9 EXHIBIT 1.0: ACTIVITY DESCRIPTION Chebeague Island Boat Yard (CIBY) is a full service marina that provides vessel storage, repairs and restoration, as well as marine fuel sales. It is the only facility on the island and is actively supporting the needs of commercial and recreational boat owners on Chebeague, the outer islands of Casco Bay, and throughout the mainland community. Commercial customers include the island lobster boat fleet and working vessels that support the local oyster aquaculture industry. Dropping Springs Lobster Co-op has a summer buying station and bait operation on a large smack float on the fringe of the boat yard mooring field. Formed by lobstermen from Chebeague, the smack serves boats from Chebeague Island, Cliff Island, and the mainland who sell their catch, load their bait, and fuel up with gasoline or ultra-low sulfur diesel fuel as required during the season. They also utilize the CIBY dock system to pick up and drop off sternmen (laborers) who work onboard the boats or at the smack operation. Recreational customers at CIBY include year round and summer residents of Chebeague as well as boat owners throughout the Casco Bay region. A 30 ton remote control submersible trailer provides the capability to haul boats up to 50 feet in length and 7 feet of draft. All hauling/launching activities are done on the tidal ramp at the facility. In season service and routine fueling operations are completed alongside the floating dock system. Transient boaters utilize the dock system at the boat yard for recreational use, access to the retail store and bathroom facilities, and to visit friends or relatives on Chebeague. With upland vehicle parking and a protected mooring field, the boat yard has also become a critical access point for boaters who live or rent on Chebeague and need to get to/from the mainland.

10 Winter storage (both outside and inside heated) provides the opportunity for year round employment at CIBY. Repair and restoration efforts enable the yard to maintain a staff of well qualified technicians on a year round basis, providing jobs that are vital to sustain an island community. Winter float storage has been a recent growth area as well. The existing railway equipment offers a unique method that can efficiently and safely handle seasonal floats that cannot or should not be stored on the shore near the pier locations. CIBY works with several firms that provide fall and spring service to float owners at locations from Orrs Island, Cliff Island, Long Island, Diamond Islands, Cousins & Littlejohns, as well as numerous installations on the Yarmouth, Cumberland, and Falmouth Foreside areas. The boatyard s existing dock consists of a sixteen (16) foot wide by one-hundred (100) foot long crib supported pier, a four (4) foot wide by forty (40) foot long ramp, a fourteen (14) foot wide by thirty (30) foot long float, eight (8) - ten (10) foot wide by twenty-four (24) foot long floats, and a ten (10) foot wide by twenty-four (24) foot long float that forms an L at the end of the dock system. The existing float set-up does not provide sufficient docking area or depth at low tide for marina users. The Applicant determined that in order to meet the current needs of the facility, extending into deeper water would be necessary. (EA) investigated the site and the surrounding area to determine the feasibility of accessing the resource and modifying the facility that will accommodate the Applicant s needs and meet project goals while avoiding and minimizing impacts to the coastal wetland. Based on the Applicant s needs, the existing conditions of the site and the outcome of our investigations, the following design criteria have been determined.

11 In order to meet the project purpose, the Applicant proposes to add four (4), ten (10) feet wide by twenty-four (24) feet long floats to the existing float set-up and add an additional ten (10) foot wide by twenty-four (24) foot long float to the end L. This will increase the length of the seasonal floats by ninety-six (96) feet in length and will provide a fifty-eight (58) foot long face. The Applicant currently secures the floats in place with seven (7) anchor chains, each of which is approximately seventy-five (75) feet long. The Applicant proposes to modify this existing set-up and secure the floats in place with up to eight (8), ten (10) inch diameter greenheart pilings and ten (10) batter pilings of the same size. All ground tackle will be removed from the subtidal zone and the eelgrass (Zostra marina) bed that is located within the area. The impacts and proposed improvements to the eelgrass bed are further discussed in Exhibit All pilings will be driven to refusal in the substrate and will result in approximately eighteen (18) square feet of direct impacts to the resource. During the off-season, the Applicant proposes to store all floats in an upland location.

