1 Legal Supplement Part B Vol. 54, No th March, LEGAL NOTICE NO. 44 REPUBLIC OF TRINIDAD AND TOBAGO THE CONSTITUTION OF THE REPUBLIC OF TRINIDAD AND TOBAGO RESOLUTION WHEREAS it is provided by subsection (3) of section 72 of the Constitution that as soon as may be after the Commission has submitted a report under paragraph (a) of subsection (1) of the said section 72, the Minister, designated by the Prime Minister for this purpose, shall lay before the House of Representatives for its approval the Draft Order by the President for giving effect, whether with or without modifications, to the recommendations contained in the report: And whereas the Commission has submitted a report to the Prime Minister and the Speaker in accordance with the provisions in subsection (1) of section 72: And whereas the draft of an Order entitled the Elections and Boundaries Commission Order, 2015 giving effect to the accommodations of the Commission was laid before the House of Representatives on the 6th day of March, Be it Resolved: That the Draft Order entitled The Elections and Boundaries Commission Order, 2015 be approved. 2 Legal Supplement Part B Vol. 54, No th April, LEGAL NOTICE NO. 61 REPUBLIC OF TRINIDAD AND TOBAGO THE CONSTITUTION OF THE REPUBLIC OF TRINIDAD AND TOBAGO ORDER MADE BY THE PRESIDENT UNDER SECTION 72 OF THE CONSTITUTION OF THE REPUBLIC OF TRINIDAD AND TOBAGO THE ELECTIONS AND BOUNDARIES COMMISSION ORDER, 2015 WHEREAS under section 71 of the Constitution of the Republic of Trinidad and Tobago (hereinafter referred to as the Constitution ) there is established an Elections and Boundaries Commission (hereinafter referred to as the Commission ): And whereas under subsection (1) of section 72 of the Constitution, the Commission is charged, inter alia, with the review of the number and boundaries of the constituencies into which Trinidad and Tobago is divided: And whereas in accordance with paragraph (a) of the said subsection (1) of section 72 of the Constitution, the Commission, on the 28th day of April, 2014 submitted to the Honourable Prime Minister, and on the 28th day of April, 2014 submitted to the Honourable Speaker of the House of Representatives, a report in which it recommends that Trinidad should be divided into thirty-nine constituencies and that there are (a) no changes to be made in twenty-nine constituencies in Trinidad; and (b) alterations of the boundaries of ten (10) constituencies in the electoral area of Trinidad as follows: (i) In Couva North due to transfer of Polling Division 3115 from this constituency to Couva South; (ii) In Couva South due to transfer of Polling Division 3115 from Couva North; (iii) In Diego Martin West due to transfer of Polling Division 0066 from this constituency to Diego Martin Central; and also transfer of Polling Division 0125 from Diego Martin North-East to Diego Martin West; (iv) In Diego Martin Central due to transfer of Polling Division 0066 from Diego Martin West;

3 1010 Elections and Boundaries Commission Order, 2015 (v) In Diego Martin North-East due to transfer from this constituency of Polling Division 0125 to the Diego Martin West constituency and Polling Divisions 0190 and 0195 to Port-of-Spain North/St. Ann s West; (vi) In Port-of-Spain North/St. Ann s West due to transfer to this constituency of Polling Divisions 0190 and 0195 from Diego Martin North-East and in addition, transfer from it of Polling Division 0680 to Port-of-Spain South; (vii) In Port-of-Spain South due to transfer to this constituency of Polling Division 0680 from Port-of-Spain North/St. Ann s West; (viii) In San Fernando East due to transfer from this constituency of Polling Divisions 4055 and 4060 to San Fernando West and transfer into it of Polling Divisions 3860, 3872 and 3905 from Oropouche East; (ix) In San Fernando West due to a transfer into this constituency of Polling Divisions 4055 and 4060 from San Fernando East; and (x) In Oropouche East due to transfer from this constituency of Polling Divisions 3860, 3872 and 3905 to San Fernando East, whereof are delineated in Appendix E to the said report and Tobago should remain divided into two constituencies: And whereas it is provided by subsection (3) of section 72 of the Constitution that as soon as may be after the Commission has submitted a report under paragraph (a) of subsection (1) of the said section 72, the Minister designated by the Prime Minister for this purpose shall lay before the House of Representatives for its approval the draft of an Order by the President for giving effect, whether with or without modifications, to the recommendations contained in the report: And whereas a draft of this Order giving effect without modifications to recommendations contained in the report of the Commission was laid before the House of Representatives for its approval by the Minister designated for this purpose by the Prime Minister on the 6th day of March, 2015 and was approved by resolution of the House of Representatives on the 20th day of March, 2015: Now, therefore, I, ANTHONY THOMAS AQUINAS CARMONA, O.R.T.T., S.C., President, do hereby order as follows: Citation 1. This Order may be cited as the Elections and Boundaries Commission Order, 2015.

