DR PETER OBEREM WRSA CONFERENCE & GALA DINNER We are looking forward to taking our industry to new heights in future. To this end, we are looking forward to welcoming all WRSA members and industry stakeholders at our 2015 WRSA Conference & Gala Dinner from 13 to 15 March at Sun City. It is now almost two years since WRSA s first highly successful congress and exhibition was held in 2013, at Castle de Wildt, Modimolle. The event was a huge success, with more than 700 delegates attending the congress, exhibition and gala dinner. Due to limited space, late bookings were unfortunately declined. In keeping with the theme of our second biannual 2015 conference and exhibition, Strive for Excellence, WRSA had to analyse our initial event and consider improvements. This resulted in a bigger venue, a broader scientific programme, more practical exposure and, most importantly, more networking time to interact with fellow game ranchers. Formalities at the gala dinner have been reduced and the auction will be incorporated in the WRSA programme to encourage this opportunity. Due to the demand for attendance at both the conference and gala dinner, a WRSA executive committee has selected Pilanesberg in the North West as the ideal region to host this year s conference. The conference and gala dinner will take place at Sun City. The property provides a venue with accommodation, conference facilities and entertainment on one property. The Superbowl provides an opportunity to have a grand gala dinner. Sun City is also accustomed to providing a professional service for more than people. The Pilanesberg area offers a wide variety of accommodation and delegates can choose whether they want to secure accommodation at Sun City or at a close-by lodge, hotel or guest house. 3 3. KOMMENTAAR OP DIE 2015 STAATSREDE DEUR DR PETER OBEREM 3. COMMENTS ON SONA ADRESS 2015 BY DR PETER OBEREM Ek het namens WRSA noukeurig na president Zuma se staatsrede geluister. Buiten die ontstellende gebeure op TV, is ek (en WRSA) uiters besorg oor wat ons tydens die gedeelte oor landbou gehoor het. In besonder oor: 1. Die afskaffing van die gewillige-koper-gewillige-verkoper-konsep, wat volgens ons verkeerd en ongrondwetlik. 2. Die perk van ha op grondeienaarskap, wat ons glo: a. die mense wat die meerderheid van die kos vir die land vervaardig, sal verhinder om produktief te wees. Ons beskou dié strategie as n groot bedreiging vir voedselsekerheid in Suid-Afrika; en b. dat dit beleggersvertroue en regstreekte buitelandse belegging n ernstige knou gaan gee. 3. Op dieselfde wyse sal die verbod op buitelanders om landbougrond te besit finansiële en ekonomiese vertroue in ons land vernietig en regstreekse buitelandse belegging aansienlik beperk. Dit sal negatiewe gevolge hê, soos n verdere afname in ons reeds sukkelende geldeenheid gevolg deur n skerp toename in inflasie. 4. Die bedekte verwysings na wildboerdery is natuurlik die kommerwekkendste. Daar is duidelik n tekort aan presidensiële begrip van Suid-Afrika se unieke mededingende voordeel in landbou, naamlik ons groen ekonomie/wildboerderybedryf wat aansienlik bydra tot die ekonomie (>R10 miljard jaarliks), kossekerheid, werksgeleenthede, en bewaring en biodiversiteit. Dit moet vir WRSA n prioriteit wees om dié wanopvattings met die regering op te klaar. 5. Die kort en vae verwysing dat 50% van elke plaas aan die werkers gegee moet word, is nie haalbaar nie. Watter boer gaan dan in die grond en plaas belê? Hy/sy dra al die risiko terwyl sy bates en winste met 50% afgeneem het, wat die banke se vermoë om hom van voldoende produksiekapitaal te voorsien, inperk. In die algemeen is die grootste kommer egter die feit dat die regering nie duidelike, konsekwente boodskappe oor die uiters belangrike kwessie van grondhervorming gee nie. WRSA, AgriSA en Proagri het al verskeie gesprekke oor dié onderwerp met die regering, top-anc-beamptes en lede van die Nasionale Beplanningskommissie gehad. Hulle het dit almal duidelik gemaak dat wat die president tydens sy staatsrede voorgestel het, nie hul beleid is nie. Ons by WRSA verstaan daar is druk op die regering om iets te doen gegewe die negatiwiteit rondom dienslewering, arbeidsonrus, Eskom, SAA en selfs die staatsrede. Ons as wildsboere, natuurbewaarders en landboukundiges