12 EXHIBIT 2.0: ALTERNATIVES ANALYSIS Several alternatives were considered in determining the need and the placement of the proposed structures. Factors considered in this analysis include: shoreline characteristics, substrates, vegetation, tidal access, identified natural resources, and existing facilities. 2.1: ALTERNATIVE ONE The Applicant considered not adding additional floats or modifying the existing float anchor system. However, this would not meet the Applicant s project purpose for additional docking area and depth at low tide. For this reason, the no action alternative was rejected since it would not meet the project purpose. 2.2: ALTERNATIVE TWO The Applicant considered extending the permanent pier portion of the dock. However, the Applicant determined the project purpose could be met by extending the seasonal structures and minimize the direct impacts to the resource as a result. alternative was rejected. Therefore, this 2.3 ALTERNATIVE THREE The Applicant considered other configurations to meet the project purpose. However, the Applicant determined the proposed configuration and float anchor change from chains to piling minimizes the existing impacts to the eelgrass bed and places the floats within deeper water in a less dense area of eelgrass. As a result, the proposed project will provide deeper water for watercraft to dock at the facility and reduce boat traffic scour to the eelgrass bed. For these reasons, the Applicant determined the proposed project will meet the project purpose and minimize impacts to the resource. 2.4 STATEMENT OF AVOIDANCE AND MINIMIZATION In summary, the Applicant considered several alternatives before determining that the proposed modifications to the boatyard are the most practicable alternatives to meet project goals. The dimensions have been designed to accommodate various size watercraft that utilize the facility and seasonal structures will be stored outside of the coastal wetland during the offseason.

Photographer: Tim Forrester, Date: April 22, SCENIC DESCRIPTION The shoreline at the project site and the surrounding area is primarily developed with commercial and residential structures that are visible from the coastal wetland. The existing facility has been in existence for over seventy (70) years. There are existing docks associated with residential structures visible from the resource. Given the existing development in the project area, the Applicant determined that the proposed modifications will be compatible within the viewshed of the resource, will not result in contrast in scale, and will not result in spatial dominance within the viewshed of the resource.

21 EXHIBIT 6.0: CONSTRUCTION PLAN The pilings for the floats will be driven to refusal within the subtidal zone with a vibratory hammer. The number and size of the piles associated with the additional floats are described in Exhibit 1.0. Any CCA-treated lumber used for the construction of the floats will be cured on dry land for 21 days prior to the start of construction. All materials will be transported to the site by boat or accessed from adjacent upland areas. Construction access will take place by boat and from the adjacent upland. The overall scope of the project will not result in measureable soil disturbance.

22 EXHIBIT 7.0: EROSION CONTROL PLAN The addition of the floats requires no excavation and/or earth moving. Pilings will be vibrated into place. All work will be conducted at low tide. The proposed activity will generate minimal sedimentation, if any, and no formal measures will be required to control erosion or sedimentation for this portion of the project.

37 EXHIBIT 12.0: FUNCTIONAL ASSESSMENT 12.1 INTRODUCTION EA personnel conducted a site visit at the property on April 22, The purpose of the site visit was to gather data to perform a Functional Assessment of the coastal wetland, map the extent of Eelgrass (Zostra marina), conduct a bathymetry survey, and locating other natural resources within the area of the existing and proposed structures. The assessment was conducted at low-tide METHODOLOGIES The site was evaluated based on DEP methodologies identified in the Natural Resources Protection Act, 38 M.R.S.A. 480-A to 480-BB NRPA Application, Appendix B, MDEP COASTAL WETLAND CHARACTERIZATION: INTERTIDAL & SHALLOW SUBTIDAL FIELD SURVEY CHECKLIST. A copy of the checklist is attached in Exhibit 9.0. Site-specific data were gathered with a survey transit and a Trimble GEO 7X GPS unit. Features identified include rock outcrops, Highest Annual Tide (HAT), Mean High Water (MHW), Mean Low Water (MLW), property pins, habitat types, and existing structures. The collected data were then used to generate plan view and cross section drawings (see Exhibit 5.0) RESULTS The upland adjacent to the shoreline is developed with a boatyard that includes a parking area, storage and repair buildings, boat launch, two marine railways, and a dock that is described in Exhibit 1.0. The topography of the upland portion of the site is relatively flat. The upper intertidal is comprised primarily of sand flats. Based on the 2013 Eelgrass (Zostra marina) survey layer of the Maine Office of GIS, Eelgrass is located

