2 Objectives: Practical information about dealing with invasive species in your rights-of-way Information to help to avoid some pitfalls
3 Questions to focus presentation: Is anyone dealing with IS now, by any means? Do you have non-is herbicide programs? Are they in-house or contract? Are any of your municipalities involved in your area s PRISM?
4 NYSDOT s Perspective: We must consider the impacts of IS in all of our maintenance & construction activities (Fed. Exec. Order and NYS mandates). Prevent new infestations Focus on what can be controlled within DOT s resources
5 NYSDOT s Perspective (cont): Context appropriate management: Do we control the entire area, isolated patch, leading edge, near a critical environmental nexus, health & safety concern? Is it a PRISM priority species? Partner with others (e.g. PRISMs)

7 Drivers of DOT IS program: ROW observations Service requests from property owners Other agencies/organizations PRISMs
8 Integrated Vegetation Mgmt: Mechanical: Time & Labor intensive Can be effective or can spread IS May be required in sensitive areas
9 IVM: Cultural/Biological: Reseed, hydroseed, straw, mulch. Don t bring in or move IS prevention is better than dealing with it later. Purple loosestrife beetles Phragmites biological control?
10 Chemical: Often herbicides are the most effective way to deal with IS Can be controversial, especially if use is not well managed or application is unprofessional
11 Herbicide program planning: In house or by contract? What do you need to treat, how much and where? The answers to these questions will drive what you do.
12 Selecting herbicides: Must be labeled for the species and the application method. Don t over purchase products that are new to you. Consider rotation to prevent resistance. Consider Thinvert for large areas far from the road. Adjuvants and surfactants. Ask product reps questions.
13 Application equipment: As with many of your other operations having the right equipment for the situation is critical. Boom sprayers, hoses/guns, backpacks, off road rig.
14 DEC Applicator Certification: Must be certified by DEC (or under the supervision of a certified applicator). Must have appropriate category: 6A ROW, 3A Turf & Ornamental Others?
15 Posting & Notification: Visual posting is required when within 100 of dwellings, public buildings or public parks Written notification to property owner when there is a dwelling anywhere on the property. Neighbor notification doesn t apply to agencies.
16 2ee determinations To treat an IS you need a product which is labeled for that species or has a 2ee determination of the species. Check the PIMS website for DEC approved labels and 2ee determinations. Check various unlabeled pest categories.

On May 29, 2008, DEC issued 2ee letters allowing the use of Accord and Escort XP for foliar application on Japanese Knotweed. 3. DEC approved Rodeo, Vegetation Manager, (Triclopyr as active ingredient), and Vista on Giant Hogweed via unlabeled pest designation issued on June 1, Product called Vine-X includes listing for bittersweet on label posted on company website. New York State label does not specifically include bittersweet. 5. DEC approved Rodeo, Veg. Mgr and Goal 2XL(oxyfluorfen as active ingredient) on Mile-a-minute through labeled pest designation issued January 11, Labels allow control of maples and DEC interprets this to include all species including Norway maple. 7. Wild parsnip is native and not technically an invasive. Included on this list as it has caused skin irritation problems for highway workers. 8. Unlabeled pest issued for Round-Up Pro (6/3/03), Garlon 4 (6/4/2003) and Brush-B-Gon (7/8/04). Brush-B-Gon has different EPA number in PIMS/2ee letter. On June 26, 2008, DEC issued 2ee to allow Garlon 4 Ultra to control swallow-wort, Vincetoxicum nigrun and Vincetoxicum rossicum.
18 Possible Wetland Issues: Herbicide applications cannot be made within a DEC wetland or it s 100 buffer without an Article 24 permit from DEC (even if the area is not wet). Article 24 permits take several months to obtain
19 Record keeping: Application records must be kept by the applicator as he goes. Annual report due to DEC by February 1. If contracting out get copies of: labels, applicator certifications, business registration, daily records.
20 Applicator training: Recertification credits for some categories can be difficult to find (e.g. 6A) DIY Some DOT regions plan their own training and get it approved by DEC Category 6 Group plans a fall training each year
21 Outreach is important If you have any questions about the regulations talk to DEC before beginning. Outreach to the public ahead of applying; via notifications, etc pays off.
22 Insects & Aquatics: Be aware of insects (e.g. EAB, ALB, HWA) future hazardous trees Be cautious using water pumped from lakes etc.