wat die nasie voed, hoop dié opmerkings van president Zuma was net n ondeurdagte poging om te wys daar is vordering en om hoop aan minderbevoorregtes te gee. Vir dié rede, en omdat ons reeds vandeesmaand vergaderings oor grondhervorming met top-anc- en regeringsamptenare geskeduleer het, wil WRSA en ons doen n beroep op almal om dieselfde te doen kalm bly en n poging aanwend om: vas te stel wat regtig bedoel is; ons boodskap oor die emorme, positiewe bydrae wat ons bedryf tot Suid-Afrika maak, oorgedra te kry; en sodoende bydra te dra tot die stabilisering van die situasie ter wille van Suid- Afrika en almal wat hier bly. On behalf of WRSA, I watched the SONA address of President Zuma carefully and intently. Apart from the unseemly scenes on TV, I (and WRSA) am deeply concerned by what we heard during the short excerpt on agriculture. In particular on: 1. The abolishment of the willing-buyer-willing-seller concept, which we believe to be wrong and unconstitutional. 2. The cap of ha on land ownership, which we believe will: a. emasculate the very people that are producing the majority of the food for this country. We thus consider this strategy to be a major threat to food security in South Africa; and b. be a major blow to investor confidence and direct foreign investment. 3. Likewise, the prohibition on foreigners owning land will destroy financial and economic confidence in our country and thus severely limit direct foreign investment and lead to negative consequences, such as a further significant decline in our already struggling currency followed by spiralling inflation. 4. The veiled references to game ranching, of course, are what alarms us the most. There is clearly a lack of presidential understanding of South Africa s unique competitive edge in agriculture, i.e. our green economy/game ranching industry that contributes significantly to the economy (>R10b annually), food security, jobs, and conservation and biodiversity. It must be WRSA s priority to address these misconceptions with government. 5. The short and vague reference to 50% of every farm having to be given over to the workers is not viable. Which farmer will then invest in the land and the farm? He/she carries all the risk while his assets and profits have declined by 50%, reducing the ability of banks to provide him with sufficient production capital. In general, however, of biggest concern is the fact that no clear and consistent messages on the critically important matter of land reform emanate from government. WRSA, AgriSA and Proagri have had numerous interactions on this subject with government, top ANC officials and NPC members, all of whom have clearly stated that what the president has proposed during his SONA address is not their policy. We at WRSA understand that there are pressures on government to do something, given the negativity around service delivery, labour unrest, Eskom, SAA and even SONA. We, as game ranchers, conservationists and agriculturalists who feed the nation, hope that these remarks of President Zuma were just an ill-conceived attempt to show some progress and to provide some hope to the underprivileged. For this reason, and because we have meetings on land reform scheduled with top ANC and government officials this month, WRSA will and we call on everyone else to do likewise keep calm and make every effort to: establish what is really intended; get across our messages on the massive, good contribution our industry is making to South Africa; and in so doing contribute to stabilising the situation for the sake of South Africa and all who live here. GRONDPLAFONNE N POLITIEKE DAGDROOM/ LAND CEILINGS A POLITICAL DAYDREAM AGRISA: 29 JANUARIE/JANUARY 2015: Die ANC se standpunt dat die besit van plaasgrond tot twee plase per eienaar asook n maksimum van hektaar beperk moet word om grondverdeling te bespoedig, is vir die landbousektor totaal onaanvaarbaar en kan die ekonomie en verbruikers tot groot nadeel strek. Dié verklaring gister deur die sekretaris-generaal van die ANC, mnr Gwede Mantashe na afloop van die party se lekgotla, bring ook die geloofwaardigheid van die huidige raadplegingsproses tussen die Minister van Landelike Ontwikkeling en Grondsake, Mnr Nkwinti, en rolspelers in die bedryf oor n pakket van praktiese