst must be prvided by the applicant as a lcal match. Matching funds may include Nn-cmpetitive Measure K Bicycle, Pedestrian, and Safe Rutes t Schl funds and ther Measure K funds derived by frmula. This nn-measure K funding can nly be cnsidered Matching funding if it ges twards Measure K eligible csts. Matching funds must be expended cncurrently and prprtinally t the Measure K cmpetitive funds as cmmitted t the prject applicatin. The Matching funds may be adjusted befre r shrtly after cntract award t reflect any substantive change in the bid cmpared t the estimated cst f the prject. 7. Funding fr Plans Funding frm the Bicycle, Pedestrian, and Safe Rutes t Schl Prgram may be used t fund the develpment f cmmunity-wide active transprtatin plans, including bicycle, pedestrian, safe rutes t schls, r cmprehensive active transprtatin plans. A list f the cmpnents that must be included in an active transprtatin plan can be fund in Sectin 12, subsectin C. Funding frm the Smart Grwth Incentive Prgram will be available fr planning studies. During the initial years f the prgram, a larger percentage f Smart Grwth Incentive Prgram funds shall be used t supprt planning activities. Measure K cmpetitive funds used fr Smart Grwth Incentive Prgram planning may nly be allcated based n a 50 percent match. Applicatins fr plans may nt be cmbined with applicatins fr infrastructure r ther nninfrastructure prjects. 8. Reimbursement The Measure K Bicycle, Pedestrian, and Safe Rutes t Schl and Smart Grwth Incentive Prgram is a reimbursement prgram fr eligible csts incurred. A cperative agreement must be signed by SJCOG and the prject spnsr befre funds are available fr the prject. Once a cperative agreement has been signed by bth parties, the prject spnsr is required t submit mnthly prgress reprts t the SJCOG. Als, mnthly invices may be submitted. Expenses are reimbursed in arrears, with the exceptin f a ne-mnth advance fr cnstructin prjects (upn request f the spnsr). Expenses incurred prir t the executin f a Measure K Renewal cntract are nt reimbursable. By the last day f each mnth, the SJCOG will pay all invices received by the 10th f that mnth. The fllwing items are nt eligible fr Measure K Renewal reimbursement under a cperative agreement: Activities relating t btaining matching funds fr a prject. Activities related t general Measure K Renewal administratin (nt specific t the prject), educatin r preparatin perfrmed by the prject spnsr r cntractr. Activities relating t anther prject nt cvered in the cperative agreement, even if it is a Measure K Renewal prject. Activities cnducted prir t executing a Measure K Renewal cperative agreement 3

Eligible Applicants The applicant and/r implementing agency fr Measure K funds assumes respnsibility and accuntability fr the use and expenditure f prgram funds. Applicants and/r implementing agencies must be able t cmply with all the federal, state, and lcal laws, regulatins, plicies and prcedures required t cmplete the prject. The fllwing entities, are eligible t apply fr Measure K Bicycle, Pedestrian, and Safe Rutes t Schl and Smart Grwth Incentive Prgram funds: The cities f Escaln, Lathrp, Ldi, Manteca, Ripn, Stcktn, and Tracy The Cunty f San Jaquin The San Jaquin Reginal Rail Cmmissin The San Jaquin Reginal Transit District Any ther public agency that is eligible fr federal transprtatin funds is eligible t apply fr nly funding frm the Smart Grwth Incentive Prgram Schl districts and private nnprfit 501(c)(3)s may nly apply fr ancillary supprt need prjects thrugh the Bicycle, Pedestrian, and Safe Rutes t Schl prgram. These are individualized cmmunity-based needs that are nt part f a larger prject. Examples include: Bicycle racks and enclsed bicycle strage facilities Lighting & signage Bicycle and pedestrian educatin and prmtin effrts Schl site specific safe rutes t schl assessments A prject applicant fund t have purpsefully misrepresented infrmatin that culd affect a prject s scre may result in the applicant being excluded frm the prgram fr the current cycle and the next cycle. 