1 Request for Proposals L4865 The Pier 25 Marine Facility Concession in Hudson River Park (RFP) Questions & Answers January 16, 2018 Q1: What is the current serviceability status of the moorings? A: All mooring lanyards are detached and stored in the pump room. The mooring blocks, hazeletts and mooring buoys are in the water. Q2: What percentage of moorings are currently in safe / serviceable condition? A: According to the prior operator, at the end of the season the moorings were in safe and serviceable condition. Q3: Are there records from annual mooring inspections, and if so from what date? A: We do not have inspection records, but there are no reported problems. Q4: Do you have a record of moorings failing in previous seasons? A: The Trust has no actual knowledge of any mooring failures. Q5: What has HRPT previously paid for a new Hazlett mooring including installation? A: $ per mooring for all hardware excluding the anchor block. It is estimated that three (3) moorings could be moved per day at a cost of approximately $3,600. Q6: Should the moorings be deemed unsuitable for mooring at the beginning of the term who will be responsible for making the appropriate repairs and / replacements. A: Concessionaire should inspect all mooring systems at the beginning of the term. The Trust will replace/repair components deemed to be unsuitable. 1

2 Q7: There have previously been some issues with the pile guides for the floating docks. What is the current repair status of the pile guides for the dock? Who will be responsible for the pile guide repairs throughout the term? A: Pile guides will be reconstructed so that all shims are eliminated and all bolt fastenings for the wear pads will be situated for safe wear pad servicing. Concessionaire will be responsible for the maintenance of pile guides during the term. Q8: Who will be responsible for the salvage and repair of the gangways if one falls into the water again? Should a gangway be damaged beyond repair during the term, who would be financially responsible for its replacement? A: Concessionaire shall be responsible for the inspection, maintenance and repair of the gangways. Q9: Does HRPT intend to return any of the additional floating docks during the term? A: Should the selected Concessionaire wish to reinstall floating docks now in storage it may propose to do so. Any such reinstallation would be subject to the approval of the Trust and be at the sole cost and expense of Concessionaire. Such a change, if approved, would require an amendment to the Concession Agreement. Q10: Is concessionaire responsible for sewage pump repairs and/or replacement? A: The sewage pump will be provided in good working condition. The repair or replacement of the sewage pump that is required during the term of the Concession Agreement is the responsibility of the Concessionaire. 2

3 Q11: I am writing to you with a kindly-meant and professionally evaluated suggestion that amending a specific clause to the docking terms at Pier 25 be considered. Specifically, I refer to the vessel length maximum of 45 feet. I suggest amending the simplistic length regulation be modified to length and/or vessel tonnage as far more suitable and professional. Length requirements has obvious merits in limited space. Considering maximum tonnage, here in the case of the long floating dock at Pier 25, may be more appropriate if the engineering formulations for stress on cleats, moorings, etc. is the basis for restricting to 45 feet. An example is my sailing vessel Ventura. She is 62.5 feet in length, yet due to her lightweight construction, is measured by the USCG as a Gross 27/Net 21 tonnage vessel. In layman's terms, she is far lighter, and hence puts far less stress on cleats and floating dock anchoring systems, than many vessels under 45 feet. (Ventura, by the way, is a USCG certified passenger carrying vessel commissioned in 1919, and has been operating in New York Harbor under my ownership since In the past decades, I have used Pier 25 many times and am very familiar with the wonderful evolution of the facility.) I would be pleased to have a conversation with you on this topic. Overall, the 'big picture' view of providing public access in a safe, affordable and aesthetically pleasing manner to the water, could be facilitated by such an amendment. A: Larger vessels will not be permitted at the floating docks. Concessionaire may, at its sole cost and expense, install an alternate mooring system to accommodate the mooring of larger vessels and ferry passengers with a launch to the floating docks. 3

4 Q12: As noted in the Trust s Request for Proposal No.: L4865 entitled Pier 25 Marine Facility RFP, as amended, (the RFP ), Citigroup is a potential Sub-concessionaire with regard to the installation and operation of a non-commuter water taxi landing at the location indicated in Appendix 4 of the RFP. The mooring field depicted at page 3 of Appendix 4 of the RFP indicates that there should be a minimum 50 clear travel lane between moorings and dock. However, Citigroup s nautical consultants advise that a typical Hudson River water taxi vessel requires a travel lane between 110 and 150 depending on the size of the vessel. A similar amount of clearance would be required around the landing platform. This would require some of the northern row of moorings to be relocated within the mooring field. (See attached Exhibit A). We would be grateful if you would clarify this point and consider a corresponding amendment to page 3 of Appendix 4 of the RFP. A: Moorings are currently situated approximately 100 feet from the dock. Should mooring(s) relocation be required, all costs would be borne by Concessionaire or its Sub-concessionaire. 4