maatreëls om van grondhervorming n sukses te maak, in die gedrang, sê Johannes Möller, president van Agri SA. In sy reaksie op dié aankondiging verwys Möller na verskeie gebeure en ooreengekome werkswyses wat betrekking het op die gronddebat en nie met hierdie beleidsuitspraak versoenbaar is nie: Die Nasionale Ontwikkelingsplan maak geen voorsiening vir die beperking op grondbesit deur regspersone ten einde grond beskikbaar te maak vir herverdeling nie. Dié plan het wel n voorstel om herverdeling per distrik te bevorder wat die afgelope jaar intensief in landbougeledere gedebatteer is en op n proefbasis toepassing vind. Verskeie ander modelle word ook reeds toegepas wat aan die vereistes van ekonomiese volhoubaarheid en standhoudende bemagtiging voldoen. In die NAREG-konsultasieproses, wat op die Groenskrif oor Grondhervorming gevolg het, het die Departement van Landelike Ontwikkeling en Grondhervorming n onafhanklike studie gelas na die lewensvatbaarheid en implikasies van grondplafonne. Dié studie het aangetoon dat so n maatreël indruis teen markkragte en boere die geleentheid sal ontneem om skaalgrootte-voordele te benut wat op sy beurt noodsaaklik is om winsgewend te bly en voedsel so goedkoop moontlik te produseer. n Beperking op plaasgroottes en verdere direkte ingrepe op eienaarskap sal waarskynlik lei tot deurlopende hoër vlakke van beskerming en ondersteuning aan die landbou, swakker uitvoerprestasie, groter afhanklikheid van invoere en duurder voedsel. Agri SA se voorstel, soos goedgekeur tydens sy 2014-kongres, was dat boere wat reeds skaalvoordele geniet en n groot bydrae tot voedselproduksie lewer, hul grondbesit slegs moet kan uitbrei indien dit toereikende deelname van n bemagtingsvennoot insluit. Dié voorstel berus op die toepassing van omsetnorme, eerder as dié van fisiese plaasgroottes en is tans die onderwerp van verdere evaluering en bespreking. Dis bykans onmoontlik om die ekonomiese waarde en produksie van n plaas slegs aan sy fisiese grootte te koppel. Geografie, klimaat, die intensiwiteit van die boerderystelsel, infrastruktuur, afstande van verskaffers of markte is van die faktore wat hierop inspeel. In praktyk kan daar plase van 50 hektaar wees wat baie groter en meer stabiele besighede is as n ekstensiewe veeplaas van hektaar. Beperkings op plaasgroottes sal dus n naïewe teruggryp na n benadering van sentrale beplanning wees wat n komplekse bedryf soos die landbou sal muilband. Mnr Mantashe het in sy verklaring toegegee dat die grondwetlikheid van dié ANC-voorstel nog uitgeklaar moet word. Dit is n vraag wat eerder vroeër as later beantwoord moet word omdat n afkeuring daarvan onnodige verdere spekulasie daaromtrent sal uitskakel. Minister Nkwinti het by verskeie geleenthede rolspelers in die bedryf uitgenooi om voor einde Februarie 2015 voorstelle in te dien waarmee volhoubare grondhervorming versnel kan word. Agri SA het reeds laasjaar intensief hieraan aandag gegee en sy kongresbesluite daaromtrent in Oktober 2014 is deur Minister Nkwinti verwelkom. Agri SA konsulteer ook hieromtrent met ander landbou-organisasies binne die Agricultural Sector Unity Forum (ASUF) wat saamwerk om n gesamentlike standpunt binne die gestelde tydsraamwerk aan die minister te voorsien. Agri SA dra ook hierdie insette in by die Interdepartementele Taakspan wat minister Nkwinti daargestel het om die kabinet oor aspekte rakende die implementering van die Nasionale Ontwikkelingsplan te adviseer. Die verband tussen hierdie beleidsuitspraak deur Mnr Mantashe namens die ANC en die bovermelde prosesse, verg nou opklaring. Klaarblyklik is die 50/50-herverdelingsvoorstel wat verlede jaar kontroversie ontlok het ook weer besig om as beleidsraamwerk te herleef, aldus Möller. Dat versnelde grondhervorming nou op n onrealistiese basis voorgestoot word om ander falings soos die energiekwessie en dié van verskeie staatsinstellings te verdoesel is natuurlik n sterk moontlikheid, sê Möller. Hierdie denke deur die ANC kan hoogstens polities dienstig wees, maar ekonomies en sosio-ekonomies is dit onsinnig. Uiteraard sal Agri SA, totdat die regering anders oordeel, betrokke bly by bestaande strukture waarheen ons uitgenooi is vir insette en waarin ons tot hiertoe in goeder trou na sinvolle oplossings vir grondherverdeling soek.