10. Partnering With Implementing Agencies Applicants are encuraged t partner with ther agencies/grups, including private and nn-prfit rganizatins, in applying fr funds. 11. Eligible Prjects All prjects must be selected thrugh a cmpetitive prcess and must meet ne r mre f the prgram gals: Infrastructure Prjects: Capital imprvements that will further the gals f this prgram. This typically includes the envirnmental, design, right-f-way, and cnstructin phases f a capital (facilities) prject. A capital imprvement that is required as a cnditin fr private develpment apprval r permits is nt eligible fr funding frm Measure K. Plans: The develpment f a cmmunity wide bicycle, pedestrian, safe rutes t schl, r active transprtatin plan, r planning studies fr a prject thrugh the Smart Grwth Incentive Prgram. 4

2017-2021 Measure K Bicycle, Pedestrian, Safe Rutes t Schl and Smart Grwth Incentive Prgram Guidelines September 2017 Nn-infrastructure Prjects: Educatin, encuragement, and enfrcement activities that further the gals f this prgram. SJCOG intends t fcus funding fr nn- infrastructure n start-up prjects. A prject is cnsidered t be a start-up when n prgram currently exists. Start-up prjects must demnstrate hw the prgram is sustainable after Measure K funding is exhausted. Measure K funds cannt fund nging prgram peratins. Nn-infrastructure prjects are nt limited t thse benefiting schl students. Prgram expansins r new cmpnents f existing prgrams are eligible fr Measure K funds as lng as the applicant can demnstrate that the existing prgram will be cntinued with nn-measure K funds. Infrastructure prjects with nn-infrastructure cmpnents. Example Prjects Belw is a list f prjects cnsidered generally eligible fr Measure K funding. This list is nt intended t be cmprehensive; ther types f prjects that are nt n this list may als be eligible if they further the gals f the prgram. Cmpnents f an therwise eligible prject may nt be eligible. Develpment f new bikeways and walkways that imprve mbility, access, r safety fr nn-mtrized users. Imprvements t existing bikeways and walkways, which imprve mbility, access, r safety fr nn-mtrized users Eliminatin f hazardus cnditins n existing bikeways and walkways. Installatin f traffic cntrl devices t imprve the safety f pedestrians and bicyclists. Safe Rutes t Schl prjects that imprve the safety f children walking and bicycling t schl, in accrdance with Sectin 1404 f Public Law 109-59. Safe rutes t transit prjects, which will encurage transit by imprving biking and walking rutes t mass transprtatin facilities and schl bus stps. Secure bicycle parking at emplyment centers, park and ride lts, rail and transit statins, and ferry dcks and landings fr the benefit f the public. Bicycle-carrying facilities n public transit, including rail and ferries. Establishment r expansin f a bike share prgram. Recreatinal trails and trailheads, park prjects that facilitate trail linkages r cnnectivity t nn-mtrized crridrs, and cnversin f abandned railrad crridrs t trails. Develpment f a cmmunity wide bike, pedestrian, safe rutes t schls, r active transprtatin plan. Educatin prgrams t increase bicycling and walking, and ther nn-infrastructure investments that demnstrate effectiveness in increasing active transprtatin. 12. Prject Type Requirements As discussed in the Funding Distributin sectin (abve), the Measure K Bicycle, Pedestrian and Safe Rutes t Schl and Smart Grwth Incentive Prgram include multiple, verlapping cmpnents. Belw is an explanatin f the requirements specific t these cmpnents. A. Disadvantaged Cmmunities Fr a prject t be cnsidered a Disadvantaged Cmmunity, the prject must clearly demnstrate, with verifiable infrmatin, a direct, meaningful, and assured benefit t a disadvantaged cmmunity. T cunt as prviding a benefit, a prject must fulfill an imprtant 5

