Isaac Collie Eagle Scout Service Project in Rhododendron Lake Nature Park Isaac Collie approached the Mayor about doing a service project in RLNP, and identified the wetland area as his interest. As with previous Boy Scout/Eagle Scout projects, the Council may elect to authorize the Town to expend up to $500 for materials and a port-a-jon. If requested, Council may also authorize overnight camping, with adult supervision. Attachment(s): Suggested Motion: $500 in support. None To approve Isaac Collie s proposed project, and the expenditure of up to 4. Presentation of Park Rules Review WCU MPA Student Dalton Buckner With the addition of a picnic area and stocked lake to the Town s park system, the Town s ordinances and rules need to be updated. Western Carolina University MPA Student Dalton Buckner researched park regulations from neighboring jurisdictions and statewide, and has drafted an update to the Town s existing ordinances. After review, the Council may direct Ms. Alexander to incorporate the recommendations into the Town s existing ordinances and rules, and present for final adoption at a future meeting. 4 Proposed Park Rules Town of Laurel Park Operating Hours: 30 minutes prior to sunrise through 30 minutes after sunset each day. It is unlawful for any person to be present in the Town parks at any other time without written permission from the Town of Laurel Park. Permit for use of Town Park: A permit is required before using a Town park for a wedding ceremony, birthday party, or other special event. Bike/ Pedestrian: The Town of Laurel Park has a bike/pedestrian plan for its parks. Lost or Stolen Articles: The Town of Laurel Park is not responsible for lost or stolen articles. Using the Parks: Park users must be aware that participation in any physical activity or program could have inherent and unforeseen risks that may cause injury, harm or death. Preservation of Park Property: It shall be unlawful for any person to remove, destroy, excavate, mutilate, or deface any structure, wall, fence, railing, vehicle, bench, trees, plants, or any other property in the park, except by such persons that are authorized by the Town Manager or designated official. Advertising: It shall be unlawful for any person to place or erect any structure, sign, bulletin board, post pole, or advertising device of any kind on any park, or to attach any notice, bill, poster, sign, wire or cord to any tree, shrub, fence, railing, post, or structure within the park, except by such persons authorized by the Town Manager or designated official. Natural Stream and Water Flow: Don t disturb the natural stream and waterflow by moving, placing or piling rocks or other items or any other means that would alter the natural stream and water flow of a pond, creek, or other area within the park.

5 Dumping: No person shall deposit, dump, throw, cast, lay or place, or cause to be deposited, dumped, thrown, cast, laid or placed any ashes, trash, rubbish, soil or earth, paper, garbage, oil, refuse, debris, plant clippings, limbs or leaves in or upon the park or park lands or in any pond or watercourse within the park. No household trash may be placed in any town trash receptacle. The use of confetti inside the park is strictly prohibited. Amplified Sound: Sound systems and musical devices producing a sound that carries more than 50 feet or is loud enough to disturb other patrons using any park facility are prohibited. Motor vehicles are not to be used as outdoor sound systems. The judgment of the level of disturbance is up to the Police Chief or designated official. Special events approved by the Town Council or other designated official may be exempted from this rule. Motorized Vehicles: Motorized Vehicles are not allowed within any park. A motor vehicle is hereby defined to include mini-bikes, go-carts, motorbikes, golf carts, ATVs and any other self-propelled motorized vehicle, but excluding motorized wheelchairs. Skateboards, Rollerblades, and Skates: The use of Skates, rollerblades, and skateboards is prohibited on park roads, walkways, and parking lots. No Open Flames: Candles and other open flames are prohibited in the park except for small birthday candles. Open fires and fireworks are prohibited on park grounds except as specifically authorized by the Town Council. Grilling is permitted only in provided grills, and the grills are for charcoal use only. Alcohol: NO alcoholic beverages are allowed. Special events approved by the Town Council may be exempted from this rule. Littering: Littering, vandalism, defacing of property, loitering or use of profanity will not be tolerated.

6 Disorder: Any expression of physical or verbal abuse, or acts of intimidation, harassment or other threatening behavior directed towards any staff member or park user will result in suspension and/or legal action. Sex Offenders: No person registered with the State of North Carolina or any other state or federal agency as a registered sex offender may enter the park. Animals: All animals must be on a leash by a competent person. Animal owners must clean up after their animal. Ponds and Lakes: Bathing and swimming are prohibited in all Town ponds and lakes. Use caution when walking near the pond. Stay off pond and lake ice. Non-motorized boats are permitted on Rhododendron Lake. Fishing: Fishing is allowed in Rhododendron Lake and is regulated by the North Carolina Wildlife Commission rules and regulations. The Lake is stocked with carp, bluegill, bass, and catfish. The Lake is catch and release only. Please place all trash and used fishing line in trash receptacles. Failure to adhere to these rules may result in ejection and/or suspension from the park.

7 Other Possible Rules: Tobacco: All parks are tobacco free areas. We ask that you please not use tobacco products while on park premises. Weapons, Firearms and Incendiary Devices: It shall be unlawful for any person, at any time or under any circumstances within the park to discharge, forcibly hurl, or cause to be discharged or forcibly hurled any edged weapon, including but not limited to knives, arrows, spears, and other similar devices. It shall also be unlawful for any person, at any time or under any circumstances, within the park to discharge, shoot, fire or explode, or cause to be discharged, shot, fired, or exploded any firearms, including but not limited to air rifles, toy pistols, paintball guns, toy guns or other toy arms designed to forcibly hurl a projectile or missile. This section shall not apply to law enforcement officers when engaged in the discharge of their duties.

Quasi-Judicial Process Review Town Attorney Sharon Alexander Town Attorney Sharon Alexander will provide an educational review of the quasi-judicial process used by the Town Council to review Conditional Use Permit applications. Attachment(s): None. Suggested Motion: None. 6. Friends of Laurel Park Update & Request to Waive Town Ordinance to Allow Alcohol Consumption at an Event Friends of Laurel Park President Mindy Collins attended the February Work Session and asked Council to think of any additional projects or events the FLP could do within the next year. She will be in attendance to discuss with Council and provide updates on planned activities. New activities include partnering with the Hendersonville Community Theater to hold a performance at Jump Off Rock on August 11, The Friends of Laurel Park request Council waive Chapter 2, Article 6 of the Town Ordinance to allow alcohol consumption within the parks for the event. If approved, patrons of the events will be able to have unfortified wine and beer. There will be no alcohol sales. Attachment(s): None Suggested Motion: To waive Chapter 2, Article 6 of the Town Ordinance to allow consumption of unfortified wine and beer within Jump Off Rock Park for the Theater event on August 11, Laurel Park Town Council Work Session Agenda Page 4

9 7. Award of Silver Pine Pipe Replacement In early March, a stormwater pipe on Silver Pine Drive unexpectedly failed. Trace & Company has already been contracted for the Sabine Drive stormwater repairs, and provided pricing to do the repair on Silver Pine. Town Engineer Will Buie has reviewed and recommends award. The Town has $41,000 remaining for paving in FY 2018, and these funds can be used for the pipe repair. With this repair, the Town will expend an estimated $315,000 on road and stormwater repairs in FY Attachment(s): Trace & Co Proposal, dated March 27, 2018, in the amount of $27,500. Suggested Motion: To award the Silver Pine Pipe Replacement to Trace & Company, and authorize the Town Manager to utilize additional paving funds for contingency, if required. An RFP was issued on March 1, 2018, and responses due April 3, Ms. Alexander, Finance Officer George Banta, and Finance Director Kim Hensley will review the responses prior to the April 17, 2018 Regular Meeting, and have a recommendation for award.