GRONDPLAFONNE N POLITIEKE DAGDROOM/ LAND CEILINGS A POLITICAL DAYDREAM AGRISA: 29 JANUARIE/JANUARY 2015: The ANC s position, namely that ownership of farm land should be limited to two farms per owner and a maximum of hectares in order to accelerate land distribution, is totally unacceptable to the agricultural sector and could be detrimental to the economy and the interests of consumers. This statement issued by the ANC secretary-general, Mr Gwede Mantashe, after the party s lekgotla, also undermines the credibility of the current consultation process between the Minister of Rural Development and Land Affairs, Mr Nkwinti, and role players in the industry, which aims to put together a package of practical measures aimed at making a success of land reform, says Agri SA president Johannes Möller. In his reaction to this announcement, Möller referred to various events and the agreed-upon modus operandi relating to the land debate that are not reconcilable with this policy statement: The National Development Plan makes no provision for a limitation on land ownership by legal entities in order to make land available for redistribution. However, this plan does have a proposal for promoting redistribution per district, which has been debated intensively over the past year within agriculture and is finding application on a trial basis. Various other models which meet the criteria for economic sustainability and lasting empowerment are also being implemented at present. In the NAREG consultation process, which followed on the Green Paper on Land Reform, the Department of Rural Development and Land Reform ordered an independent study into the viability and implications of land ceilings. This study showed that such a measure was contrary to market forces and would deprive farmers of the opportunity to utilise economy of scale, which in turn is essential to remain profitable and to produce food as cheaply as possible. A limitation on farm size and further direct interferences with ownership will probably increasingly lead to higher levels of protection and support for agriculture, weaker export performance, greater dependence on imports and more expensive food. Agri SA s proposal, approved at its 2014 congress, was that farmers who already enjoy scale benefits and who make a considerable contribution to food production should be able to expand their land ownership on condition that it includes adequate participation by an empowerment partner. This proposal hinges on the application of turnover norms rather than on physical farm size, and is currently the topic of further evaluation and discussion. It is virtually impossible to link the economic value and production of a farm predominantly to its physical size. Factors such as geography, climate, intensiveness of farming systems, infrastructure and distances from suppliers or markets should also be considered. In practice, there could be farms of 50 hectares that are much bigger and more stable businesses than an extensive livestock farm of hectares. The placing of limitations on farm sizes will, therefore, be a naïve return to a central planning approach that will constrain a complex industry such as agriculture. In his statement, Mr Mantashe conceded that the constitutionality of the ANC s proposal still has to be tested. This is a question that should be answered sooner rather than later because a rejection thereof will eliminate further unnecessary speculation. Minister Nkwinti has on various occasions invited role players in the industry to submit proposals for accelerating sustainable land reform by the end of February Last year, Agri SA gave intense attention to this matter and its October 2014 congress resolutions in this regard were welcomed by Minister Nkwinti. Agri SA also consults with other agricultural organisations within the Agricultural Sector Unity Forum (ASUF) with a view to compiling a wider representative input for consideration by the minister, within the set time-frame. Agri SA also provides these inputs to the interdepartmental task team that Minister Nkwinti appointed to advise the cabinet on aspects regarding the implementation of the National Development Plan. The implications of this policy statement issued on the abovementioned processes by Mr Mantashe, on behalf of the ANC, now requires clarification. Apparently the 50/50 redistribution proposal, which elicited controversy last year, is being revisited as a policy framework, says Möller. It is possible that the unrealistic proposals regarding accelerated land reform are used to divert attention from other failures such as the energy crisis and that of various state institutions. This thinking of the ANC can at best be politically expedient; but economically and socio-economically it is nonsensical. Naturally, unless government decides differently, Agri SA will continue to be involved in existing structures where we are invited to make inputs and where we have, to date and in good faith, sought meaningful solutions to land redistribution. 