10 Elections and Boundaries Commission Order, YEAR 2014 REPORT OF THE ELECTIONS AND BOUNDARIES COMMISSION ON THE REVIEW OF CONSTITUENCY BOUNDARIES PURSUANT TO SECTION 72 OF THE CONSTITUTION OF THE REPUBLIC OF TRINIDAD AND TOBAGO TO: THE HONOURABLE KAMLA PERSAD-BISSESSAR, PRIME MINISTER AND THE HONOURABLE WADE MARK, SPEAKER OF THE HOUSE OF REPRESENTATIVES The Elections and Boundaries Commission (the Commission) hereby submits its Year 2014 Report on the review of the number and boundaries of the constituencies into which Trinidad and Tobago is divided pursuant to Section 72 of the Constitution of the Republic of Trinidad and Tobago (the Constitution). Specifically, subsection 72(1) of the Constitution requires the Commission to review periodically the number and boundaries of the constituencies into which Trinidad and Tobago is divided for the purpose of elections to the House of Representatives (the House), and to submit to the Speaker of this body and to the Prime Minister for presentation to the House in accordance with this subsection, reports either: (a) showing the constituencies into which it recommends that Trinidad and Tobago should be divided in order to give effect to the rules set out in the Second Schedule; or (b) stating that, in the opinion of the Commission, no alteration is required to the existing number or boundaries of constituencies in order to give effect to the said rules. Subsection 72(2) of the Constitution prescribes as follows: Reports under subsection (1) shall be submitted by the Commission not less than two nor more than five years from the date of submission of its last report. The last Report of the Commission executed in pursuance of its responsibilites under subsection 72(1) and 72(2) as aforementioned, was submitted on 30th April, 2009, Thus, the deadline for the submission of the instant Report (the Report) to the Prime Minister and to the Speaker of the House is 29th April, The Report is submitted for such action as is provided for by subsections (3) and (6) of Section 72 of the Constitution which prescribe as follows: (3) As soon as may be after the Commission has submitted a report under subsection (1)(a) the Minister designated by the Prime Minister for this purpose (in this section called the Minister ) shall lay before the House of Representatives for its approval the draft of an Order by the President for giving effect, whether with or without modifications, to the recommendations contained in the report, and that draft may make provision for any matters which appear to the Minister to be incidental to or consequential upon the other provisions of the draft. (6) Where any draft made under this seciton is approved by resolution of the House of Representatives, the Minister shall submit it to the President who shall make the Order in terms of the draft; and that Order shall come into force on such day as may be sepcified therein and, until revoked by a further Order made by the President in accordance with the provisions of this section, shall have the force of law. PRESCRIBED CONSTITUENCIES It should be noted that with respect to elections to the House, Section 70 of the Constitution stipulates that: (1) Trinidad and Tobago shall be divided into thirty-six constituencies or such other number as may be provided for by an Order made by the President in accordance with the provisions of this Part and each such constituency shall return one member to the House of Representatives. (2) Not less than two such constituencies shall be in the Island of Tobago..