Fr a prject t qualify as directly benefiting a disadvantaged cmmunity, the prject must be lcated within r in reasnable prximity and have a direct cnnectin, t the disadvantaged cmmunity served by the prject; r the prject must be an extensin r a segment f a larger prject that cnnects t r directly adjacent t that disadvantaged cmmunity. It is incumbent upn the applicant t clearly articulate hw the prject benefits the disadvantaged cmmunity; there is n presumptin f benefit, even fr prjects lcated within a disadvantaged cmmunity. T qualify as a disadvantaged cmmunity the cmmunity served by the prject must meet at least ne f the fllwing criteria: The Median Husehld Incme (Table ID B19013) is less than 80% f the statewide median based n the mst current Census Tract (ID 140) level data frm the 2010-2014 American Cmmunity Survey (<$49,191). Cmmunities with a ppulatin less than 15,000 may use data at the Census Blck Grup (ID 150) level. Unincrprated cmmunities may use data at the Census Place (ID 160) level. This list can be fund at the fllwing link under SB 535 List f Disadvantaged Cmmunities: http://www.calepa.ca.gv/envjustice/ghginvest/ At least 75% f public schl students in the prject area are eligible t receive free r reduced-price meals under the Natinal Schl Lunch Prgram. Prject must be lcated within tw miles f the schl(s) represented by this criteria. B. Safe Rutes t Schls infrastructure prjects must be lcated within tw miles f a public schl r within the vicinity f a public schl bus stp and the students must be the intended beneficiaries f the prject. Other than traffic educatin and enfrcement activities, nn-infrastructure prjects d nt have a lcatin restrictin. C. Active Transprtatin Plans A city, cunty, r transit district may prepare an active transprtatin plan (bicycle, pedestrian, safe-rutes-t-schl, r cmprehensive). An active transprtatin plan prepared by a city r cunty may be integrated int the circulatin element f its general plan r a separate plan which is cmpliant r will be brught int cmpliance with the Cmplete Streets Act, Assembly Bill 1358 (Chapter 657, Statutes f 2008). An active transprtatin plan must include, but nt be limited t, the fllwing cmpnents r explain why the cmpnent is nt applicable: The estimated number f existing bicycle trips and pedestrian trips in the plan area, bth in abslute numbers and as a percentage f all trips, and the estimated increase in the number f bicycle trips and pedestrian trips resulting frm implementatin f the plan. 6

A descriptin f bicycle and pedestrian safety, educatin, and encuragement prgrams cnducted in the area included within the plan, effrts by the law enfrcement agency having primary traffic law enfrcement respnsibility in the area t enfrce prvisins f the law impacting bicycle and pedestrian safety, and the resulting effect n cllisins invlving bicyclists and pedestrians. Prject Selectin Prcess 13. Prject Applicatin A prject applicatin must include the signature f the Chief Executive Officer r ther fficer authrized by the applicant s gverning bard. Where the prject is t be implemented by an agency ther than the applicant, dcumentatin f the agreement between the prject applicant and implementing agency must be submitted with the prject applicatin. A prject applicatin must als include dcumentatin f all ther funds cmmitted t the prjects. 14. Scring Criteria Prpsed prjects will be scred and ranked n the basis f applicant respnses t the belw criteria. In frming the Prject Evaluatin Cmmittee, staff will seek participants with expertise in bicycling and pedestrian transprtatin and land use, including Safe Rutes t Schls type prjects, and in prjects benefiting disadvantaged cmmunities, and will seek gegraphically balanced representatin frm lcal jurisdictins and nn-gvernmental rganizatins. 17. Prject Prgramming SJCOG staff will prgram funding t prjects based upn the prject scres and input frm the Prject Evaluatin Cmmittee. Fr prjects that request funding frm bth the Bicycle, Pedestrian, and Safe Rutes t Schl Prgram r the Smart Grwth Incentive Prgram, SJCOG staff will attempt t fund prjects frm nly ne f the funding types if pssible. Final prgramming recmmendatins are subject t review and cnsideratin by the SJCOG cmmittees befre adptin by the SJCOG Bard. 9