7 6. LEGISLATION CHALLENGED! WRSA and many individual members have and are in the process of responding to the proposed amendments to two pieces of legislation: 1. Notice 44 of 2015 National Environmental Management: Biodiversity Act, 2004 (Act No 10 of 2004) Norms and standards for the translocation of indigenous species in South Africa. Refer to the WRSA website for the complete submission of 23 pages by Dr Peter Oberem and Dr Gert Dry, dated 10 February 2015: 2. Notice 1147 of the same Act s regulations: For the registration of professional hunters, hunting outfitters and trainers. WRSA members are urged to familiarise themselves with legislation, gazetted regulations and proposed changes. All comments can be shared with the WRSA office for inclusion in collective responses. Minister and Sir/Madam, NOTICE 1147 OF 2014 NATIONAL ENVIRONMENTAL MANAGEMENT: BIODIVERSITY ACT, 2004 (ACT NO 10 OF 2004) REGULATIONS FOR THE REGISTRATION OF PROFESSIONAL HUNTERS, HUNTING OUTFITTERS AND TRAINERS. COMMENTS & COUNTER PLEA (Argument) I, the undersigned DEON FURSTENBURG, declare herewith the following: 1. I am an adult male, employed as senior scientist in wildlife ecology and game production by the Agricultural Research Council of South Africa, based at the Irene campus, Pretoria, residing in Krugersdorp. 2. The facts, comments and arguments herein compounded are according to my personal, professional and educated scientific expert knowledge and experience, unless otherwise stated. 3. I hereby act on account of the interest of the South African game industry. 4. Of utmost importance and relevance to Notice 1147 are my previous comments submitted to the Hon. Minister and the Director General of the Department of Environmental Affairs (DEA, attention: Ms Mamelato Ngoasheng), dated 5 February 2015, on Notice 44 of 2015, NORMS AND STANDARDS FOR TRANSLOCATION OF INDIGENOUS SPECIES IN SOUTH AFRICA, 46 pages. COMMENTS 5. Notice 1147, Definition par. 1 (b): coup-de-grace indigenous animal species The term indigenous animal species is by no means legally defined by the department, DEA, as Notice 44 of 2015 and the present application of the Biodiversity Act (NEMBA) provides no legal defining of whether any specific animal species are indigenous to a specific location within a specific habitat within a specific province or a specific municipal district or not. The legal recognition of any specific animal species and its status as being indigenous or not has not yet being declared or approved by the South African government. An issue still in national dispute as for Notice 44 of The Biodiversity Act (NEMBA) itself is still in dispute as it deviates in meaning and interpretation of the Convention on Biodiversity as signed by South Africa in 1992, and published in the Government Gazette No dated 28 July NEMBA 7 June 2004, Government Gazette No , The National Environmental Biodiversity Act (NEMBA) was published, compiled from the Convention, but the terminology and definitions of the Convention changed at will by DEA. The industry had no say in the drafting of NEMBA; it was bluntly enforced within the industry. On what basis can coup-de-grace indigenous animal species be applied by any professional hunter not knowing if species X at locality X in any point in time is indigenous or not as the matter is still in dispute, with merits (par. 4 above), by the wildlife industry and Wildlife Ranching South Africa (WRSA)? 6. Notice 1147, Definition par. 1(b), par. 14 (2), and par. 17 (2) (a): My argument in par. 5 above applies likewise to your definitions of hunt, hunting client, hunting outfitter, as exotic animals, as by any of your definitions, including NEMBA and the Biodiversity Act, as per species X, per locality X in point and time, are also hunted by foreign hunters. Such hunts by foreigners may only be conducted, guided and supervised by a qualified professional hunter. This implies that a foreign hunter may, in future, hunt exotic species, e.g. lechwe, e.g. nyala in Western Cape and many more, unsupervised by a professional hunter, as your definitions as explained above only concern indigenous animal species part of regulatory norm. In this regard your defining of indigenous animal species in your proposed regulatory registration and training control is a direct contradiction to your intention of control. 7. Notice 1147, par. 2 (5) and par. 14 (3): as far as it relates to hunting, apply to a specimen of an indigenous animal species. Hereby the proposed regulations do not apply for example a nyala being hunted in the Western Cape, by any hunter, local or foreign, as the indigenous status of natural animals within the boundaries of South Africa has not yet being legally recognised by any legislation. 8. Notice 1147, par. 4 (b), par. 6 (1), par. 7 (d), par. 8 (e), par. 9 (1) (c), par. 11 (b), par. 14 (1) (a), par 17 (1) (d, e & f): This requirement is utterly outrageous and not in line with the practise of the hunting business of South Africa. Hunts are not pre-defined and professional hunters operate nationally and per event as per status quo hunting request by the hunter as per X localities in place and time. By your intention all professional hunters will be forced to obtain nine training courses and nine registrations. Such

8 requirement by Notice 1147 cannot be accepted and hence, as per definition of the yet legally undefined distribution of indigenous status of animal species, many natural animal species in various locations will be excluded from your contradictory proposal. 9. Notice 1147, par. 15 (1): This is contradictory to the requirements as being discussed in par. 8 above. 10. WRSA members must engage constructively with this process South Africa s interests in conservation and wildlife ranching will best be served if all those involved try to work together.