11 1018 Elections and Boundaries Commission Order, 2015 By virtue of Elections and Boundaries Commission Order, 2005 made by the President of the Republic of Trinidad and Tobago and published as Legal Notice No. 198 in Legal Supplement Part B, Vol. 44, No. 138, dated 8th August, 2005: Trinidad is hereby divided into thirty-nine constituencies the boundaries whereof are defined in the Schedule to this Order and Tobago remains divided into two constituencies.. THE ANNUAL LIST Subsections (1) and (2) of Section 29 of the Representation of the People Act, Chap. 2:01 (ROP) provide as follows: 29.(1) The Commission shall, in respect of each Parliamentary, Municipal Council and the Tobago House of Assembly electroal district, publish on 1st July, of every year a list (hereunder referred to as the annual list) of all persons qualified to be, and duly registered as, electors in that electoral district. 29.(2) The annual list shall continue in force until 30th June of the following year and on the commencement of an electoral registration shall be deemed to be the preliminary list of electors for that electoral district.. However, because of the proximity, in 2013, of the Chaguanas West By-Election and the Municipal Corporation Election, it was considered necessary for the Commission to request a variation of the date of publication of the annual list which is provided for under subsection 29(3) of the ROP which states: 29.(3) The President may by Order in any year vary the date specified in subsections (1) and (2) wherever it appears to him that circumstances have arisen that warrant the variation.. Arising therefrom, the President of the Republic of Trinidad and Tobago issued an Order dated 28th day of June 2013 by way of Legal Notice NO. 88 for variation of... the date of publication of the annual list for each Parliamentary, Municipal Council and the Tobago House of Assembly electoral district in Trinidad and Tobago (...) from 1st July, 2013 to 2nd December, The Annual List of Electors which was accordingly published on 2nd December, 2013 and updated as at 29th January, 2014 contained a total of one million and eighty-seven thousand, seven hundred and eighty-one (1,087,781) names of individuals; of which number one million and forty thousand, four hundred and sixty-two (1,040,462) were registered to vote in Trinidad and forty-seven thousand, three hundred and nineteen (47,319) in Tobago. A listing of registration areas in Trinidad and Tobago showing the number of electors in each is provided at Appendix A. In Appendix B, comparative data are tabulated for Trinidad and Tobago showing the distribution, by constituency, given in (a) the Commission s Year 2009 Parliamentary Report on the Review of Constituency Boundaries Pursuant to Section 72 of the Constitution of the Republic of Trinidad and Tobago, and (b) the instant Report. APPLICATION OF RULES IN RESPECT OF DELIMITATION OF CONSTITUENCIES In the Second Schedule of the Constitution the following prescriptions are provided under BOUNDARIES AND CONSTITUENCIES : 1. These rules are the Delimitation of Constituencies Rules in accordance with which the constituencies of Trinidad and Tobago are to be delimited under section 72(1). 2. Subject to paragraph 3, the electorate shall, so far as is practicable be equal in all constituencies. 3. The number of constituencies in Tobago shall not be less than two. 4. In Trinidad and in Tobago, respectively, the electorate in any constituency shall not be more than one hundred and ten per cent nor be less than ninety per cent of the total electorate of the island divided by the number of constituencies in that island.

