Ordinance No Throwing or distributing of items prohibited. Under no circumstance shall items of any kind be thrown or distributed from any mobile parade entry including but not limited to motorized or animal. This shall include, but not be limited to candy, toys, prizes and promotional items. Any participants throwing or distributing items of any kind from any mobile parade entry, including but not limited to motorized or animal entry, shall have their parade entry and associated persons immediately removed from the parade by City Staff. If the parade entry and associated persons refuse to leave the parade route, CMC shall be fully enforceable. The only distribution of items, such as, but not limited to candy, toys, prizes and promotional items shall be directly from parade entry participants walking along the designated parade route by hand to spectators who are physically on a sidewalk or other area as the City staff may designate Penalty for violation. Violations of this chapter are declared to be misdemeanors punishable upon conviction by fine only in an amount not to exceed the maximum penalty permitted for the Centralia municipal court under then effective state law. 3 relinquish all future television, video and photographic rights by virtue of our appearance. For the same consideration, I assume any and all risks, damage or injury associated with participation in the parade and hereby release and hold harmless all of the following, who are hereafter called "the indemnified parties'" namely the Centralia Downtown Association, the City of Centralia, Centralia College, Washington State Transportation Commission, the Washington State Department of Transportation, the Washington State Patrol, their respective directors, officers, employees, agents, successors, assigns, sponsors, members and volunteer workers from and against all and all claims, damages, liabilities, costs and expenses, including reasonable attorney's fees, arising out of my participation in the parade, including without limitation, any personal injuries or damage to my personal property which I may incur as a result of participation in the Summerfest 4th of July Parade. It is farther understood that we/i am to furnish my own insurance in case of injury. I also agree to and shall indemnify and hold harmless all of the indemnified parties from and against any and all claims, losses, damages, causes of action, suits and liability of every kind including expenses of litigation, court costs and attorney's fees for injury to or death of any person for damage to any property arising out of or in connection with the Summerfest - Windermere Real Estate Centralia 4th of July Parade or associated events the day of the parade, whether such injury, death or damages are caused by the sole negligence of the indemnified parties or the joint negligence of the indemnified parties and any other person or entity. I agree that this Waiver, Release and Indemnification Agreement shall be governed by the laws of the State of Washington and that the venue for litigation involving the indemnified parties shall be in a court of competent jurisdiction in Lewis County, Washington. The ultimate responsibility for safety lies with each individual parade entry. Entries must comply with all the Official Parade Rules, instructions from City officials (including the Centralia Police Department) and the Parade Volunteers, and implement relevant government regulations, safety codes and manufacturer's recommendations and similar standards necessary to safely operate tractors, floats and equipment. I/We hereby understand and agree to accept the rules and penalties outlined regarding the distribution of candy or other items to the spectators I/We hereby understand and agree to accept all risk of bodily injury and/or property damage which I/we may incur or cause a third party to incur as a result of my/our participation in the Windermere Real Estate Centralia 4th of July Parade. This Waiver, Release and Indemnification Agreement has been thoroughly read and understood and is given in consideration of the privilege to participate in the Summerfest - Windermere Real Estate Centralia 4th of July Parade. 4 General Information - Please retain pages four through six for your records To make sure you thoroughly enjoy the parade experience, read all instructions carefully. The Parade Committee does not want you or your organization to miss any important deadlines. On parade day, it is important to have everything you need. If you are prepared, you will not have to worry about being told at the last minute that what you have arranged does not meet the guidelines. The following guidelines are designed to make the parade safe, enjoyable and entertaining for all. The parade will be held on Tuesday, July 4, 2018, in Historic Downtown Centralia. Parade begins at 4:00 p.m. All participants are asked to consider the theme and how it relates to their organization or entry group.* GENERAL RULES FOR ENTRY All entries should be decorated or costumed and related to the parade theme. All entries must check in at the staging area registration table located on the north side of Centralia College Blvd. between Pearl & Silver (by Washington Park) between 12:30-2:00 p.m. This is an all forward motion parade. Performing groups should choreograph routines to maintain forward motion at the parade pace. No slow cadences allowed. All entrants must conform to the description stated on their application. Any changes must be submitted in writing with a copy of your Entry Application. No changes will be allowed after July 2, The Parade Committee reserves the right to re-classify applicants. All amplification systems must be noted on application and approved by the Parade Committee. The Parade Committee will select judges. Parade units can only compete in one category. Each unit will be judged on its overall presentation and the judges decision will be final. All entries will be prejudged beginning at 2:15 p.m. in the staging area. Announcer will recognize award-winning entries during the parade at the review stand (located at Tower Ave. & Pine St.). Entries not in the pre-parade area by 2:15 p.m. will not be judged. Entries depicting violence, drugs, and illegal activities or otherwise deemed inappropriate will be disqualified from judging and will not be allowed into the line-up. Additionally, confederate flags will not be allowed to be flown/displayed in the parade. Your signature on the parade entry form is evidence that you agree to all rules and will abide by those rules and the decisions of the Parade Committee and judges. Further, your signature on the entry form indicates that you agree that the Summerfest organization, the Centralia Downtown Association, its Parade Committee, the City of Centralia and their associates, employees and agents are released from any and all responsibility for loss, damage, or injury to any person or property relating in any way to participation in the parade. The deadline for entries is July 2, 2018, either in person, or mail, at Centralia Downtown Association s Office. The parade goes on rain or shine. 5 Animal entries are responsible for all animal waste along parade route and in staging/disbanding areas. Applications received after July 2, 2018 will be considered only as space is available. Your location in the parade line-up will be based on the date your entry form was received (i.e. first come, first in line). The parade committee reserves the right to move entries as needed. Parade participants may not jump onto or off of any float or moving vehicle and may not interfere with any other unit in the parade. 2. Drivers of any and all vehicles in the parade must have a valid driver s license and be at least 18 years of age. 3. Alcoholic beverages are forbidden on any float, in any vehicle, or on the person of any participant. Page 5 of 6

6 4. Participants consuming alcohol prior to or during the parade will be removed from the parade. 5. Floats should have handholds or barriers to secure riders in the event of sudden stops or starts, chairs or seating should be attached to float-bed. 6. Floats should be constructed of fire safe materials. ==>As a parent or Guardian: I represent that I am the parent or guardian of the named participant, that I am of legal age and that I have read and fully understand the foregoing Waiver, Release and Indemnification Agreement and that I so agree to be bound by the terms set out above, individually and as participant's parent or legal guardian on behalf of participant, and our respective heirs, executors, administrators and assigns.
