PRES LEIGH DIRECTOR OF PUBLIC WORKS 701 OCEAN STREET, ROOM 410, SANTA CRUZ, CA (831) FAX (831) TOO (831) AGENDA: SEPTEMBER 28, 2010 September 16, 2010 SANTA CRUZ COUNTY BOARD OF SUPERVISORS 701 Ocean Street Santa Cruz, California SUBJECT: SURF CITY AIDS BICYCLE RIDE EVENT Members of the Board: On May 18, 2010, your Board approved the permit for the Surf City AIDS Bicycle Ride Event to be held on Sunday, October 3, The Santa Cruz AIDS Project has since requested that the Public Works Department revise the event permit to include an additional l2-mile route and a slight modification to the 30-mile, 60-mile, and 100-mile routes (see attached revised maps). The modification was necessary to avoid a construction zone on the original proposed routes. The Surf City AIDS Bicycle Ride Event will begin and terminate in the Santa Cruz City limits. No road closures wil be necessary, although an event of this nature may cause inherent traffic delays. The attached revised permit includes the additional 12-mile route and the modified 30-mile, 60-mile, and 100-mile routes, limits the type of directional pavement markers allowed, requires that bicycle riders obey all traffic laws, and requires the ride organization to obtain separate permits from each of the affected Cities and the California Department of Transportation. It is therefore recommended that the Board of Supervisors take the following action: 1. Approve the attached revised permit for the Surf City AIDS Bicycle Ride Event subject to the conditions on the permit.

The Santa Cruz AIDS Project shall provide a unique identification number to each paricipant. The numbers shall be prominently displayed on each rider. The printing must be of suffcient size to be legible at a distance of at least 50 feet. A sample participant identification number wil be provided to the Department of Public Works at least 30 days prior to the event. 3. The Santa Cruz AIDS Project shall provide restroom facilities and trash receptacles at the rest stop locations. 4. The Santa Cruz AIDS Project shall provide a vehicle that can pick up any rider or participant who is required to drop out of the ride. The vehicle shall be clearly identified as a SAG vehicle. 5. The Santa Cruz AIDS Project shall furnish, at its own expense, all personnel and incidentals to comply with all permit conditions. 6. The Santa Cruz AIDS Project may provide directional pavement markings to guide its participants. These markings shall conform to the dimensional standards detailed in the drawings provided as Attachment A. The paint used for the markings shall be ultraviolet light sensitive. If the markings have not faded to an acceptable level within 30 days, the Santa Cruz AIDS Project will be responsible for their timely removal. 7. Immediately following the ride, a general clean-up of trash and materials generated by the event shall be made of the entire ride route.
9 SANTA CRUZ AIDS PROJECT COMMITTEE MEMBERS Page The Santa Cruz AIDS Project shall exonerate, indemnify, defend, and hold harmless, the County of Santa Cruz, including without limitation, its offcers, employees and volunteers from and against any and all claims, demands, losses, damages, defense costs, or liability of any kind or nature which the County may sustain or incur or which may be imposed upon it for injury to or death of persons, or damage to property as a result of, arising out of, or in any manner connected with the performance under the terms of this Permit. Such indemnification includes any damage to the person(s), or property(ies) of the County of Santa Cruz and third persons. 9. The Santa Cruz AIDS Project, at its sole cost and expense, for the full term of this Permit (and any extensions thereof), shall obtain and maintain at minimum compliance all of the following insurance coverage(s) and requirements. Such insurance coverage shall be primary coverage as respects County and any insurance or self-insurance maintained by County shall be excess of the Santa Cruz AIDS Project insurance coverage and shall not contribute to it. a. Automobile Liability Insurance for each vehicle used in the performance of this Permit, including owned, non-owned (e.g., owned by the Santa Cruz AIDS Project employees), leased or hired vehicles, in the minimum amount of$100, combined single limit per occurrence for bodily injury and property damage. b. Comprehensive or Commercial General Liability Insurance coverage in the minimum amount of$l,ooo,ooo combined single limit, including coverage for: (a) bodily injury, (b) personal injury, (c) broad form propert damage, (d) contractual liability, and (e) cross-liability. 