5 COUNCIL DIRECTIVE 92/65/EEC Article 1 This Directive lays down the animal health requirements governing trade in and imports into the Community of animals, semen, ova and embryos not subject to the animal health requirements laid down in the specific Community acts referred to in Annex F*. *ANNEX F Council Directive 64/432/EEC of 26 June 1964 on animal health problems affecting intra-community trade in bovine animals and swine

6 COUNCIL DIRECTIVE 92/65/EEC Article 2 1. For the purposes of this Directive: (b) animals means specimens of animal species other than those referred to in Directives 64/432/EEC, etc.

7 COUNCIL DIRECTIVE 92/65/EEC Article 2 1. For the purposes of this Directive: (c) approved body, institute or centre means any permanent, geographically limited establishment, approved in accordance with Article 13, where one or more species of animal are habitually kept or bred, whether or not for commercial ends, and exclusively for one or more of the following purposes: display of the animals and education of the public; conservation of the species; basic or applied scientific research or breeding of animals for the purposes of such research;

8 COUNCIL DIRECTIVE 64/432/EEC Article 1 This Directive shall apply to intra-community trade in bovine animals and swine with the exception of feral pigs as defined in Article 2 (e) of Directive 80/217/EEC* without prejudice to the provisions laid down in Directives *COUNCIL DIRECTIVE 2001/89/EC: 2(b) feral pig means a pig which is not kept or bred on a holding;

9 COUNCIL DIRECTIVE 2002/60/EC Article 2 (a) pig shall mean any animal of the Suidae family, including feral pigs; (b) feral pig shall mean a pig which is not kept or bred on a holding; (c) holding shall mean any agricultural or other premises located in the territory of a Member State where pigs are being bred or kept on a permanent or temporary basis. This definition does not include slaughterhouses, means of transport and fenced areas where feral pigs are kept and may be hunted; these fenced areas must be of a size and structure that makes the measures laid down in Article 5(1) not applicable.

10 COUNCIL DIRECTIVE 64/432/EEC Article 2 (b) animal for slaughter means a bovine animal or swine intended to be taken to a slaughterhouse or assembly centre from which it may only move to slaughter; (c) animals for breeding or production means bovine animals and swine other than those referred to in (b), including those intended for breeding, milk or meat production, or draft purposes, shows or exhibition with the exception of animals taking part in cultural and sporting events;

11 COUNCIL DIRECTIVE 64/432/EEC Article 5 1. Bovine animals and swine covered by this Directive must be accompanied during transportation to destination by a health certificate conforming to either model 1 or 2* set out in Annex F as appropriate with Sections A and B duly completed and certified by the approved veterinarian for the holding of origin. *Animal health certificate for swine for breeding/production/slaughter

12 Commission Implementing Decision 2014/709/EU status quo Art no live feral pigs shall be dispatched from the Member States listed in the Annex, unless certain additional risk mitigation measures are implemented: free areas (with effective geographical barriers) biosecurity in the holding residency period of at least 30 days laboratory testing additional attestation in the veterinary documents and in the health certificates for swine referred to in Directive 64/432/EEC etc. Current revision (ongoing, REV.3) Art. 23: MS concerned, shall prohibit the dispatch of feral pigs to other MS and third countries or from areas listed in Annex I to any other areas of the same MS. No derogation!

13 Conclusions (1) Article 2 of Directive 92/65/EEC defines animals as specimens of animal species other than those referred to in legislation listed in the Annex F to that Directive, which includes also Directive 64/432/EEC Directive 64/432/EEC applies, amongst others, to intra-eu trade in swine (with the exception of feral pigs as defined in Article 2 (b) of Directive 2001/89/EC and pigs for sport or cultural events) and in particular for swine intended for breeding Therefore, and taking into account points (a) and (b) of Article 2 of Council Directive 2002/60/EC, wild boar kept or bred on a holding (former feral pigs) should be considered as pigs and therefore must comply with the relevant requirements laid down in Directive 64/432/EEC and etc. (identification in accordance with Council Directive 2008/71/EC on the identification and registration of pigs) The intra-union trade certificate drawn up in accordance with the Model 2 in Annex F to Directive 64/432/EEC shall accompany those animals when they are to be moved to other Member States Applications of additional requirements in CID 2014/709 must be ensured.

14 Conclusions (2) Currently, there are no requirements/certificate for the trade of live wild boar, caught in a wild and destined for hunting grounds. Therefore such trade shall not take place. The trade of former feral pigs from the holding is possible only in accordance of Dir. 64/432 Exemption: specimens of swine (for ex. - Potamochoerus spp., Phacochoerus spp., Babyrousa spp.) in accordance with Dir. 92/65 for the purposes of: display of the animals and education of the public; conservation of the species; basic or applied scientific research or breeding of animals for the purposes of such research In all cases, for the purpose of the intra-eu trade, the wild boar (the former feral pigs) must be kept in the holding of origin and destination for 30 days (resident period on the holding)

15 Future steps Definitions: feral pigs, former feral pigs, wild and feral pigs/captive wild pigs (OIE)? Prior authorization of CA of destination for each movement? Prior bilateral agreement between MS (including transit MS) of additional risk mitigation measures? Compulsory post-movement regime of: - observation/quarantine before release or subsequent movement in holding of destination? and/or - testing regime for (brucellosis/aujeszky, TB, ASF, CSF)? Other? Further steps under AHL: Dir. 64/432 and 92/65 to be repealed (date of effect of 21 April 2021) New DA laying down animal health rules for movements in the EU of terrestrial animals (incl. ungulates) - to be adopted by 20 April First discussion with MS - end of May 2018.