12 Elections and Boundaries Commission Order, Special attention shall be paid to the needs of sparsely populated areas which on account of size, isolation or inadequacy of communications cannot adequately be represented by a single member of Parliament. 6. Natural boundaries such as major highways and rivers shall be used wherever possible. 7. In this Schedule Trinidad means the Island of Trinidad and its offshore islands, and Tobago means the Island of Tobago and its offshore islands.. Upon application of Rule 4 of the Second Schedule referred to in the foregoing, the relevant parameters shown in the table below were determined using the figures for the total electorate in Trinidad, and in Tobago, viz: respectively, one million and forty thousand, four hundred and sixty-two (1,040,462), and forty-seven thousand, three hundred and nineteen (47,319). Band Parameter Trinidad Tobago (Electors) Permissible Upper Limit 29,347 26,026 Average 26,679 23,660 Permissible Lower Limit 24,011 21,294 Inspection of the data in the table labelled Appendix C which is a listing of the distribution of the electorate in Trinidad and Tobago reveals that two (2) constituencies, viz: Couva North and Diego Martin West fall above the Permissible Upper Limit and that four (4) constituencies, viz: Port-of-Spain North/St. Ann s West, Port-of-Spain South, San Fernando West, and San Fernando East fall below the Permissible Lower Limit. ADJUSTMENTS In order to meet the requirement that constituencies should fall within the Permissible Upper and Lower Limits, it became necessary to make the following adjustments. These changes were made with due consideration being given to maintenance of communities and the use of natural boundaires. A. CONSTITUENCY: COUVA NORTH ELECTORATE: 29,355; (above Permissible Upper Limit) ORIGINAL NUMBER OF POLLING DIVISIONS: 40 ADJUSTMENTS Polling Division 3115 (in Couva North) having an electorate of 526 was transferred to Couva South, thereby reducing the electorate of couva North to 28,829, and the number of Polling Divisions to 39. Collaterally, the electorate of Couva South was increased to 28,069 which is below the Permissible Upper Limit. Correspndingly its number of Polling Divisions was increased by one to 37. SUMMARY OF RESULTS OF ADJUSTMENTS UNDER A : (i) Constituency: Couva North Electorate: 28,829 (within Permissible Limits) No. Polling Divisions: 39 (ii) Constituency: Couva South Electorate: 28,069 (within Permissible Limits) No. Polling Divisions: 37

CONSTITUENCY: DIEGO MARTIN WEST ELECTORATE: 29,434; (above Permissible Upper Limit) ORIGINAL NUMBER OF POLLING DIVISIONS: 48 ADJUSTMENTS Polling Division 0125 in Diego Martin North/East having an electorate of 583 is added to Diego Martin West thus increasing the electorate of the latter to 30,017 and the number of its Polling Divisions to 49. Next, Polling Division No having an electorate of 773 is removed from Diego Martin West and added to Diego Martin Central having an electorate of 28,555 and 41 Polling Divisions, thereby resulting overall in a nett electorate of 29,244 and a reduction of Polling Divisions to 48 in Diego Martin West; and an increase in the elctorate of Diego Martin Central to 29,328 and in the number of its Polling Divisions by one to 42. As a consequence of the removal of Polling Division 0125 from Diego Martin North/East, this constituency s electorate of 29,114 and 45 Polling Divisions were reduced to 28,531 and 44 respectively. However, it became necessary to transfer two Polling Divisions, viz: Nos and 0195 with a combined total of 838 electors from the electoral district of Diego Martin North/East to that of Port-of-Spain North/St. Ann s West in the process of adjusting the boundaries of the latter, its electorate of 23,364 being below the Minimum Permissible Limit. Thus, the electorate of Diego Martin North/East was reduced to 27,693 and the number of Polling Divisions to 42. SUMMARY OF RESULTS OF ADJUSTMENTS UNDER B : (i) Constituency: Diego Martin West Electorate: 29,244 (within Permissible Limits) No. Polling Divisions: 48 (ii) Constituency: Diego Martin Central Electorate: 29,328 (within Permissible Limits) No. Polling Divisions: 42 (iii) Constituency: Diego Martin North/East Electorate: 27,693 (within Permissible Limits) No. Polling Divisions: 42 C. CONSTITUENCY: PORT-OF-SPAIN NORTH/ST. ANN S WEST ELECTORATE: 23,634; (below Permissible Lower Limit) ORIGINAL NUMBER OF POLLING DIVISIONS: 58 ADJUSTMENTS Polling Divisions 0190 and 0195 with electorates of 715 and 123 respectively, were transferred from Diego Martin North/East to this constituency as was stated at item B. Accordingly, the electorate in Port-of-Spain North/St. Ann s West was increased to 24,472 and the number of Polling Divisions to 60. Next, Polling Division 0680 with an electorate of 212 in Port-of-Spain North/St. Ann s West was transferred to the constituency of Port-of-Spain South, thereby reducing the elctorate of the former to 24,260 and the number of Polling Divisions to 59. As a consequence, the Port-of-Spain South s electorate of 23,989 and 63 Polling Divisions are increased respectively, to 24,201 and 64. SUMMARY OF RESULTS OF ADJUSTMENTS UNDER C : (i) Constituency: Port-of-Spain North/St. Ann s West Electorate: 24,260 (within Permissible Limits) No. Polling Divisions: 59 (ii) Constituency: Port-of-Spain South Electorate: 24,201 (within Permissible Limits) No. Polling Divisions: 64

CONSTITUENCY: SAN FERNANDO WEST ELECTORATE: 23,846; (below Permissible Lower Limit) ORIGINAL NUMBER OF POLLING DIVISIONS: 53 ADJUSTMENTS Two Polling Divisions viz: 4055 and 4060 with respectively, 514 and 227 electors are transferred from San Fernando East having an electorate of 23,501 and 44 Polling Divisions, to San Fernando West. This results in a revised electorate for the latter constituency of 24,587 and 55 Polling Divisions; and for the former an electorate of 22,760 and 42 Polling Divisions. Next, three Polling Divisions viz: 3860, 3872 and 3905 with respectively, 1,225, 63 and 619 equal to a total of 1,907 electors are transferred from the constituency of Oropouche East which has an electorate of 28,702 and 23 Polling Divisions to San Fernando East. This results in an increase of the San Fernando East electorate to 24,667 and the number of its Polling Divisions to 45. Similarly, the electorate of Oropouche East is reduced to 26,795 and its Polling Divisions by 3 to 20. SUMMARY OF RESULTS OF ADJUSTMENTS UNDER D : (i) Constituency: San Fernando East Electorate: 24,667 (within Permissible Limits) No. Polling Divisions: 45 (ii) Constituency: San Fernando West Electorate: 24,587 (within Permissible Limits) No. Polling Divisions: 55 (iii) Constituency: Oropouche East Electorate: 26,795 (within Permissible Limits) No. Polling Divisions: 20 The adjustments effected in the foregoing resulted in a change of configuration in ten (10) constituencies altogether, i.e., the six (6) that fell outside the Permissible Limits as previously defined, viz: Couva North, Diego Martin West, Port-of-Spain North/St. Ann s West; Port-of-Spain South, San Fernando East, San Fernando West; and, the four (4) whose boundaries were affected by nett transfers of electorate from Polling Divisions within their area to the six (6) constituencies outside the Permissible Limits, in order to make the latter compliant. RECOMMENDATIONS The Commission therefore recommends as follows: (i) No change be made in the boundaries of the following twenty-nine (29) constituencies in Trinidad viz. Arima, Arouca/Maloney, Barataria/San Juan, Caroni Central, Caroni East, Chaguanas East, Chaguanas West, Cumuto/Manzanilla, d Abadie/O Meara, Fyzabad, La Brea, La Horquetta/Talparo, Laventille East/Morvant, Laventille West, Lopinot/Bon Air West, Mayaro, Moruga/Tableland, Naparima, Oropouche West, Pointe-a-Pierre, Point Fortin, Princes Town, Siparia, St. Ann s East, St. Augustine, St. Joseph, Tabaquite, Toco/Sangre Grande and Tunapuna; (ii) No change be made in the configuration of the two (2) constituencies in Tobago, viz: Tobago East and Tobago West; (iii) Alteration of the boundaries of ten (10) constituencies in the electoral area of Trinidad as follows: (a) In Couva North due to transfer of Polling Division 3115 from this constituency to Couva South;