10. All required Automobile and Comprehensive or Commercial General Liability Insurance shall be endorsed to contain the following clause: "The County of Santa Cruz, its officials, employees, agents and volunteers are added as an additional insured as respects the operations and activities of, or on behalf of, the named insured performed under Permit with the County of Santa Cruz." 11. All required insurance policies shall be endorsed to contain the following clause: "This insurance shall not be canceled until after thirty (30) days prior written notice has been given to: County of Santa Cruz, Department of Public Works, Beatriz Barranco, Senior Civil Engineer, 701 Ocean Street, Room 410, Santa Cruz, CA " 12. The Santa Cruz AIDS Project agrees to provide its insurance broker(s) with a full copy of these insurance provisions. 13. CERTIFICATE OF INSURANCE(S) MUST BE FILED WITH THE DEPARTMENT OF PUBLIC WORKS AT LEAST TEN (10) DAYS PRIOR TO THE EVENT OR THIS PERMIT WILL BE CANCELED. All Certificates ofinsurance shall be delivered or sent to: County of Santa Cruz, Department of Public Works, Beatriz Barranco, Senior Civil Engineer, 701 Ocean Street, Room 410, Santa Cruz, CA "
10 SANTA CRUZ AIDS PROJECT COMMITTEE MEMBERS Page The Santa Cruz AIDS Project shall provide verification that they have met with the California Highway Patrol and the Santa Cruz County Sheriff s Office to coordinate final traffic control plans and enforcement. The Santa Cruz AIDS Project shall also provide verification that each agency has been supplied with event route maps. Verification shall be provided to the County of Santa Cruz no later than 30 days prior to the event. 15. The Santa Cruz AIDS Project shall obtain permits from all other adjoining agencies, the County of Monterey, and the California Department of Transportation. 16. A critique will be held on November 3, 2010, at the Deparment of Public Works office with the Santa Cruz AIDS Project representative. It is the responsibility of the Santa Cruz AIDS Project to arrange for representatives from the California Highway Patrol and the Santa Cruz County Sheriff s Offce to attend as well as other interested parties to discuss recommendations or required changes as determined. 17. Widespread disregard of the permit conditions will result in the Santa Cruz County Board of Supervisors recommending disapproval of future Surf City AIDS Bicycle Ride Events. 18. The Santa Cruz AIDS Project will furnish the Santa Cruz County Department of Public Works with the name and phone number of the contact person that wil be accessible during event hours. race10-2.doc
11 0293 acknowledgment of RIDE PARTICIPANTS Each ride participant must be advised by the ride organizer and sign a statement of the following: 1. Ride participants must abide by all applicable state and local vehicular laws. This includes, but is not limited to, riding as close as practicable to the right-hand curb or edge of roadway and obeying stop signs and traffic signals. Bicyclists riding more than one abreast shall yield to vehicular traffic. 2. Certain obstacles exist along the roadways which could cause injury to riders. Attention is hereby directed to the many sign posts, utilities, curbs, medians, guardrails, retaining walls, pavement markings, delineators, barricades, road bumps, etc. 3. Paper cups, food wrappers, or any other trash generated by the ride participants must be disposed of in the receptacles provided by the event organizer at the designated rest stops. 4. Ride participants should use the restroom facilities provided by the event organizers at the designated rest stops. 5. Advise all participants that riders cited by law enforcement officials for violating the California Vehicle Code or Santa Cruz County regulations will be automatically disqualified, and could result in enforcement action against the participant. Verification that all ride participants have agreed to and acknowledge the above conditions shall be submitted to the County of Santa Cruz Department of Public Works no later than ten (10) working days after the event.