38 within the vicinity of the project site. The site visit confirmed that Eelgrass is located in the vicinity of the project site and was mapped to determine the extent. According to Inland Fisheries and Wildlife, the site is located in Tidal Waterfowl and Wading Bird habitat. The energy level is considered semi-protected and no freshwater wetlands were identified on the parcel. The general slope along the shoreline is between 0-5% and the shoreline is best defined as developed. There were no signs of shoreline erosion within the project site. Three (3) general habitat types were identified in the vicinity of the project: Upland, Sand Flats and an Eelgrass Bed. The proposed structures will be positioned over sand flats and eelgrass DISCUSSION AND CONCLUSIONS All organisms identified within the footprint of the proposed structures are common within the surrounding area. The majority of seasonal structures will be stored outside of the coastal wetland during the off-season. There are no trees proposed to be cut for the project. Based on the conditions identified during the investigation and the proposed dock configuration, no loss of wetland functions or values is expected to occur. The existing facility has a high level of boat traffic that is transient in nature. The dock as it is currently configured is located in just over three (3) feet of water at low tide. As a result of prop wash, it can be assumed that the eelgrass has been impacted over the years. By removing the ground tackle and extending the floats beyond the

39 dense area of eelgrass, it is EA s opinion, that impacts to the eelgrass will be minimized. This is due to the fact that the end floats will be located in deeper water which will reduce potential prop wash and scour from boat traffic and the floats will extend beyond the more dense areas of eelgrass. It is projected that the eelgrass bed closer to the upper intertidal will be able to naturally re-vegetate over time.

This species list fulfills the requirements of the U.S. Fish and Wildlife Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended (16 U.S.C et seq.). New information based on updated surveys, changes in the abundance and distribution of species, changed habitat conditions, or other factors could change this list. The purpose of the Act is to provide a means whereby threatened and endangered species and the ecosystems upon which they depend may be conserved. Under sections 7(a)(1) and 7(a)(2) of the Act and its implementing regulations (50 CFR 402 et seq.), Federal agencies are required to utilize their authorities to carry out programs for the conservation of threatened and endangered species and to determine whether projects may affect threatened and endangered species and/or designated critical habitat.

41 A Biological Assessment is required for construction projects (or other undertakings having similar physical impacts) that are major Federal actions significantly affecting the quality of the human environment as defined in the National Environmental Policy Act (42 U.S.C. 4332(2) (c)). For projects other than major construction activities, the Service suggests that a biological evaluation similar to a Biological Assessment be prepared to determine whether the project may affect listed or proposed species and designated or proposed critical habitat. Recommended contents of a Biological Assessment are described at 50 CFR If a Federal agency determines, based on the Biological Assessment or biological evaluation, that listed species or designated critical habitat may be affected by the proposed project, the agency is required to consult with the Service pursuant to 50 CFR 402. In addition, the Service recommends that candidate species, proposed species and proposed critical habitat be addressed within the consultation. More information on the regulations and procedures for section 7 consultation, including the role of permit or license applicants, can be found in the Endangered Species Consultation Handbook at: This species list also identifies candidate species under review for listing and those species that the Service considers species of concern. Candidate species have no protection under the Act but are included for consideration because they could be listed prior to completion of your project. Species of concern are those taxa whose conservation status is of concern to the Service (i.e., species previously known as Category 2 candidates), but for which further information is needed. If a proposed project may affect only candidate species or species of concern, you are not required to prepare a Biological Assessment or biological evaluation or to consult with the Service. However, the Service recommends minimizing effects to these species to prevent future conflicts. Therefore, if early evaluation indicates that a project will affect a candidate species or species of concern, you may wish to request technical assistance from this office to identify appropriate minimization measures. Please be aware that bald and golden eagles are not protected under the Endangered Species Act but are protected under the Bald and Golden Eagle Protection Act (16 U.S.C. 668 et seq.).
